REQUEST: Renewal of Conditional Use (Case 03AN0137) to pennit an electrical contractor's
business incidental to a dwelling unit.
PROPOSED LAND USE:
In addition to the single-family residential use, the applicants plan to continue to
operate an electrical contractor's business.

This business was originally pennitted by a Special Exception in 2003. After consideration of
public input, should the Commission and Board wish to approve this renewal, acceptance of the
proffered conditions would be appropriate.

Location:

This Conditional Use shall be granted to and for F. Craig Waters
and Sonya Waters, exclusively, and shall not be transferable or run
with the land. (P)
2.
This Conditional Use shall be limited to the operation of an
electrical contractor's business, exclusively. A maximum of seven
(7) employees, other than those persons outlined in Proffered
Condition 1 may be engaged in this operation. (P)
3.
This use shall not operate before 7:00 A.M. and after 4:30 P.M.,
Monday through Friday nor on Saturday or Sunday. (P)
4.
There shall be no deliveries to or from the site via tractor-trailer
carriers. Any deliveries shall be made between the hours of 8:00
A.M. and 6:00 P.M., Monday through Friday. There shall be no
Saturday or Sunday deliveries. (P)
5.
There shall be no outside public address system. (P)
6.
One (1) sign, not to exceed one (1) square foot in area, shall be
pennitted to identify this use. Such sign shall not be illuminated.

7.
Within sixty (60) days of approval of this request, forty-five (45)
feet of right of way on the west side of Winterpock Road measured
from the centerline of the road immediately adjacent to the
property, shall be dedicated, free and unrestricted to and for the
benefit of Chesterfield County. (T)
GENERAL INFORMATION
West line of Winterpock Road across from Physic Hill Road and better known as 11200
Winterpock Road. Tax ID 720-654-3173 (Sheet 23).

UTILITIES
Public Water System:
A sixteen (16) inch water line extends along the southeast side of Winterpock Road
adjacent to this site. The existing structure is connected to the public water system. Use
of public water is required by County Code.
Public Wastewater System:
The public wastewater system is not available to serve this site. The existing structure is
served by a private septic system. The County Code excepts uses from mandatory
connection to the public wastewater system if the use (home business) is incidental to the
principal use (a home) that was previously allowed with a septic system.
Private Septic System:
The Health Department must approve any new or expanded use of private septic system(s).
ENVIRONMENTAL
Drainage and Erosion:
This request will have no impact on these facilities.
PUBLIC FACILITIES
Fire Service:
The Winterpock Fire Station, Company Number 19, currently provides fire protection and
emergency medical service (EMS). This request will have a minimal impact fire and EMS.
Transportation:
The property is located on the west side of Winterpock Road across from Physic Hill
Road. The applicant is requesting renew of a Conditional Use (03AN0137) to pennit an

existing electrical contractor's business. This use will have the same impact on the
transportation network as the previously approved conditional use.
Winterpock Road is classified as a major arterial on the County's Thoroughfare Plan with
a recommended right of way width of ninety (90) feet. The applicant has proffered to
dedicate forty-five (45) feet of right of way along Winterpock Road adjacent to the
property, measured from the centerline of the road in accordance with that Plan.

LAND USE
Comprehensive Plan:
Lies within the boundaries of the Southern and Western Area Plan which suggests the
property is appropriate for rural conversation area use.
Area Development Trends:
Area properties are occupied by single family dwellings on large lots. The
Comprehensive Plan suggests that the area should remain rural for the near future.
Zoning History:
On January 2, 2003, the Board of Zoning Appeals approved a Special Exception for the
operation of a business (electrical contractor) incidental to a dwelling unit (Case 03AN0137)
subject to a number of conditions.
Site Design:
With approval of this request, the business must be operated incidental to the dwelling unit
on the property. Proffered conditions would restrict the operation to an electrical
contractor's business only and limit the operation of the use to the applicant and his spouse.
Further limitations include hours of operation, times for deliveries, outside public address
systems and signage. (Proffered Conditions 1 through 6)
CONCLUSION
This business was originally pennitted by a Special Exception in 2003. If this were a new request,
staff would not support the use as the area is characterized by residential development. This,
however, is a renewal of a previously granted Conditional Use.
After consideration of public input, should the Commission and Board wish to approve this renewal,
acceptance of the proffered conditions would be appropriate.

Planning Commission Meeting (12/15/05):
The applicant accepted the recommendation. There was no opposition present.
On motion of Mr. Bass, seconded by Mr. Wilson, the Commission recommended
approval and acceptance ofthe Proffered Conditions on page 2.

The Board of Supervisors, on Wednesday, January 25, 2006, beginning at 7:00 p.m., will take
under consideration this request.
