Dale Magisterial District 2939 Space Road REQUEST: Conditional Use Planned Development to permit a communications tower and exceptions to Ordinance requirements in a General Industrial (1-2) District. PROPOSED LAND USE: A 195-foot communications tower with accessory equipment is planned. Setback exceptions are requested to accommodate the tower. Specifically, the proposed tower is intended to replace an existing 195 foot tower that had been approved for use by Columbia Gas. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITIONS ON PAGE 2. STAFF RECOMMENDATION Recommend approval for the following reason: The proposal conforms to the Central Area Plan, the Tower Siting Policy and the Public Facilities Plan. (NOTE: CONDITIONS MAYBE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) The color and lighting system for the tower shall be as follows: a. The tower shall be gray or another neutral color, acceptable to the Planning Department. b. If lighted, lighting during daylight hours shall be limited to medium intensity strobe lights with upward reflection and lighting during night time hours shall be limited to soft blinking lights. (P) 2. At such time that the tower ceases to be used for communications purposes for a period exceeding twelve (12) consecutive months, the owner/developer shall dismantle and remove the tower and all associated equipment from the property. (P) 3. With approval of this request, an eighty-two (82) foot exception and a seventy-six (76) foot exception to the 170 foot setback requirements from the northern and western property lines respectively shall be granted (P). 4. The base of the tower shall be enclosed by a minimum six (6) foot high fence designed to preclude trespassing. The fence shall be placed so as to provide sufficient room between the fence and the property line to accommodate evergreen plantings having an initial height and spacing to provide screening of the base of the tower and accessory ground mounted equipment or structures from adjacent properties. A detailed plan depicting this requirement shall be submitted to the Planning Department for approval in conjunction with final site plan review. Existing Zoning: 1-2 Size: 0.3 acre 2 06SN0142-]AN25- BOS _....__.,.~_w..._,.-.~_.;__.n'^'....".~,....".._.,,~________,~__.U Existing Land Use: Industrial Adjacent Zoning and Land Use: North South East West - I; Industrial - 1-2; Industrial - 1-1 and 1-3; Industrial or vacant - 1-2; Industrial UTILITIES The proposed use will not necessitate a manned facility; therefore, the use of the public water and wastewater system is not required. ENVIRONMENTAL Drainage and Erosion: If the construction of the tower disturbs more than 2,500 square feet, then a land disturbance permit must be obtained from the Department of Environmental Engineering. PUBLIC FACILITIES Fire Service: The Bensley Fire Station, Company Number 3, currently provides fire protection and Bensley-Bermuda Volunteer Rescue Squad provides emergency medical service. This request will have a minimal impact on fire and EMS. Transportation: This request will have no impact on these facilities. COUNTY COMMUNICATIONS The Zoning Ordinance requires that any structure over eighty (80) feet in height be reviewed by the County's Public Safety Review Team for potential detrimental impacts the structure could have on the County's Radio Communications System microwave paths. This determination must be made prior to construction of the communications tower. A preliminary review of this proposal has indicated that the facility will not interfere with the County's communications system. The Ordinance addresses measures for correction if interference occurs. 3 06SN0142-]AN25-BOS COUNTY AIRPORT A preliminary review of this proposal indicates that, given the approximate location and elevation of the proposed installation, it appears there will be no adverse affect on the County Airport. LAND USE Comprehensive Plan: Lies within the boundaries of the Central Area Plan which suggests the property is appropriate for general industrial use. Area Development Trends: The area is characterized by industrial zoning and land uses. This development pattern is expected to continue. Development Standards: The request property lies within a Post Development Area. The development standards in such areas are intended to promote renovation and improvement of areas which have already experienced development. CONCLUSION The proposal conforms to the Central Area Plan which suggests the property is appropriate for general industrial use. In addition, the proposal conforms to the Tower Siting Policy which suggests towers should be located in areas designated on the Plan for general industrial use, and to the Public Facilities Plan which suggests that communications tower locations should generally be located to minimize the impact on existing or future areas of development. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (12/15/05): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Litton, seconded by Mr. Wilson, the Commission recommended approval subject to the Conditions on page 2.
