REQUEST: Rezoning from Community Business (C-3) with Conditional Use Planned
Development to Community Business (C-3).
PROPOSED LAND USE:

permitted.

STAFF RECOMMENDATION
Recommend approval for the following reasons:
A. The proposed zoning and land uses conform to the Eastern Midlothian Plan which
suggests the property is appropriate for a mixture of community-scale uses.
B. The proposed zoning and land uses are representative of and compatible with
existing and anticipated area development.

GENERAL INFORMATION
Location:
North line of Midlothian Turnpike, west line of North Providence Road and better known as
8220 Midlothian Turnpike. Tax ID 758-706-9917 (Sheet 7).

C-3 with Conditional Use Planned Development

2.2 acres

Commercial (former Piccadilly Cafeteria)

UTILITIES
Public Water System:
There is an existing sixteen (16) inch water line extending along the north side of
Midlothian Turnpike, adjacent to this site,. The existing structure is connected t6 the public
water system. Use of public water is required by County Code.
Public Wastewater System:
There is an existing eight (8) inch wastewater collector line extending along the north side of
Midlothian Turnpike and along North Providence Road, adjacent to this site. The existing
structure is connected to the public wastewater system. Use of the public wastewater system
is required by County Code. The remaining capacity in the existing wastewater line has
not been determined.

This development will have minimal impact on these facilities.
PUBLIC FACILITIES
Fire Service: .
Buford Road Fire Station, Company Number 9, and Forest View Rescue Squad currently
provide fire protecti~n and emergency medical service. This development will have a
minimal impact fire and EMS.
Transportation:
This development will have minimal impact on these facilities.
LAND USE
Comprehensive Plan:
Lies within the boundaries of the Eastern Midlothian Plan which suggests the property is
appropriate for a mixture of community-scale (C-3) uses~
Area Development Trends:
Area properties are zoned Community Business (C-3) and General Business (C-5) and are
occupied by commercial uses of various intensities. It is anticipated that this area. of
Midlothian Turnpike will continue to experience redevelopment that is both consistent with
the Eastern .Midlothian Area Plan and encouraged through the flexible design criteria
est,ablished in the Zoning Ordinance for Post Development Areas.
Zoning History:
On May 27, 1981, the Board of Supervisors, upon a favorable recommendation by the
Commission"approved a rezoning from Light Industrial (M-I) to Community 'Business (B-
2) with 'Conditional Use Planned Development to permit setback exceptions on the. 5.2 acre
tract (Case. 81S034). Uses were limited to those permitted in the B-2 District, with the
exception of automobile service stations and repair services. The proposed motor vehicle
wash was first permitted in the General Business (B-3) District.
On May 26, 1982, the Board of Supervisors approved an amendment to Case 818034
regarding signage on the subject property. (Case 838079),

Site Design:
The request property lies within a Post Development Area. New construction or
redevelopment of the site must conform to the requirements of the Zoning Ordinance which
address access, p':lfking, landscaping, architectural treatme~t, setbacks, signs, pedestrian
access, utilities and screening of dumpsters, loading areas and outside storage.
CONCLUSION
The proposed zoning and land uses conform to the Eastern Midlothian Plan which suggests the
property is appropriate for a mixture of community-scale (C-3) uses. In addition, the proposed
zoning and land uses are representative of, and compatible with, existing and anticipated area
development.
Given these considerations, approval of this request is recommended.
