REQUEST: (Amended) Amendment to a previously granted rezoning (Case 67-85) to delete
a requirement that there be no exterior merchandising in a Community Business
(C-3) District. Specifically, with the approval of Case 67-85 a restriction was
placed on the property prohibiting exterior merchandising. The applicant wishes
to be allowed to provide for the outside display and sales of merchandise, as
accessory to a permitted use.
PROPOSED LAND USE:
Continuous outside display of merchandise for sale, in conjunction with an existing
retail facility is planned.
PLANNING COMMISSION RECOMMENDATION
RECOMMEND APPROVAL.
STAFF RECOMMENDA nON
Recommend approval for the following reasons:
A. The requested use is representative of and compatible with existing and anticipated
area commercial development.
B. The development standards of the Zoning Ordinance address standards for outside
display of merchandise. These standards assure provision of adequate
pedestrianways and limit the amount of outside display. Specifically, the Zoning
Ordinance allows continuous outside display in Community Business (C-3)
Districts, subject to restrictions on the location and size of display areas and the
provision of unobstructed pedestrian access. Outside display areas on the request
property would be subject to these restrictions.

Area Development Trends:
Area properties to the north and east are zoned and developed for commercial uses.
Properties to the south and west are zoned and developed for single-family residential
uses.
Zonin~ History:
On December 13, 1967, the Board of Supervisors, upon a favorable recommendation from
the Planning Commission, approved rezoning from Residential (R-1) to General
Commercial (C-2) on the northernmost portion of the request property (Case 67-85). Due
to concerns from area property owners, with the approval of Case 67-85 a restriction was
placed on the property prohibiting exterior merchandising.
On April 10, 1968, the Board of Supervisors approved rezoning from Residential (R-1)
to General Business (C-2) on the part of the property located to the southwest of the
request property (Case 68-23). With the approval of Case 68-23, a prohibition on exterior
merchandising, similar to that imposed with the approval of Case 67-85, was imposed on
the property that was subject of Case 68-23. The applicant does not plan to allow exterior
merchandising on this portion of the shopping center and has withdrawn this property from
the request.
On July 25, 1979, the Board of Supervisors approved rezoning from Agricultural (A) to
Community Business (B-2) on the portion of the property located to the south of the
request property, subject to provision of buffers along the eastern and western property
boundaries (Case 79S103).
Site Desi~n:
The request property lies within a Post Development Area. Redevelopment of the site or
new construction must conform to the development standards of the Zoning Ordinance
which address access, parking, landscaping, architectural treatment, setbacks, signs,
buffers, utilities, and screening of dumpsters and loading areas.
Continuous outside display of merchandise for sale is allowed as a restricted use in a C-3
District, provided that:
· merchandise is located under a covered pedestrian way that does not exceed
sixteen (16) feet in width;
· no more than five (5) percent of the gross floor area of the principal use is
used for outside display purposes; and
