'Jhereupon a discussion followed and 1',~. Irvin G. ltorner, soe~ing for the Board
stated that the members of the Board acting as af~rou~ had requested the Ext~sion
Division to make a s~'vey of the activities ~ the Cowry A~:;ant~s dep~tment and
report their f~dings to the Board, and he hadbeen informed that the renort would
be ready for the Board in a few days. Where:upon the Board of Sup&rvisors azreed
that they .~ould call ~1 adjourned meeting of the Board at 7:00 p.m. on Tuesday,
l~rch i5, 1949 at which time the r aport would b e heard and ~y action taken on the
mat tar.
This day i4r.R.Stuart Royer appaared b afore the Board introducin~ ~.Ir. Sloan, one
of his associates~ who delivered to the Board copies of a survey of the wazer
supply of Powhite Creek on Jahnke Road, and it was a~reed that after a study of
this survey by t he gOard that I,~[r. Royer would return t o the Beard for a more
detai led explanatioh.
This day I~tr Irvin G. Horner stated that the road leading to the prop4rty owned
by ~. Hinds in Clover Hill District, Rt. 6~6, did not go all the way to serve
these people and that the road beyond at-the end of Rt. 646 needed considerable
attention. Upon consideration whereof, and on motion of IrFin G. Homer, it is
resolved that the Virginia Department of t{iKhways be and it hereby is requested
to improve the road from the end of Rt.646 to Hinds property, charging same to
the 3~ road levy, expending a sum not to exceed $100.00.
This day there appeared before the Boar,i ~'~r. Jolm Russell, representing certain
citizens of i4idlothian, ob~ecti[~g to the erection, of a radio tower in the Village
of Midlothian, for whmch a Use Fermmt was g rano~d by the Board on April 27, 1948.
Upon consideration whereof, and on motion of H.T.Goyne, it is resolved that the
Executive Secretar.v be and he hereby is instructed to communicate with the
Radio Corporation (Southern Broadcasters, Inc.) calling their attention to the
fact that there is a question of legality in issuing a permit for this radio towerp
This day the Executive Secretary stated that an Ordinance tentatively adopted by
this Board on J~uary 11, 1949, regulating the operation o£ restaurants had been
duly advertised and that it was ready for passa,ze. T~ re appeared no one ob]ecti~
to the passage of the ss me, and on motion of H.T.Goyne, ~ is resolved that the
Ordinance as ~dvertised be and it hereby ia adopted:
AN
ORDINANCE
Defining restaurants, other food establishments, employee, eating,
drinking, and cooking utensils, health officers, person, unwholesome
food, the storage of food, the cleaningand s toting of utensils; providir~
£or the issuance and/or revocation of ~ rmits, prohibiting the sale of
unwholesome food and drink, providing for the insoection of such esta-
blishments and food, establishing classes and grades of restaurants and
placarding the same, the enforcement ~this Ordinance and fixing penalties
for the violation thereof, and to repeal all ordinances in conflict
therewith.
Under and by virtue of the authority conferred upon the Board of
Supervisors of Chesterfield County, Virginia, by an Act of the
General Assembly of Virginia of 1946, approved February 22, 1946,
and known as Chapter 46 of said Acts of Assembly, this Board of
Supervisors, having carefully considered the matter, doth ordain
as foll~s:
Section 1. Definitions: For the purpose of this ~dinmce the following terms
shall have the meaning respectively indicated~unless another meaning
is clearly intended or requ~ ed by the content.
A. Restaurant: The term ,restaurant" shall mean restaurant, coffee shopi
cafeteria, short order cafe, luncheonette, hotel dining room, tavern,
sandwich shop, soda foundation, and all other public eating and drinkin~
establishments by whatever name called, including the dining accommodations
of clubs, all State institutions, and schools and colleges both public andl
private; provided, however, this ordinance shall not be construed to
include facilities of public service coroc~ations under the jurisdiction
of the State Cornoration Commission.
B. Employees: The term" employee" shall mean any ~erson who handles
food or drink during preparation or serving, or who comes in contact with
any eaDing or cooking u~ensils, or who is employed at any time in a room
in which food or drink is stored, prepared or s erred.
C. Eating, Dr.i~.~iqM a~.d CookinE Utensils: "EatinE~ drinking and cooking
utensils." shall include any' kitchenWa~,~ tableware, cutlery, containers,'
orother equipmm t with whichfood or drink comes in contact during storage,
preoaration or s erring.
D. Commissioner: The chief exe~ative officer of the State Board of
Health and hi's'""duly authorized agents.
E. Health Officer: The term "Health Officer" shall mean the director Of
Healthactiviti~ Sf Chesterfield County or his authorized representative.
F. Person: The word "person" shallmeanperson, firm, cor~ration or
association.
G. Unwholesome Food~ "Unwholesome Food" shall mean any food or drink not
fit for hmi~n consumption.
SECTION 2. Permits:
It shall be unlawful for any persons to operate a restaurant ~n the
County of Chesterfield who does not possess an unrevoked permit from the Health
Officer and in whose plaae of business such permit is not posted in a conspicious
place; and mo local license to operate a restaurant shall be issued by any officer
or official of Chesterfield County until a health department permit is presented

Every restaurant shall display at all ti~mes in a eons~icious place a~prov~d
by the Health officer, a placard furnished by the health department stating the
grade of the restaurant.
SECTION 4. F~Lu,.a.t!on and Cond~mat,~on of Uswholesom~ ,,Food or Drink:
Sspples of food an drink may be taken and examined by the Health Officer
as often as he deems necessary f c~ t he detection of unwholesomeness. ~ne health
offiCer may condemn, remove and destroy amy food or drink which he deems unwhole-
somee
SECTION 5. Inspection of Restaurants:
The local health officer is hereby made responsibla for the enforcement
of this ordinance. Inspection shall be made as frequently as deemed necessary
by the health officer.
One copy of the inspection report shall be retained by the establishment;
another copy shall be filed wihh the records of the health department.
In case the health officer discovers the violation of anyi tom of sanitation
require~ for the grade then held, he shall make a second inspection after a lapse
of such time as he deems necessary for the defect tobe remedied. If~ upon the
second inspection, the same item of sanitation is found to be violated, the
restaurant shall be required to display immediately a g~ade notice based upon the
second inspection.
The health officer an.d any of his agents, acting under his direction, may
close any restaurant if the owner, manager, or operator thereof has been guilty ·
of flagrant of continued violation of this ordinance; in event of such violation,
i£ shallbe his duty to take such action. The ~heriff or sergeant of such county
or city shall enforce such closure until the closing order is revoked in writing.
SECTION 6. The. Grading. of.....RestAurants:
The grading of all restaurants shall be based upon the following standards:
Grade A. Restaurants: Grade A restaurants are those which comply with all of t~e
roil'owing items'Of Sanitation:
· Item 1. ~ · The floor af all restaurants shall be of such constructior
as to be easily c-~a~ed, shallbe smooth, and shall be ke~t clean and in good
repair.
Item2. Walls and Ceilings.. Walls and ceilings of all food establishments
shallbe kept clean and 'in go~d repair, the kitchens finished in light color, and
the walls of kitchens and wash roomw'shall have a smooth, washable surface up to
the level reached by splash or spray.

Item ~. Vent.ilat, ion~- All restaurants shallbe well ventilated. Exhaust
fans and metal hoods over ranges, equipped with ventilaeor, must be provided
when necessary to pre~ent odors and condensation and to promote clean lines.
Item 5. Toilets. AdequaDe, approved toilet facilities must be provided
for patrons an~em'~lo'~es. Toilets m~ t be constructed and maintained in
accordance with rules and r egula tions of the State Health Department.
Toilets, must be entirely separate and apart from any room used

Item 10. Dishwashin~ Equipment. Adequate facilities shall be provided and

debarring any equipment which has been demonstrated as of at least equal efficien~Y
and is approved by the State Health Commissioner.
Item ll.~ Methods of Beactericidal Treatment Required. One of the following i
methods must be us-~d:' Hot Waber~or 'chlor['ne chemicals.~ Otensils must be submerged
in hot water at 1700 F., or more, for at least two minutes; or submerged in a
chlorine solution contqining not less than fifty parts perhmillion of residual
'chlorine for at least two minutes. (A solution co~Z aini~g one hundred parts per
million, or more, if recommended.)

The a hove requirements apply to manual dishwashinz methods. Where dishwashiBg
machines are used, the operation of the ~achine, temperature of wash and rinse
waters, and retention period of dishes in the ~a chine must mee~ the approval of thie
State Health Commissioner.
Item 12. Storaze and Handlin~ of Utensils and E~uipment. After bactericidal
treatment no utensil shallbe st0~ed' excep~ i~" a' cT~an' dr~ place protected from
flies, dust, or other contamination, and no utensil shallbe handled except in
such a manr~r as to prevent contamination a s far as practicable. Single service
utensils shall be purchased only in sanitary containers and shallbe stored
therein in a clean dry place until used~
Item 13. Disposal of Wastes. All wastes shallbe properly dispcs ed of and
all garbage ~nd ~trash Shall be kept in suitable covered receptables, in such a
manner as not tobecome a nuisance.
Drain and waste pipes from floors, washsinks, soda fountains~. !c~,~boxeS,
etc., must be of sufficient size, well trapped, and in a good state of repair.
Item l~.~ Refrigerat.iRn.~. Refrigerators, ice boxes, etc., shall be of adequate
size' t~ 'store all perishable food, constructed ~n~ materials that will permit
thorough cleaning, shall be properly drained and ventilated, shall be equipped
wtth thermometer and kept ~t a temperature of 50°F. , or lower,'at all times,
except during periods of defrosting. Floors, walls, ceilings, rackets, hooks,
pipes, etc., shall be kept clean. Drains from ice bozes ~shall not be connected
directly to a sewer but shall drain into an open fix ture.
Item l~ Milk and Cream_. Only graded milk or cream ahallbe used or s erred in
any restaurant. All'milk must be served in the orginal container in which it was
bottled at the plant.
Item 16. Storage and Displa~ of Food and Drink. All food and drink shall be
so s toted and displ~.~ed as robe p'~Q~tect"~d f rom'" h'ust, flies, vermin, handling,
droplet inf~ction, overhead leakage, and other contamination. No animals or
fowls shall be kept or allowed in any room in whichfood or dribk is prepared or
stored. All means necessary for the elimination of flies shall be used.
Item ,1 ~. Cl. eanliness of employees and. Restaurants. All employees shall wear
cl~a~ 6uter garments 'an'd s'~all keep '~heir hands' cl'ean a~ all times while engaged
in handling food, drink, utensils, or equipment. None of the operations'connected
witha restaurant shall be conducted in any room used for domestic purnose..
Item 18. M..~se.el~..sae0~s The surroundings of all restaurants shall be kept
Ci~n' and f r~ of litter, ~r rubbish. Adequate lockers or dressing rooms shall
be provided for employees' clothing. Soiled linens, coats, and aprons, shall be
kept in containers provided for this purpose.
No articles~ polish or substance containing any cyanide preparation or other
poisonous material shall be used for the cleaning or polishing of eating or
cooking utensils.
Item 19. Tables, Shelyes, etc..~ All tables must be properly constructed of
material that can 'be' th6rough~y' and easily cleaned. All t able tops must b e of
nonabsorbent material when deemed necessary h~rthe health officer.' Table tops,
must be free of unnecessary articles, table covers, napkins, etc., muZ be
clean and all shelves shall be clean, free of unnecessary articles and neatly
arranged. All napkins shallbe discharged or laundered after each usage.
Item ~O,~ Vermin and Roden Control .~et, hods. Methods used for the control of
Vermin a nd ro~e~t~"'muSt'' be effective' at a 11 restaurants.
.G..r.ade B, Restaurants. Grade B restaurants are those whi_ch have~ been found,
on two ~u~cess'iv~ ins~'ection, tohave violated the same one'of'any om'the following
items of sanitation required for Grade A restaurants: 1, 2, 3, 4, 18.
Grade C Restuarants: Grade ¢ restaurants a re those which h ave been found, on
t~o' ('2)' s~'ccesS[v~ '~hsoections, to have violated the same'one of the following ·
items of sanitation r~quired for ~rade A, restaurants: 5, 6, 7,8,9,10,11,12,1~,
15, 15, 16, 17, 19 and 20; except ~o Grade C.restuarant shallbe'allowed to operate
for a longer period then 30 consequtive daya, or'in emergencies, such longer
periods a~ the health officer may deem necessary.
Section 7. Examination and Condemnation of Unwholesome Food or Drink
Samples of food and drink may be taken and emamined by the Health Officer,
as often as he deems necessary for the detectiom of unwholesomeness. The Health

i~ediate clos~g of the food establis~ent concerned ~t~ no further danger
of diease outbreak exists, in the option of the health officer; (3) Adeq~te
medical ex~imtion of the ~ployee and of his associates, with ~ubh laborato~
examina~ons as may be indicated.
Because of the impracticability of requiring' for temporary aating and drink-
~g establishments the s~e s t~dards in eq~pm~t, buildings and some facilities
as are required of permit establishments, they are classified and defied as
it~erent restau~ts ~d s~itation st~dar~s established herewith.
