SUMMARY
One (1) single-family dwelling is planned yielding a density of 0.013 unit per acre. In 2007, the
property was rezoned from Agricultural (A) to Residential (R-88) under Case 07SN0201, which
permitted a single-family subdivision with a maximum of 17 lots. This subdivision was proposed as
a future phase of the Whispering Winds subdivision previously planned on properties to the west.
The applicant no longer intends to develop the subject property as the 17-lot subdivision;
therefore, rezoning to Agricultural (A) is proposed.

Proposal

The planned subdivision was proposed to be developed as a future phase of the Whispering
Winds Subdivision located on the properties to the west. The applicant no longer intends to
develop the 17-lot subdivision. Construction of one (1) single-family dwelling is planned.
The Comprehensive Plan suggests the property is appropriate for agricultural use and larger lot
single family residential development. Staff supports this rezoning request.

transportation needs that are expected to mitigate traffic impacts of future growth. The

and it is anticipated to be minimal.

water. It is outside of the mandatory connection areas for residential subdivision to connect to
public wastewater. By downzoning from R-88 to A, a single-family home would only be required
to connect to public water or wastewater if public lines are within 200 feet of the property and the
onsite utility lines would be less than 400 feet. There are no existing public water and
wastewater lines within 200 feet of the property at this time.
This use will not impact the public water and wastewater system.

Geography
The subject property drains north and northeast to an unnamed tributary to Franks Branch.
Franks Branch is a tributary to Swift Creek. The entire property is located within the Lower
Swift Creek Watershed.
Natural Resources
A Resource Protection Area (RPA) Designation must be submitted to and confirmed by the
Environmental Engineering Water Quality Section prior to issuance of a building permit,
subdivision plat approval, and/or parcel plat modification. A Water Quality Impact Assessment
must be submitted to and approved by the Department of Environmental Engineering and/or the
Board of Supervisors for any improvements which encroach into the RPA. In addition, wetlands
shall not be impacted without approval from the U.S. Army Corps of Engineers and/or the Virginia
Department of Environmental Quality.

Access
If the primary access to the residential dwelling crosses any of the existing stream channels on
the property, the driveway culvert(s) over the existing stream channel must be sized to
adequately pass the 100-year storm peak discharge without overtopping the driveway. In
addition, the backwater from the 100-year storm cannot encroach onto adjacent property.
