Lawrence C. Harrison, Pastor of the Enon Baptist Church gave! a brief scripture reading and invqcation. This day th~ County Engineer came before the Board discussing various problems of the Water Department and it was generally agreed that he would present to the Board at its next meeting, an itemization of pipe on hand at this time. Whereas, there exists a need for additional funds in tho Water Construction Fund, a nd, Whereas. thoro is set out in the Water Department budget provisions for trans~ letting $20.000.00 from the Operating lb/nd to the Construction Fund. Now. Therefore, Be it Resolved on motion of Mr. Ountor. seconded by Mr. Britton. that the Treasurer of tho County of Chesterfield bo directed to transfer $20.000.00 from tho Water Operating Fund to tho Water Construction Fund as soon as funds are available, as provided bythe current budget. The matter of the Causey and Weeks recommendations for the improvement of the water system and tho amendments recommended by tho Board on this report discussed briefly. Whereupon M~. Goyno makes tho following motion: That this Board request tho engineering frim of Causoy and weeks to review all of the recommendations of this Boa~d for the amendments of the engineering report and to. approve in writing the.d01otion or addition of each recommendation, which motio, n died for the want of a second. On motion of Mr., Britton, seconded by Mr, Cmntor, it is resolved that tho County Engineer be authorized to get an addendum to the water report, including all changes to date. This day Mr. Stuart Schmidt appeared before the Board presenting deeds deeding the sewerage plant in Kenmore Ridge to tho County of Chesterfield, On the adFioe of the County Engineer it was generally agreed to hold these deeds and preson~ thom formally to tho Board after th.o plant has boon placed in operation. It was generally agreed t.hat this Board waive any charge for services rendorod to tho Matoaoa Baptist Church for some investigative work completed by the Water Department, This day Mr, Benton came before the Board seeking some relief from the Board's request to install an 8n line on Dundas Avenue in Sherbourno.Heights~ and cited tho fact that contracts had boon entered into with tho County for a 4" line. On motion of Mr..Goyno. seconded by Mr. Gunter. it is resolved that the County Water Department pay the difference between a ~" line and an 8# line and install and 8" line approximately 900 feet on Dundas Avenue. beginning at Mills Road and running eastwardly. ~ This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Forest Lake Road in tho subdivi- son of Mid-Cities Farms in Bermuda. Magisterial District, which report shows that in the opinion of the County Road Engineer it is expedient that said road be estgblished as a public road. Upon consideration whereof and on motion of Mr. Goyne. it is resolved that Forest Lake Road in tho subdivision of Mid-Cities Farms in Ber~nuda District, bo, and the same is hereby established as a public road. Andbe it further resolved that the Virginia Department of Highways.bo and. it hereby is requested to ~ke into the Secondary Road System of Chesterfield Count2 Forest Lake Road, at a point on tho western and of maintenance of Forest Lake Road, .23 of a milo northwardly and westwardly to a dead end. This read serves 2 houses. And be it further resolved that the Board of Supervisors of Chesterfield Gounty guarantees a right of way of not less than 50 feet for this road.to the Virginia Department of Highways° This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Richdale Road and Williams Lane in the subdivision of Hollandale in Manchester Magisterial District, which report shows that in the opinion ortho County Road Engineer it is expedient that said roads be established as public roads. Upon-consideration whereof and on motion of Mr, Britton, it is resolved that Richdale Road and Williams Lane in the subdivision of Hollandale in Manchester Magisterial District, be,and the same are hereby.established as public roads, And be it further resolved that the ¥1rgifiia Department of Highways be and it hereby is requested to take into the Secondary Road System, Richdale Road, from a point on Ri, lg49, ,32 of amiIe west of its intersection with Rt. 10,,06 of a mile southwardly to Williams Lanel Williams Lane, from the intersection of Riohdale Road.12 of a mile eastwardly to a dead end, Thesd roads serve ? houses, And be it further resolved that the Board of Supervisors of ahesterfield CountyI guarantees a ri§hi of way of not less than 50 feet on Hichdale Road and a right ~ of way of not less than 40 feet on Williams Lane, to the Virginia Department of Highways, This.day the County Road Engineer in accordance with directions,from this Boar6 made.report in w~iting upon his examination of Blakemore-Road and Stonybrook Drive in the subdivision of Westlake Hills Subdivision, in Manchester Magisterial District, which report shows that in the opinion of the County Road Engineer it! is expedient that said-road be.established as public roads, Upon consideration whereof and on motion of Mr. Britton, it is resolved that Blakemoro Road and S}onybrook Drive in the subdivision of ~estla~Hills Subdivi- sion.in Manchester M~gisterial ])istrict, bo,and tho same are hereby established as public roads. And bo it further resolved that the Virginia Department of High{ays bo and it hereby is requested to ~ako into the Secondary Road System Blakemore and Stony- brook Drive in the subdivision of ~estlako Hills in ~nchoster ~agisterial District, 01akomoro Road, from a point on Rt. 68~, o13 of a mile west of Nether- wood Road, .05 mile northwardly to Stonybrook Drivel · Stonybrook'Drive, from a point on Blakomore Road .05 of a milo north of Ri, ~8~, ,6 of a mile northeaster- ly to Nethorwood Road which intersection to .11 of a milo north of Rt. 68~, Those roads serve And bo it further resolved that th~ Board of Supervisors of Chesterfield County guarantoes.a right of way of not less than ~0 feet for those roads, This day the County Road Engineer in accordance with directions from this Boardl made report in writing upon his examination of Swan Drive, Swan Court and Jalee Drive in the subdivision of Wilkinson Terrace, in Manchester Macisterial District, which report shows that in the opinion of the County Road Engineer it is expedient that said roads bo established as public roads. Upon consideration whereof and on motion of Mr. Britton, it is resolved that Swan Drive, Swan Court and Jalee Drive in the subdivision of Wilkinson Terrace in Manchester ~4agisterial District, be, and the same are hereby established as public roads. And be it further resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System Swan Drive, from a point on Rte 651, .~9 of a mile east of Ri. 650...16 of a mile southwardly to Jalee Drive, thence .10 of a mile southwardly to Sherman Roadl Swan Court, from a point on Swan Drive .05 of a mile east of Rt. 651. .02 mile northwardly to a turn-aroundl Jalee Drive. from a point on Swan Drive~ .16 of a mile east of 651, .23 of a milo northwardly to Sherman Road. These roads serve 23 houses. And be it further resolved that the Board of Supervisors of Chesterfield County! Guarantees a right of way of not less than 50 feet for these roads. This day the County Road Engineer in accordance with directions from this Board made report in writing upon his examination of Hickory Road~ in the Nottingham Subdivision in Midlothian Nagisterial District, which report shows that in the opinion of the County Road Engineer it is expedient that said roads be established as a public road. Upon consideration whereof and on motion of M~ Britton. it is resolved that Hickory Road in the subdivision of Nottingham in Midlothian Magisterial District, be. and the same is hereby established as a public road. And be it further resolved that the Virginia Department of Highways be and it hereby is requested to take into the Secondary Road System Hickory Road in the Subdivision of Nottingham in Midlothian Macisterial District, from the intersec- tion of Wexford and Hickory Road. .09 of a mile northwardly to Rto 1808. This road serves 2 houses. And be it further resolyed that the Board of Supervisors of Chesterfield Coun%yl ~uara~tees a right of way of not less than-50 feet for this road.. Gill, presented to the Board the matter of the installation of a drainage pipe leading wostwardly from Rt. 36 alo0g the northern boundary of the Ettrick School property, and it was repovted that Mr. Kellam of the Highway Department had agreed in writing that if. the. Z4" culvert were purchased by the County, the Highway would install the culvert at its expense. Mr. Robert Lux, Supt. of Maintenance, School Board, reported that due to the recent rulings of the Supreme Court certain fun4s had been impounded and were not available as previously heleived and if the School Board proceeded with this project it may possibly exceed its present budget. Upon consideration whereof, and on motion of Dr. Gill, seconded by Mr. Hague, it is resolved that if the proposed drainage problem is completed and if the County School Board exceeds its present budget for.this reason, this BOard will repay to the School BOard approximately $2000.00 to cover this expenditure. This day there was discussed again the matter of constructing a road leading westwardly from Rt. $1 across the Deford property to the old Centralia Road. There was presented a survey by the County Surveyor, showing the existing right of way and how the road could be widened to the desired width. Upon consideration whereof, and on motion of Mr. Goyne, seconded by Mr. Gunter , it is resolved that the Highway Department be requested to determine the best entrance into Rt. ~1 and generally approve the location of the ~oad and to make a cost estimate of the construction of this road. It was generally agreed that the Road budget woul~ be discussed with Mr. Kollam, Resident Engineer, on December 21st,at 7:30 p.m. On motion of Mr. Gunter, seconded by Mr. Britton, it is resolved that the Highway Department be requested to investigate Rt. 653 to ascertain the feas~bi- lity of making same an extension of Rt. 147 to Ri. 360. Mr. H. T. Goyno recorded with the Board the fact Shat the Soreamersville Road exte~]sion should be included in our next Rural Road ~udget. Resolution on vacating the easement to Mr. F. D. Utley will be copied: WHEREAS: By the terms and provisions of an agreement dated September 20, 1948, of record in the Glerkts Office of the Circuit Court of Chesterfield, Virginia, in Deed Book 343, page 82, FRED D. UTLEY AND ALEISE G. UTLEY, HIS WIFE, and W. H. GALDWELL AND DAVENA G. CALDWELL, HIS WIFE, did, for the benefit of the County of Chesterfield, agree to the creation of a lake and impoundment of the waters of Powhite Greek for a water supply system for the County of Chesterfield, in language as follows: "In consideration of the promises and of the agreement and forbearance here£nafter set out, the parties hereto agree that Powhite Greek may be dammed up so as to create a lake and impoundment of water for a water supply system for the Gounty of Chesterfield'under authority vested in the Board of Supervisors of said County to operate a water supply system in said County, and that they, the said parties of the first and second parts, agree for themselves, their successors and assigns that they will not claim any damage that may be occasion- ed by damming said Greek and flooding the land of'the said partiesm, and WHEREAS: The necessity for the aforesaid agreement and the necessity of the impoundment of the waters of Powhite Creek and the oreatin§ of a lake thereon in order to provide a water supply system for the County of Chesterfield no lon~er exists, and ~HEREA$: In a meeting of the Board of Supervisors on March 11, the Executive Secretary was authorized to institute the necessary proceedings to release the said parties from the easement which'was acquired by the County of Chesterfield under the terms and by reason of the aforesaid agreement, which authorization and direction has never been carried out, and WHEREAS, It is proved that the necessity for said easement and/or agreement no longer exists. BE IT RESOLVED: By the Board of Supervisors of Chesterfield County, Virginia, that Irvin G. Hornet, Ghair~nan of the Board of Supervisors and M. German, game warden, appeared before the Board presenting the game claims for the month. *On motion of Mr.'Gunter, seconded by Mr. Britton, it is resolved that these claims be paid as amended. This day again there was discussed the matter of the rezoning of the following described parcel of'land by Mr. 0. K; Brooke: In Manchester Magisterial District, a parcel of land fronting approximately 830 feet on Rt. 10 and 630 feet on Belmont Road, said parcel being the triangle of approximately.~ acres fromed by the intersec- tion of said two roads. Tare, being represented by Mr. William 01d and Mr. Wallace Moncure, came before the Board requesting the resoning from Residential-2-to Industrial on the follow: In Manchester Ma~isterial District, a parcel of land fronting 530 feet on the Belt Boulevard and extending northwardly 300 feet, said parcel being approximately 1600 feet west of Rt. 360. Mr. Tare stated that the propose~ building being a wholesale bakerywould be set back ?0 feet from the Highway. That no loading would be done from the front of the building, and presented a petition signed by some 17 people pro- posing the requested rezoning. Mr. Fred Grant, County Sanitation Officer, stated that the land was not suit- able for residential purposes unless it was filled several feet. Mr. D. W. Murphey, Jr., who represented the opposition in this case, presented a petition signed by some 90 people and stated that due to the noise of tho trucks, the odor of baking bread and the general devaluation of property, this request should not be granted. Mr. Caa~pbell speaking for the Weatherford Baptist Church objected to the pro- posed resorting. Whereupon Mr, Britton moves that this Board deny the request'for rezoning, which motion died for the want of a second, Upon further consideration and on motion of Hr. Gunter, seconded by Mr. Goyne, it is resolved that this Board approve the request, provided a bakery is built according to the plans submitted. It is here noted that Mr. Britton votes This day Mr. R. Pinkney Sowers, representing Hr. James Sowers, developer of Highland'Hills Subdivision. requesting a Use Permit for the operation of a swimming pool on the following described parcel of land: In Midlothian Magisterial District, a parcel of land fronting ZOO feet on Greenock Drive and extending northeastwardly approximately 200 feet, said parcel being 350 feet northwestwardly from Robert Bruce Drive. Mr. Goyne stated that Hr. Morner is tnconsistant and that he has on many occas- ions previously requested the proposed use of the land. On motion of Mr. Gunter, seconded by Mr. Hague, it is resolved that the afore- described parcel of land be and it hereby is zoned for general business. It is here noted that Mr. Goyne votes "No". Mr. Irvin Homer eliminated himself from a vote on this question. This day Mr. Frank Beck came before the Board'requesting a Use P~rmit for a tire recapping plant on the following described parcel of land: In Bermuda Magisterial District, a parcel of land fronting on Ri. ~1, 100 feet and extending eastwardly 405 feet, said parcel being 300 feet north of Chesterfield Avenue and being Lot ~5, Block C, of Patterson Park Subdivision. Came also Mr. Fred Crowder, representing the opposition to this request, stat- ing that there would'be some hazard to the operation and presented a petition duly signed and notarized for 14 property owners in the area, and another peti- tion on which names we*re not notarized, signed by some ~1 citizens, all oppos- ing the ~onstpuction and operation of a tire recapping plant in the rear of Mr. Back's present business. Mr. Marshall Briskill testified tha't there would be no odor, however, there would be some ha'zard in the operation of this plan',. This day Mr. Raymond G. Moore came before the Board requesting that the County Water Department take over the water system in Beulah Village. Upon considera- tion whereof and on motion of Mi-, Hague, seconded by Mr. Britton, it is resolv- ed that action on this question be deferred until the next regular meetinc of this Board, which date is after the Bond Referendum. This day Chief G. W. Smith, came before the Board and recommended that the requirement of one year of County Residence as a prerequisite for a job as County Police officer be deleted. Upo~ consideration whereof and on motion of Mr. Britton, seconded by Mr. Ounter, it is resolved that the re~uirement of one year~s residence in the county as a prerequisite to becoming a Police Officer in the County~be, and the same is hereby deleted. However, officers will be required to live in the County as soon as practicable. On motion of Mr. Gunter, seconded by Mr. Britton, it is resolved that this Board approve the recommendation of Chief G. ~. Smith and request the Judge of Circuit Court, the Hon. J. Garland Jefferson to appoint Mr. John A. SimmOns and Mr. W. G. Walton as Pol'ice Officers for the County of Chesterfield. And be i~ further resolved that ~hief G. W. Smith be authorized to employ Mr. George T, Martin to be dispatcher for the Police Department. This day again the matter of ~rantin~ a building variance to the E1 Patio Restaurant on Rt. 60, at its intersec'tion with Buford Road was discussed be- fore the Board, and upon consideration whereof and on motion of Mr. Britton, seconded by Mr, Gunter, it is resolved that the request to allow the construc- tion of a reception room within 6-1/2; from the property line, fronting on Rt, 60 be and the same is hereby denied. This day Dr. Gill cited the fact that it was possible to build houses on 50- foot lots in the Sanitary District of Ettriok under tho zoning laws and that certain restrictions were working hardships in the location of houses on small lots, On motion of Dr. Gill, seconded by Mr. Britton, it is resotved that th~s Board grant ~ariances to Mr, G. R. Wade, at 15 James Street, Mr, Horace Blank- enship, 1~ Main Street, Mr. W. A. Andrews, 10 Granger Street, and Mr, M. M. Pond on Second Avenue, for the construction of houses not less tha~ 5 feet from the side line, This day the matter of the vacation of a road leading northwardly from Cozy Lane in Manchester District again came before the Board and upon inspection of the property by aerial photography and it appears that the extension of the right of way in question would be beneficial to the orderly subdivision of property in this area. On motion of Mr. Britton, seconded by Dr. Gill, it is resolved that this request be and it hereby is denied. Be it resolved by the Board of Supervisors of Chesterfield County that this Board does approve the proposal ~hat Section 1~1 of the Constitution of the State of Virginia be amended in accordance with the recom~endations of the Gray Commission and that this Board does urge tt~t the constitutional conven- tion be approved by the voters of the election to be held on January 9, 1956. his day Mr. William 01d, Mr. D.. Murphey, and Mr. Ernest Ge.tee, appeared be- fore the Board representing the Chesterfield-Colonial Heights Bar Association, seeking the support of the Board ~n an application of a now judicial circuit involving Chesterfield County or an additional judge for the Fourth Judicial Circuit. On motion of Mr. H. T. Goyne, seconded by Mr. S. R. [{ague, it is re- solved that, ~hereas, during recent years the expansion and development of the County of Chesterfield has resulted in an enormous increase in the population of the County,bringing about a serious expansion of all public functions of the County, including the volume of litigation, both criminal and civil, in the Circuit Court, and Whereas, this situation is becoming more and more aggravated with the continuing industrial development of the County, and particularly in view of the geographi- cal location of the County as the cross roads between dities, and Whereas, it is the view of those connected with the Circuit Court and those practicing therein, that it is no longer feasible or possible for business of this Court to be efficiently administered by a Court connected with and a part of a large circuit, unless an additional judge should be provided for said Circuit, and Whereas, the public interest requires the provision of said additional judge the creation of a new judicial circuit composed of this County and Colonial Heichts as the on]y practical long range solution of the problems involved. Therefore~ be it Resolved, that this Board doth hereby request the representative~ of this County in the General Assembly, and the Honorable Lloyd C. Bird, ~he Honorable Edward M. Hudgins, and the Honorable Minetree Folk.s, to introduce the 1956 session of the General Assembly appropriate le~islation to bring abou~ the appointment of such additional ~udge or the establishment ~f a new judicial circuit for Chesterfield County and Colonial Heights, and to vigorously present to the appropriate committee of the General Assembly and to the General Assembly the necessity for such additional judKe or for the creation of such new judicial cirucit. On motion of Mr. H. T. Ooyne~ seconded by Mr. S. H. Hague, Jr., the above solution was unanimously adopted. It is here noted that a hearin~ will be held at 10:30 a.m. on December 15th, at the HiKhway Department on the deepening of the James River channel. The Executive Secretary reported that the pay scale of the Treasurer, Com~onwealtl Attorney and Sheriff had been received, which reports are ordered filed. On motion of Dr. Gill, seconded by Mr, Hague, it is resolved that the pay raises as presented by the Water Department, Building Inspector,s Office, Executive Secretary,s 0ffioe and the Assessin~ Clerk,be, and they are hereby approved as presented and that said raises be retroactive to July 1, 1955. This day Mr. Thcs. W. Cosby, writing in behalf of the Ben Air Fire Department, request that the Board of Supervisors install a gas heating unit in the Ben Air Fire Station. Upon consideration whereof and on motion of Mr. Goyoe, seconded by Dr. Gill, it is resolved that this request be denied at this time. This day a letter from the State Water Control Board was read, which letter cited the fact that the progress report was due the latter part of January. was generally agreed that the matter be again considered at the next regular meeting of the Board. It On motion of Dr, Gill, seconded by Mr. ~oyne, it is resolved that the members of the General Assembly representing the County of Chesterfield are hereby requested to take appropriate action necessary in the 1956 Session of the General Assembly to amendthe "Hospitalization and Treatment of Indigent law as found in the Code of Virginia, so that the County will be liable only for cost of hospital care and treatment for the period of certification at the Medical College of Virginia Hospital and the University of Virginia Hospital. On motion of Mr. Goyne, seconded by Mr. Britton, it is resolved that the members of the General Assembly representing the County of Chesterfield are hereby quested to take appropriate action necessary in the 1956 Session of the General Assembly to delete Section 63-69.1 Title 63, Chapter 3, "Submission of Biennial Welfare BudKet,,, of the Code of Virginia, as this section is considered unneces- sary and time consuming, serving no real purpose. This day Mr. Garland Barksdale requested a donation from the County of Chester. field for the developing Fund of the Petersburg General Hospital, and cited the fact that ~90 patients from the County of Chesterfield had been treated in 195~. Upon consideration whereof and on motion of Dr. Gill, seconded by Mr. Goyne, it is resolved that this Board donate $1000.00 from the unappropriated surplus of the General County Fund to the Developing Fund of the Petersbur~ General Hospital And be it further resolved that the budget of the County be amended and the Treasurer of the Oounty authorized to transfer $1000.00 from the unappropriated surplus of the General Fund to 8f-ll~. This day a letter from Mr. Herbert Wilson was read requesting time for a hearin~ before the Board of Supervisors. It was generally agreed that this matter be deferred until some time in January. This day a letter was read from Mr. Ed. Hawks, Coordinator Civil Defense for Chesterfield County, requesting the use .of one of the old County vehicles for civil defense purposes.
