On motion of Mr. R.J. Britton, seconded by Dr. Gill it is resolved that this
Board request the Virginia Department of Highways to improve Sheridan Lane in
the Forest Vzew Subdzvzsmon to specmfmcations acceptable to the State Secondary
System, at a cost not to exceed $550.00, same to be charged to the 35 Road Fund.
This day Mr. Kellam, of the Yirginia Department of Highways met with the Board
and discussed road ~roblems. Mr. Goyne brought to the attention of the Board
the drainage on Willis Road and Rt. 1 was not adequate, that during heavy rains
water would stand on Willis Road. Also, that the section of Rt. 617, betwmen
Rt. lO and Rt. 618, was in a bad state of repair. ~Ar. Kellam promised to make
some investigation of these complaints.
This day the Executive Secretary read a leLter for the Board's hearing signed
by citizens living on Legion Avenue complaining of the lack of hard surface
and it was agreed that the Executive Secretary write a leSter explaining the
road policies of the Highway Department for this County.
Un motion of i~r. Britton, seconded by ~r. Goyne, it is resolved that this Board
recommend to the Highway Department the inclusion of ~4eadow Lane into the
Secondary System as a rural road, to be taken over as of July 1, 1953.
This day a petition was read for the Board's hearing signed by four citizens
living on Walker Avenue in DuPuy 8ourt, ~'~toaca District, complaining about
the rough roads in this area, and it was agreed that the Executive Secretary
would contact Mr. A. B. Windham the Subdivider and ascertain what remedies
may be effected.
This day the matter of the improvement of Hudson Street again came before the
Board and,
Whereas, the State Highway Department has stated it could not install drainage
culverts, it was agreed that the Executive Secretary obtain the cost of a survey
of Hudson Street, locating the depth and proposed location of manholes and cul-
verts of suitable size and length to drain said Hudson Street.
This day Capt. D. C. Page, appeared before the Board requesting the rezoning of
the following parcel of land:
"In Matoaca Magisterial District, a parcel of land beginning at a point on Rt.
623, 600 feet north of the Atlantic Coast Line Ry., 2400 feet eastwardly along
the line of Mason Cole, thence northwardly 220 feet to Old Town Creek, thence
eastwardly along said Creek to the Appomattox River, thence northwardly along
said river 1800 feet to the south line of Archer, thence westwardly 4800 feet
to Rt. 625, thence southwardly 800 feet along Rt. 625 and Rt. 623 to the Old
Town Creek, thence westwardly along said Creek to the Atlantic Coast Line Ry.,
Thence southwardly 600 feet along said Railroad, thence eastwardly 2600 feet
parallel to said Creek to Rt. 623 and southwardly to the point of beginning.
Also a parcel of aldn 24~ acres being an island off ~he eastern property lines
of Archer, Tussing ~:d Covington, to he rezoned from Agricultural ~o Industrial,
on an application of A~r. D. C. Page.
And there appearing no opposition to such proposed rezoning and on motion of
Dr. Gill, seconded by ~r. Goyne, it is resolved that this property be zoned from
Agricultural to Industrial, according to the plat filed with the Board's papers.
This day the Executive Secretary read a request from Mr. Coleman Horrowitz for
the rezoning from Residential to General Business on the following described
parcel of land:
"In Bermuda Magisterial District, a parcel of land fronting 570 feet on the east
side o£ the 300.foot business area bordering Rt. #l, and extending eastwardly
approximately 285 feet alOng the north side of Rt. 1626, to be rezoned from
Residential to General Business, on an application of Mt.Coleman Horrowitz."
And there appearing no opposition to the proposed rezoning, it is on motion of
I~r. Goyne, seconded by ~'~r. Britton, resolved that ~hm aforesaid described parcel
of land be and it hereby is re~oned from Agricultural to ~eneral Business.
This day ~. C. F. ~ryan appeared before the Board seeking to rezone from Agricul-
tural to General Ousiness the following described parcel of land:
"~ Manchester i~agisterial District, a parcel of land beginning at a point on the
west side of Bywood ~ane, 800 feet from Rt. ~60 extending westwardly 400 feet,
thence southwardly 1OOO feet, thence eastwardly 800 feet and northwardly 480 feet
to the point of beginning, to be rezoned from Agricultural to General Business."
And there appearing no opposition to this rezoning and on motion of Mr. Britton,
seconded by 14r. Gunter, it is resolved that the aforesaid described parcel of
land be and it hereby is rezbned from Agricultural to General Business.
This day I~r. R. ~. Dixon, appeared before the Board seeking the rezoning from
Residential to General Business the following described parcel of land:
"In Manchester ~agisterial District, a parcel of land fronting 60 feet on the
west side of Stockton Street and extending ~ack 155 feet, said lot being the
triangular lot adjacent to the Atlantic Coast Line RR.~ to be rezoned from
Residential to General Business."
Came also l~rs. Snellings presenting petitions against said rezoning and it was
pointed out that the lot was too small on which to build according to the County
Ordinance.
Upon consideration whereof and on motion of Mr. Britton, seconded by ~r.
Goyne, it is resolved that this request be denied without prejudice.
This day Mr. R. L. Bates came before the Board requesting the rezoning of a parcel
of land from Agricultural to General Business as follows:
"In Dale ~'~gisterial District, a }mrcel of land of irregular shape containing
39 acres and fronting on the north side of Rt. 360, l~OO feeq and lying on the
west side of Old l~ill I{oad, to be rezoned from Agricultural to General business
on an application of l~[r. R. L. Bates.
Since this was held over from the last regular meeting of this Board, and there
appeared then no o?position and there appeared now no opposition, on motion of
Mr. Hague, seconded by i¥tr. Britton, it is resolved that this request be reduced
to 1400 feet on the north side of Rt. 360, beginning at the western boundary of
Mr. Bates and extending to the land belonging to Rev. Arthur, extending north-
wardly 3OO feet in depth as per the sketch filed with the Board's papers.
This day the matter of instituting a Planning Commission by the County of Chester-
field came before the Board, and the F~ecutive Secretary having been ordered to
have adequate notices published advertising such a Commission, and there appearing
no opposition to the setting up of a Planning Conm~ission, it is on motion of
Gunter, seconded by ~ur. Goyne, resolved that the following ordinance be and it
hereby is adopted.
AN ORDINANCE
To define the authorities and duties of a planning commission appointed by the
board of supervisors of Chesterfield County.
WHE~EAS, it is provided by ~ act o~ General Assembly of ~irginia,
approved April 3, 1952 (Chapter 595, Acts of 1952} that any county ~hat has
adopted a zoning ordinance as provided by Chapter 15 of the Acts of 1927, as
amended, may appoint a planning commission and by ordinance define its powers
and duties; and
WHEi{EAS, the board of supervisors of Chesterfield County has appointed
a planning com~ission under this act;
NoW, THE~EFuRE, be it ordained by the board of supervisors of Chester-
field County, Virginia as follows:
Section 1. The county planning co~m~ission is authorized to appoint
from its membership an executive committee, consisting of the chairman and not
less than four other members, which committee may exercise between meetings of
the co~nission all powers of ~he commission, or such powers as the co,remission
determines.
Section 2. County planning co~ission--organization, rules, staff and
finances.--The county planning co~mnission shall elect from amongst the appoint-
ive members a chairman, whose term shall be for one year with eligibility for
reelection, and the commission may create and fill such other offices as it may
determine. It shall have the power and authority to appoint such employees and
staff as it may deem necessary for its work, and may contract with planners and
other consultants for such services as it may require. The expenditures of the
commission, exclusive of gifts, shall be within the amounts appropriated for the
purpose by the county board of supervisors.
The co~muission shall adopt rules for transaction of business and mhall
keep a record of its resolutions, transactions, findings, and determinations,
which record shall be a public record. Upon request of the commission, the
county board of supervisors, or other county officials or the chief executive
officer of any municipality may, from time to time, for the purpose of special
surveys under the direction of the planning commission, assign or detail to the
co~nission any members of staffs of county or municipal administrative depart-
ments, or may direct any such department to make for the commission special sur-
veys, or studies requested by the commission.
Section 3. County master plan.--It shall be the function and duty of
a county planning commission to make and adopt a master plan for the physical
development of the unincorporated territory of the county. Any such plan may
include the planning of incorporated towns to the extent to which, in the com-
mission's judgment, they are related to the planning of the unincorporated terri-
tory or of ~he county as a whole, provided, howe~er, the plan shall not be con-
sidered as a master plan for any incorporated towns without the consent of the
planning commission and council of said incorporated town, and further provided
that the county plan shall be coordinated with the plans of the State Department
of Highways, insofar as it relates to highways or thoroughfares unter the juris-
diction of that department.

reco~m~enda~ions for ~he develo~ment of the territory covered by the plan, and may
include, among other things, the general location, character, and extent of streetst
or roads, viaducts, bridges, waterways, and waterfront developments, parkways,
playgrounds, places and spaces; the general location and extent of publicly owned
utilities and terminals, and other purposes; the acceptance, widening, removal,
extension, relocation, narrowing, vacation, abandonment, or change of use of any
of the foregoing public ways, grounds, places, spaces, buildings, properties,
utilities or terminals; the general character, location and e~tent of community
centers, town sites or housing developments; the general location and extent of
forests, agricultural areas, and open development° areas for purposes of conservatio~
food and water supply, sanitary and drainage facilities, or the protection of
urban development; a land classification and utilization program; the distribution
of population, and the uses of land for trade, industry, habitation, recreation,
agriculture, forestry, soil and water conservation, and other purposes.
Section 4. General purposes of the plan.--In the preparation of a
county master plan, a county planning co~mission shall make careful and comprehen-
sive surveys and studies of the existing conditions and probably future changes
of said conditions within the territory under its jurisdiction. The county mas~er
plan shall be made with the general purpose of guiding and accomplishing a
coordinated, adjusted and harmonious development of the county which will, in
accordance with present and future needs and res~rces, best promote the health,
safety, morals, order, convenience, prosperity, or the general welfare of the
inhabitants, as well as efficiency and economy in the process of development,
including amongst other things, such distribution of population and of the uses
of land for urbanization, trade, industry, habitation, recreation, agriculture,
forestry and other purposes, as will tend to create conditions favorable to
health, safety, transportation, prosperity, civic activities, and recreational,
educational, and cultural opportunities; will tend to reduce the wastes of
physical, financial, or human resources which result from either excessive con-
gestion or excessive scattering of population; and will tend toward an efficient
and economic utilization, conservation, and production of the supply of food and
water, ~'~ of Crainage, sanitary, and other facilities and resources.
Section 5. Adoption of master plan.--A county planning commission may
adopt the county master plan as a whole by'a singl$ resolution, or, as the work
of making the whole master plan progresses, may from time to time adopt a part
of parts thereof, any such part to corr~espond generally with one or more of the
~lctional subdivisions of the subject matter which may be included in the plan.
The commission may from time to time amend, extenc~ or add to the plan, or carry
any part of it into greater detail. The adoption of the plan or any part,
amencknent, extension or addition s~all be by resolution carried by the affirmative
votes of not less t~mn a majority of the entire membership of the commission.
The resolution shall refer expeessly to the maps and descriptive matter ir~tended
by the commission to form the whole or part of the plan, and the action taken
shall be recorded on the map or maps and descriptive matter by the indentifying
signature of the secretary of the co~muission.
Section 6. CertiI'ication of plan to counties and municipalities and
subsequent adoption by municipalities.--The county planning commission shall
certify a copy of its master plan or an adopted part or amendment thereof or
addition thereto to the board of supervisors of the county. The county planning
commission shall certify such copies to the planning commissions of all incor-
porated towns within the county. Any planning commission of an incorpoarted
town which receives any such certificiation may adopt so much of theplan, part,
amendment, or addition as falls within the territory of the town as a part or
addition to the master plan of said town, and when so adopted it shall have the
same force and effect as though made and prepared, as well as adopted, by a
planning commission of such town.
Section 7. ~iscellaneous powers of the commission.--It shall be the
further duty of a county planning commission to promote the cooperation of the
planning co~nissions of any incorporated towns within the county and coordination
of the plans of such towns and the coordination of such plans with the county plan,
and generally to confer with and advise town and county executive and legislative
officials for the purpose of promoting a coordinated and adjusted development of
the county. Any such commission may also advise county co~mmissioner with respect
to the formulation of public improvement programs and the financing thereof.
Ail public officials shall, upon request, furnish to the commission,
within a reasonable time, such available information am it may require for its
work. The members and employees of the co,remission, in the performance of~ its
functions, may enter upon any land and make examinations and surveys and place
and :m%intain necessary monuments and marks thereon. In general, the commission
shall have such powers as may be necessary for it to perform its functions and to
promote county or regional planning.
Section 8. Legal Status of plan--~henever any county planning co~aission
shall havu adopted a master plan of the county or any part thereof, and said
master plan or part thereof s~mll have Oeen approved by the board of supervisors
of such county, then and thenceforth no road, park, or other public way, public
ground, or public space, no public building or structure, or no public utility,
whether publicly or privately owned, slmll be constructed or authorized in the
unincorporated territory of the county or region until andunless the proposed
loc~tion and extent thereof shall have been submitted to and approved by such
county planning commission;provided, howe~er, that in case of disapproval, the
commission shall communicate, its reasons for disapproval to the board of super-
visors of the county in which, the public way, public ground, public space, public
building, public structure, or public utility is proposed to be located; and such
board shall have the power to overrule such disapproval, and upon such overruling
said board or other official in charge of the proposed construction or authoriza-
tion may proceed therewith. The failure of the commission to act with thirty days
from and after the date of official submission to it shall be deemed approval,
unless a longer period be granted by t?~ submitting board, body or official.
Section 9. Cooperation with the State Division of Planning and Economic
Develppment. It s~mll be permissible for the county planning commission to
cooperate with the State Division of Planning and-~Economic Development in the
preparation of so much of State-wide plans as may affect the county under the
jurisdiction of said county planning commission. It shall also be the duty of
the county planning commission to file with the State Division of Planning and
Economic Development copies of all surveys, reports and master maps conducted or
prepared by said commission.
Section 10. Definitions.--For the purpose of this ordinance,''unincor-
porated'' means situated outside of ci~ies, and incorporated towns. "Incorporated,
conseeuently, means situated within cities and incorporated towns. The term
,,municipality" ,'municipalities," or ,,municipal" includes or relates to cities and
incorporated towns.
This day the Executive Secretary read a request from Ferrow and Srockenbrough for
payment of $2748.15 being the amount due to the consulting engineers at this time
for work completed on the water improvement program in the County.
~n motion of Mr. Gunter, seconded by ~4r. Goyne, it is resolved that the
Executive Secretary be and he hereby is authorized to pay said amount.
on motion of Mr. Gunte, seconded by ~r. Britton,.it is resolved that the Executive
Secretary be and he hereby is authorized to pay $1000.O0 to the firm of Perrow
and Brockenbrough, consulting engineers, for engineering services completed on a
preliminary report on the proposed County sewer system. And be it further re-
solved that the budget of the County of Chesterfield be and it hereby is amended
in the amount of $1000.00, said sum being appropriated from the unexpended sur-
plus of the General Gounty Fund.
This day the Executive Secretar~ read a letter from ~,~r. Gordon Clark, District
Traffic ~,4anager, The C&P Telephone Company, citing certain mai-practices of our
switchboard, and it was agreed that this letter be received and filed.
This day the matter of repairing the roof o£ the Enon Fire Department came before
the Board, and it was agreed that the Supervisor from Bermuda District and the
Executive Secretary make some investigation of this request.
This day the Executive Secretary read a letter from i~r. Leo ~4yers advising that
our fleet policy covering all county owned vehicles would be up for renewal on
January i, 1953, and it was agreed that the Executive Secretary make some in-
vestigation of this insurance policy and if possible obtain bids from other
c om~ni es.
This day the Executive Secretary presented bids for weatnerstripping the windows
in the buildings at the Courthouse. It was agreed that the work be put off to
some future date.
This day the Executive Secretary read a letter from i'~r. M. A. Cogbill, resigning
from the office of Co-ordinator of Civilian Defense of Chesterfield County.
un motion of Mr. Goyne, seconded by Dr. Gill it is resolved that this Board
accept this resignation with extreme regret.
This day the Executive Secretary read a letter from ,~lr. G. W. Sutton, of the
Richmond Rubber Company, citing firm bids on the construction of fire equipment
for the Matoaca and Clover Hill Fire De~rtments., and offering to construct
said truck as soon as chassis becomes available, and accept payment after July
l, 1953.
It was ~]enerally agreed by the Board members that this letter be received
and filed.
On motion of *~r. Britton, seconded by Dr. Gill, it is resolved that the County
employees be given Friday, December 26, 1952 as a holiday.
on motion of ~4r. Britton, seconded by Dr. Gill, it is resolved that the Executive
Secretary be and he hereby is directed to write to ~,~r. Edward Hudgins, I,~r. Lloyd
Bird and ,,~r. Jos. J. Williams, thanking them for theLr efforts in successfully
obtaining additional representation for Chesterfield County.
On motion of ~,~r. Goyne, seconded by Dr. Gill, it is resolved that the livestock
and fowls claims as presented by the Game Warden, be and the same are hereby
ordered to be paid.
This day the matter of drainage in Rayon Park again came before the Board of
Supervisors and the Board was advised t[~t the appropriation of approximately
$8,000.00 given to the Beliwood Depot by the Federal Government had been re-
turned to the Government as being inadequate for the job necessary to be done.
It was reported that additional funds would be available in the near future to
carry out this proposal.
Upon consideration whereof, and on motion of Mr. Goyne, seconded by
Hague, it is resolved that this Board request the Commanding to advise the
County of Chesterfield when this matter is re-opened fdr bids on the proposed
improvement.
On motion of Mr. Hague, seconded by Mr. Goyne, it is resolved that the Executive
Secretary be and he hereby is authorized to ~ake whatever corrective action is
necessary to give adequate sanitation to the Red Cross Building on the Fair
grounds.
