REQUEST: Conditional Use to permit outdoor recreational facilities for boat slips and a
boat ramp in an Agricultural (A) District.
PROPOSED LAND USE:
Applicant plans to construct boat slips and a boat ramp for private use by
members of Cameron Farms and Riverscrest Associations. Unless, however,
so conditioned, the facility could be used by others with the property owners'
permission.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND DENIAL.
STAFF RECOMMENDATION
Recommend approval subjectto theapplicantaddressingtransportation impacts, as discussed
herein. This recommendation is made for the following reasons:
A. The recreational facilities provide an amenity that will enhance the overall
qual ity of area residential dev.elopment.
B. Riverview Drive and Riverview Court are dedicated, but unpaved County
rights-of-way. Vehicles accessing this fad Iity will necessitate travel along these
unimproved rights of way. These roads should be improved to State standards
and taken into the state system to relieve the County from any potential
maintenance responsibilities. The applicant has failed to commit to upgrading
these rights-of-way, as discussed herein.

Prior to utilizing this facility, the driveway shall be primed and double sealed
from its terminus at the Port Walthall Channel of the Appomattox River to a
point 151.5 feet from its intersection with Riverview Court. (EE)
(NOTE: Prior to utilizing this facility, site plans must be submitted for review
and approval.)

Site Design:
As discussed herein, a driveway has been constructed from unimproved Riverview
Court to the Port Walthall Channel of the Appomattox River. The applicant intends
to construct boat ramps and slips along the waterfront. Site plans must be submitted
to the County prior to any further construction or use of this facility. At the time of
site plan review, driveway width and number of parking spaces will be addressed.
Except in those areas recommended by Environmental Engineering to be primed and
double sealed, the driveways and parking areas will be require by the Zoning
Ordinance to be graveled.
Conclusions:
While boat slips and ramps would provide a valuable amenity that will enhance the
overall quality of the surrounding residential neighborhood, transportation impacts
have not been addressed. Therefore, approval of this request is recommended
subject to the applicant addressing the transportation impacts, as discussed herein.
CASE HISTORY
Planning Commission Meeting (8/17/93):
The Commission deferred this request for thirty (30) days.
Staff (8/18/93):
The applicant was advised in writing that any substantial changes should be
submitted no later than August 23, 1993, for consideration at the Commission's
September public hearing.
Staff (8/27/93):
To date, no new information has been received.
Planning Commission Meeting (9/21/93):
The applicant did not accept the recommendation. There was no opposition present.

Transportation:
Traffic generation information is not available for this use (boat slips and ramp),
therefore, it is difficult to anticipate traffic generation. Vehicles generated by this
development will be distributed along Enon Church Road which had a 1992 traffic
count of 2,712 average vehicles per day.
The applicant intends to operate a private recreational facility with a maximum
membership of ten (10). However, unless so conditioned, this zoning will not limit
the use of this facility. These boat slips and ramp could be opened to the general
public with unlimited use. Even if conditions were imposed, it would be virtually
impossible for staff to determine who uses the facility and the number of members.
Vehicles accessing this recreational facility from Enon Church Road must travel along
Riverview Drive and a part of Riverview Court. Riverview Drive and Riverview Court
are dedicated unpaved County rights of way which have not been upgraded to VDOT
standards.
In order to utilize County rights of way, a license agreement must be obtained from
the Board of Supervisors. Currently, three (3) property owners have obtained a
license from the County to construct a driveway within these rights of way to serve
their residential properties. Each property owner agreed to accept maintenance
responsibility of the common driveway to gain permission from the County to use the
right of way. In similar situations throughout the County, residents often request the
County to perform maintenance on the rights of way even though a "private
maintenance" agreement exists. The County has no funds budgeted for this type of
service. Prior to operation of this recreational facility, Riverview Drive and Riverview
Court should be paved and accepted by VDOT to relieve the County from any
maintenance responsibilities. Without a commitment to upgrade these roads, to State
Standards, the Transportation Department cannot support this request.
LAND USE
General Plan:
Lies within the boundaries of the Eastern Area Land Use and Transportation Plan,
which designates the area for residential use of 1.50 units per acre or less.
Area Develooment Trends:
The area surrounding the request site is characterized by agriculturally and
residentially zoned properties that have been subdivided but remain undeveloped.
The request property encompasses parts of vacant lots within the Cameron Farms
Subdivision.

Mr. Cunningham indicated that he was concerned if the request were approved, it
would put a burden on County citizens and taxpayers to bear the cost of upgrading
Riverview Drive and Riverview Court. He indicated that if the applicant would
commit to upgrade portions of the roads, he could support the proposed recreational
use.
On motion of Mr. Cunningham, seconded by Mr. Miller, the Commission
recommended denial of this request.
AYES: Messrs. Gulley, Cunningham, Marsh and Miller.
ABSENT: Mr. Easter.
The Board of Supervisors on Wednesday, October 27, 1993, beginning at 7:00 p.m., will
take under consideration this request.
