Clover Hill Magisterial District North line of Hull Street Road REQiTEST: Amendment to Conditional Use (Case 91SN0286) relative to square footage limitations for the shopping center. PROPOSED LAND USE: Commercial uses are planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL. STAFF RECOMMENDATION Recommend approval for the following reason: The proposed amendment conforms to the Upper Swift Creek Plan which suggests the property is appropriate for neighborhood commercial uses, to include shopping center development, as part of a neighborhood mixed use node. (NOTE: CONDITIONS MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. CONDITIONS WITH ONLY A "CPC" ARE ADDITIONAL CONDITIONS RECOMMENDED BY THE PLANNING COMMISSION.) Providing a FIRST CHOICE community through excellence in public service GENERAL INFORMATION Location: East line of Harbour View Court, west line of Bayside Lane and north line of Hull Street Road. Land Use: North, East and west — C-3 with Conditional Use; Commercial, office or vacant South --C-2, C-3, 0-2 and A; Commercial, public/semi-public or single family residential • T TlT1TT TTlTT1 r'J This request will not impact the public water and wastewater systems. The existing shopping center is connected to the public water and wastewater systems and connection will be required for any future stores constructed on -site. ENVIRONMENTAL This request will have no impact on these facilities. PUBLIC FACILITIES This request will have no impact on these facilities. LAND USE Comprehensive Plan: Lies within the boundaries of the Upper Swift Creek Plan which suggests the property is appropriate for neighborhood commercial uses, to include shopping centers, as part of a neighborhood mixed use node located at the northwest quadrant of the intersection of Hull Street Road and Harbour Pointe Parkway. Such nodes should cover between twenty 2 06SN0112-FEB22-BOS (20) and forty (40) acres and include 100,000 to 250,000 square feet of office and commercial space. The Uuner Swift Creek Plan is being amended. The draft Plan, as recommended by the Planning Department, suggests the property is appropriate for community mixed use which includes shopping center development. Area Development Trends: Surrounding .properties include commercial outparcels along the north line of Hull Street Road, with office uses transitioning to the east and west of the subject shopping center. Property to the north of the center is currently vacant and permits office/multifamily uses as part of this mixed use development. Zoning Histom On December 11, 1991 , the Board of Supervisors, upon a favorable recommendation by the Planning Commission, approved a rezoning to Community Business (C-3) with Conditional Use to permit shopping center, multi -family residential and townhouse residential uses (Case 91 SN0286). This case limited the square footage of the now developed Harbour Pointe Village shopping center to 127,500 gross square feet (Proffered Condition 2.a). with approval of this request, the square footage limitations will be eliminated. CONCLUSION The proposed amendment conforms to the Uvver Swift Creek Plan which suggests the property is appropriate for neighborhood commercial uses, to include shopping center development, as part of a neighborhood mixed use node. Given these considerations, approval of this request is recommended. CASE HISTORY Planning Commission Meeting (1/17/06): The applicant accepted the recommendation. There was no opposition present. On motion of Mr. Gulley, seconded by Mr. Litton, the Commission recommended approval.
