Twedt Midlothian Magisterial District South line of Midlothian Turnpike REQUEST: Amendment to Conditional Use Planned Development (Case 82SNOOI6) relative to signage. Specifically, this amendment would allow signage to conform to current Ordinance requirements. PROPOSED LAND USE: Commercial uses are planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL. AYES: MESSRS. WILSON, BASS GECKER AND GULLEY ABSENT: MR. LITTON STAFF RECOMMENDATION Recommend approval for the following reason: Amendment would allow signs to conform to current Zoning Ordinance standards. (NOTE: CONDITIONS MAYBE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFFICPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) Providing a FIRST CHOICE community through excellence in public service GENERAL INFORMATION Location: South line of Midlothian Turnpike, east of Coalfield Road. Tax ID 729-707-2778 (Sheet 5). Existing Zoning: C-2 with Conditional Use Planned Development Size: 0.8 acre Existing Land Use: Commercial Adjacent Zoning and Land Use: North, South and West - C-3; Commercial East - R-7; Public/semi-public (Midlothian Middle School) Utilities: While installation of the proposed free standing sign will not impact the required use of public water and wastewater, the applicant is cautioned that the proposed sign must not conflict with any existing utility lines or easements. ENVIRONMENTAL AND PUBLIC FACILITIES The requested amendment will have no impact on these facilities. LAND USE Comprehensive Plan: Lies within the boundaries of the Midlothian Area Community Plan which suggests the property is appropriate for village shopping district use. Area Development Trends: Surrounding properties to the north, south and west are zoned Community Business (C-3) and are developed for commercial uses to include the Midlothian Station Shopping Center within which the subject property is an outparcel. Property to the east is occupied by a middle school. 2 OSSN0302-SEPT21- BOS Zoning History: On March 24, 1982, the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved an amendment to Conditional Use Planned Development (Case 79S211) to permit a health club associated with a chiropractic office and a third freestanding sign on a twelve (12) acre parcel commonly known as Midlothian Station Shopping Center (Case 82S016). The subject property was identified as the location of this facility and third freestanding sign. With the approval of this request, a condition was imposed requiring that the sign be constructed as shown in a rendering submitted with the application (reference attachment). Signs: The freestanding sign for this site is currently regulated by a condition of Case 82SN0016 which requires that the sign be consistent with the attached rendering. The applicant has requested that this condition be deleted so as to allow signage to comply with current Zoning Ordinance requirements. The subject property is part of a shopping center or similar group of buildings. Currently, within the Village Districts, the Ordinance would permit individual businesses within such a development one (1) freestanding sign not to exceed an area of twenty (20) square feet and a height of eight (8) feet. The area of the sign could be increased with the incorporation of changeable copy (reader board) and the advertisement of fuel prices. CONCLUSION Deletion of the Condition would allow for signs to conform to Zoning Ordinance standards. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (8/16/05): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Gecker, seconded by Mr. Gulley, the Commission recommended approval. AYES: Messrs.
