The applicant proposes to construct a roof over an existing patio located off the rear of dwelling.
Considered a structure open on three sides, the covered patio requires a 15 -foot setback from the
rear property line. The applicants' patio currently sits 10.8 feet from the rear property line,
necessitating a 4.2 -foot setback exception. (Exhibit A)
ADDENDUM
The purpose of this Addendum is to modify the setback exception requested based upon
Attachment 3. Specifically, the proposed covered patio would extend 17 feet to the rear of the
dwelling, inclusive of supporting posts and eave. The measurement originally provided by the
applicant accounted for the existing concrete patio only, extending 14.5 feet to the rear of the
dwelling (Attachment 2). As such, the setback exception required to accommodate the roof is 6.7
feet rather than 4.2 feet.
Staff continues to recommend approval as outlined below.

Proposal
A concrete patio is currently located adjacent to the rear of the dwelling, extending to within
10.8 feet from the rear lot line (Exhibit A). The applicants propose to construct a roof with
supporting posts over this patio, which measures 15 feet x 40 feet(Exhibit B). The Zoning
Ordinance requires a minimum 25-foot rear yard setback for buildings in an R-12 District.
When open on three sides, additions may encroach up to 10 feet into this required setback. As
such, the covered porch would require a minimum 15-foot setback from the rear lot line. Given
the location of the existing patio, a 4.2-foot exception to this 15-foot setback is requested.
In evaluating this exception, staff notes that while the Ordinance would typically require a front
yard dwelling setback of 35 feet, a recorded front yard building line increases this minimum
setback to approximately 47 feet to meet lot width requirements. This larger front setback
results in a minimum rear yard provision of 25 feet in depth. Further, the lot directly behind
this property is currently vacant, permitting flexibility in the placement of a future dwelling in
relation to the subject lot. The applicant plans to provide landscaping along this rear (western)
property line to minimize the visual impact of the covered porch encroachment from this
adjacent property.

CONDITIONS
Note: The following conditions are recommended by the Planning Commission and staff.
1.Setbacks. This setback exception is limited to a covered porch, in a location as depicted
on Exhibit A (concrete patio).(P)
2.Screening.Prior to the issuance of a building permit for the covered porch, a planting
plan shall be submitted to minimize the visual impact of this setback reduction on
property to the west (Tax ID 726-661-8567). This planting plan shall be approved by the
Planning Department approval, along with a timing commitment for installation.(P)
(Staff Note: Any plantings located within the 8-foot rear easement may require
obtaining a License Agreement from the county.)
