Proposal
A shopping center, commonly known as Swift Creek Place, is being developed on the property.
A restaurant (Texas Roadhouse) is currently under development on the site and would include
two (2) flags attached to the roof of the building. The flags would be erected to a height of
approximately 41 feet from grade, with the poles reaching roughly 12 feet above the roofline of
the building. The flag poles would comply with the 45-foot height allowance for structures
within the Route 360 West Design District.
While the proposed flags are considered non-commercial signage under the Ordinance, they
are not permitted above the roofline of a building. Staff is supportive of an exception to this
requirement for the following reasons:
The proposal would provide for flexibility to display non-commercial flags which are
featured on all of the locations nationwide
The proposal complies with the Ordinance requirement for height of structures
The proposed flags will have minimal impact on surrounding development and will not
be visible from nearby residential properties

CONDITIONS
Note: The following conditions are recommended by both the Planning Commission and
Staff.
1.Non-Transferable Ownership. The flags shall only be permitted accessory to the business
(Texas Roadhouse) of which David Stolberg, the applicant, is a majority owner. (P)
2.Location and Design. The flags and their poles shall be located on the property as
depicted in Exhibit A, and shall have a design generally consistent with the rendering in
Exhibit B. (P)
3.Flag Display. Display shall be limited to two (2) non-commercial flags not to exceed
45 square feet of area per flag. (P)
