Amendment to Conditional Use Planned Development (Case 878016) to permit an automobile service station and to delete the condition requiring use of public water and sewer. PROPOSED LAND USE: An unmanned automobile service station is planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL SUBJECT TO THE CONDITION ON PAGE 2. AYES: MESSRS. WILSON, GECKER, GULLEY AND LITTON. ABSENT: MR. BASS. STAFF RECOMMENDATION Recommend approval for the following reason: The Powhite Route 288 Development Area Plan suggests the property is appropriate for light industrial use. This use will serve the industrial uses within the industrial area. (NOTE: CONDITION~ MAY BE IMPOSED OR THE PROPERTY OWNER(S) MAY PROFFER CONDITIONS. THE CONDITIONS NOTED WITH "STAFF/CPC" WERE AGREED UPON BY BOTH STAFF AND THE COMMISSION. CONDITIONS WITH ONLY A "STAFF" ARE RECOMMENDED SOLELY BY STAFF. GENERAL INFORMATION Location: West line of Oak Lake Boulevard, south of Oak Lake Court.. Tax ID 735-690-6552 (Sheet 10). Existing Zoning: I-I with Conditional Use Planned Development Size: 1.1 acres Existing Land Use: Vacant Adiacent Zoning and Land Use: North, South, East and West - 1-1 with Conditional Use Planned Development; Industrial or vacant UTILITIES Public water and wastewater lines extend along Oak Lake Boulevard and Spectrim Lane, adjacent to this site. The umnanned facility will not require connection to the public utilities. ENVIRONMENTAL AND PUBLIC FACILITIES This request will have no impact on these facilities. 2 06SN0167-lvLAR8-BOS LAND USE Comprehensive Plan: Lies within the boundaries of the Powhite Route 288 Development Area Plan which suggests the prop~rty is appropriate light industrial use. Area Development Trends: The area i~ characterized by industrial uses within the Oak Lake Business Park, with adjacent property to the north, east and west developed for industrial uses. The adjacent parcel to the north, while in the park, remains vacant. Industrial development is expected to continue in this area, as suggested by the Plan. Zoning Historv: On July 22, 1987, the Board of Supervisors, upon a favorable recommendation from the Planning Commission, approved rezoning with Conditional Use Planned Development on the subject and surrounding property (Case 878016). Industrial and limited ~ommer~ial uses were approved, which resulted in the development of the Oak Lake Business Park. An automobile service station was not a permitted use. Uses: As previously noted, conunercial uses are allowed on the site and surrounding prop~rty as a result of the approval of Case 878016. An automobile servic.e station is not permitted. The proposal, as submitted would only allow such facility if it is an unmanned facility. Development Standards: Conditions of zoning approval for Case 878016 address development standards for this property, and would apply should this request be approved. In addition, requirements of the Zoning Ordinance would be applicable, where not covered by zoning conditions. CONCLUSION The Powhite Route 288 Development Area Plan suggests the property is .appropriate for light industrial use. The unmanned automobile service station will provide a service to the industrial uses within the industrial park. Given this consideration, approval of this request is recommended. 3 06SN0167-:MAR8-BOS CASE HISTORY Applicant (2/7/06): The request for relief to the requirement to connect to public utilities was withdrawn. Planning Commission Meeting (2/21/06): The applicant accepted staff s recommendation. There was no opposition present. The Commission acknowledged the withdrawal of the request for relief to the connection requirement to public utilities. On motion of Mr. Gulley, seconded by Mr. Litton, the Commission recommended approval subject to the Condition on page 2. AYES: Messrs. Wilson, Gecker, Gulley and Litton. ABSENT: Mr. Bass. The Board of Supervisors, on Wednesday, March 8, 2006, beginning at 7:00 p.m., will take under consideration this request. 4 06SN0167 -:MAR8-BOS Stemmle Enterprises LLC Amended Textual Statement The CUPD approved as part of case 878016 is hereby amended as follows: 1. The following new condition is added: In addition to those uses previously authorized under Case 878016, an automobile service station shall also be permitted on the subject property.
