Greene, be instructed to communicate with Dr. Foster informin~ him that this request was denied because our budget for this year had been completed, and requesting him to make any further request for increase to that School so that it can be incorporate¢ in the budget of Chesterfield County. Upon consideration whereof, and onmotion of J.G.~iening, it is resolved that the road running northu'ardly from Rt. 360 into the property owned by ~r. James .%iiles be and it hereby is taken into the County Road Jystem. And be it further resolved that the ¥irginia Department of tti~hv~ays be and it hereby is requested to improve this road, expending a sum not to exceed $10~.00, charging same to the Zct. road levy. This day Ya~.J.G,' Iiening, Supervisor of Dale District, presented to the Board a petition from residents li~ir~ on a road running westwardly from Rt. ~10, approximately 1/2 mile south from the intersection of Rt. l0 and ~638, known as DuPont Bculevard in Ampthill Gardens, requestin~ that same be taken into the County Road ~ystem and improved. Upon considerstion whereof, and on motion of J.G.~iening, it is resolved that thi road be taken into ti~eCounty Road System. ~nd be it further resolved that the Virginia Department of Highways be and 'it hereby is requested to improve this road for a distance of approximately 1/4 of a mile, chazging same to the 5ct. road levy, and expending a sum not to exceed ~100.00. This day the Executive Secretary read a lettew from the Carolina Coach Company relative to the possibility of extendin~ its service over Rt. ~10, via Cheste~field Courthouse, which letter is received and filed. This day the Executive ~ecretary read a letter from the Compensation Board stati~ that the date of October 15th, had been set as the date to consider the fixing of salaries of officials of Chesterfield Ccunty, which letter is received and filed. This day the Executive Secretary read a letter from the State Board of Education stating that they had completed the tabulationof the 1945 school census and according to that report the basic salary of the Division Supt. of Schools for Chesterfield County should be $2600.00 per year, which amount would remain as a basic sala~'y until such time as the School census should be taken again. This day the ~ixecutive Secretary read a letter from the Commandant, Fifth Naval District, statir~g that proposal to establish a berthing area in the James River for placing demobolized United States Navy vessels, which letter is received and filed. This day ~.J.A.~tratton appeared before the Board stating that he represente~ the owners of the right-of-way on the old Tidewater and ~,estern Ry. and that the County and State had constructed upon a section cf the right-of-way betv~een ap Coalbore and ~,interpock a public highway, without first securing from them a right-of-way, and st~,ted that his clients were anxious to settle the matter and to be able to convey the title to the State of Virginia for the sum of $1000.00. Upon consideration whereof, end on motion of E.L.~halkley, it is resolved that the o~ners of the right-of-way on th~ Tidewater and -estern Ry. between Coalboro and l~in.terpock, through their representative Mr.J.%.Strattom, be offered the sum 'el $100.00 for this section of their right-of-way taking in the entire width, which is supposed to be approximately 80 feet. This day the Executive Secretary read a letter from the Sydnor Pump & ~,ell Company offering to sell to Chesterfield County the water system now owned and operated by them in Bensley Village. Upon consideration whereof, and on motion of J.G.Hening, the matter is referred to the ~,ater Gommittee for investigation. bda~ the Executive ~ecretar7 reported to the Board that sin_c.e there.,was a ~i~~ th~ woli~e force du~-to ~he retirement of Mr. Geo.~i. W.Smith, be and he hereby is authorized to employ a policeman to fill the vacancy caused by the retirement of Mr.Geo. M.Johnson. At a previous meeting of the Board the Executive Secretary was instrmc~ed to get bids for the weatherstripping on the doors on the Courthouse buildin~ and the l~rge courtroom and the Executive Secrelary reported that bids had been requested ~and that one bid for ~76.00 had been received. Upon consideration whereof, and on motion of p.w.Covington, the Executive Secretary is hereby au~hOrized to procee wdth this work. This day the Treasurer reporled to the Board that a warrant dragon in the ~avor of ~r.~.J.Cheatham, in 1937 and which ha~ by virtue of the lapse of time been charged from the books, had been submitted by the heirs of Mr. Cheatham and had been honored by the Bank, requestin~ that the honoring of this warrant be authorized by the Board. Upon conside~~tion whereof, and on motion of W.A. Horner, it is resolved that the Treasurer of Chesterfield County be and he hereb~ is authorized to pay the amount of this warrant to the Mechanics & Merchants Ban~. At a previous meetin~· of this Board the Commo~v~ealth's Attorney submitted an Ordinance on the dumping, placing and/or~storing of garbage in Chesterfield ~ounty, and notice of this Ordinance having been duly advertised, it is resolved on motion of ~i.A. Homer, that the S.ame be and it hereby i~ adopted, as follows: AN ORDINANCE An ordinanc~ prohibiting the dumping and/or placing end,or storing of ~arbage with.in a distance of 400 yards of the dwelling plac,e of another, or a place wh~re persons regularly ¥~ork, or any church, school, or public meetin~ place in the County of Chesterfield, Virginia; and setting out certain definitions and providing for penalty for the violation of said ordinance. Under and ~y virtue of ~he authority conferred upon the Board of Supervisc~ of Chesterfield County, yirginia, by an Act of the General ~ssembly of Virginia, approved April 2, 1942, and known as Chapter 389 of said Acts of Assembly, this Board of Supervisors having carefully consider~d the matter, doth ordain as follows: SECTION 1. That the dumping and/or placing and/or storing of garbage within a distance of ~'our ~undr~d 1400) ysrds of the dwelling place of another or a ~lace wher~ persons regularly ~ork, or any church, school, or public meeting place in the County of Chesterfield, Virginia, i~ prohibited; provided, however, shoul~ any home o2 human habitation, and/~r place where persons r~gularly work, or any church, school or public mseting place become such subsequent to the dumping and~or placing and/or storing of garbage then this ordinance shall be operative as ~uch. P~ovided, however, this ordinance shall ~ot apply to garbage from one's own kitchen and/or market or store. SECTION ~. ~t shall be unlawful for any person, firm or corporation or ~ump or place or store garbage or to permit another to dump or place or store garbage, the County of Chesterfield, ¥irginia, within a distance of Four Hun~red Yards ~0 of the dwelling house of another, or a place where persons regularly work, or any church, school or public meeting place. Provided, however, this Ordinance shall not apply to garbage from one's own kitchen and/or market or store. SL~TION Z. ~ny person, firm or corporation who or which shall violate the provisions of this ordinance shall upon con~iction thereof be punished by a fine not exceeding $50.00 and by confinement in jail not exceeding 30 days, eithe or both. SECTION 4. The term "garbage" as used in this ordinance shall mean refuse animal and/or vegetable matter from k~tchen~, markets, stores or hatcheries. in QTt05.. Trials of all violations of this ordinance shall be before the lal ~usti~e Court of Chesterfield County in like manner and with like right of appeal as is provided by law in misdemeanor cases. SECTION 6. If any section or part of a section of this ordinance is hereafter held by any Court of competent jurisdiction to be unconstitutional and invalid, such decision shall in no ~ise affect or render void ~he remainder of this ordinance. ~ddittonal funds being needed in cert~in accounts of the General Fund, it is resolved on motion of ',i.A.
