Summary of Information: Students representing each of the county's high schools are participating in this year's Model County Government program. This program is designed to give high school government students an opportunity to see their local government in action. In addition to attending today's board meeting, students have also attended a school board meeting and tomorrow morning each student will shadow a county or school official. Summary of Information: Older Americans Month is observed in Chesterfield-County and the nation in May to celebrate and acknowledge the contributions of past and present older Americans to our country. The U.S. Administration on Aging has chosen "Celebrate Long-Term Living" as the 2005 theme for Older Americans Month. This theme was selected to honor older Americans as a national treasure, and to highlight the need for mid-life and older adults to be prepared to live longer than previous generations. Many organizations and Chesterfield County Departments provide services and programs to help Chesterfield County's older residents lead active, fulfilling and independent lives. Subiect: Acceptance of a Bid to Purchase Chesterfield County Certificates of Participation, Series 2005A-C, Related to Financing for Various Capital Improvement Projects County Administrator's Comments: ~--~~~ :~~~ County Administrator: Board Action Requested: The Board is requested to accept and approve a bid to purchase (adjusted as permissible in accordance with the terms of the preliminary official statement) $4,300,000 principal amount of Certificates of Participation, Series 2005A, $8,950,000 principal amount of Certificates of Participation, Series 2005B, and $1,245,000 principal amount of Certificates of Participation, Series 2005C, in connection with the planned Certificates of Participation financing for the Police Property/Evidence Storage Facility, the Community Development Building, Airport Hangar Project and the Finance/Human Resources Information System. The responsible bidder, whose proposal must represent the lowest true interest cost to the County, and whose proposal must be in accordance with the Detailed Notice of Sale, as well as the principal amount of certificates sold will be identified on April 27tn after the bids are received. On April 13, 2005, the Board approved a Resolution which authorized entering into a Ground Lease for the Police Evidence/Storage Facility (with SunTrust Leasing as Lessee), and authorized entering into a Lease/Purchase Agreement, and Trust Agreement, and other related agreements (subject to approval by the County Attorney and Bond Counsel) related to planned Certificates of Participation financing. Additionally, at its April 13th meeting, the Board appropriated up to $450,0000 in anticipated proceeds to complete the Airport Hangar Project at the Chesterfield County Airport. Subiect: Reappointment to the Camp Baker Management Board County Administrator's Comments: County Administrator: Board Action Requested: Reappoint member to serve on the Camp Baker Management Board. Summary of Information: The Camp Baker Management Board has the responsibility of overseeing and monitoring the operation of Camp Baker. The position representing the Dale District has expired. Mr. James Lumpkin, 5020 Southmoor Road, Richmond, VA 23234, has been a supporter of Camp Baker services for a number of years and is willing to serve a three-year term on the Camp Baker Management Board, if reappointed. Mr. Miller concurs with the reappointment of Mr. Lumpkin. The Camp Baker Management Board concurs with the reappointment of Mr. Lumpkin. The term would be effective May 1, 2005, and will expire on April 30, 2O08. Under the existing Rules of Procedure, appointments to board and committees are nominated at one meeting and appointed at the subsequent meeting unless the Rules of Procedure are suspended by a unanimous vote of the Board members present. Appointment to the Board of Riverside Regional Jail Authority County Administrator's Comments: County Administrator: Board Action Requested: The Board of Supervisors is requested to nominate and appoint James J. L. Stegmaier to serve as a member to fill the remainder of Lane B. Ramsey's term, which expires on June 30, 2006. Summary of Information' The Riverside Regional Jail Authority (RRJA) operates the Riverside Regional Jail in Prince George County. The Authority consists of fourteen members, one member appointed by the governing body of each participating locality, and the Sheriff of each participating locality. Alternate members may also be appointed in the event the appointed member is unable to attend. Currently Lane Ramsey represents Chesterfield on the RRJA Board and Mary Ann Curtin serves as an alternate member. Sheriff Williams is also a member of the Board by virtue of his office. In 2002, Mr. Ramsey was appointed to a four-year term on the RRJA Board, which expires on June 30, 2006. However, due to scheduling conflicts, Mr. Preparer: Steven L. In order for the Board to nominate and appoint Mr. Steg~naier at this meeting, it will be necessary for the Board to suspend its rules. 0505:68737. ! 000009 RESOLUTION OF THE BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY, VIRGINIA WHEREAS, Chapter 726 of the 1990 Acts of Assembly created the Riverside Regional Jail Authority (hereinafter "the Authority); and WHEREAS, that legislation stated that members of the Authority shall serve four year terms; and WHEREAS, on June 26, 2002, the Board appointed Lane B. Ramsey to serve a four-year term from July 1, 2002 through June 30, 2006 and also appointed Mary Ann Curtin to serve as Mr. Ramsey's alternate member during the entirety of the four-year term; and WHEREAS, scheduling conflicts make it impossible for Mr. Ramsey to attend upcoming meetings of the Authority; and WHEREAS, in order to ensure that Chesterfield County maintains full representation at future meetings of the Authority, the Board now wishes to replace Mr. Ramsey with another appointee to serve the remainder of Mr. Ramsey's four-year term. Norfleet began her career in public social services thirty years ago and has been with Chesterfield County in the field of Child Protective Services since May 15, 1984; and WHEREAS, in her roles as a social worker, senior social worker and supervisor, Mrs. Norfleet has worked diligently with individuals, families and the community to provide advocacy and excellent services that protect the well-being of children; and WHEREAS, throughout her career, Mrs. Norfleet has served as sponsor for Parent's Anonymous self help group, was a professional resource for Theater IV in the development of the musical drama "Hugs and Kisses," which deals with child sexual abuse; and organized a group for sexual abuse victims; and WHEREAS, Mrs. Norfleet was actively involved in the Chesterfield- Colonial Heights Multidisciplinary Child Abuse and Neglect Team; was in the leadership role on the Sex Abuse Task Force that developed the County Response Protocol; represented the Department on the Domestic Violence Task Force and on the Fatality Review Team; and has served on numerous state and county committees; and WHEREAS, Mrs. Norfleet has been a strong leader who was committed to the vision, mission and values of the department; and WHEREAS, Mrs. Norfleet has been a role model of teamwork and professionalism for her colleagues in and outside of Chesterfield County. Summary of Information: The Commonwealth of Virginia is adopting May 15-21 as Business Appreciation Week and is encouraging all localities to do the same. Chesterfield continues to experience significant growth from existing businesses; therefore, in adopting Business Appreciation Week in conjunction with the State's efforts, the Board of Supervisors will be recognizing the valuable economic and employment benefits the business community provides to Chesterfield County. Summary of Information: On October 22, 2003 the Board of Supervisors created the 24-1ot "Englewood Sewer Assessment District". That sewer line extension is currently under construction. The Utilities Department has received a request to create an assessment district for an additional four (4) lots. This will necessitate deviating from the County's design/construction specifications to allow less than the normal minimum ground cover over a sewer line, and will require lowering an existing water line. If an assessment district is created, the County will initially pay all engineering, construction and other costs to extend a public sewer line that will serve 9416, 9417, 9426 and 9427 Beckham Drive. The sewer assessment on each lot may be paid in a lump sum or over a 20-year period in semi-annual installments. Property owners, who occupy a home within the assessment district, and who are aged 65 or over, may qualify to have their assessment payments deferred until ownership changes. The property owners will also pay interest at a rate, which will be the index of average yield on United States Treasury securities adjusted to a constant maturity of one year, as made available by the Federal Reserve Bank at the time the assessment ordinance is adopted. Summaryoflnformation: The county has received a request from Fox Croft residents to restrict any through truck or truck and trailer or semi-trailer combination, except pickup or panel trucks, from using Fox Club Parkway (Route 5201) and Fox Club Road (Route 5200) from Route 360 to Woolridge Road (Route 668). The recommended alternate route is Route 360, Otterdale Road (Route 667), and Woolridge Road (Route 668). Fox Club Parkway is currently being extended, as part of the new Cosby Road High School construction, from its current terminus in Fox Croft Subdivision to Route 360. The Virginia Department of Transportation (VDOT) has four criteria it considers when a restriction is requested. A requested restriction must meet the first two criteria, in that: 1) a reasonable alternate route is provided; and 2) the character or frequency of truck traffic on the route proposed for restriction is not compatible with the effected area. Evaluation of the second criterion will include safety issues, accident history, engineering of the roadway, vehicle composition, and other traffic engineering related issues. County Administrator's Comments= ~_~~-~<:~ /~/~/~~ County Administrator: Board Action Requested: On April 13, 2005 the Board was requested to set a public hearing for this date to consider revising the county's emergency response cost recovery ordinance to eliminate the provision which allows the county to recover its reasonable costs incurred for incidents relating to driving without a license or driving with a suspended or revoked license. Summary of Information: Pursuant to state law, the county has adopted an ordinance allowing the county to recover its expenses incurred for emergency responses to several categories of traffic offenses: the operation of a vehicle while impaired (DUI), reckless driving, driving without a license, and leaving the scene of an accident. When originally adopted in 2002, the ordinance provided for cost recovery for only DUI incidents, but it was expanded by the General Assembly in 2003 to include the other traffic offenses. The County amended its ordinance in August 2003 to add these offenses. The addition of the new offenses has greatly increased the number of invoices from approximately 100 per month to 400 per month. Since the addition of the additional offenses in August 2003, 65-70% of the invoices have been for offenses in the driving without a license category, but, due to collection difficulties, only 10% of the amount collected relates to those offenses. Consequently, the county has been spending significantly more staff time and financial resources on collecting for these offenses than it has been able to recover. After the Preparer: Steven L. OOO091 AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING SECTION 13-71 RELATING TO REIMBURSEMENT OF EXPENSES INCURRED IN RESPONDING TO DUI AND OTHER TRAFFIC INCIDENTS BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Section 13-71 of the Code o£ the County of Chesterfield, 1997, as amended, is amended and re-enacted to read as follows: Sec. 13-71. Reimbursement of expenses incurred in responding to DUI and other traffic accidents or incidents. (a) A person convicted of violating any of the following provisions shall be liable in a separate civil action for reasonable expenses incurred by the county or by any volunteer rescue squad, or both, when providing an appropriate emergency response to any accident or incident related to such violation. Personal liability under this section for reasonable expenses of an appropriate emergency response shall not exceed $1,000.00 in the aggregate for a particular accident or incident occurring in the county: (1) The provisions of Code of Virginia §§ 18.2-51.4, 18.2-266 or 29.1-738, as amended, or a similar county ordinance, when such operation of a motor vehicle, engine, train or watercraft while so impaired is the proximate cause of the accident or incident; (2) The provisions of Code of Virginia, tit. 46.2, ch. 8, art. 7 (§§ 46.2-852 et seq.), as amended, relating to reckless driving, when such reckless driving is the proximate cause of the accident or incident; and ~ (3)The provisions of Code of Virginia, ~ 46.2-894, as ~ended, relating to improperly leaving the scene of an accident. (b) In dete~ining "reasonable expenses", the county may bill a fiat fee of $250.00 or a minute-by-minute accounting of the actual costs incu~ed. As used in this section "approp~ate emergency response" includes all costs of providing law-enforcement, fire-fighting, rescue, and emergency medical services. The cou~ may order as restitution the reasonable expenses incu~ed by the county for fire-fighting, rescue and emergency medical services. (c) The police dep~ment shall compile a repo~ of the reasonable expenses of the appropriate emergency response for each accident or incident and fo~d that info~ation to the county attorney's office or the accounting dep~ment for appropriate procee~ngs. The fire dep~ment shall have the same reporting requirements except for accidents or incidents for which restitution is sought. Summary of Information: Lucy Corr Nursing Home, like virtually all other public and private nursing home facilities, receives a large percentage of its revenue form the federal Medicaid program. In Virginia the Department of Medical Assistance Services (DM_AS) administers the Medicaid program pursuant to the Virginia State Medicaid Plan. Under the program, whenever Lucy Corr provides Medicaid- eligible services, it receives Medicaid reimbursement from DMAS. For years, DMAS has reimbursed Lucy Corr based on an established reimbursement schedule. In turn, the federal government reimburses DM_AS. Last year, the Commonwealth realized that it was eligible under federal regulations to receive a large reimbursement amount. In order to recover this additional reimbursement, Medicaid regulations require DMAS to make enhanced payments in a lump sum to a public nursing home provider like Preparer: Bradford S. On June 24, 2001, the Commonwealth amended the Virginia State Medicaid Plan to permit recovery of enhanced payments. The Commonwealth has planned and the Health Care Financing Administration has authorized, transactions which for the County will total $10,790,356. Under the plan, participating localities will borrow respective shares of the Statewide total. The borrowed funds will be transferred to a state account, then returned to the local account and used to repay the loans. In addition, the Commonwealth will pay an incentive fee of about 1.5% of the transaction amount, and pay an amount to cover transaction costs, to the locality. DMAS calculates this fee to total $266,129 (this amount includes fees) that the locality can use for any purpose. The Health Center Commission will use 100% of the actual incentive payment to pay off a portion of the outstanding loan ($694,000) with the County. Because this money will have to be appropriated and the amount will exceed $500,000 a public hearing is required by law.
