Subiect: Ordinance Amendments Relating to Department of Utilities' Fee Changes County Administrator's Comments: County Administrator: Board Action Requested: Adopt attached amendments to Sections 18-27I and 18-114 of the County Code Relating to Department of Utilities' fee changes Summary of Information: The Board of Supervisors held a public hearing on March 27, 2019 concerning the proposed changes to Utilities fees. The Utilities Department's analysis of the FY2020 budget, capital replacement and maintenance projects, and projections over the next ten years indicate that current revenues, without fee increases, will not be sufficient to cover operating and capital expenses. As an enterprise fund fully supported by payments from users, fee increases are necessary to offset costs of capital projects for rehabilitation of pump stations, new and replacement water tanks, new and replacement water. and wastewater lines, investments in older neighborhoods to replace water and wastewater lines, the county's contractual share of Richmond water plant projects, as well as maintaining the integrity of the county's water and wastewater facilities. The additional revenues are required to meet the projected longer term operating and capital costs. This rate setting approach supports a financial plan to manage current and projected capital expenses and is prudent financial management necessary to maintain the triple AAA bond rating. The changes in utility rates are displayed below. The customer and capacity charges are unchanged from FY2019. A typical residential combined water and wastewater bi-monthly bill will increase from $114.08 to $115.34, or 1.10 based on consumption of 14 CCFs (one CCF is 100 cubic feet or 748 gallons of water) . Utility Connection Fees - There are no proposed fee changes for the water and wastewater capital cost recovery charges. Strong Waste Surcharge - The Utilities Department evaluates the strong waste surcharge on an annual basis to ensure that rate for each parameter adequately reflects current treatment cost. The BOD is increasing by 50 and TSS increasing by 100, offset by a 501 decrease in TN and TP. The proposed change will have a net decrease of approximately $2,000 to the 36 industries that are currently participating in the surcharge program. Strong Waste Surcharge Rate ($/lb.) The Board held a public hearing on March 27, 2019 concerning the attached ordinance regarding annual tax rates. Tax rates on existing classes of property for calendar year 2019 were advertised as follows: $0.95 for real estate; $3.60 for personal property; $1.00 for machinery and tools personal property; $.50 for aircraft personal property; $0.96 for personal property for volunteer firefighters, rescue squads, and auxiliary members; $0.01 for wild and exotic animals personal property; $3.24 for vehicles using clean and special fuels; $0.01 for specially equipped motor vehicles for the physically handicapped, $0.96 for vehicle trailers and semi -trailers with a gross weight of 10,000 pounds or more, and $0.24 for computer equipment and peripherals used in data centers. Subject: Adoption of the FY2020 Budget, FY2020-2024 Capital Improvement Plan (CIP), FY2020 Appropriations Resolution, and the FY2020 Community Development Block Grant and the HOME Investment Partnership Annual Plan County Administrator's Comments: County Administrator: Board Action Requested: Adopt the FY2020 Budget, adopt the FY2020-2024 CIP, Appropriations Resolution, and Community Development Block Grant and the HOME Investment Partnership Annual Plan with changes as approved. Summary of Information: The County Charter requires that the budget, inclusive of the CIP, be adopted by May 1 and that an appropriations resolution be adopted to authorize the expenditure of funds. In addition, the County's Community Development Block Grant and HOME Investment Partnership Annual Plan for FY2020 is required to be submitted to the U.S. Department of Housing and Urban Development by August 16, 2019. CDBG and HOME allocations are based on a tentative notification but are contingent upon final award notification from HUD for FY2020. Public hearings were held on each the aforementioned items on March 27, 2019. Chesterfield County Board of Supervisors April 10th 2019 Members of the board and guests, my name is Tyler Moody and I thank you for giving me this opportunity to address an issue that should be on your agenda and a top priority with all county officials. There are homes in rural areas of Chesterfield County that are without access to reliable cable, and internet, due to outdated ordinances in the Code. Specifically, section 15.62, stating Comcast is not required to run, without charge, cabling to any housing development that does not meet the homes per mile density specifications, which are 25 dwellings per. Any rural area not meeting those specs, no matter how creative Comcast's measurements might be, are being asked to pay anywhere from $4,300 to $24,000 per homeowner to have the same service others in the county have installed for free. This constitutes technological discrimination at its worst. We in these rural areas would like to take online classes, have reliable security systems, and run home businesses, without capping out our cell and satellite data plans, both of which are costly and quite unreliable. Our home resale values are dropping, as we are basically operating on extremely limited connectivity. I live on Rhodes Lane, off Woodpecker Road, and the frustrating part of this is that Comcast has end point service connections at each end of our street, but they left out the 21 homes in the middle. One homeowner who lives exactly 1/5th of a mile from the last Comcast serviced home just received a price of $23,000 to run service to her dwelling. Another received a quote of $2,300 to run service directly across the road, possibly 30 feet at most, and another at the end of our street was just hooked up for free last year. We don't understand the disparity of pricing and how Comcast decided exactly which homes were eligible to have cabling run to them free of charge. The measurements Comcast configured just don't add up. We ask that you consider amending or revising the code to include provisions for equal access to equal cable and high speed internet services for all areas of the county, whether the supplier is Comcast or Verizon. Many homeowners cannot afford $4,300-24,000 for cable installation. Why should we be penalized for where we live, especially since this is supposed to be one of the most progressive counties in the state? There is a 25 year old Comcast Cablevision franchise agreement; which the county attorney provided, but he informed me the county has no legal authority to regulate internet services in any manner and any new agreement would only address cable television services. I would like to request the board revisit this agreement and negotiate better terms providing for cable access to rural areas of Chesterfield, specifically the 25 homes density per mile specification. It's preventing many of us from obtaining what is provided in the denser areas, mainly reliable cable and internet access. I would think a 25 year old agreement would be way past its adequate serviceability standard for Chesterfield by now. I have documentation relating to our neighborhood's two year attempt to negotiate for a fair market value installation price with Comcast and our written communications with the county's various departments and officials. The price doubles each time I request something in writing from Comcast, as do their excuses as to why service cannot be run on our road, unless we pay thousands of dollars. Summary of Information: to change the polling change in the name of The current polling place for Bon Air Voting Precinct, Bon Air Community House, has informed the Registrar that they no longer wish to serve as a polling place. The Registrar is therefore proposing to move the polling place to St. Michael's Episcopal Church, which is located across the street from the Community House and will therefore be equally convenient for the precinct's voters. Although the polling place for Southside Voting Precinct is not changing, the church in which the polling place is located, Southside Baptist Church, is now named the Transformation Church.
