PROPOSED LAND USE: A 150 foot communications tower and associated improvements are planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND DENIAL. STAFF RECOMMENDA nON Recommend denial for the following reasons: A. The proposed tower, in the requested location, does not conform to the locational criteria of the Public Facilities Plan which suggests that communications towers should generally be located away from existing or planned residential areas. Specifically, the request property is located near an established neighborhood of single family residences in Hening Heights Subdivision. B. Given the location, topography and denuded condition of this request property and surrounding area, the site is highly visible to the Chippenham Parkway fIron Bridge Road interchange. Consistent with the Public Facilities Plan and the Guidelines for Planning Commission Review of Zoning Approval, the tower should be located so as to reduce its visibility from these two (2) heavily traveled major County arterials. PUBLIC FACILITIES Fire Service: This request will have no impact on these facilities. County Communications: A preliminary review of this tower proposal has indicated that the facility will not interfere with the County I s communication system; however, as a further precaution, if this request is approved, a condition should be imposed to ensure that the tower is designed and constructed so as not to interfere with the Chesterfield County Public Safety Trunked System. Once the tower is in operation, if interference occurs, the ownerfdeveloper should be required to correct any problems. County Aiqmrt: A preliminary review of this tower proposal has indicated that the facility will not interfere with the operation of the County Airport; however, as a further precaution, if this request is approved, any necessary FAA approvals for this facility should be obtained prior to the release of a building permit. Transportation: The proposed tower and associated equipment will have a minimal impact on the existing transportation network. LAND USE Comprehensive Plan: Lies within the boundaries of the Central Area PlaJl which suggests the property and surrounding area are appropriate for residential use of 2.51 to 4,0 units per acre. Area Development Trends: The request property is located in an area characterized by single family residences on acreage parcels and in Hening Heights Subdivision to the south and church and civic uses on agricultural parcels to the north and west. The property is bounded on the east and northeast by the Chippenham Parkway right-of-way. CASE HISTORY Planning Commission Meeting (5f20f97): At the request of the applicant, the Commission deferred this case for sixty (60) days, Staff (5/21/97): The applicant was advised in writing that any significant new or revised information must be submitted no later than May 27, 1997, for consideration at the June public hearing. The applicant was also advised that a $50,00 deferral fee was due. Staff (5/28f97): To date, no new information, has been submitted nor has the $50.00 deferral fee been paid, Applicant (6f6f97): The $50.00 deferral fee was paid. Planning Commission Meeting (6fI7f97): The applicant did not accept the recommendation. There was opposition present.
