81S008 STAFF REPORT CASE 81S008 LINDA R. MUSTAIN --F~-b- '-,ak y-t-~ -!~J~_ t- -6zP~- March 25, 1981 BS REQUEST: A Conditional Use to permit a child day care center in a Residential (R-7) District. SUBJECT PARCEL: LOCATION, ACREAGE AND USE: Dale Magisterial District. This property fronts the south line of Bur Oak Lane and is located approximately 250 feet east of its intersection with Black Oak Road. This .33 acre parcel is occupied by a single family residence. Tax Map 66-15 (5) Brentwood, Section A, Block A, Lot 4 (Sheet 22). RECOMMENDATION Recommend approval for the following reasons: A. Through the imposition of conditions which control and regulate the operation, the use, as proposed by the applicant, should not adversely affect adjacent or area property owners. B. Since the applicant intends to reside in the dwelling and the day care center will be only a secondary use, the property will be maintained residential in nature. CONDITIONS: 1. This use shall be granted to and for Linda R. Mustain exclusively and shall not be transferable nor run with the land. 2. No more than ten (10) children (exclusive of the applicant's) shall be permitted on site at any one time. 3. No commercial signs relative to operation of the center shall be permitted. 4. Hours of operation shall be restricted to between 7:00 a.m. and 6:00 p.m., Monday t~rough Friday. Saturday and Sunday operation shall be prohibited. 5. The play area, as shown on the attached floor plan, shall be enclosed by a fence designed to prevent access to adjacent property by children. 6. Other than the exterior play area, no addition or exterior alterations to the existing residence shall be permitted to accommodate this use. 7. This Conditional Use shall be granted for a period not to exceed three (3) years from date of approval. Upon satisfactory reapplication and demonstration that this use has not adversely affected area property owners, the Board of Supervisors may consider renewal. SUPPORTING INFORMATION ADJACENT ZONING AND LAND USE: North - R-7, Single family residential use South - R-7, Single family residential use East - R-7, Single family residential use West - R-7, Single family residential use GENERAL PLAN: Single family residential use. UTILITIES: The existing single family residence is presently connected to both public water and sewer. SOILS, DRAINAGE AND EROSION: No additional construction has been proposed; therefore, this portion of the report has been eliminated. TRANSPORTATION AND TRAFFIC: area traffic patterns. This use should not have a significant impact on PUBLIC FACILITIES: This property is served by Dale Fire Station, Company Number 11. This station is staffed by both paid and volunteer personnel. Fire service capability is good at the present time. Before this residence can be used as a day care center, it must meet the requirements of the Virginia State Welfare Department, the Chesterfield Health Department, the Virginia Uniform Statewide Building Code, the Chesterfield Fire Prevention Bureau and the Virginia State Fire ~rshal's Office. It should be noted that requirements will differ dependent on the age group of children to be housed. DISCUSSION: The applicant has a large (14' x 25') unfinished room in her home which she intends to convert to a small day care center. The applicant's residence is located in Brentwood subdivision and is adjoined on all sides by other single family residences. The applicant has stated that a maximum of ten (10) children will be cared for at any one time and that a majority of the children reside in Brentwood subdivision. It has been Staff's experience that day care centers located within single family dwellings can be a compatible land use provided conditions controlling and regulating the use are imposed. These conditions minimize the commercial impact on adjacent residences and insure that the property is maintained residentially in appearance. CASE HISTORY Planning Commission Meeting: (1/20/81) The Commission deferred this case for thirty (30) days to allow the applicant an opportunity to meet with the adjacent property o~er to the northwest. 81S008 Planning Commission Meeting: (2/17/81) On a motion of Mr. Crump seconded by Mr. Belcher, the Commission resolved to recommend denial of this application. AYES: Messrs.: Howard, Belcher, Crump and Williams Mr. Howard noted that he conducted an informal survey of area residents and found that the majority opposed the use.
