Midlothian Magisterial District
Summary of Information:
Mr. Ramsey received the attached letter from Mr. Barber resigning his
position as supervisor from the Midlothian magisterial district effective
July 9, 2006. The Board should vote to accept Mr. Barber's resignation.

As cvents have unfolded over the past scvr:n months, each and every decision required of
me has been made with the love, support and inclusion of my family and close friends.
Many ofthe:;e decisior.s have heen puinful to !:lll. but they have been neec:s~. I
understand that at this poi.1\t it docs not matter why r chose to plead to misdemeanors,
reduced from the felony char~s I vigorously contested. The:: filet that my family rould
not risk even a remote possibility of my set\."ing time in pri~on does not cliange the
reaction to the reduced, misdemeanor convictions. By putting my family needs first, I
have compromised my ability to smve the citizens ofMidlothian.
After spending a few days out of town with my family and mends, I have decided that it
is best that 1 tender:my resignation from the Board of Supervisors effective July 9. 2006.
It is my undcr5tanding this date would allow the citil:ens of the Midlothian Dj~irict the
opportunity to elect its next representative to the Board this November.
It has been II pleasure serving Midlothian.'s constituents over the past fo'!.lrta:n years. No
pe!'llOl1 can be mora disappointed and soay than 1 that my service will be concluded .in
. this manner, but I believe this is what is best for my family, the Midlotman District and
Chesterfield County.

Discussion of Process for Appointment of a Midlothian District Supervisor
Replacement
Summary of Information:
The Board appointment to replace Mr. Barber will serve until the election
resul ts are certified for the special election for Midlothian District
Supervisors to be held on November 7, 2007. The interim replacement must
receive three votes from the remaining four Board members and the appointment
requires separate meetings to nominate and then appoint unless the Board
suspends its rules to nominate and appoint at the same meeting.
There is no legally required process for making the decision to appoint a
supervisor. In the past the Board has followed a variety of practices when
appointing replacements for both Supervisor and School Board member.

The County Administrator recommends that the Board adopt the following
process for appointing an interim supervisor from the Midlothian Magisterial
District.
July 7:
Board announces that it will accept applications for
appointment as Midlothian District Supervisor from qualified
voters in the Midlothian District until 5:00 p.m. on July 14th.
The application should include a resume, a statement of
reasons why the person desires the appointment and any
expressions of written support from citizens. The
administration will advertise the deadline for applications.
The Board will adjourn to July 20th at 7:00 p.m.
July 20:
The Board will hold a special meeting to consider the
applicants. Each applicant will have ___ minutes to explain
to the Board his/her reasons for wanting to be appointed
Supervisor. The board members will then have minutes to
ask questions of that candidate. The candidates will be
questioned in the order in which their applications were
received by the clerk. Only candidates who appear before the
Board will be eligible for appointment. Board members may
then individually contact applicants prior to appointment.
July 26:
The Board will suspend its rules to nominate and appoint a
replacement for the Midlothian District supervisor.
