19SN0522 CASE NUMBER: 19SN0522 APPLICANT: Christopher Brown CHESTERFIELD COUNTY, VIRGINIA MATOACA DISTRICT AND RECOMMENDATION Board of Supervisors (BOS) Hearing: NOVEMBER 14, 2018 BOSTime Remaining: 365 DAYS Applicant: CHRISTOPHER BROWN (804-986-7393) Planning Department Case Manager: 69.4 Acres 9800 Hickory Road DREW NOXON (804-796-7122) REQUEST Rezoning from Residential (R-88) to Agricultural (A). Specifically, the applicant proposes to construct one (1) single-family home on the subject property. Note: The only condition that may be imposed is a buffer condition. The property owner may proffer conditions. SUMMARY One (1) single-family dwelling is planned yielding a density of 0.013 unit per acre. In 2007, the property was rezoned from Agricultural (A) to Residential (R-88) under Case 07SN0201, which permitted a single-family subdivision with a maximum of 17 lots. This subdivision was proposed as a future phase of the Whispering Winds subdivision previously planned on properties to the west. The applicant no longer intends to develop the subject property as the 17-lot subdivision; therefore, rezoning to Agricultural (A) is proposed. RECOMMENDATIONS APPROVAL PLANNING COMMISSION APPROVAL Proposed zoning and land use comply with the Comprehensive Plan STAFF which suggests agricultural uses and larger lot single family development are appropriate. Proposal In 2007, the subject property was rezoned from Agricultural (A) to Residential (R-88) under Case 07SN0201, permitting a single-family residential subdivision with a maximum of 17 lots. The planned subdivision was proposed to be developed as a future phase of the Whispering Winds Subdivision located on the properties to the west. The applicant no longer intends to develop the 17-lot subdivision. Construction of one (1) single-family dwelling is planned. The Comprehensive Plan suggests the property is appropriate for agricultural use and larger lot single family residential development. Staff supports this rezoning request. COUNTY TRANSPORTATION Staff Contact: Steven Adams (804-751-4461) adamsst@chesterfield.gov The Comprehensive Plan, which includes the Thoroughfare Plan, identifies county-wide transportation needs that are expected to mitigate traffic impacts of future growth. The property is currently zoned for single-family residential (R-88) uses, and the applicant is seeking rezoning to Agricultural (A). The anticipated traffic impact of the proposal has been evaluated and it is anticipated to be minimal. It is outside of the mandatory connection areas for residential subdivision to connect to public wastewater. By downzoning from R-88 to A, a single-family home would only be required to connect to public water or wastewater if public lines are within 200 feet of the property and the onsite utility lines would be less than 400 feet. There are no existing public water and wastewater lines within 200 feet of the property at this time. This use will not impact the public water and wastewater system. The Utilities Department supports this case.
