If the Board has any suggested revisions to the Procedures, they should be made at this time. The changes recommended by staff are indicated on the attached procedures. Yes D No - - 199~ PROCEDURES OF THE BOARD OF SUPERVISORS BE IT RESOLVED by the Board of Supervisors of the County of Chesterfield in accordance with Section 3.4 of the County Charter that the following rules of procedures shall govern the conduct of meetings and work sessions of the Board of Supervisors during the 19931. calendar year. Presiding Officer Section 1. Except as modified herein or as provided by law or historical practice, Robert's Rules of Order. a Manual of General Parliamentary Law, shall be the parliamentary authority of the Board of Supervisors. The County Attorney shall act as parliamentarian to the Board. Any questions involving the interpretation or application of Robert's Rules shall be addressed to the County Attorney. Section 2. The Chairman, or the Vice-Chairman, or in their absence, the most senior member of the Board, shall preside at all meetings of the Board, and on the appearance of a quorum shall call the meeting to order and the Board shall then proceed with its business. Section 3. The presiding officer shall preserve order and decorum. He may speak, make motions, and vote on all questions and he shall decide questions of order and procedure. The Chairman shaH may set reasonable time limits for all speakers and public hearings; provided that by majority vote the Board may reject such time limits. Quorum Section 4. A quorum shall consist of at least three members of the Board. A majority of a quorum shall be sufficient to carry any question except tax issues, incurring of debt and appropriations in excess of $500.00 all of which shall require a majority of the full Board for adoption. No Board member is required to vote on any question, but an abstention, although not a vote in favor of carrying a question, shall be counted as a vote for the purpose of determining a quorum. A tie vote shall defeat the motion, resolution or issue voted on, provided that all zoning cases must be disposed of by a motion approved by a majority of those voting. The Board shall not designate a tie breaker pursuant to § 15.1-535 of the Code of Virginia. 0800:538.7 (Rev. 1/5/94) 1 003 -. - Order of Business Section 5. The order of business at a regular meeting of the Board shall be as follows beginning at 3:00 p.m.: (a) Approval of minutes of the previous meeting. Reading of the minutes shall be automatically dispensed with. (b) County Administrator's comments. ( c) Board Committee reports. (d) Requests to postpone action, emergency additions or changes in the order of presentation with respect to any matter on the agenda. W Special resolutions of recognition. (e1) Work sessions. The Board shall confine their decisions to the matters presented on the agenda. (Marcil 25, 1992) Section 6. Any citizen desiring to present any matter concerning the services, policies and affairs of the County or claims against the Board shall be allotted appropriate time to present his case by the presiding officer. The presentation of the claim shall not exceed 30 minutes and each speaker may not exceed 5 minutes. Every citizen desiring to present a matter to the Board shall by noon on the 6th calendar day prior to the meeting notify the Clerk of his intent to speak and the topic. The notice shall describe in detail the nature of the issue to be presented to the Board and the remedy, if any, that the citizen will ask of the Board. No citizen shall speak on any matter of business which is the -ª subject of an ordinB.flCe or resolution induded on the Board's agenda for that day. Persons appearing before the Board will not be allowed to: (a) Campaign for public office; (b) Promote private business ventures; (c) Address matters within the atiministrative prevmce ef the C.unty Administration; (d) Engage in personal attacks; (e) Use profanity or vulgar language; or ill Speak to matters previously presented to the Board by the speaker. ~. Section 7. Any person speaking to a matter shall be limited to such period of time as shall be allotted by the presiding officer when necessary to preserve order and the efficiency of the meeting. Section 8. The order of business at a special meeting shall follow that of a regular meeting to the greatest extent possible. 0800:538.7 (Rev. 1/5/94) 3 005 - Minutes of Meeting Section 9. The Clerk of the Board shall prepare and maintain adequate minutes of the proceedings of the Board in accordance with the requirements of the Code of Virginia, 1950, as amended. Preparation of minutes will not include every aspect of the Board's meetings relating specifically to discussion and debate but will include all significant events relating to official action. Minutes shall be included as part of the agenda package for the subsequent meeting of the Board. Section 10. The Board may correct its minutes at any time after approval of the minutes only upon a clear showing that a clerical or administrative mistake was made. Agenda Section 11. The County Administrator shall prepare an agenda for each regular or special meeting of the Board on which shall appear the title of each matter on which action is to be taken at that meeting. The agenda for each regular meeting shall (a) be prepared at least five days prior to the meeting, (b) be promptly mailed or delivered to each member of the Board or placed in the repository assigned to such Board member, and (c) be distributed to appropriate officers and employees of the county government and members of the public and media requesting copies. Section 12. Upon a majority vote of the Board of Supervisors any item on the agenda may be called out of sequence. Section 13. Any matter not on the scheduled agenda, may be heard on the day of its introduction only if authorized by the Chairman and upon the unanimous vote of the Board members present. Any such matter must be of an emergency nature, vital to the continued proper and lawful operation of the County. Motions Section ~14. When a motion is made, it shall be accurately stated by the presiding officer or proponent prior to voting on the question. Section ±é15. When a question is under debate no motion may be made except a motion to adjourn, to table, to substitute, or to amend. Such motions shall take precedence in the order listed above. 0800:538.7 (Rev. 1/5/94) 4 008 - - Reconsideration of Ordinances. Resolutions and Motions Section -1816. Any vote by a member of the Board is final once cast. No ordinance, resolution or motion previously voted upon by the Board shall be brought forward for reconsideration during the same meeting of the Board. Debate Section -1917. The patron of an ordinance, resolution, motion or other matter may speak to the ordinance, resolution, motion or other matter. Each member of the Board may participate in discussion of any issue only after being recognized by the Chairman. Each Board member will be allotted an appropriate period by the chairman to speak to the matter. Each member of the Board shall be afforded an opportunity to speak before any member of the Board may speak a second time. At the conclusion of debate, the question shall be called and no further debate shall be in order. Requests by members of the Board or the County Administrator relating to criticisms or concerns regarding the administration of the County, except when related to agenda items, shall not be presented or raised at a meeting of the Board unless first submitted in writing to the County Administrator and unless his response does not resolve the issue. Regular Meetings Section ~18. Each year at its organizational meeting the Board shall set the regular meeting times and dates for the following year provided, however, that the Board shall meet at least once each month. Whenever the regularly scheduled meeting date shall fall on a legal holiday, the regular meeting of the Board shall be held on the following day in accordance with § 15.1-536 of the Code of Virginia, 1950, as amended. The Chairman may cancel any meeting because of inclement weather and should reschedule any cancelled meeting at the earliest possible date by sending written notice to each member of the Board. 0800:538.7 (Rev. 1/5/94) 5 o~r¡; - -- Special Meetings Section 2-119. Special meetings of the Board may be called by two members of the Board in accordance with §§ 15.1-537 and 15.1-538 of the Code of Virginia, 1950, as amended. Upon making such request the Clerk shall notify all members of the Board at least five days prior to the meeting and obtain approvals of such request in accordance with the requirements of the Code of Virginia, 1950, as amended. The five-day notice can be waived only if waivers are signed by every member of the Board and the County Attorney and every member and the County Attorney attend the special meeting. Appointments Section ~20. Appointments to committees of the Board and to authorities, boards and commissions shall be made only by resolution adopted by a majority of the full Board at a meeting subsequent to the meeting when the name has been offered to the Board for consideration. Prior to consideration of the nomination, the nominee shall he notified to determine his willingness to serve and to determine if he meets the minimum qualifications for such appointment. Committees Section ;G21. The Board or Chairman may recommend the creation of committees and the Chairman shall appoint members to such committees or appointment shall be by the Board when required. Committees may hold hearings and perform such other duties as may be prescribed. A committee may be instructed concerning the form of any report it shall be requested to make and a time may be fixed for submission of any report. Amendment of Rules Section ~22. The rules of procedure of the governing body may be amended at any time during the year by a resolution of a majority of the full Board. Section 2á23. The Board of Supervisors may suspend the application of any section of these rules by a unanimous vote of the full Board members present taken in advance of an agenda item considered under the suspended rules. No zoning case shall be considered by the Board of Supervisors if amendments, changes or proffers have been submitted by the applicant after the case has appeared in the newspaper pursuant to the required publication. All such cases shall be deferred to the next appropriate Board meeting for consideration after proper readvertising. Section ~26. Summary of Information: Under the new cable television law, the County is authorized to regulate basic cable service rates and the rental of equipment (e.g. remote controls, convertor boxes). Basic service is defined under the regulations as the lowest service tier which includes, at a minimum, all television broadcast stations, and all public, educational, and governmental programming stations. Comcast's (Storer changed its name e~ective January 1, 1994) basic service provides approximately 11 channels and costs $7.73jmonth. Only about 450 residents subscribe exclusively to the Limited Service, but the $7.73jmonth charge is also the base rate to which additional charges are added to establish the rate for the more popular Preferred Basic Service. The County has been certified by the FCC to regulate basic rates, but before the certification becomes finally effective the County must make the proposed ordinance amendment which recognizes that there will be public input during the regulatory process. This amendment is mandated by federal regulations. Staff asks that this ordinance be adopted on an emergency basis because the FCC has established a deadline of January 30, 1994 to adopt the ordinance and a public hearing cannot be held prior to that deadline due to legal advertising requirements. The recommended alternate route is Midlothian Turnpike and Salisbury Drive. The Virginia Department of Transportation (VDOT) has five (5) primary criteria it considers when a prohibition is requested. Based on Staff's preliminary review, this request will satisfy three (3) of VDOT's five (5) criteria for imposing a prohibition, in that; 1) a reasonable alternate route is available, 2) Mount Pisgah Drive and Oak Lane are classified as local roads, and, 3) the engineering of the route proposed for prohibition indicates that it is not suited for truck traffic. NOW, THEREFORE BE IT RESOLVED, that the Central Virginia Regional Summit supports the recommendation of the Superintendent of State Police that the jurisdictions pursue the formation of a multi-jurisdictional homicide task force. 9. ARTICLE II. ARTICLE III. ARTICLE IV. ( I \, - _. MONACAN BAND BOOSTERS ASSOCIATION BYLAWS NAME The name of this organization shall be the Monacan Band Boosters Association. PURPOSE The purpose of this association shall be to support the total band program and encourage support of music education in the community. MEMBERSHIP . .',:~. Membership in the Association shall consist of all parents or guardians of members of the Band program at Monacan High School. Membership shall also be open to other interested adults and businesses. STRUCTURE A. Officers of the Association shall President, 1st Vice President, President, 3rd Vice President, Secretary, Corresponding Secretary, and Historian. consist of 2nd Vice Recording Treasurer B. Executive Committee shall include the Officers of the Association. Ex-officio members of the Executive Committee shall be the Band Director and Chairman of the Advisory Committee. The Executive Committee shall supervise all affairs of the Association including setting the committee organization each year. The Executive Committee shall present to the Association at the May meeting for approval a budget for the new fiscal year. C. The Executive Committee shall hold its meetings at such time and place as it may designate, and a meeting may be called at any time by the President or by any two officers. Due notice of the time and place of each meeting of the Executive committee shall be given by the corresponding Secretary personally, by mail or by telephone to each officer. The quorum is three elected officers. The Executive Committee will establish committees as appropriate to implement objectives of the Association. - (- D. An Advisory Committee shall be appointed by the President and Executive committee. The purpose of the commi ttee is to serve as a liaison between the various organizations and the Band Boosters. The composition of this committee can vary but should include representation of past officers, various groups wi thin the Band program and student representation. ARTICLE V. FINANCE Section 1. Income earning projects may be undertaken as approved by the Executive Committee. Section 2. Income produced by the Association shall be used to operate the Association and to the advantage of the Monacan High School Band Department; ·~upo~ dissolution any remaining funds or assets shall be conveyed to the Monacan High School Band Department. It is strictly mandated that this Association be a non-profit organization. ( ". -.- Section 3. Disbursements of budgeted funds shall be made by the Treasurer. Non-budgeted disbursements up to $500 may be made from the Contingency Fund if authorized by the president or the Band Director. Non-budgeted disbursements over $500 and exceeding the Contingency Fund must be approved by the Executive Committee. Section 4. The fiscal year is June 1 through May 31. Section 5. There shall be a Budget Committee composed of the President-elect, current President, two members of the Board and two members-at-large from the general membership. Section 6. There shall be an Audit Committee to audit the financial records annually. This Committee shall consist of three members appointed by the Second Vice President. ARTICLE VI. OFFICERS AND DUTIES Sec1:ion 1. The President is responsible for all activities within the Association and specifically shall chair the Executive Committee and the general meetings and shall present annually in the Fall a general outline of goals and priorities for the Association for approval by the membership. 2 - section 2. The 1st Vice president shall serve as assistant to the President and coordinate all Ways and means Projects. Section 3. The 2nd Vice President shall serve as assistant to the President and coordinate all activities in the areas of membership and publicity. Section 4. The 3rd Vice President shall serve as assistant to the President and shall help in coordinating all activities of the band program. Section 5. The Recording Secretary shall keep the records which include minutes and attendance of all meetings and handle any business correspondence. The Recording Secretary serves on the Advisory committee and the Executive Committee. .'~~;,-- Section 6. The Corresponding Secretary shall be responsible for handling incoming and outgoing correspondence in regard to membership. This includes meeting notices, newsletters, and other mailings. The Corresponding Secretary will record minutes of meetings in the absence of the Recording Secretary. The Corresponding Secretary is a member of the Executive Committee. (, section 7. The Treasurer shall be responsible for the Association's financial affairs including receipts and disbursements of monies. The Treasurer shall establish appropriate financial controls; maintain an accurate record of all financial transactions; and report the financial status of the Association at each meeting of the Executive Committee and at each general meeting. The records will be made available for review, audit, and approval at the request of the President. Section 8. The Band Director of Monacan High School is a resource person to the Executi ve Commi ttee specifically and to the Association generally. ARTICLE VII. ELECTIONS AND TERM OF OFFICE section 1. ENDORSING THE EFFORTS OF NEW KENT COUNTY TO LOCATE VIRGINIA'S FIRST PARI -MUTUEL RACING FACILITY IN NEW KENT COUNTY WHEREAS, in November, 1988, the voters of Virginia approved a referendum to permit pari-mutuel betting in the Commonwealth; and WHEREAS, in July, 1989, New Kent County became the first locality in the Commonwealth to vote in favor of locating a horse racetrack within its jurisdiction; and WHEREAS, a Central Virginia location will offer the maximum benefit to the Commonwealth by making live racing conveniently available to the majority of Virginia's populace versus one metropolitan area; and WHEREAS, a central location will maximize the benefits to the agribusiness, tourism, and economy of Central Virginia communities to a greater extent than would sharing benefits with neighboring states by locating the facility in the extreme northern or southeastern part of the Commonwealth; and WHEREAS, the Chesterfield County Board of Supervisors believes that the location of Virginia's first pari-mutuel racing facility in New Kent County will greatly enhance existing tourism, agribusiness, and the economy of this region and will, therefore, provide the maximum benefit to Virginia as a whole. This is a public hearing to readopt the ordinance amendment. Summary of Information: The County Code incorporates all driving violations set forth in the Code of Virginia into the County Code so that offenders can be charged with local ordinance violations instead of State statute violations, which results in fines going to the County rather than the State. One provision incorporated by the County provides that a person violating the drunk driving laws shall be guilty of a Class 1 misdemeanor which carries a maximum penalty of 12 months in jail and a fine of $2,500. The Commonwealth's Attorney, however, has informed staff that a General District Judge has recently held that the County's incorporation provision for drunk driving does not also incorporate by reference the Class 1 misdemeanor penalty for drunk driving, notwithstanding the clear language of the Code. Therefore, the Judge is limiting fines to no more than $100.00 which is the general catch-all penalty provision in the ordinance. The following articles of Title 46.2 of the Code of Virginia are specifically excluded from such adoption and incorporation: Article 2 of Chapter 2; Articles 6, 13, 14, 15, 16, 17, 18 and 19 of Chapter 3; Articles 4 and 5 of Chapter 6; Articles 2 and 23 of Chapter 10; and Chapter 14. References to "highways of the state" contained in the provisions and requirements hereby adopted and incorporated shall be deemed to refer to the streets, highways and other public ways within the county. First, the Commissioner believes that the new minimum penalty of $10.00 for unpaid taxes will be overburdensome on the many taxpayers whose total tax liability does not exceed $10.00. The Commissioner requests that the minimum penalty be reduced to $2.00. Second, the Commissioner has requested that the ordinance be amended to clarify that penalties and interest accrue only on the unpaid portion of the tax owed. As companies have discovered the lack of available buildings they have had to turn to new construc- tion backed by the company's financial strength. While there are numerous sites available to develop, the lead time to develop the site and building are frequently too long to meet corporate needs. Thus the need for developing a prepared industrial pad site. The concept is to get site plan approval and clear a site which would accommodate a 50,000 square foot building which is expandable to at least 100,000 square feet. Summary of Information: On November 30, 1993, the Planning Commission recommended approval of the Zoning Conversion Project which will convert "old" zoning districts to "new" zoning districts and various ordinance amendments which address discrepancies between the "old" ordinance and the"new" ordinance as well as concerns identified by various individual property owners, civic associations and business organization. The Conversion Project will eliminate the need to maintain and explain two (2) zoning ordinances; result in adjacent properties being subject to the same development standards except where previous zoning conditions established different standards; and result in less confusion for property owners, citizens and the County. Jacobson, Director of Planning ¿;t' ~ TO: DATE: December 1, 1993 SUBJECT: Zoning Conversion Project and Related Ordinance Amendments NOTIFICATION. ADVERTISEMENT AND PUBLIC RESPONSE Staff prepared detailed documents explaining the project and comparing the "old" district uses and requirements to those in the "new" districts. In addition, staff and members of the Planning Commission had several meetings with business and civic groups, as well as individual property owners to discuss and review the project. 2,350 individuals who own 3,861 properties as well as almost 1,000 other potentially interested individuals and groups were notified of the project and invited to attend one or all of the six (6) informational meetings held throughout the County during May 1993. The project and the date and time of the informational meetings were advertised in the Richmond Times Dispatch. Many individuals who could not attend the meetings contacted the Planning Department directly for more detailed information. These notifications and meetings were not required by County or State law, but rather were performed as part of the County's customer service efforts to explain this important project and its impact on the Community. Staff again notified the previous list of individuals and groups of the Planning Commission's September 3J), 1993, public hearing. A large advertisement ran in the Richmond Times Dispatch on September 16. These notifications and advertisements also noted that updated information on future public hearings could be obtained by calling the teleworks line at 751- 4700 (998). These notifications and advertisements were not required by County or State Law, but again, were made to help the Community follow this project. As required by State Law, all Planning Commission and Board of Supervisors' public hearings are advertised in the Richmond Times Dispatch Classified Section fourteen (14) and seven (7) days prior to each public hearing. 114 Providing a FIRST CHOICE community through excellence in public service. © - - Chesterfield County Board of Supervisors December 1 I 1993 Page: 2 In general, the response to the project has been positive. As meetings were held throughout the Community, minor concerns were raised about certain use restrictions and development standards in the "new" Zoning Ordinance. Staff evaluated those concerns and agreed that certain Zoning Ordinance Amendments were warranted. On September 30, 1993, the Planning Commission held their first public hearing on the project and agreed to defer final action to allow staff and the Richmond Board of Realtors to meet and attempt to address particular concerns. Following that public hearing, staff met with the Richmond Board of Realtors and agreed that additional Ordinance Amendments would be appropriate to address discrepancies between the "old" and "new" Ordinances. On November 30, 1993, the Planning Commission held a second public hearing and following receipt of positive comments, recommended approval of the conversion and related Ordinance Amendments. Following is a synopsis of the related Ordinance Amend ments: RELATED ORDINANCE AMENDMENTS r ORDINANCE I This Ordinance: (1) Converts the "old" 0, Band M Districts to the "new" 0, C and I Districts; (2) Retains conditions of previous land use cases; and (3) Repeals Chapter 21. This Ordinance and Ordinance II actually accomplish the conversion project. ORDINANCE II This Ordinance will establish the date on which the "Zoning Conversion Project" is adopted as the date on which any use legally existing prior to the conversion becomes legally non- conforming, if applicable. ORDINANCE III The "old" Zoning Ordinance permits churches by right in commercial districts. During several Community meetings, representatives of various churches currently located in commercial districts, expressed concern that churches are not a permitted use in the "new" commercial classifications. This Ordinance Amendment will permit churches by right in C- 2, C-3, C-4 and C-5 Districts. IIÓ _. Chesterfield County Board of Supervisors December 1, 1 993 Page: 3 ORDINANCE IV The "old" Zoning Ordinance did not require setbacks adjacent to railroad sidings or navigable waterways in industrial districts. The "new" Zoning Ordinance requires a setback from these features. Several industrially zoned property owners expressed concern relative to the "new" Zoning Ordinance requirements. Following the Planning Commission's September 30, 1993, public hearing, the Director of Economic Development expressed concern that there was any required setback adjacent to a railroad for any non-residential use. Staff evaluated these concerns and agreed that those uses dependent upon a navigable waterway should not be required to have a setback adjacent to the waterway. Staff also agrees that there should be no setback adjacent to railroads for non-residential uses. The second part of Ordinance IV addresses flexibility in setbacks and other development standards where adjacent to A, R, R-TH or R-MF zoned property occupied by or zoned for non-residential or non-agricultural use. At the Planning Commission's September 21, 1993, work session, it was suggested that this Ordinance also include a provision that would not allow the flexibility if there is a time limit on the zoning for the adjacent non-agricultural or non-residential use on the A, R, R-TH or R-MF property. ORDINANCE V The "old" Zoning Ordinance allowed General Business (B-3) permitted uses and Conditional Uses by Conditional Use in all Industrial Districts. The "new" Zoning Ordinance allows Community Business (C-3) permitted uses and Conditional Uses by Conditional Use in all Industrial Districts. The Board of Realtors expressed concern that General Business (C-5) permitted uses and Conditional Uses were not allowed by Conditional Use in any of the Industrial Districts. It was generally agreed that C-5 permitted and Conditional Uses would be appropriate through Conditional Use in the more intense Industrial Districts (i.e., 1-2 and 1-3). ORDINANCE VI The Board of Realtors expressed concerns relative to inconsistencies between the "old" and "new" Ordinances relative to appropriate locations for shopping centers and motor vehicle rental. In addition, staff identified that drive-in theaters are not listed as a use in the "new" Zoning Ordinance. I1b _. - Chesterfield County Board of Supervisors December 1, 1993 Page: 4 Shopoing Centers The "old" Zoning Ordinance did not address shopping centers in any zoning district. As a matter of interpretation, shopping centers had been permitted by right in all Commercial Districts (Le., B-1, B-2 and B-3). The "new" Zoning Ordinance does not permit shopping centers in Convenience Business (C-1) Districts and in all other commercial districts has certain size and locational restrictions. Without an amendment to the "new" Zoning Ordinance, the conversion would render many existing shopping centers non-conforming. Staff recommends an amendment to delete the restrictions on shopping centers and to allow shopping centers by right in all commercial districts. It should be noted, however, that staff will continue to rely on the Comprehensive Plan for guidance as to the appropriate locations for new shopping centers as well as the various zoning districts "purpose and intent" statements outlined in the Zoning Ordinance. The most recently adopted Plans recommend locations and sizes in accordance with the standards currently outlined in the "new" Zoning Ordinances as well as the "purpose and intent" statements of each zoning district. Motor Vehicle Rental The "old" Zoning Ordinance permits motor vehicle rental in all commercial districts. The "new" Zoning Ordinance permits motor vehicle rental in a General Business (C-5) District and as accessory to motor vehicle sales in a Community Business (C-3) District. The Board of Realtors expressed concerns that the "new" Ordinance is more restrictive with respect to appropriate locations for motor vehicle rental. Staff recommends that the "new" Ordinance be amended to allow motor vehicle rental as a restricted use in C-2, C-3 and C-4 Districts. Motor vehicle rental would continue to be permitted by right in the C-5 District. Drive-In Theaters The "old" Zoning Ordinance permitted drive-in theaters in a B-3 District. The "new" Zoning Ordinance fails to address this use. Staff recommends that the "new" Ordinance be amended to include drive-in theaters as a use and to permit the use in a C-5 District. l1r; - - Chesterfield County Board of Supervisors December 1, 1993 Page: 5 ORDINANCE VII At the time of the Ettrick Village Business Core and the Jefferson Davis Highway Corridor District standards were adopted, revisions to the areas of applicability of Post Development and Emerging Growth Districts Standards were not amended to reflect these new districts. Staff recommends that the "new" Ordinance be amended to address these discrepancies. The second part of the Ordinance relates to any Conditional Use Planned Development being exempt from the requirements of Post Development and Emerging Growth District Standards. Ordinance I addresses this issue and therefore, these references should be deleted. SUMMARY: Ordinances I and II are integrally related to the actual conversion of "old" zoning districts to the "new" zoning districts and should not be acted upon separately. The remaining Ordinances are independent of Ordinances I and II, as well as each other. These Ordinances are in response to concerns expressed at various meetings or to correct discrepancies. These Ordinances can be acted upon independently and are not necessary to actually accomplish the Zoning Conversion project; however, in staff's estimation, adoption of all of the Ordinances is reasonable and would maintain equity of certain uses and restrictions through the Conversion project. These regulations are established with reasonable consideration of the character of the county with a view toward conserving the value of buildings upon the land and providing the best possible environment for human habitation. It is intended that these regulations shall supplement and facilitate the enforcement of the provisions and deveJopment standards contained in the Uniform Statewide Building Code, chapter ri 21.1 of this Code, the utilities department water and sewer ordinancê and the general plan and other applicable laws and regulations. An ordinance to amend the Zoning District Maps of Chesterfield County, Virginia. Specifically, this ordinance proposes amending the maps to convert those properties zoned 0, B, and M to 0, C, and I classifications as follows: Existinq Zoning Proposed Zoning Office Business (0) Convenience Business (B-1) Community Business (B-2) General Business (B-3) and Travel Trailer Park (B-T) Light Industrial (M-1) General Industrial (M-2) Heavy Industrial (M-3) to to to Corporate Office (0-2) Neighborhood Business (C-2) Community Business (C-3) to to to to General Business (C-5) Light Industrial (I-1) General Industrial (I-2) Heavy Industrial (I-3) This amendment will not affect conditions and property - specific development and use conditions and restrictions. This amendment will also repeal Chapter 21 of the Code of the County of Chesterfield, and amend the Code of the County of Chesterfield to delete references to Chapter 21 and insert references to Chapter 21.1. 2 . An ordinance to amend the Code of the County of Chesterfield, 1978, as amended, by amending and reenacting section 21.1-3 relating to nonconforming uses. This ordinance will establish the date on which this ordinance is adopted as the date on which a property becomes legally nonconforming to use and bulk requirements of Chapter 21.1. 3. An ordinance to amend the Code of the County of Chesterfield, 1978, as amended, by amending and reenacting section 21.1-152 relating to churches in commercial districts. This ordinance would permit churches by right in C-2, C-3, C-4, and C-5 Districts. 4. An ordinance to amend the Code of the County of Chesterfield, 1978, as amended, by amending and reenacting Sections 21.1-185, 21.1-192, 21.1-199, 21.1-243, and 21.1-281 relating to yard requirements adjacent to railroads or navigable waterways in Office, Commercial, and Industrial Districts and defining navigable waterways; and amending and enacting section 21.1-243.1 relating to yard and other development requirements in Office, Commercial, and @ -. _c Industrial Districts which are adjacent to A, R, R-TH, or R-MF zoned property occupied by or zoned for non-residential or non-agricultural use. This ordinance would delete the requirements for setbacks adjacent to railroads or navigable waterways in Office, Commercial, and Industrial Districts and define navigable waterways in certain instances. This ordinance would also allow reduction of side and rear yard setbacks in Office (0), Commercial (C), and Industrial (I) Districts which are adjacent to Agricultural (A), Residential (R) , Residential MUlti-family (R-MF) , or Residential Townhouse (R-TH) zoned property occupied by or zoned for non-residential or non-agricultural use in certain instances. 5. An ordinance to amend the Code of the Countv of Chesterfield, 1978, as amended, by amending and reenacting section 21.1-190 relating to uses permi tted by Condi tional Use in General Industrial (1-2) and Heavy Industrial (1-3) Districts. This amendment would allow any permitted or Conditional Use allowed in the General Business (C-5) District by Conditional Use in 1-2 and 1-3 Districts. 6. An ordinance to amend the Code of the County of Chesterfield, 1978, as amended, by amending and reenacting Sections 21.1-145, 21.1-153, 21.1-159, 21.1-160, 21.1-166, and 21.1-173 relating to shopping centers and motor vehicle rental as permitted and restricted uses in commercial districts and drive-in theaters as a permitted use in General Commercial (C-5) Districts. This amendment would delete ordinance requirements relati ve to shopping center acreages and locations. This amendment would also allow motor vehicle rental as a restricted use in C-2, C-3, and C-4 Districts and as a permitted use in the C-5 District. In addition, this amendment would permit drive-in theaters in a C-5 District. 7. An ordinance to amend the Code of the County of Chesterfield, 1978, as amended, by amending and reenacting Sections 21.1-245 and 21.1-252 relating to applicability of Post Development and Emerging Growth Districts standards and Conditional Use Planned Developments. This ordinance will eliminate inconsistencies between areas of applicability of Post Development and Emerging Growth Districts standards, and Highway Corridor District - The Jefferson Davis Highway Corridor and Village Overlay District - The Ettrick Business Core standards. This ordinance will also eliminate references to Conditional Use Planned Developments approved prior to April 12, 1989, which is now addressed by a proposed related ordinance amendment. Copies of the ordinances are on file in the County Administrator's Office, Room 505, 9901 Lori Road, Chesterfield, Virginia, and may be examined by all interested persons between the hours of 8:30 a.m. to 5:00 p.m., Monday through Friday. ®
