The data presented in the Monthly Report will continue to be reported on within this report. 2 INTRODUCTION TO THE KEY INDICATORS QUARTERLY REPORT As part of the County's commitment to provide strategic insight and easy access to information, this first-ever quarterly report represents the most comprehensive financial, economic, and demographic datasets ever published bythe County. The aim of this report is to share with residents and businesses the key metrics that are tracked noonth|y, quarterly, and annually. It is designed not tojust state what these metrics are, but what they represent; their past and present performance; and how they inform the future econonnic.0nmnda[ and budgetary outlook. At present, more than 100 indicators at the national, state, and local levels are tracked and analyzed. In future publications, these indicators will rotate and provide an in-depth analysis ofhow they may impact the County. This inaugural quarterly report on Financial Indicators for Chesterfield County provides an opportune time to ask the question: How has Chesterfield's economy performed over the last ten years? Nationally, the economy isatits strongest level since the end ofthe Great Recession. At113months ofeconomic expansion, this recovery is the second -longest on record, and is on track to become the longest based upon current forecasts, if it is able to surpass the 120 months of growth between March 1991 and March 2001. Measured using several key indicators, the County's economy is in strongest position inten years. Historically, the County has averaged a lower unemployment rate compared to State and National levels, and the latest reading continues this trend. AsofSeptember, the rate was Z796-aneleven year low (see Chart 1). The strengthening labor market is also reflected through lower local monthly initial unemployment claims. AsofSeptember, the number ofclaims reached aneleven year low of3S4applicants (See Chart 2). CHART 1. LOCAL INITIAL UNEMPLOYMENT CLAIMS The strengthening labor market has rippled out into incomes and household balance sheets. Average weekly wages in the County steadily grew from 2012, but over the last two years, they have surged, reaching an all-time high of $942 as of Q3 of FY2018. Moreover, the percentage of County residents who have subprime credit scores less than 660 has continued its downward trend reaching 25.43% as of Q1 of FY2019 (see Chart 3). Strengthening wages and household balance sheets have spurred economic growth in the County. Since FY201O,local sales tax collections have risen year -over -year and reached an all-time high of $50.9 million in FY2018, a 4% increase over FY2017. This growth is expected to continue through FY2019, with year-to-clate collections up 5.4% compared to FY2018. Additionally, auto registrations in the County have rebounded significantly, surpassing levels last seen prior to the recession, which is a significant driver in the increase in personal property tax revenue for the County (see Chart 4). At this stage in the economic expansion, these performances point to strong consumer confidence in the County. Despite the generally sound fundamentals, there are a handful of indicators that whisper a bit of caution into the economic picture moving forward. Heading towards the longest economic expansion on record there are two indicators that may provide an early signal of a change in the economic landscape- U.S. Corporate Debt, and Household Debt levels. The growth of corporate debt in the United States has continued to increase over the ten years reaching $9.4 trillion as June 2018, a 44% increase since June 2008. If corporate debt continues to increase at its current rate there is a potential danger that businesses may be borrowing against their equity levels as opposed to against cash-flow and income. In other words, businesses may not be generating enough income to cover debt payments (see Chart 6). CHART 5. Household debt has now risen for 17 straight quarters, and the transition of auto and credit card debt into serious delinquency isonthe rise. These trends may indicate that consumers, like corporations, are beginning to struggle to service their debt levels which may affect consumer spending in the economy (see Charts 7&8). With low unemployment and increasing average weekly wages consumer spending in the County continues to increase, resulting in higher sales tax revenue for the County. Year -to -Date collections are up 5.4%, and the latest monthly reading is an increase of 5.5% compared to the some period last year. As the County's labor force has increased, the number of county residents employed has increased more lowering the unemployment rate for the county. At 73.9%, this ratio has improved by 1.3% points compared to the same period last year, but the County still exports workers daily. With a continued focus on economic development the county remains committed to its goal of increasing the ratio closer to 0.8 over time. At 2.70%, the County unemployment rate is below the state and national rates and is at its lowest level since November 2007. This low rate, coupled with increasing average weekly wages, has driven an increase in consumer confidence in the County as evidenced by increasing retail sales and home prices in tha Cnunty. The County's rate is eight percent. As of September, collections are up 7.596 year -over year. However, year-to-date collections are down 7.096. Since this tax is heavily driven by seasonal events in the County, this revenue can be cyclical in nature. We are tracking collections monthly to monitor this source for any major cyclical changes. Higher interest rates, coupled with moving operating cash into longer-term investments, are driving this surge in earnings. Therefore, timely collection of those revenues are critical to operations. Kahlson is retiring from the Chesterfield Fire and Emergency Medical Services Department, Chesterfield County, on January 1, 2019; and WHEREAS, Captain Kahlson faithfully served the citizens of Chesterfield County for over 25 years as a firefighter and officer; and WHEREAS, Captain Kahlson began her career with Chesterfield County on October 22, 1993, as a member of Recruit School #24, and served as a firefighter at the Bon Air, Dale, Bensley, Matoaca, Ettrick, Rivers Bend, Swift Creek, and Buford Fire and EMS Stations, as well as in the Training and Education Division; and WHEREAS, Captain Kahlson achieved Emergency Medical Technician -Cardiac Certification in 1994; and WHEREAS, Captain Kahlson was recognized with a Unit Citation Award for assisting in the removal of a victim who had fallen into a smoke stack at the Dutch Gap Power station; and WHEREAS, Captain Kahlson was recognized with multiple EMS Unit Citation Awards for her team's actions in reviving a 17 -year-old in full arrest at Monacan High School, a fatal asthma attack, saving a man who had jumped from a moving vehicle on Genito Road, saving a patient from a fatal drug overdose and one of numerous cardiac arrests; and WHEREAS, Captain Kahlson was recognized with a Unit Citation for the extraordinary actions of her team in rescuing five citizens whose cars were being overcome by flood waters on Turner Road during Tropical Storm Gaston; and WHEREAS, Captain Kahlson was recognized with several EMS Lifesave Awards and EMS Unit Citations for her efforts in successfully converting patients from cardiac arrest and achieving return of spontaneous circulation throughout her career; and WHEREAS, Captain Kahlson is recognized for serving 25 years in the Virginia Air National Guard, during which time she was also employed by Chesterfield Fire and EMS, and for reaching the rank of Colonel before her retirement in December 2017; and WHEREAS, Captain Kahlson is recognized as the first woman to serve 25 years as a career firefighter and officer reaching full retirement with Chesterfield Fire and EMS. Under the VDOT Economic Development Access program, the county can receive up to $500,000 in unmatched VDOT funds and up to $150,000 in matched VDOT funds for the construction of economic development access roads. The County's required match, $150,000, is being requested from the Industrial Access Account and is available. Before VDOT will authorize the economic development access funds, the qualifying capital investment must be under firm contract or the county must provide VDOT a surety bond guaranteeing that the investment will occur within five years of the Commonwealth Transportation Board's allocation of the economic development access funds. It is anticipated this project will be under firm contract. VDOT funds can only be used for engineering and access road construction. Right-of-way acquisition and utility adjustments must be financed from sources other than economic development access funds. The developer has indicated they expect to develop sufficient qualifying capital investment to justify the requested VDOT economic development access fund allocation. The developer has agreed to prepare the road construction plans and environmental studies, dedicate the right-of-way necessary for the access road, and be responsible for all utility adjustments and the wetland mitigation for the project, if necessary. It is anticipated that the county will manage the construction of this access road and provide the matching funds. A VDOT/County agreement, similar to those the county has executed in the past, will be necessary. Under the terms of the agreement, the county will administer the construction of the project and be reimbursed by VDOT for the $650,000 in VDOT Economic Development Access funds. It is requested that the County Administrator be authorized to proceed with the customary project activities and authorize the Procurement Director to advertise the construction contract for the project. The subject property is located on the south line of Chesterfield Avenue, across from Granger Street. County Schools is proposing the replacement of Ettrick Elementary School at the existing school site, located at the southwest corner of Chesterfield Avenue and Paine Street. The Department of Parks & Recreation is proposing a neighborhood park/passive open space to be co -located with the Ettrick Elementary School site. The Public Facilities Plan suggests these new and replacement facilities are appropriate for this area. This rezoning is proposed to accommodate these public facilities as generally identified in Exhibit B - Conceptual Plan. The parcels located at 20810 through 20824 along Chesterfield Avenue were acquired from Virginia Department of Transportation by the county as remnant parcels created from the Chesterfield Avenue Triple Nickel Bridge project. These parcels were acquired by the county for the replacement Ettrick Fire Station in 2014. The purchase of 20910 James Street added to these parcels to consolidate the block bounded by the rail lines, Chesterfield Avenue and Paine Street. Subsequently, the staff studied abandoning the James Street right-of-way south of Chesterfield and Byrd Street, an unpaved right-of-way parallel to Chesterfield Avenue. The purchase of 20800 Chesterfield Avenue (former Stallings Oil parcel) will allow abandonment of a portion of James Street and all of Byrd Street. Consolidating the sum of these properties with the existing school site creates a large block of 22.8 acres. County and Schools staff have been working together to co -locate a new elementary school and a new fire station since 2017. In late 2017, the School Board initiated purchase of 20910 James Street. The joint use of the overall site was clarified in December 2017 when the Board of Supervisors approved the purchase of this property for a school and fire station. The remaining 2.2 -acre parcel (former Stallings Oil) to the west of the site was acquired to allow vacation of the right-of-way and is currently not anticipated to be used by the school or fire department for typical activities associated with these uses. The needs for an elementary school (ballfield, paved recess areas, grass recreation areas, bus loop, parking, etc.) will be accommodated on the 18.15 -acre portion of the school site. The neighborhood park/passive open space along Chesterfield Avenue is proposed to buffer parking for the school. It will be maintained by Parks & Recreation along with the entire school grounds as is the case for all school properties. As a passive open space, it will likely include walkways, street lights, benches and landscaping for public use as well as preserving open space along Chesterfield Avenue. Construction of the new school will be accommodated by utilizing the fire department portion of the site for construction activities including material staging. Construction of the fire station would then take place after completion and occupancy of the new school. As part of the rezoning request, the Planning Commission and Board of Supervisors will consider exceptions to the Ettrick Area Plan to allow development as depicted on exhibit B - conceptual plan. Virginia law permits the Board of Supervisors to initiate a rezoning application on the principles of good zoning practice and general welfare. Consideration of this request will provide for a public process to review and determine if any adverse impacts would be generated on the property(s), on adjacent property owners, or the County in general and, if so, to determine what conditions might alleviate any adverse impacts and enhance land use compatibility. Further we request the Board to appoint Andrew Gillies as your agent and to waive disclosure requirements. Such notification shall be on the first page of such notice and be in bold type no smaller than fourteen points and mailed to, or posted at, the last known address of the taxpayer as shown on the current real estate tax assessment records. Notice under this subsection shall satisfy the notice requirements of Code of Virginia, § 58.1- 3331. In an appeal before the board of equalization, such written notice may be contained in the written notice of the hearing date before the board. For all applicable assessments on or after January 1, 2012, such written notice shall: (a) be given at least 45 days prior to the hearing of the taxpayer's appeal; (b) include a statement informing the taxpayer of his rights under Code of Virginia, § 58.1-3331 and this section to review and obtain copies of all of the assessment records pertaining to the assessor's determination of fair market value of such real property; and (c) advise the taxpayer of his right to request that the assessor make a physical examination of the subject property. Furthermore, in any such appeal by a taxpayer as owner of real property containing less than four residential units, the assessor upon written request shall provide the taxpayer or his duly authorized representative copies of the assessment records set out in subsections A, B, and C of Code of Virginia, § 58.1-3331 pertaining to the assessor's determination of fair market value of the property under appeal. In an appeal to the board of equalization, the assessor shall provide such records within 15 days of the written request. In an appeal to the circuit court, any such written request by the taxpayer or his duly authorized representative shall be made following the filing of the appeal to circuit court and no later than 45 days prior to trial, unless otherwise provided by an order of the court. Provided the written request is made in accordance with Code of Virginia, § 58.1-3984 and this subsection or any applicable court order, the assessor shall provide such records within 15 days of the written request. If the assessor fails to provide the assessment records set out in subsections A, B, and C of Code of Virginia, § 58.1-3331 after written request as addressed above, the assessor shall present the following into evidence prior to the presentation of evidence by the taxpayer at the hearing before the board of equalization or the circuit court, as applicable: (i) copies of the assessment records maintained by the assessor under Code of Virginia § 58.1-3331, (ii) testimony that explains the methodologies employed by the assessor to determine the assessed value of the property, and (iii) testimony that states that the assessed value was arrived at in accordance with generally accepted appraisal practices, procedures, rules, and standards as prescribed by nationally recognized professional appraisal organizations such as the International Association of Assessing Officers (IAAO) and applicable Virginia law regarding the valuation of property. (e) The board of equalization shall publish notice in a newspaper having general circulation in the county, giving the regular time and place of its hearings, and instruct the sheriff to post such a notice at the courthouse and at each voting precinct, at least ten days prior to each sitting in accordance with Code of Virginia, § 58.1-3378. 0A-1, 'i Ll, 3123:113518.1 (f) The board of equalization shall rule upon all protested assessments within 90 days from the date of hearing or by June 15, whichever occurs first. No studies or analyses published after December 31 immediately preceding the effective date of the assessment shall be considered in an appeal filed relating to that assessment. An appeal before the board of equalization regarding an assessment on residential property shall not be denied on the basis of a lack of information on the application, as long as the application includes the address, the tax parcel number, and the owner's proposed assessed value for the property. An appeal before the board of equalization regarding an assessment on commercial, multi -family residential, or industrial property on the basis of fair market value shall not be denied on the basis of a lack of information on the application, as long as documentation of any applicable assessment methodologies is submitted with the application, and the application includes the address, the parcel number, and the owner's proposed assessed value for the property. In addition, no assessment shall be increased on commercial, multi -family residential, or industrial property unless such increase is recommended by the assessor in compliance with the provisions of (Code of Virginia,} § 58.1-3379. Summary of Information: On October 16, 2018, the Planning Commission on a vote of 5-0 recommended approval of attached code amendment. For residential subdivision plats certain information is required to comply with federal, state and county requirements. Such information helps determine the buildability of such parcels under regulatory provisions and ensures that current and future owners of a residential property can utilize it for a dwelling. A primary area of concern for many subdividers is the requirement for a Resource Protection Area designation (RPAD) as this may be a costly endeavor depending upon scope of RPA features. Recognizing the expense and effort involved in such action for line modification plats, staff was asked to develop a solution to alleviate the requirement under certain conditions. A line modification plat is an adjustment of one or more lot/parcel lines within recorded subdivision that does not create one or more lots/parcels. Preparer: Andrew G. Where such exemption is granted there would be required an advisory certificate and deed restriction that would notify owners or purchasers that topographic and environmental features that could affect buildability have not been identified on the plat and that RPAD or other engineering research may be required at time of building permit or future plan review. Staff has received approval of the Virginia Department of Environmental Quality for this proposed amendment pursuant to the requirements of the Chesapeake Bay Preservation Act. It should be noted that this does not alleviate an owner or purchaser of future responsibility to account for such features, rather it delays the implementation of such accounting. This lack of research at the time of approval of a line modification plat may lead to some residential properties modified under this process to be unable to construct a dwelling or only after much research and site work. Summary of Information: On October 16, 2018, the Planning Commission on a vote of 5-0 recommended approval of attached code amendment. The state code was amended this year to require (i) that a locality give consideration to the need for reasonable modifications in accordance with the Americans with Disabilities Act or state and federal fair housing laws when preparing a zoning ordinance and (ii) the standards for a variance to include consideration of reasonable modifications for a person with a disability. Staff prepared amendment based upon the state code legislation. The amendment would provide that the purpose of the zoning ordinance include reasonable modifications in accordance with the Americans with Disabilities Act of 1990 (42 U.S.C. § 12131 et. seq.) or state and federal fair housing laws as applicable. The amendment would also provide, as part of the justification for both Administrative and Board of Zoning Appeals variance approvals, the circumstance that the variance would alleviate a hardship by granting a reasonable modification to a property or improvements on behalf of a person with a disability. Such variances would expire when the person benefited by it is no longer in need of the modification to such property or improvements provided by the variance. In addition, staff has updated the flow chart that accompanies the Administrative Variance process to correctly reflect the procedure. The old flow chart shows the ability to transfer review of setback variance to the BZA but this is no longer available under state and local code. AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND REENACTING SECTIONS 19.1-1,19.1-14 & 19.1-15 OF THE ZONING ORDINANCE RELATING TO VARIANCE AND ZONING FOR PERSONS WITH DISABILITIES BE IT ORDAINED by the Board of Supervisors of Chesterfield County: (1) That Sections 19.1-1, 19.1-14 & 19.1-15 of the Code of the County of Chesterfield, 1997, as amended, are amended and re-enacted, to read as follows: Chapter 19.1 ZONING A. Purpose. The purpose of this chapter is to promote the health, safety, convenience and general welfare of the public and to accomplish the objectives of the Code of Virginia. This chapter is designed to: • provide for adequate light, air, convenience of access, and safety from fire, flood, failure of impounding structures, crime and other dangers or conditions; • reduce or prevent congestion in the public streets; • facilitate the creation of a convenient, attractive and harmonious community; • facilitate the provision of adequate police and fire protection, disaster evacuation, civil defense, transportation, water, wastewater, flood protection, schools, parks, forests, playgrounds, recreational facilities, airports and other public requirements; • protect against destruction of, or encroachment upon, historic areas; • protect against overcrowding of land, undue density of population in relation to community facilities, obstruction of light and air, danger and congestion in travel and transportation, and loss of life, health, or property from fire, flood, panic or other dangers or conditions; • encourage economic development that provides desirable employment and enlarges the tax base; • provide for the preservation of agricultural and forestal lands and other lands of significance for the protection of the natural environment; • protect surface and ground -water; 1928:113281.1 o promote the creation and preservation of affordable housing suitable for meeting the current and future needs of the county as well as a reasonable proportion of the current and future needs of the planning districts within which the county is situated; ftftd o provide reasonable protection against encroachment upon licensed public -use airports, as well as military bases, military installations, and military airports and their adjacent safety areas, excluding armories operated by the Virginia National Guard; and e provide reasonable modifications in accordance with the Americans with Disabilities Act of 1990 (42 U.S.C.
