This day again the matter of the abandonment of a p®rtion of old Rt.360 came~%efore
the Beard for sctien, which had been duly advertised, ~he viewers having been
app®inte~ and their ~ep~rt received. Up®n censiderati®n whereof, and on motion
of James W. Gordon, Jr., it is resolved th~.t Item £ and 3 as shown on a plat made by
the State Highway Department and included in the instructions to the viewers, be,
snd the same is hereby abandoned as right-of-way for highway in Chesterfield County.
And be it further resolved that~the consideration of Section 8 as contained in the
Plat and included in the instructions to the viewers be deferred until a later
date.
And be it further resolved that the Virginia Department of Highways be and it
hereby is requested to take intp the Secondary road system of Chesterfield County,
that portion of Section 8, beginning near the Stine property on the east end and
running to the Miles property on the west, thence over a private road to its
intersection with the present Rt.360.
This day the request of Mr. Walter Hicks on the rezoning of Lots 214, 215, 216 and
217, in tSe subdivision of "Cloverdale" came before the Board, and the Attorney
for those opposing the rezoning raised the question as to whehter all the people
in accordance with the Ordinance had been duly notified and stated that he
represented property owne~ in the area which should ~ve been notified but who
had not been notified. Upon consideration whereof, and on motion of J. C.
McKesson, it is resolved that the former action of this Board reaoning this property,
be, and the same is hereby rescinded.
This day ~4r. H. T. Goyne, Supervisor, stated that he felt some action should be taken
to im~ove the traffic and parking conditions in the ~illage of Chester. Upon
consideration whereof, and on motion of H.T.Go~e, it is resolved that the Board
communicate with~r.A.H.Pettigrew, Virginia Department of Highways, inquiring
as to the ~atus of the relocation of Rt. 14~ and Rt. 10 over the old carline
bridge and through Chester.
And be it further resolved theft the Virginia Department of Highways b e and it
hereby is requested to investigate the traffic and parking problem within the
Village of Chester and endeavor to improve the same.
This day C.A.Ryburn, Jr., Chief of Police, of Chesterfield County, repgrted that
in purchasing uniforms for the Police Department there appeared to be $190.25
differ~ce in the amount appropriated and that needed to make this purchase.
Upon consideration whereof, and on motion of H.T.Goyne, the sum of $190~25 be and
it hereby, is approp~ated from the unappropriated surplus of the General Fund to
6a-325 - ~earing Apparel - Police Department.
This day ~h-. James W. Gordon, Jr., stated that Mr.W.H. Flynn, inactive police
officer of Chesterfield County, who had been receiving the sum of $62.50 per
month felt that it was impossible to exist on this amount and requested that
the amount be raised to that amount paid by the Benevolent Association to
retired police officers of $65.00. Upon consideration whereof, and on
motion of James W.Gordon, Jr., it is resolved that the sum of'$65.00 be and it
hereby is set as the amount to be paid per month to W.H.Flynn, effective as of
November l, 1948.
This day the Executive Secretary read a letter from the Developers of "Westover
Pa~k" on Jahnke Road, reque,~tin!~ that this area be rezoned from Agriculture to
Residential-2, with a section'reserved and rezoned for business. Upon consideration
whereof, and on motion of J.C.McKesson, it is resolved that the Executive Secret~ry
be and he hereby is directed to advertise this matter for t.~ublic hearing on
November 30, 1948.
This day a request was received from I~r. St. Clair Sager, Attorney for Mr.~Walter Hicks,
requesting t~e rezoning of Lots 214, 215, 216 and 217 in the subdivision of "Cloverdale
from Agriculture to General Business. Upon consi~ration whereof, and on motion
of J.C.McKesson, it is resolved that the Executive Secretary advertise this matter
public hearing on November 30, 1948.
This day a letter ~r~s read from the First and Merchants Bank, setting forth charges
which would have to be made in order to act as Fiscal Agent for the Utility Department
in accordance with a resolution recently passed by this Board. Upon consideration
whereof, and on motion of James W.Gordon, Jr., it is r~solved that the proposition
of $100.O0 annually and other ~greements as set forth in the letter from the First
and Merchants Bank be and the same are hereby agreed to by this Board.
This day the Chief of Police, C.A.~yburn, Jr., stated he felt that it would be of
comsiderable value to have painted on the highways in front of schools the word
~School Zone". Upon consideration whereof, and on motion of J.C.McKesson, it is
resolved that the Virginia Department of Highways be and it hereby is requested to
mark all highways in Chesterfield County in front of school buildings with the
words "School Zone" painted on the pavement.
This day the Executive Secretary read a letter from the Badger ~eter ~Lfg. Company
stating that there would be in effect &~ once an Yncrease in price of meters but
according to a conversation with a representative of the Com~a~ywith the Executive
Secretary he had placed an order for 500 5/8" meters for Chesterfield County at
$14.70 each, subject to the approval of the Board of Supervisors. Upon consideration
whereof, and on motion of Irvin G.Horner, it is rezolved that the order fc~ 500 5/8"
meters be and it hereby is approved.
This day ~r. Irvin G. Homer, Supervisor, stated that in his observation he had
discovered that $35.00 was insufficient to pay for a water connection to water
systems in Chesterfield County. Upon consideration whereof, and on motion of
Ir yin G. Homer, it is resolved that the connection fee for water systemm in
Chesterf~ ~ County shal~ be $50.00 beginning January 1, ~949.
This day ~r.H.T.Goyne, Supervisor, stated that he had consulted with ~r. P. ~.Snead,
regarding work done by the Utilities Department on water lines and he felt that
this work was a contract and theft the contractor should be liable for reconditioning
of roads; however, after thorough discussion of the ~tter and ruling of the
Commonw~alth~s Attorney it was decided that the ditching work was done ~y an employee
of the County and not a contractor, and was the County's responsibility for
reconditioning the roads. Upon consideration whereof, ~nd on motion of H.T.
Goyne, it is resolved that the District Engineer be and he h~eby is advised that the
work in connection with the installation of water lines in Chesterfield County is
not contractural work but done by the County.
This day again the mat,,er of securing the right-of-way on the Jahnke Road and Bon
Air Road in accordance with plans prepared by the High~ay Department was considered.
Upon consideration whereof, and on motion of James W.Gordon, Jr.~t is resolved
that some person be employed to work with the State Highway Department in s e~uring
these rights-of-way and that he be paid $10.00 per day for suuh days worked in this
connection.
This day the Executive Secr~tary stated that he had been informed that the Seaboard
Airline R~. would rebuild t~e crossing at DeLaVial Street in Ches~e~'~and place the
same several feet north of the present crossing provided the Highway would build
the road to that point, and upon investigation he found that to cross the tracks
it would be necessary to level down a small grade in order for the road to be of
service and that this part of the road was not in the Highway System. Upon
consideration w~ereof, and on motion of H.T.Goyne, it is resolved that the Virginia
De~rtment of I~ighways be requested to move the crossing of DeLavial Street
in accordance with the Seaboard Eirline RR. and to improve a road beyond the Railroad
in order to make it ~a~sabt~/and charge the ~nount for this improvement to the 35
road levy in an amount not to exceed $150.00.
This day there appeared before the B~rd, Ross Newsome, Colored District Agent,
stating that he had inspected the office offered by the County to the Farm Agent and
Local Ho~e Demonstration A gent in the ~arver High School and that he felt withthe
installation of a telephone and proper means of heating the office when the school
heating plant was not in operation, would ~ake the office satisfactory.
Upon consideration whereof, and on motion of H.T.Goyne~ it is resolved that the
Executive Secretary be and he hereby is instructed to have a telephone installed
in this office for the, colored Farm Agentand Home Demonstration Agent and to
purchase an electric heater which will be satisfactory to this office.
An Ordinance on Sanitation having been duly advertised is on motion of Irvin G.
Homer, adopted as previously presented to this Board as follows:
AN ORDINANCE
An Ordinance regulating the disposal of human wastes and excre-
ment in the County of Chesterfield, Virginia, prescribin~ certain
types of sanitary closets and privies, the size and drainage fields
of septic tanks and providing for approval and inspection of septic
tanks instal~d under the provisions of this ordinance; requiring
the owner and/or user of any flush toilet system, if same is avail-
able; requiring any ]~erson, firm or corporation who installs, re-
pairs or cleans septic tanks in the County of Chesterfield for any
other person, firm or Department, and providing punishment for fail-
ure to comply with said ordinance.
Under and by virtue of the a~thority conferred upon the Board of
Supervisors of Chesterfield County, Virginia, by an Act of the
General Assembly of Virginia of 194~ known as Chapter 46, approved
February 22, 1946, the Board of Supervisors having considered the
matter, doth ordain as follows:
Section 1. It shall be unlawful for the owner of any house used as a human
habitation, any warehouse, any public building or other place where human beings
congregate or are employed in the County of Qhesterfield, to pccupy or to rent
or lease the same for occupancy by any person, firm or corporation, or to permit
the same to be occupied by any person, firm or corp~ation, or for any person,
firm or corp~ation to occupy the same unless and until the said houBe or building
shall have been su?plied or equipped with a sanitary closet or privy of such
construction as will comply with the requirements hereinafter set out.
Section 2. That for the purpose of this ordinance a "s:~n~ary closet or privy"
shallbe deemed to be either
(a) A properly installed flush toilet connection to an approved public or
private sewer. If 8 public or priv~e sewer is available to the property owner,
the owner will be required to connect to the public or private sewer if the o~ter
of the latter permits such connection.
(b) A properly installed flush toilet connected to an app~.oved properly
installed septic tank o£ not less than seven hundred and twenty (720) gallons
working capacity with sufficient subsurface drainage as determined by the Health
Department, in any case not less than 200 feet.
(c) A properly constructed septic privy with an adequate subsurface draimge
system for disposal of effluent.
(d) A standard pit privy of concrete or double wood slab construction.
The terms" properly constructed and approved" as used in this ordinance
shall be construed to mean "in accordance with the specifications of the State an~
County Health Departments providing arrangements for the disposal of wastes and
excrements in such manner that the wastes or excrements shall not be acce.s~ibls
to flies or endanger s source of drinking water. The term "Health Dep~rtment"
shall mean Counhy Health ufficer or his duly authorized representative.
Section 3. All homes or other places having flush toilets,discharging on the
ground or into small streams or ditches shall be provided by the owner with
a septic tank or other approved sewage disposal plant for treatment and sedimentation
of the sewage from such flush toilets. In the future, cess pools will not be
permitted in the County of Chesterfield.
Section 4. Any person, firm or corporation contracting to install, repair or
clean a septic tank in Chesterfield County for another person, firm or corporation
shall first obtain a permit to do such work. Nothing in this section shall
prevent the ownere fr~m installing, repairing or cleaning a septic tank on propert~
owned by him, provided he complies with the regulations of the Health Department.
To obtain a permit the person, firm or corporation will apply to the Chesterfield i

Health Department for satisfactory compliance with this ordinance.
Section 5. It shallbe unlawful for anyone to install a septic tank in Chesterfiel~
County without first obtaining a permit from the County Health Department. The
health Department shall determine the capacity of the septic tank, the number ef
feet of drain tile to be used and the location of same.
The minimum capacities of septic tanks shallbe as follows:

The capacity of septic tanks for buildings other than residences shall be
determined by the Health Department.
The kind and amount of material to be used in the sub-surface drainage
field shall be determined by the Health Department.
Section 6. Septic tanks ~shall be installed under the supervision of the Health
Department and shall be inspected and approved by the Health Department before
being covered.
Section 7. All septic tanks shall be equipped with a distribution box, and all
lines of drain bile must lead from said distribution box. The size of said
distribution box shsll be determi~d by the Health Department.
Section 8. It shall be unlawful for any person, firm or corporation to wilfully
fail er refuse to comply with the previsions of this ordinance.
Section 9. All ordinances, or parts~ of ordinances, in conflict with the
provisions of this ordinance are 'hereby repealed.
Section lO: Any persgn, firm or corporation that violates any of the provisions
of this ordinance and/er in any way wilfully obstructs the Health Department
in the pr,per and lawful exercise of the duties prescribed by this ordinance shall.
upon conviction, be fined a sum of not less than $10.00 nor more than $25.00
for each offense, and each day's continuance to so violate this ordinance shall
constitute a separate offense.
This day Dr.E.C.Cates, County Health Officer, appeared before the Board st~ ing
th~ he had learned from the State Health Department that an additional white nurse
could be furnished, provided the County was willing to pay the su~ of $1,O00.OO
per year and that her services would be available as of January 1, 1949.
~pon consideration whereof, and on motion of H.T.Goyne, it is resolved that th~
Board appropriate the sum el' $~OO~O0 from the unappropriated surplus of the
General Fund to secure the services of an additional white nurse for Chesterfield
County from January 1, to ~une 30, 1949.
This day the Executive Secretary read a letter from Nr.Robert Jeffress stating t~
he had seen that someone had placed a street name on the Old MillRoad and called
it "Yorkshire Drive" but it ad been t~e Old Mill Road for all these years and he
hoped that the Board of Supervisors would see to it that this name was not changed
Upon consideration whereof, and on motion of J.C.~cKesson, it is resolved that
insofaras the CoUnty of Chesterfield has authority the name of this road should
the Old ~4ill R~ad.
This day the Executive Secretary stat~d he had been informed by a reliable source
that in the Proctor's Creek bottom would be a source of abundant water for use in
conjunction with the utilities department and he felt this should be investigated
and probably a test well drilled at this location. Upon consideration whereof
and on motion of H.T.Goyne, it is resolved that the Executive Secretary be and he
hereby is instructed to consult with the State Geologist and such engineers as he
deems necessary ~o termine whether a large supply of %water could be had from t h~
area,
This day the Executive Secretary presented a bill from~the Virginia Printing
Company from the Electoral Board in the amount of $276.00, which ~ is ordered
to he paid.
This day it was reported to the Board that the County had received a check in the
amount of $400,938.$8 for the sale of water revenue bonds which put the Utilities
Department in position tostraighten up with the Geners. l~Fund and other accounts.
Upon consideration whereof, and on motion of J.G.Henin~, it is resolved that the
Treasurer be and he hereby ~s authorized and directed to pay to the Mechanics
sad Merchants Bank the sum of $92,647.90, which would include all principal and
interest on bonds issued against the Manchester Sanitary District.
And be it further resolved that the Treasurer be-and he hereby is instruct'ed to
transfer from the Utilities Fund the sum o f $162.970.04 to the Germ ral Fund of
Chesterfield County, which is the amount borrowed from time to time by the
Utilities Department.
And be it further resolved that the Treasurer be and he hereby is instructed to
pay to the Mechanic s & Merchants Bank $100,000,OO with interest, which was a loan
made to the General Fund of Chesterfield County by this Bank.
This d~y Mr.J.G.Hening stated that since the Utilities Department had received mon~y
from the sale of revenue bonds which was in a position to stra~hten up matters
which h ad been continued by the Board, tha~ he felt these matters should be closed
up. Upon consideration whereof, and on motion of J.G.Hening, it is resolved
that the Auditing Committee and the Treasurer make a thorough.check of all bills
and obligations of the Utilities Department and pay the same in order that the
Board may know, at its next regular meeting, the amount of money ~eft on hand for
construction work in the Utilities Department.
And~ be it further resolved that the Board of Supervisors employ a consulting
engineer to plan the installation of a filtration plant on the Jahnke Road water
site, and the Executive Secretary is hereby instructed to co:mnunicate with Mr.R.
Stuart Royer and request him to submit an estimate of the cost of this installatio~
and charge he would make to serve as consulting engineer for the same.
And be it further resolved that the Board of Supervisors, shall at a future date,
meet with the engineer at the Jahnke Road water site and determine how much of the
area purchased would be necessary to have transferred to the County for this project.
And be it further resolved that when this decision is ~de that the Executive
Secretary be instructed to employ W. W. LaPrade & Company, Surveyer, to make a p]a~ of
same to be used in conjunction with the transfer of the prop~ rty.
This day there was brought to the attention of the Eoard that since the Utilities
Department was purchasing bonds of the Manchester Sanitary District it would make
the Utilities DeparSment one account. Upon consideration whereof, and on

be carried as one account, beginning December l, 1948.

Attorney to the Compensation Board for the year 1949, and after a thorough dis cuss on
it was decided to make no objection to the same.
This day there was read to this Board a letter from the Honorable J.Garland
Jefferson, Judge of Circuit Court of Chesterfield County, calling this Bcard's
attention to the recent transition of the Town of Colonial Heights to a city of
second class and wherein such frans ition Created some double as to the authority
of Trial Justice John W. Snead to try cases in the now City of ~olonial Hei~ ts
and referred to Section 4987c of the Code of Virginia, suggesting resolutions
be passed by the City Council of the City of Colonial H eighta and the Boar~ of
Supervisors of Chesterfield County, Virginia.
Upon consideration of said letter and said Section of the Code, it is on motion of
H.T.Goyne, resolved that the appointment of a~Trial Justice for the County of
Chesterfield and the City of Colonial Heights, the s aid city being within the
bounds of the County of Chesterfield, be and the same is approved.
This day the Executive Secretary read ale tter from the Chase Construction Compan~
requesting that certain streets in Grindall Creek Park Subdivision be taken into ~he
secondary system. Upon consideration whereof, smd on motion of J.C.McKesson,
the County Road Engineer is requested to view said streets in Grindall Creek
Park subdivision and take such steps as n~cessary to havesame taken into the
State Secondary System.

This day the Executive Secretary read a letter from Mr. M.H.Omohundro, Jr.,
requesting that Old Zion Hill Road be taken into the. Secondary System. Upon
consideration whereof, and on motion of J~ G. Hening, ~t is resolved that the
County Road Engineer take such steps as necessary to have this road taken into
the Secondary Road System of Chesterfield County.
This day the Executive Secretary read a letter from the Shaw Well Drilling Compan~
regarding the wellat "Brenda Court" wh~h letter was received and filed.
This day the Executive Secretary read a letter from ~r.R.W. Almond offering his
serv~ es on. the maintenance of Police radio:: system in Chesterfield County, which
matter was held in abeyance for further consideration.
This day the Executive read a letter from the Virginia Electric & Power Company
relative to additional street lights in Chesterfield County. Upon consideratioz
whereof, and on motion of J.C.McKessen, the Executive Secretary is instructed to
advise the Virginia Electric & Power COmpany that the Board accepts their first
proposal to install 75 additional street lights of 1000 lumen.
This day anotice from the St~te Corporation Commission of the hearing on an
a~plication of the suburban Coach Company for an extension of their lines over
roads in Chesterfield County was read before the Board, which notice is received
and filed.
This day the,matter of a telephone in the Bon Air Fire Station was brought before
the Board. Upon consideration whereof, and on motion of James W.Gordon, Jr.,
the Executive Secretary is instructed to request the C&P Telephone Company to
install a telephone in the Bon Air Fire Station in Bon Air.
This day Mr.H.T.Go~yne st~ted he had numerous requests for water along Route #l,
between Dutch Gap ~{W!nfree Motor Company's corner) and its intersection with
Rt. #lO, particularly by M~.Clyde Crump of Moore's Tavern, who had been informed
by the State Health Department that he did not have sufficient water for
operating the Tavern. Upon consideration whe~eof, and on motion of H.T.Goyne,
the Executive Secretary is instructed to install a water line along these points
as soon as pipe is available.
This day the matter of the nomination of a~tditional personnel for the Police'
Department came~b efore the Board. Upon-reco~mmendation of C.A.Ryburn, Jr..
Chief of Police, this Board doth on motion, nominate Bernard C. Furman and Floyd
M. Bowman, Jr., for appointment by the Judge of the Circuit Court as members ~of t
Police Department of Chesterfield County.
It is further resolved that the Executive Secretary be and he hereby is directed
certify a copy of this resolution to the Judge of Circuit Court.
And be it further r esolve~ that C.E.Ritcher be and he hereby is appointed
Dispatcher in the P$1ice Department to fill the vacancy created by Mr. Furman
being promoted to Police Officer.

This day Mr. James W. Gordon, Jr., stated there appeared to be considerable
confusion in the' interpretation of "Neighboring and adjacent" as applied to the
Zoning Ordinance, and he felt that some definite rule should be laid down ~
cone erning same. Upon consideration whereof, and onmotion of James W.Gordon, J|.,
it is resolMed that hereafter the interpretation of "neighboring and adjacent"
shall mean, if it is in a subdivision, all the people who' own property or live
within the block of the iroperty requested t o be rezoned, and all people who own
prop~ rty or live on the opposite side of the streets which bound the block; that
if it is not in a subdivisiSn, then "adjacent and neighboring" shall mean one-
quarter of a mile radius from the boundaries of the property requested for
rezoning.
