This day, ~r. Geo. W. ~,Ioora, Jr., Commissioner of the Revenue, submitted his report of expenses incurred in the operation and maintenance of his office for tLe month of September, 194£, showing a total of $661.00 of which the County has paid two-thirds or $440.67, the remainder to be paid by the State and the Board approving, the said report the same is filed. This day, Mr. Macus A. Cogbill, Comnonv~'ealth's Attorney, submitted his report of expenses incurred in the operation and r~intenance of his office for the month of September, 19~2, showing a total of $468.32, of which the County pays one-half or $£34.16, the remainder to be paid by the State, and the Board approving the said report, the same is filed. Total .................... $59.49 This day the matter of reestablishing a by-pass roadway between the '~oodpecker Road and the River Road ~t a~d opposite the ~lorth ?etersburg Atlantic Coast Line Railway St:~tion in ~atoaca District, again came before the Board, and the Board being in doubt as to the proper width of said proposed road, doth on motion of P. W.Covington, resolve that the matter of establishing said ro~d, be, and the same is hereby referred to the Road Committee who shall neet with the engineers of the Railway Company, the State Highway Department, and the owner of the property to be acquired for the purpose of locatin4, and establishing said road. This day Er.J.G. tiening, member o~' the Board of Supervisors, presented to the Board of ~upervisors of Chesterfield County, furniture and decorations for the ne~' S~pervisor's' room at the Courthouse. Whereupon on notion of ~.:r. H. T. Goyne, who expressed the thanks of the ~oord of Supervisors and Chesterfield County to Idr. tiening in very appropriate terns, tlc furniture ~n~ decorations for the Board room are accepted for the Board of Supervi~:ors and the County of Chesterfield. The Executive Secre%ary read to the Board ~letter from the Department of Highways concerning additions ~ua abandonments of roads in the Secondary Road System, reque~tir~ the Board to submit the list of additions and abandonnent~ which should becor~e effective as of July 1st of each year to the Resident Enginee: in the month of February rather than in the month of April as had been previously done. Upon consideration v:hereof and on motion of T. D. Wat.~ins, the letter is received and the Executive Secretary is instructed to comply with the request contained ~herein. The Executive Secretary read to the Board a letter from the Department of High~,~sys concerning deletions from the Primary System and transfers from the Secondary System to the Primary System, informing, the Board that the Secondary Road in Chesterfield County known as the Belt Boulevard, or Sec. Rt. ~685, south of the corporate limits of the City of Richmond to the ~tlantic Coast Line Railway, a distance of approximately 3.20 miles, had been transferred from the Secondary Road System of Chesterfield County to the Primary System and ¥~ould be designated as Route ~161. Upon consider~'~tion whereof, and on motion of H. T. Goyne, the letter is received ~d filed. This day Supervisor H. T.Goyne, culled the attention of the Board to the fact theft there had been previously made a survey for an additional road east of Route ~l, from the City of Richmond to Route ~10, and stated that with the present industrial agit~tion he felt th~ Board should take further steps toward the early establishment of such road,s. Upon consideration whereof and on nlotion of H. T. Goyne, it is resolved thet the County Road Oonnuittee be and it hereby is requested to confer with the State Planning Board regarding this survey and to ascertain their advice on this matter and such other suggestions as they may have for roads in this area, and endeavor to conform with their plans for road establishing. This day the Executive Secretary read to the Board a letter dated September 10, lg42, from the Department of Public Safety of the City of Richmond advising the Board that from that date they would be unable to provide service with their Resque Squad truck to any locality outside of the City Limits, and on motion of T. D. Watktns, the letter is filed. a letter w~s read from the Bom Air Citizens Association again referrir~ to the matter of the establishment of an airfield by the Richmond Air Transport and Sales Company, near Bon Air, and thanki~ the Board for their efforts in the matter, st~ting that the Bon Air Citizens Association was still of the same G. pinion as formerly. Upon consideration whereof and on motion of To D. Watkins the letter is received and filed. The Executive Secretary calleo the Board's attention to thc fact theft he had received communication from ~r. Louis Reynolds of the Reyn61ds Metal Company regarding an airport in Chesterfield County, and asking what cooperation the Board of Supervisors might give to the establishment of such an airport. Upon consider~tion whereof and on motion of I~. T. Goyne, the Chairman is requested to appoint a Committee to investigate the advisability of any coopera~io in this matter. Whereupon the Chairman appointed Mr. H. T. Coyne, and Mr. T. D. Watkins, as this C o~ t tee. The Executive SeCretary submitted to the Board of Supervisors a report from the Commonwealth of Virginia on the records of the County Clerk's office of the Circuit Court of Chesterfield County for the calendar year of 1941, together with a bill for ~180.46. Upon consider~tion whereof and on motion of T. D. Watkins, it is resolved that this report be and it hereby is received and the amount of $180.46 be paid to the Co~onwealth of Virginia. The Executive Secretary presented to the Board a bill from the Virginia Electric & Pov~er Company for current used by the booster pump in the Ettrick Sanitary from July, 1941 through August, 1942, in the amount of $494.84, which District erroneously charged to the Virginia State College for Negroes. had bee~ ~ -~ Upon considerStion v~ereof and on motion of P. W. Covington, it is resolved that the Executive Secret~ry ~e and he hereby is instructed to pay the bill from the Ettrick sanitary District Operating Fund. Lnd be it further resolved that the amount of $700.00 be and it hereby is appropriated from th~e~ unappropriated surplus of the Ettrick Sanitary District ~h~nd to the Ettrick Sanitary District Operating Fund - budgetary code 10d-207. The Executive ~ecretary having been previously instructed to make certain alterations and repairs to the buildings at Chesterfield Courthouse, presented a bill to the BoerG from ~ir. A. Robins, in the ~ount of ~274.50 for ~ork ~hich had been done to date. On motion of W. A. Homer, it is resolved that this bill be paid. This d~y the Executive Secretary brought to the attention of the Board the fact that the offices of the ,~ar Price and Rationing Board had been moved from the Administration Building to a building owned by Mrs. Herbert Cogbill,in July, and that the State Office of the 0.P.A. had authorized the payment of the rent for this building beginning September l, 1942 and requested permission to make a payment of the rent for this building for the month of august in the amount of ~25.00 from an appropriation set up for Civilian Defense. Upon consideration whereof, and on motion of J.G.Hening, it is resolved thst the Executive Secretary be and he hereby is instructed to pay the sum of $25.00 ~o Mrs. Herbert Cogbill for the building used by the Local War Price and Rationing Board for the month of August, 1942. The z~atter of insurance on the County owned car furnished for the use of the Executiv~ Secretary was called to the Board's attention with the request that sufficient money be transferred 2rom the account of traveling expenses of the Executive Secretary -la-220a to insurance on county owned vehicles -la-211. On motion of W. A. Horner, the County Treasurer is directed to transfer from the account of traveling expenses of the Executive Secretary la-220a to insurance on county owned vehicles la-211,the sGnount of $88.70. The Executive Secretary presented to the Boar~ a petition from residents of a section of Petersburg known as "Pocahontas" requesting the Board to prohibit the enlargement of the present slaughter house in Chesterfield County near this section, or the erection of a new slaughter house adjacent thereto. On motion of P. W. Covington the ~atter is referred to the Zoning Commission for considera~i on. This day the matter of this Board's reco~endatlon to the Compensation Board as to the number of full time deputies and part time deputies for the Sheriff of Chesterfield County, came before the Board. Upon consi~erction whereof, and on motion of ~,. A. Iiorner, it is resolved that this Board recommend to the Compensation Board ths. t it authorize the Sheriff of Chesterfield County to appoint two full tine deputies; one part time deputy; one jailor, and a part time clerical helper .... ~ud be it further resolved theft the data ~urnished this Board by Robt. This day t~e Board took under consideration the matter of compensation of Joint County and State employees, not including heads of department s and principal officers; and upon consideration ~'~hereof, and on motion,~ is resolved that the State Compensation Board be and it hereby is requested to grant an increase of 10% of the compensation ~llo~ed such employees for the last calendar year, not including heads of departments or principal officers. ~nd be it further resolved that the compens~tion, beginning as of January l, 194Z, for all employees of the County, not including heads of departments and principal officers, be, and the same is hereby increased by 10%. This day the Executive SecretGry reported to the Board thct deeds for transfer of certain properties of ri~ht of way for an outlet from Drewry's Bluff to Rt. 038, from ~!r.J.Scott Parrish and the Jeffress Estate had been prepared. Upon consider~tion ~hereof and on motion of U. A. Horner, it is resolved that the Executive Secretary be and it hereby is authorized to execute the necessary deeds for the County of Chesterfield. This day ~ir.P.~i.Covington, requested that the following roads in ~.1atoaca Magisterial District be improved and the amount ch~-~rged to the three cent road levy: Williams Street in Ettrick Sanitary District, north from Rt. ll07, a distance of approximately .2 of a mile; Charles Street, Ettrick Sanitary District north from Rt. ~107, a distance of approximately .2 of a mile; Puckett street in Swift Creek Subdivision from Route ~l, near Landa's Service Station, west a distance of approximately .1 of a nile. Upon consideration whereof and on motion of P. ~. Covington, it is resolved that the Executive Secretary be and he hereby is directed to request the State ~i~hway Department to improve the following roads and charge same to the 3ct. road levy: Williams Street in Ettrick sanitary District, north from Rt. ll07, a distance of approximately .2 of a mile; Charles Street, Ettrick Sanitary District, north from Rt. ll07, a distance of approximately ~2 of a mile; Puckett Street in Swift Creek h~bdivisi from Route $1, near Landa's Service Station, w~-~st a distance of approximately .1 of a mile. This day the m~tter of the consider~ltion of certain ordinances for passage came before the Board, and it ~p~earing that due advertisement and notice having been made in accordance with law'~ it is resolved theft the following ordinances be and they hereby are adopted and passed, and spread upon the ninutes of this Board. ~n ordinance imposing license and tax on dance halls; an ordin~.~nce imposing license and tax on carnivals, side-shows, dog and pony (or either) show, trained animal sho~4 circus, and ~enagerie or a~'~y other show,exhibition or performance similar thereto; and an ordinance imposing a license and tax on slot machines of ~ll kinds. A__.~N 0 R D I N A E C E An ordinance requirir~ a license to keep, operate, or naint~in a dance hall, dance r~m or dance pavilion for gain, whether the same be kept, operated or main- tained along with or in conjunction ~ith any other character of business, or whether such dance hall, dance room or dancc pavilion be simply a plaice or room, the use of which for dancing nay be eRercised by the p~trons of Gny other business with or without ch~rge to the patrons of such other business; ~nd defining a dance hall; placing a tax o~ the license therefor; and providing for a penalty for the violation of the ordinance · Under ~nd by virtue of tile authority confer?ed upon the Bombard of Supervisors of Ch, esterfield County, Virginia, by an ~ct of the General ~ssembly of Virginia, approved April 2, 1942, and known Oahpter 389 of the sa~id Acts of ~ssembly, this Board of Supervisors having carefully considered the matter, doth ordain as follows: SECTION 1. That an annual license be required of persons to keep, operate or maintain any d~nce hall, d~&nce room, or dance pavilion, for gain, whether the same be kept, operated or maintained along with or in conjunction with any other character of business, or whether such dance hall, dance room or dance pavilion be simply a place or room the use of which for dancing may be exercised by the patrons of any other bu~<~ness with or without charge to the patrons of such other business. For the purpcs~ of this ordinance, all places of business wherein dancing is permitted are decimated to be d~nce halls. SECTION 2. That a tax Upon the license required in Section One of this Ordinance is hereby levied and imposed in the a~ount of Five ($5.00) Dollars. SECTION 3. Each such license as is hereinabove provided for in this 0rdin~nce shall designate the place where the businesses of the licensee will be carried on. No such license shall be transferable from one licensee to another, by may be amended to show a change of business. ~ ~ SECTION 4. The Term "person" as used in this ordinance means an individual, partnership, association or corporation. SECTION 5. ~ny person who shall operate, keep or maintain any dance hall, dance room or d~ce pavilion as described herein, without having first obtained the license required by this ordinance, or shall fail or 2efuse to pay any tax provided f~or herein, shall be deemed gu~ilty of a misdemeanor, and upon conviction therefor shall be punished by a fine o~~ not less than Ten Dollars nor more than Fifty Dollars. ~ach da~s continuance to violate the provisions of this Ordinance shall be deened to be and hereby is declared to be a misdemeanor, and such person shall be punishable as provided above herein. SECTION 6. Theft the Commissioner of the Revenue of Chesterfield County shall collect a fee of Sewenty-~'ive Cents for the issuance of each license required under this Ordinance, ~nd he shall pay the same into the County treasury in the manner he collects snd pays other fees into said treasury. A N 0 R D I N A N C E ~n Ordinance imposing a license upon every person, firm, company, or corporation, who or which exhibits in the County of Chesterfield performances in a side show, dog or pony (or either) show! trained animal show, carnival, circus and menagarme or any other show, exhibition, or performance similar theretoi providing for ~ tax on ouch licenses; and providmng for a penalty for the violation thereof. Under snd by virtue of the authority conferred upon the Board of Supervisors of Chesterfield County, Virginia, by an Act of the General ~ssembly of Virginia, approved April 2, 1942, and known as Chapter 389 ~of the s~id Acts of ~ssembly, this Board of Supervisors having carefully considered the matter, doth ordain as follows: SECTION 1. That a County license be required of every person, firm, conpany or corporation ~ho or ~Jhich exhibits in the County of Chesterfield perfornances in a side show, dog and pony ( or either) show, trained animal show, carnival, circus, and menagerie, or any other show, exhibition, or performance similar the fete. SECTION 2. For the ~urpose of this ~ rdinance a carnival shall mean an age-rogation of sh~s, amusements, concessions, eating places and riding devices, or any of them operated together on one parcel of ground, street or road, or contiguous parcels of ground, street or roads, moving from place to place, whether the same are o~'med and actually operated by separate persons, firms, or corpor~tions, or not. SECTION 3. That a tax on the license required in section one of this ordin~nce is hereby levied and imposed, and sh~ll be in the following amounts: $10.00 for one concession for the fir~t day of operation or part thereof, and $5.00 a day or part thereof for each succeeding day's operation on such first and ~4.00 a day or part thereof for each additional concession for concession; ......... ~ ~ ~o ~ ~ day or hart thereof first day of oper~tlon or parm ~n~.r~u~; ~oh~e ach a~ditional concession for each suceee~z~ ~ay ~ SECTION 4. The term "concession" as used in this ordin~ce sh~ll mean side show, dog and pony (or either) show, trained ~al show, eating places ~hen operated in co~ection with a ~rnival or other s~ilar show, ridi~ devices, ~usement show, curiosity show, or s~tls, r show, or other display or g~e for the operation of Yhich or psrticfpation ther~n the patro~ is required to pay a monetary cons ider ~tion. SECTI0~ 5. ~y person, f~m, company or corporation who or which shall operate ~y c~rnival, side ~ow, dog ~d pony (or either) show, trained animal show, menagerie, eating place when ope~ted in c~nection with a c~nival or other similar sho~, riding device, ~usement sho~% curiosity show, or similar show, or other display or g~e for the operation of ~hich or participation the~in the patron is required to pay a r.onetary com~itier~:~tion, or ?rmit any con- cession exhibiting on the sane parcel of ~round, street or road, or contiguous ~ parcels of ground, streets or roads, n~oving from place to place, whether the ssme are o~'med and actually opera, ted by separate persons, firms or corporations, or not, ','~'ithout first havin~ obtaAned the license required by this ordinance, or shall fail or refuse to pay any tax orovided for herein shall be deemed guilty of a misdemeanor and upon a conviction therefor slmll be punished by a fine of not less than Fifty Dollars nor more than Five Hundred Dollars for each offense. SECTION 6. That a County license be required of persons to have anywhere in Chesterfield County a slot machine of a~y description into ~,hich are aropped pennies or coins of larger denominations to dispose of che~'~in~~ gum or other articles of merchandise, or for the purpose of operating ~usical or other devices, inclusive of such nmchines as are controlled by the operator after any coin is depo sited therein ~md are f~nerally knov,'n to be ~mchines in ~-:hich the ope ator exercises skill, that operate on the nickel-in-the-slot principle, used for gain; provided hov~ever, th~:t oay telephone, vendin~ r.~achines as are used solely for the sale of a~'ricultur~l products or cigars, weighing machines and ~,~achines used solely for the purpose of selling st~oestrings, automatic baggage of parcel checking machines, or receptacles and slot machines theft are used for the purpose of selling: individual sanitary drinkin[~ cups, are ext~ressly hereby exe~.,pted froz~ the operation of this ordin~mce. SECTION 2. That an annual tax upon tt~e license for each ~.~achine provided for in Section One of this ordin~nce is hereby levied and imposed and shall be in the following respective amounts: For each machine requirin£: a deposit of one cent, $10.00; for each machine r,;quiring a deposit of a nickel, ~25.00; for each machine requiring a deposit of a dime, e40.00; and for earth rmchine requiring a deposit of a quarter, ~50.00, The license tax provided for herein if obtained after July 1st of any year shall be paid on the basis of one-half of the above respective amounts; · SECTION 3. Each such license as is hereinbefore provided for.~i.n this ordin~mce shall designate the place v;here the business of the licensee wz~z be carried on. A separate~license shall be required for each slot mschine possessed, operated, exhibited, for operation or placed for operation in this County. No such license shall be transferable from one licensee to another, but may be al.~ended to sho~ a change of p~ace of business. SECTIOI? 4. No license required herein shall be issued unless such person shall hold or shall simultaneously ther~,~ith acquire the proper Stat~ license required by law. SECTI0t~ 5. The term" person" as used in this crdi~nce means an individual, partnership, association or corporation. SECTION 6. ~ny person ~Jho shall h.uve, operate, exhibit~ ~ for. operation or place for operation any slot m~chine in the County of Chesterfield without being licensed as required by this ordinance, or shall fail or refuse to pay any ta~ provided for herein~ shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not les?m than ten dollars nor nore than fifty dollars, and ach day's continuance to have, operate, exhibit for operation or place for operation any such machine in Chesterfield County shall be deened a separate violation of this ordinance. SECTION 7. That the Commissioner of the Revenue of Chesterfield County shall collect a fee of seventy-five cents for the issuance of each license under this ordinance and he shall pay the same into the County Treasurer in the ~mnner he collectE and pay other fees into said treasury.
