Dance, Treasurer, submitted to the Board his report of expenses incurred in the operation and maintenance of his office for the month of August, 1943, showing a total of ~1164.3~, of which the County has paid two-thirds or ~ ~776.25, the remainder to be paid by the State, and the Board approving the same, the report is filed. This day, Mr.geo. -. Moore, Commissioner of Revenue, submitted to the Board his report of expenses incurred in the operation and maintenance of his office for the month of ~u~ust, 194~, showing a total of $731.00 of whichthe County has paid two-thirds or ~487.Z4, the remainder to be paid by the State, and the Board, approving the same, the report is filed. This day, Mr. 0.B.G~tes, Sheriff, sub~itted to the Board his report of expen.ses incurred in the operation and maintenance of his office for the month of Juzy, 1943, shorting a total of $551.58, of ~:hich the County pays one-third or $18~.86, and the Board approving the report, the same is filed. This day came Mr. ~'arror Ohelton, of the Sta~e Planning Board, speaking on ?ost-,~ar Planning, stating that there will be available federal funds for various$ projects, and ~s{~ggested that a Pla~Lning 6or.'.~ission be appointed for Chesterfiel~ County to work with this Board of SuperVisors and plan projects to be executed afte~ the .ar.~ Upon consideration ~hereof, an~d on motion of-. ~. Morner, Mr. ~helton wa~ thanked for his interest in Che~teYfield County, and it is resolved that the matter be carried over for further study. This day came the atlantic Coast Line Railroad Company, by its Attorney, and filed its application praying that that~ part of the Woodpecker Road which lay between the northeastern and southwestern right-of-way lines of said Railroad Company, and now used as a crossing of the tracks of said Company, situated in Matcaca Magisterial District, Chesterfield County, Virginia, a short distance northwardly from the North Petersburg Station on said Railroad, be discontinued as a public or 0ounty road, or secondary highway; and it appearing that due notice of this application has been posted at the front door of the Courthouse of this County, and at two public places in the neighborhood for more than twenty days prior to the entry of this order, and that this ia the next meeting of this Board after posting of such notice. There came also the following persons speaking in opposition thereto: P.Rixey Jones, W.W.Britton, G.P. Hardy, R. C. Stewart, John Butler, O.E. Bollinger, E.G.Webb, Adolph Cizek, L.M.Spencer, ~.R.Burton and D. P. Bass. On motion of H. T.Goyne, it is ordered that J.T.Moore, ~,.L. Putney, R. N. Winfree, A. A.Moseley, and J.B.Watkins, Jr., be and they are hereby appointed as viewers, who shall view such part of said road as is sought to be discontinued, and shall make report to this Board in writing, whether, in their opinion, any, and if any, what inconvenience would result in discontinuing the same; together with such other facts, as in their opinion, would enable the Board to properly pass upon the merits of said application. Unless some other data is fixed upon by the viewers themselves, they shall meet for the performance of their duties hereunder on the premises on the 22nd day of September, 1943, at 10:00 o'clock A.M. This day citizens of Ettrick and Eicinity appeared before the Board stating that the Railroad crossin6 at Ettrick where the River Road (State Highway $36) crosses the Atlantic Coast Line, presents a traffic hazard to the people of this area, requesting that the Board of Supervisors take some action having this condition improved. Upon consideration whereof, and on motion of W, A. Horner, it is resolved that the Atlantic Coast Line RR. Company be and it hereby is requested to provide a flagman at the crossi~ of the River Road (State High~ay ~6) in Ettrick, near the North Petersburg Station, until such time as the crossing is made safe for travel. This day the condition of a by-pass, running ~arallel to the Atlantic Coaat Line Railroad tracks at the North Petersburg Station, between Woodpecker Road and River Road, was brought to the a~tention of the Board of Supervisors.. Upon whereof, and on motion of ,~. A. Horner, it is resolved that the Department of Highways be and it hereby is requested to make every effort to secure materials for hard-surfacing this road at once. 'This day the Executive Secreta~ry called the Board's attention_to the fagt that at a previous meeting the sum of $350.00 was authorized to be paid to William Old, representing the County in a suit of the School Board Versus the Board of Supervts( stating that there was insufficient funds in the budget and requested that such an appropriation be made. Upon consideration whereof, and on motion of W.A. Homer, it is resolved that the sum of $350.00 be and.it hereby is appropriated from the unappropriated surplus of the General Fund to Acoount-18-10$-Services of Special Attorneys. The Executive Secretary presented to the Board statements from the State Commission of the Utlli~es in the State of Virginia, and these statements were ordered received and filed. This ~$ythe Commonwealth's Attorney submitted to the. Board a revised Ordinance on Subdivisions, stating that it was necessary to make certain changes in order to clarify certain conditions which had arisen. Upon consideration whereof, and on motion of W. A. Horner, it is resolved that the revised Ordinance be and it h~reby is adopted and advertised according to law. ~ion This day the Executive oecretary read to the Board letters from the State Corpora~i Commission notifying the Boars of meeting dates to hear applications for permits by Stewart Driscoll, and the Cochrane Transportation Company to operate over certain roads in Chesterfield County, which notices were received and filed. The ~xecutive Secreta~-y read a letter from the oupt. of tie ~tlantic Coast Line RR. concernin8 crossing at Rt. 611 (Kingsland Road) which letter was received and filed ~ letter was read from the Compensation Board advising the Board that they had approved the recom~mendation of $10.00 increase for stenographic help in the office of the Uommonwealth's attorney, effective September l, 1943, which was accepted. The Executive Secretary read a report from Mr.a.L. Smith, Fire ~arden for Chesterfie County, on activities for the month of August, ~hich was received and filed. The Executive Secretary read a letter from the ~sst. Comptroller, setting forth the amount to be paid into the Treasury of the ~tate on the salary of the Judge of Circuit Court, v:hich letter is received and filed. on This day t~e Executive Secretary r.sad a letter addressed to the Chairman of the Board of Supervisors concerning a meeting of the Metropolitan Committee of the League of Virginia Counties, t~ be held in the hotel Richmond, ~riday, Sept. 17, 1943, to discuss legislation to be proposed at the coming meeting of the General Assembly. Upon consideration whereof and on motion of ~,.A. Horner, it is resolved that the Commonwealth's Attorney and the Executive Secretary are instructe~ to attend the meeting and to take such action as would be to the interest of Chesterfield County. This day Mr. H. T. G~yne, Supervisor, called the Board's attention to the fact the certain counties in irginia ha~ been able to secure equipment for establishing canneries within the Counties, which were available for use by the citizens in the County under the supervision o~f the Home Dem. ~gent and the Otate Board of EducatiOn, statin8 that he felt that Che~,terfield County s~ould take immediate steps to secureI such ecuipment and establish one or more canneries in the County. Substantiating| ~,~r. G~½ne's report and request, ~r.P.kixey Jones, County ~gricult~ural .Agent and $ ~iss ~ancy Tyree, home Dem. ~ent, expressed belief thst~ s~ch equipmen~ in . ~ Chesterfield County would not only be of assistance to Che~,terfield County bu~ would be a large factor in conserving food in these critical times. Upon consideration whereof, and on motion of J.G. Hening, the matter is held over for further consideration. This day the Executive SecreDary reported that the Home Dem. Agen~ had been able to purchase a food dehydrator to be used by the citizens of the County of Chesterfield, snd that it v:[~ necessary to supply ad~itional funds for payment of the same. Upon consideration whereof, and on motion of T. D.~atkins, it is resolved that the sum of ~5.00 be and it hereby is appropriated from the un- appropriated surplus of the General Fund to llb-3a~, supplies for the Home Dem. Age nt. This day a bill from Mr. A. Robins in the amount of $1£6.02 for work at the Courthouse was presented and ordered paid. This day the Executive Secretary reported that a bond for the F. ttrick Sanitary District would be due on October l, 194~, and r~quested t~t the Treasurer be instructed to mak~ such payment. Upon consideration whereof, and on motion of J. G. ~ening, it is resolved that the sum of ~5,000.00 be and it hereby is transferred from the unappropriated surplus of the EttrickSanitary District Debt Fund to account 10d-800 in the Debt Fund. This day the ~xecutive Secretary reported to the Board that the property of Mr. John Cogbill a~ Chesterfield Courthouse ~ould be purchased for the sum of %5,000.0~ and that the building thereon could be used for temporary office space. Upon conside~ation whereof, and on motion of J. G. Hening, it is resolved that the matter be referred to the Buildings and Grounds Committee to determine the advisability of the purhcase of such property by the County of Chesterfield, and report at a future meeting. This day Er. H. L. Chalkley, reported to the Board that he had a request from citizens of Cl~ver Hill District for the improvement of a road leading from Rt. 604, approximately one r. ile east of Junction of 604 and 605, in a souhherly direction, approximately a distance of .5 of a mile, to property formerly owned by Major Adams and recently purchased by Mr. Allison, a~.d three other properties. Upon consideration whereof, and on motion of ;~.A. Hornet, it is resolved that the State Department of High~,'ays be and it hereby is requestea to improve this road, expending a sum not to exceed $£00.00, and charge same to the 3ct. road levy. This day the Executive Secretary requested an additional appropriation of $50©.00 to the ~'aintenance of Buildings and Grounds, and $10.00 for supplies for election~ Upon consideration whereof, and on motion of J.G, Hening, it is resolved that the sum of $500.00 be and it hereby is appropriated from the unappropriat, ed surplus of the General Fund to 14-215-Siaintenance of Buildings and Grounds. And be it further resolved that $10.00 be and it hereby is appropriated from the unappropris surplus of the General Fund to 13-319-Election supplies. ted This day ~he ~xecutlve Secretary stated there was continual trouble with the water supply in Ettrick and Colonial Bei~.hts and that he had made certain inquiries and believed that adequate water system to supply water t~ Colonial Heights and Ettric~ could be supplied for approximately $40,000.00, and that the State Normal School had stated t~at they would be glad to purchase water from Chesterfield County if and when the County was able to supply them, and stated further that the combine water bi~ls paid to the City of Petersburg by Colonial Heights, Ettrick and the State Normal School was in excess of $20,000.00, and suggested that further investigation be made of the ~ituation. Upon consideration whereof., and on motion of J'G. Rening, the matter is referred to the ~ater Committee. (Mr. Goyne Mr. Horner). This day the Executive Secretary requested the Board to permit him to reimburse the Chle~ Forest Fire ~arden, Mr. A. L. Smith, in the amount of $7.03 for supplies purchased for the Fire ~ardens' Outing recently held at Chesterfield Courthouse. On motio~ of ~.T. Goyne, it is resolved that the sum of $7,03 be and it hereby is ordered paid to Mr. A. L. Smith for supplies purchased for this Outing. This day Mr. H. T. Goyne, Supervisor, stated that he had a number of r~quests for an additional telephone line from Chesterfield Courthouse to Chester, and suggested that another line be added as soon as possible. Upon consideration whereof, and on motion of H. T.Goyne, it is resolved that the E~ecutive Secretary be and he hereby is instructed to secure a~s soon as available an additional teleph~ line to Chester. There appeared before the Board ~r. U. S. Adams, ~top 14, Petersburg Pike, stating that the County and State Highway Department had constructed a road across the property belonging to the Estate of ~. T. Adams, near Falling Creek, under an agreement with his Mother to pay the sum of ~300.00 for such right-of-way, and he'and his brothers did not wish to accept this amount and fe~t it was worth at least ~l~,000'00 for such right-of-way. Upon consideration whereof, and on motion of J. G. Hening, it is resolved that the ~xec. Sec'y. be and he hereby is instructed to'request the State Department of Highways to post bond and to proceed with construction of the road. This day the Executive Secretary reported to the Board that he had conferred with Mr. J. M. Turner regarding a right-of-way along the old narrow guage road from Rt. l0 to Rt. 632, and that Mr. Turner had offered to convey to the County a right-of-way of 80 feet wide for the entire distance, except where the right-of- way faced the property now owned by him and for that distance a right-of-way of 60 feet, ~reserving the right to remove such pu~p wood as was on the right-of-wa for the sum of $50.00. Upon consideration whereof, and on motion of W.A. it is resolved that the Board of Supervisors accept Mr. Turner's offer and purchas~ sUch right-of-way for the sum of $50.00. On this matter Mr.Hening voted "No". This day Mr. M. ~ Cogbill, Commonwealth's Attorney, stated to the Board that in t~e matter of the County School Board of Chesterfield County Yersus the Board of Supervisors of Chesterfield County, the Court had rendered an opinion, entering a decree or order adverse to the contention of the Board of Supervisors. Upon consideration whereof, and on motion of W. A. Homer, it is resolved that thi Board in order to protect its interest should note an appeal to the Supreme Court of Virginia. ~d be it further resolved that the action of its attorney William 01d, in formal! noting an appeal before the Court bc and the same is hereby approved and ratified. And further~that said William 01d, Attorney, proceed to perfect the appeal in the Supreme Court and to prosecute the same through said Court. And be it further resolved that W. ~. Caldwell, Executive Secretary, be and he hereby is authorized and directed to issue the County's voucher for all necessary costs in said Court as and when the same may be required. This day Mr. H. T. Goyne, Supervisor, presented to the Board a copy of the By-Laws of the Chesterfield Volunteer Fire Department #1, which having been read to the Board, a~.~e received and filed. ~This day, Mr. J. ~,m. Dance, Treasurer, of Chesterfield County,reported to the Board that the County had some surplus mone~ on hand and suggested that the Treasurer be authorized to purchase ~25,000.00 in ~ar Bonds. Upon consideration whereof, and on motion, it is resolved that the Treasurer of Chesterfield County be and he hereby is authorized and directed to purchase United States War Bonds up to an amount not to exceed $~5,000.00 with surplus ~unds of Chesterfield County. r!
