REQUEST: Appeal of Planning Commission's Substantial Accord Determination to permit a
150 foot communications tower. Title 15.1-456 of the Code of Viriinia (1950)
requires that the proposal must be determined to be substantially in accord with the
County I s Comprehensive Plan. This application was submitted in conjunction with
Conditional Use, Case 97SN0224.
PLANNING COMMISSION RECOMMENDATION
DENIED.
STAFF RECOMMENDATION
Recommend that the Board uphold the Planning Commission's determination for the following
reasons:
A. The proposed tower, in the requested location, does not conform to the locational
criteria of the Public Facilities Plan which suggests that communications towers
should generally be located away from existing or planned residential areas.
Specifically, the request property is located near an established residential
neighborhood of single family residences in Hening Heights Subdivision.
B. Given the location, topography and denuded condition of the request property and
surrounding area, the site is highly visible to the Chippenham Parkway/Iron Bridge
Road interchange. Consistent with the Publi~ Facilities Plan and the Guidelines
for Planning Commission Review of Substantial Accord Determinations, the tower
should be located so as to reduce its visibility from these two (2) arterials.

Staff (5/21/97):
The applicant was advised in writing that any significant new or revised information must
be submitted no later than May 27, 1997, for consideration at the June public hearing.
The applicant was also advised that a $50,00 deferral fee was due,
Staff (5/28/97):
To date, no new information, has been submitted nor has the $50.00 deferral fee been
paid.
Applicant (6/6/97):
The $50,00 deferral fee was paid.
Planning Commission Meeting (6/l7/97):
The applicant did not accept the recommendation. There was opposition present. Concern
was expressed that the site does not comply with the Commission's policy relative to the
appropriate locations for towers.
Mr. Miller indicated that the site does not comply with the adopted :elans.; that the tower
would be highly visible; that the site is located in a residential area; and that the site does
not conform to the Commission's policies relative to the appropriate location for towers.
On motion of Mr, Miller, seconded by Mr. Shewmake, the Commission did not fmd the
use to be in Substantial Accord with the Comprehensive Plan.
AYES: Unanimous.

The applicant appealed the Commission's determination to the Board of Supervisors,
The Board of Supervisors, on Wednesday, July 23, 1997, beginning at 7:00 p.m., will take under
consideration this request.
