EVERYDAY EXCELLENCE 42 43 Dr. Casey recognized Ms. Zane Mullins as the recipient of the 44 Everyday Excellence Award for her exceptional contributions to 45 the Department of Utilities. Ms. Mullins serves Chesterfield 46 Utilities as an automation coordinator, providing oversight 47 and management of many of the various systems and technology 48 projects within the department. REPORTS ON THE STATUS OF DISTRICT IMPROVEMENT 17 OPERATING AND CAPITAL FUNDS, GENERAL FUND UNASSIGNED 18 BALANCE AND DEBT POLICY RATIOS, AND INVESTMENTS 19 20 The Board approved reports on the status of district 21 improvement operating and capital funds, general fund 22 unassigned balance and debt policy ratios, and investments. 23 24 25 6. FIFTEEN-MINUTE CITIZEN COMMENT PERIOD ON UNSCHEDULED 26 MATTERS 27 28 Ms. Doris Knick addressed the Board relative to supporting the 29 ability of Chesterfield County residents to choose to have an 30 analog electric and gas meter rather than a smart meter. 31 32 33 7. BLACK HISTORY MONTH UPDATE 3 4 Ms. Kim Conley, assistant director of Community Engagement and 5 Resources, provided an update relative to the variety of 6 programs designed to explore the rich, diverse heritage of 7 African Americans and their contributions to the community and 8 nation. 9 10 11 10.B. 275TH COUNTY ANNIVERSARY EVENTS 12 13 Ms. Conley stated this year, Chesterfield County will reach a 14 milestone, celebrating its 275th anniversary. She further 15 stated the 275th anniversary special events committee, 16 comprised of county staff, representatives from the 17 Chesterfield Historical Society of Virginia, private 18 foundations and regional partners, is developing activities 19 for 2024 that include living history programming, 20 presentations, concerns, special events and much more. 21 22 23 10.C. STATE LEGISLATIVE UPDATE 24 25 Ms. Natalie Spillman, Intergovernmental Relations 26 Administrator, provided a brief update to the Board of 27 Supervisors regarding her tasks of monitoring legislation and 28 delivering the county’s legislative priorities to lawmakers 29 during the ongoing General Assembly session. 30 31 32 10.D. OTHER COUNTY ADMINISTRATION UPDATES 33 34 • Dr. Casey stated given the continued growth in use of 35 mobile phones and other technologies relying on 36 connectivity, the demand for phone numbers in the Central 37 Virginia region has increased substantially. As such, he 38 announced the addition of the 686 area code to Central 39 Virginia is a necessary measure to ensure a continuing 40 supply of new telephone numbers in the region. 41 42 • Fire Chief Loy Senter provided an update to the Board of 43 Supervisors regarding a recent event where power lines 44 fell across Route 288 following a crash between a tractor-45 trailer and SUV near Midlothian Turnpike. 46 47 • Sheriff Karl Leonard announced the county’s jail has 48 received their initial accreditation from the National 49 Commission on Correctional Health Care (NCCHC) by 50 demonstrating compliance with NCCHC’s nationally 51 recognized standards of care for correctional health 52 services in jails. 53 54 55 56 57 58 24-12 DRAFT 2/21/2024 11. KNAPP, UTILITIES 54 DEPARTMENT, UPON HIS RETIREMENT 55 56 On motion of Dr. Miller, seconded by Mr. Ingle, the Board 57 adopted the following resolution: 58 59 24-13 DRAFT 2/21/2024 WHEREAS, David Knapp retired from the Chesterfield County 1 Utilities Department on February 1, 2024, after faithfully 2 serving the county and its citizens for over 39 years; and 3 4 WHEREAS, David Knapp began his service to the citizens of 5 Chesterfield County in 1984 as a utilities engineer in the 6 development section of the Utilities Department; and 7 8 WHEREAS, David Knapp was promoted to senior utilities 9 engineer for his experience ensuring the expansion of the 10 county’s utility system met the present and future needs of 11 its citizens; and 12 13 WHEREAS, David Knapp obtained his Professional 14 Engineering license in 1994, earning a promotion to principal 15 engineer where he applied his new skills to managing utility 16 projects of increasing complexity; and 17 18 WHEREAS, David Knapp was instrumental in developing a 19 memorandum of understanding with the Virginia Department of 20 Health in 1998, allowing Chesterfield County to locally review 21 waterline extensions without additional state oversight; and 22 23 WHEREAS, David Knapp was promoted to engineering 24 supervisor in January of 2004, leading the technical support 25 section of the Utilities Department through countless projects 26 that improved the delivery of service to customers; and 27 28 WHEREAS, David Knapp oversaw the team responsible for 29 upgrading the county’s Falling Creek and Proctors Creek 30 Wastewater Treatment Plants to include biological nutrient 31 removal technologies that were operational in 2012 and 2014 32 respectively, thereby decreasing the nitrogen and phosphorus 33 loading to the James River and the Chesapeake Bay and improving 34 water quality; and 35 36 WHEREAS, David Knapp coordinated multiple projects 37 following the historic flooding of August 2020, including a 38 major rebuild of the Addison-Evans Water Treatment Plant; and 39 40 WHEREAS, David Knapp was known by his colleagues as a 41 dependable and ethical professional dedicated to ensuring 42 Chesterfield County received the most reliable and efficient 43 utility service possible; and 44 45 NOW, THEREFORE, BE IT RESOLVED that the Chesterfield 46 County Board of Supervisors recognizes the contributions of 47 David Knapp, expresses the appreciation of all residents for 48 his service to the county, and extends their appreciation for 49 his dedicated service and their congratulations upon his 50 retirement. 51 52 Ayes: Holland, Miller, Ingle, Schneider and Carroll. 53 Nays: None. 54 55 56 57 58 24-14 DRAFT 2/21/2024 13.B.1.b. RESOLUTION RECOGNIZING MRS. DIANE LANIER, 1 ACCOUNTING DEPARTMENT, UPON HER RETIREMENT 2 3 On motion of Dr. Miller, seconded by Mr. Ingle, the Board 4 adopted the following resolution: 5 6 WHEREAS, Mrs. Diane Lanier will retire from Chesterfield 7 County on February 29, 2024, after providing 26 years of 8 outstanding service to the citizens of Chesterfield County; 9 and 10 11 WHEREAS, Mrs. Lanier faithfully served all 26 years with 12 the Accounting Department in the Accounts Payable section; and 13 14 WHEREAS, Mrs. Lanier began her career as a Principal 15 Clerical Aide on July 1, 1996; and was promoted to an Accounts 16 Payable Technician in 1998; and 17 18 WHEREAS, Mrs. Lanier continued her career path in the 19 Accounting Department as an Accounts Payable Specialist; and 20 21 WHEREAS, Mrs. Lanier saw many changes during her career 22 in Accounts Payable including the growth of Chesterfield County 23 from expenditures paid by Accounts Payable of approximately 24 $260 million in 1996 to more than $650 million currently; and 25 26 WHEREAS, Mrs. Lanier worked diligently with co-workers to 27 grow the Purchasing Card Program from it’s infancy to currently 28 having just over 600 cards; and 29 30 WHEREAS, Mrs. Lanier helped to ensure our payments were 31 made timely each month to our Purchasing Card Provider which 32 enabled Chesterfield County to receive just under a total of 33 $800,000 in rebates from 2012 to 2023; and 34 35 WHEREAS, Mrs. Lanier was flexible and adaptable to change 36 and had a role in two major implementations that positively 37 affected Accounts Payable with our imaging system in 2002 and 38 our ERP system in 2008; and 39 40 WHEREAS, Mrs. Lanier has demonstrated throughout her 41 career a positive attitude, being thoughtful with a calm 42 demeanor, and an ability to work extremely well in a team- 43 oriented environment; and 44 45 WHEREAS, Mrs. Lanier provided a high level of customer 46 service when working with county and school customers, looking 47 for better ways to serve them, often going out of her way to 48 meet a need and consistently exceeding customer expectations 49 throughout her career; and 50 51 WHEREAS, Mrs. Lanier has demonstrated her loyalty to 52 Chesterfield County through her dedication and 53 conscientiousness. 54 55 NOW, THEREFORE, BE IT RESOLVED that the Chesterfield 56 County Board of Supervisors recognizes the contributions of 57 Mrs. Diane Lanier, expresses the appreciation of all residents 58 for her service to the county, and extends its appreciation 59 for her dedicated service and its congratulations upon her 60 retirement. 61 62 Ayes: Holland, Miller, Ingle, Schneider and Carroll. 63 Nays: None. 64 24-15 DRAFT 2/21/2024 13.B.1.c. RESOLUTION RECOGNIZING MR. KENNETH L. CREW, 16 DEPARTMENT OF GENERAL SERVICES, FLEET SERVICES 17 DIVISION, UPON HIS RETIREMENT 18 19 On motion of Dr. Miller, seconded by Mr. Ingle, the Board 20 adopted the following resolution: 21 22 WHEREAS, Mr. Kenneth L. Crew retired from the Chesterfield 23 County Department of General Services Fleet Services Division 24 effective February 1, 2024, after more than 40 years of 25 service; and 26 27 WHEREAS, Mr. Crew joined Chesterfield County Public 28 Schools, Department of Pupil Transportation as a Service 29 Mechanic on April 1, 1983; and 30 31 WHEREAS, in September 1992, Mr. Crew, was transferred to 32 the Department of General Services as a Senior Vehicle Mechanic 33 Helper, due to the consolidation of fleet maintenance 34 operations between Chesterfield County Government and 35 Chesterfield County Public Schools; and 36 37 WHEREAS, in 1999, Mr. Crew’s job title was changed to 38 Automotive Technician Apprentice; and 39 40 WHEREAS, in 2001, Mr. Crew graduated from the School of 41 Quality and Continuous Improvement; and 42 43 WHEREAS, in 2005, Mr. Crew’s position was reclassified to 44 a Senior Labor Crew Chief with a working title of Service 45 Manager; and 46 47 WHEREAS, Mr. Crew was instrumental and took the lead in 48 the daily coordination of various activities and special 49 projects for the Fleet Services Division, including but not 50 limited to, vehicle surplus sales, processing of vehicles 51 deemed as total losses, fuel station operations and expanding 52 Fleet’s usage of alternative fuels; and 53 54 WHEREAS, Mr. Crew played a critical role in assisting with 55 preparation and oversight during the construction of Fleet 56 Services’ fuel site at CTC-Hull in 2022; and 57 58 NOW, THEREFORE, BE IT RESOLVED that the Chesterfield 59 County Board of Supervisors, on the 21st day of February 2024 60 publicly recognizes the outstanding contributions of Mr. 61 24-17 DRAFT 2/21/2024 Kenneth L. Notice of a hearing for the following proposals shall be advertised once 2 a week for two successive weeks in a newspaper published, or having general 3 circulation, in the county, with the first notice appearing no more than 14 days before 4 the intended adoption. 5 6 • zoning approval or zoning district map amendment; 7 8 • ordinance or amendment thereto; 9 10 • appeal of decision of the director of planning to the board of zoning appeals; 11 12 • interpretation of the zoning map by the board of zoning appeals; 13 14 • comprehensive plan amendment; or 15 16 • a historic district or designation of landmark or landmark site. 17 18 For any proposed amendment of the zoning ordinance involving a change in zoning 19 map classification of 250 or fewer lots of land, or a change in the applicable zoning 20 ordinance text regulations that decreases the allowed density of any lot of land, the 21 newspaper advertisement shall include the street address or the tax map parcel 22 number of the lots, the approximate acreage subject to the action, and a link to a map 23 of the subject area. 24 25 For any proposed amendment of the zoning ordinance involving a change in zoning 26 map classification of more than 250 lots of land, the newspaper advertisement shall 27 include the approximate acreage subject to the action, a description of the boundaries 28 of the area subject to the changes, and a link to a map of the subject area. 29 30 C. [RESERVED] 31 32 D. Posting of Property. The planning department shall post a notice of the application 33 on the land or building involved for each application for zoning approval, appeal of 34 the planning director’s decision, schematic plan, administrative site plan, or planning 35 commission site plan. The notice shall be posted at reasonable intervals along roads 36 abutting the area subject to the zoning request, or, if there is no abutting road, at the 37 proposed road or entrance into the area subject to the zoning request, in locations 38 reasonably visible from existing roads. The holding of a public hearing or the validity 39 of action on an application shall not be affected by the unauthorized removal of a 40 notice which has been posted in accordance with this section. Postings shall meet the 41 following deadlines: 42 43 1. Administrative Site Plans. Posting shall occur at least 10 days prior to the 44 approval or disapproval of an administrative site plan; and 45 2. Administrative Variances. Posting shall occur at least 14 days prior to the 46 approval or disapproval of an administrative variance. 47 48 3. All Other Applications. Posting shall occur at least 21 days before the date of 49 the first hearing. 50 51 E. Notice to Subject Property Owners, Adjacent Property Owners and Specific 52 Others. 53 1. Notice Recipients. For properties located within the county, staff will obtain the 54 names and addresses of property owners from the department of real estate 55 assessments. For property which lies outside the county, the applicant shall 56 24-39 DRAFT 2/21/2024 provide the planning department with the names and addresses of those property 1 owners which shall be obtained from the real estate assessor’s office of the 2 applicable locality. 3 a. Zoning Approval, Appeal of the Decision of the Director of Planning, Historic 4 District or Landmark Designation, Schematic Plan, Administrative Site Plan 5 or Planning Commission Site Plan Applications. The planning department 6 shall provide written notification of these applications to the following: 7 • the owner of the subject property; 8 • except for Zoning Approvals involving a change in zoning map 9 classification of more than 250 existing lots, persons owning any adjacent 10 property, including property across any road, railroad right-of-way, or 11 body of water; 12 • if the subject property is located at, or within 100 feet of, the intersection 13 of any 2 or more roads or within 100 feet of the intersection of the right-14 of-way of any 2 railroads, the owners of property situated at all corners of 15 the intersection; 16 • if the subject property is located within 0.5 miles of the boundary of an 17 adjoining locality, that locality’s chief administrative officer or designee; 18 • if the subject property is located within 3,000 feet of the boundary of a 19 military base, installation, airport, excluding armories operated by the 20 Virginia National Guard, the commander of the applicable military 21 operation; and 22 • if the subject property is located within 3,000 feet of the boundary of a 23 public use airport, the owner of the airport. 24 b. Amendment to Condition of Zoning, Conditional Use, or Conditional Use 25 Planned Development. In addition to those persons outlined in 1.a., the 26 planning department shall notify in writing all owners whose property was 27 subject to the original zoning or condition provided such property is located 28 within 1,500 feet of the subject property. 29 c. Zoning Approval. In addition to those persons outlined in 1.a. and 1.b., if the 30 subject property is located within a development containing open space, the 31 planning department shall notify in writing any incorporated property owner’s 32 association within the development. 33 d. Zoning Ordinance Text Amendments Decreasing Allowable Density. Except 34 for the owners of subdivision lots having less than 11,500 square feet, the 35 planning department shall notify, in writing, the owners of property which 36 may be impacted by a zoning ordinance text amendment that would decrease 37 the allowable dwelling unit density of their lot. 38 e. Zoning Approval for a Communications Tower. In addition to those persons 39 outlined in 1.a., 1.b. and 1.c., the planning department shall notify in writing 40 all owners of property within 1,500 feet of the subject property. 41 f. Comprehensive Plan Amendments. The planning department shall provide 42 written notice of a proposed comprehensive plan amendment to the following: 43 • if the proposed amendment impacts property within 0.5 miles of the 44 boundary of an adjacent locality, that locality’s chief administrative 45 officer or designee; 46 24-40 DRAFT 2/21/2024 • if the subject property is within 3,000 feet of the boundary of a military 1 base, installation, airport, excluding armories operated by the Virginia 2 National Guard, the commander of the applicable military operation; and 3 • if the subject property is within 3,000 feet of the boundary of a public use 4 airport, the owner of the airport; 5 • if the proposed amendment designates or alters previously designated 6 corridors or routes for electric transmission lines of 150 kilovolts or more, 7 each electric utility with a certificated service territory that includes all or 8 any part of such designated electric transmission corridors or routes. 9 2. Notice Deadline. 10 a. For those applications requiring notice to commanders of military operations 11 or owners of public use airports, the notice shall be postmarked a minimum 12 of 30 days before any hearing. 13 b. For those applications requiring notice to an electric utility or an adjacent 14 locality’s chief administrative officer or designee, the notice shall be 15 postmarked a minimum of 10 days before any hearing. 16 c. Administrative site plan and planning commission site plan notices shall be 17 postmarked a minimum of 10 days prior to approval or disapproval of the 18 plan. 19 d. Schematic plan notices shall be postmarked a minimum of 21 days before any 20 hearing. 21 e. Administrative variance notices shall be postmarked a minimum of 21 days 22 prior to approval or disapproval of the variance. 23 f. All other required notices shall be postmarked a minimum of 5 business days 24 before any hearing. 25 26 3. Notice Mailing. The required notice shall be sent by registered, certified or first 27 class mail. If the notice is provided by first class mail, the planning department 28 shall make affidavit that the mailings were made and file the affidavit with the 29 papers of the case. If a public hearing is continued or deferred to a date that has 30 not previously been advertised, notice shall be re-mailed. If a public hearing is 31 either continued, deferred to a date that has been previously advertised, or if a 32 public hearing is closed and the decision deferred to a later date, notice shall not 33 be required to be re-mailed. 34 35 4. Waiver of Notice. A person shall be deemed to have waived the right to challenge 36 the validity of proceedings for which written notice is required if the person did 37 not receive the required notice, but had actual notice of, or actively participated in, 38 the proceedings. 39 40 OOO 41 42 (2) That this ordinance shall become effective immediately 43 upon adoption. 44 45 Ayes: Holland, Miller, Ingle, Schneider and Carroll. 46 Nays: None. 47 48 49 24-41 DRAFT 2/21/2024 18.D. TO CONSIDER CONVEYANCE OF COUNTY PROPERTY AT 8610 1 PERRYMONT ROAD 2 3 Mr. Elder stated this date and time has been advertised for 4 the Board to consider conveyance of county property at 8610 5 Perrymont Road. On June 27, 2018, the Board declared county 6 property at 8610 Perrymont Road surplus and authorized staff 7 to offer the property for sale. The site is commonly known as 8 Perrymont School and is not needed for school or county use. 9 On February 22, 2023, the Board authorized the execution of 10 the Real Estate Purchase Contract Contingency Period and is 11 ready to move forward with purchasing the property for the 12 agreed-upon $100,000 as stated in the Real Estate Purchase 13 Contract. 14 15 Mr. Ingle noted he would recuse himself from consideration of 16 the issue due to a conflict of interest. 17 18 Discussion and questions ensued relative to the process 19 regarding the sale of the property. 20 21 Mr. Holland called for public comment. 22 23 Mr. Phil Lohr and Mr. Mike Uzel expressed concerns relative to 24 the change of process and lack of transparency of the sale of 25 surplus county property. 26 27 Ms. Renae Eldred stated the property is not worth the assessed 28 value and encouraged new business and growth along the Route 29 1 corridor. 30 31 There being no one else to speak to the issue, the public 32 hearing was closed. 33 34 Discussion ensued relative to future transparency of sales of 35 county property. 36 37 On motion of Mr. Holland, seconded by Mr. Carroll, the Board 38 approved the conveyance of county property at 8610 Perrymont 39 Road. 40 41 Ayes: Holland, Miller and Carroll. 42 Nays: None. 43 Abstained: Ingle and Schneider. 44 45 46 19.
