SUMMARY
A tow lot, to include the temporary storage of damaged, disabled, inoperative or impounded motor
vehicles, automobiles and tractor trailers, is planned. The proposed site would occupy a maximum of
3.3 acres on an interior lot within the Clover Hill Industrial Park (Exhibit-Attachment 2). Condition 3
of Case 84SN0111 limits uses in this park. These permitted uses do not include a tow lot, thereby
necessitating a zoning amendment.

Proposal
A tow lot is proposed on a vacant property within the Clover Hill Industrial Park. Use of the lot
would be for the temporary storage of damaged, disabled, inoperative or impounded motor
vehicles, automobiles and tractor trailers. The Ordinance defines this temporary storage as
storage of items up to a maximum of 30 days, unless the vehicle is abandoned by the owner (up
to 90 days) or legal obligations preclude removal of the vehicle (up to 6 months).
Condition 3 of Case 84SN0111 limits uses in the industrial park to those permitted by right or
with restrictions in the Light Industrial (I-1) District, as well as several uses first permitted in the
General and Heavy Industrial Districts (I-2 and I-3) provided these uses are not located adjacent
to residentially-zoned property. A tow lot is first permitted as a restricted use in the I-3 District.
These restrictions address setbacks from external roads and properties zoned or designated on
the Comprehensive plan for residential and office uses, and screening of vehicles from
properties not permitting this use. Tow lots are not included as permitted uses with Case
84SN0111, necessitating a zoning amendment.

The Comprehensive Plan, which includes the Thoroughfare Plan, identifies county-wide
transportation needs that are expected to mitigate traffic impacts of future growth. The
anticipated traffic impact of the proposal has been evaluated and it is anticipated to have a
similar impact as existing permitted uses on the property.

PROFFERED CONDITION
(April 5, 2019)
Note: The Planning Commission and staff recommend acceptance of the following proffered
condition, as offered by the applicant.
The applicant hereby proffers the following, amending Proffered Condition 3 of Case 84SN0111:
In addition to those uses permit by Proffered Condition 3 of Case 84SN0111, a tow lot, to
include automobiles, motor vehicles and tractor trailers, shall be permitted subject to the
following restrictions:
1.a maximum of one facility shall be permitted;
2.use shall be limited to a maximum of 3.3 acres, located on the property as generally
depicted on the plan

3.use shall be screened from view of Deerhill Road in accordance with Ordinance
requirements. (P)
(Staff Note: This proffered condition amends Condition 3 for the request property only. Except
as amended herein, all previous conditions of Case 84SN0111 shall remain in effect.)
