Chalkley Horace L. Chalkley, Chairman, being absent, the Executive Secretary asked for noniaations for election of a temporary chairman, oh motion, John B. \iatkins,Jr., was duly elected Chairman Pro Tempore. Dance, Treasurer, submitted to the'Board his report of the expenses incurred in the operation 'and maintenance of his office during the month 0 October,1938, showing a total of $825.69, ot which two-thirds, or $650.46, is pay- able by the County and the remainder is payable by the State; And the Board approv ins s~e, a warrant was acoordingly issued to the said J. \hn. Dance for $560.46, as listed on a preceding page, for the County's proportionate part; and the said repor is filed. This day, R. ~. ~nes, Cotuniasioner of Revenue, submitted to the Board his re- port at expenses incurred in the operation and maintenance of his oftice for the month of October, 1938, showing a total of $596.33, of which two-thirds, or $397.55 Ie payable by the County and the remainder is payable by the state: And the Board approving the said report a warrant was aooordingly issued to the said R. E. Eanes in the said sum of $397.55 in payment of the County's proportionate part, as listed on a preceding page; and the said peport is tiled. This day, lAlss Gr6Qe B. Pond, Committee Clerk for Ettrick Sanitary District No 1, submitted to the Board her report of water rents and sewer connections collected for by her during the month of October, 1938, together with her check in the amount of $390.90, in payment of the amount collected: And it is ordered that the Oounty Treasurer place the said sum at $390.90 to the credit of the Ettrick Sanitary Dis- trict No.1, on his books, and that the said report be tiled. This day, C. W. Smith, Chief of Police, presented to the Board seven (7) witness oertificates, representing fees allowed to the following polioe officers, who by agreement endorse the same for delivery to the County, viz.: . Council No. 20, Sons and Daughters of Liberty, representing rent due on the meeting 1/'1~J~~ hall in the Munioipal Building in Ettriok, for '\ihe months, July, August and Septem- 'I' ber, 1938, was presented to this Board and, on motion, the Oounty Treasurer is here by directed to accept the said check in the amount of Twenty-Five ($25.00) Dollars. And be it further resolved that the said sum be credited to the Ettrick Sanitary District Fund, on the books of the County Treasurer. To make regular entrie6 of all the board's resolutions and decisions or questions concerning the raising of money; and within five days after any order a levy is made, to deliver a copy thereof to the Commissioner of the Revenue of County. . Third. To record the vote of eaoh supervisor on any question submitted to the ~oard, it required by any member present. Fourth. To sign all warrants issued by the Board for the payment of money. and upon installation of the system being prepared by the Auditor of Public Accounts, to record the receipts and disbursements of the County Treasurer as contemplated QY sald system. I Fifth. To preserve and file all accounts.and papers acted upon by the Board, I with its aotion thereon; to preserve and file all accounts and papers acted on by tht Executive Secretary by authority of the Board of Supervisors, or otherwise. I Sixth. To make reoommendations to the board ooncerning any office or department' of the County government o~ employee under the control and supervision of the board. Seventh. To attend to the exeoution of and enforce all lawful resolutions and orders of the Board concerning any department, office or employee in the county I government, and to see that all laws of the State required to be enforced through thr Boar~of Supervisors or any county officer or employee subjeot to the control of the Board of Supervisors are faithfully exeouted, and when required by the Board, to make report to the Board how such orders, resolutions and laws have been executed. . Eighth. To confer with any person ooncerning the affairs of the oounty govern- ment and to make report to the Board of all such matters whereon the Board should take action. Ninth. To make any necessary reports to the Board in regard to matters of administration and upon installation of the new system by the Auditor of Public Accounts, keep the Board fully advised as to the financial oondition of the county. Tenth. To prepare and submit to the Board, in accordance with general law con- cerning county budgets, a proposed annual budget, with his recommendations. Eleventh. To audit all claims against the County, except those required to be received and audited by the county school board, to ascertain that suoh olaims are in aocordance with the purchase orders or contracts Of employment or in accordance with the law from which same arise; subject to suchexoeptions as are provided else- Where in theee resolutions, to present suoh claims to the BOard for approval and allowance after such audit; and to draw all warrants in settlement of such claims. Upon installation of the system being prepared by Auditor o~ Public Accounts,prepare and submit to the Board statements showing the progress and status of the affairs of the County at such times and in suoh form shall be required under the system referre to above. Twelfth. To act as purchasing agent with po\wr to transfer supplies, materials and equipment between departments, officers and employees and to sell surplus suppli s materials and equipment, to set standards for such purchases with ppwer to reject such as do not eOnform. However, any purchases, sales or transfers involving supplies, materials or equipment fmr any department not directly under this Board shall be of such qualitie' and other specifications as are speoified by suoh other departments. All purchases, sales and transfers shall be made in accordance with the system being prepared by the Auditor Of Public Accounts after it is installed. Competitive bids must be secured in every instanoe in which it appears to the County's best interest, with authority to the Exeoutive Seoretary to waive suoh requirements if so the Executive Seoretary circumstanoes justify waive~ and amount involved does not exceed One llundred Dollars, but in evey instance in which the amount is in excess of One Hundred Dollars bids shall be had, and if practicable, sealed bids not less than three in number, and be opened by the Executive Secretary. Thirteen. (a) To pay with his warrants all claims chargeable against the genera county fund where the claim arose out of purchase or contraot negotiated by Executi~ Se.c re tary . (b) To pay with his \varrants as soon after the first of each month as is practicable, except his own which must be specifically approved by the Board each month,~all walaries, compensations, allo\wances and mileage to officers ~nd employees which have been fixed by this Board, the State Compensation Board or by law, and 1s then due,~he aggregate of such ite~s to be so paid in any one month not to exceed $5,000.00 (c) To pay with his warrants as soon as is practicable all routine or standard claims against the county incident to the usual operation of the county government, the aggregate of such claims to be so paid in anyone month not to ex- ceed $3,500.00 To use as his warrant the following form:- (Seal) The County Treasurer Will Pay Chesterfield, C.H.Va. 193 Dollars$, To the Order Of~ "It To MECHANICS loND l.l:ERClIANTS BANK RICID101ID, VIRGD!IA 68 5 Executive Secretary of Board of Supervisor reasurer. ...~.... For Account of County Fund In Settlement of To furnish the County Treasurer as soon as practicable certified copies of this resolution as prescribed by the law. To have available at each regular monthly meeting all recrpt~d bills or vouche s he has been able to secure that represent claims he has paid under this section during the monthimoediately preceding in order that they may be inspected by the Board when desired and also be prepared to furnish full information regarding such claims as have been so paid, receipted bills or vouchers for which he has not yet procured. - I To furnish the Board at each regular monthly meeting \dth information covering the amounts paid during the immediately preceding month under (a), (b), and (c) above. Fourteenth. To hereafter record claims against the county in the minutes of this Board according to the following formula: - -... 1st. The list of claims shall be preceded by the general heads - "Claims agains the County which have been presented and paid by the Executive Secretary and approve , and Claims allowed by the Board of Supervisors: - 2nd. There shall be an underscored sub-heading reading"Salaries, Compensation, Allowances and Mileage paid by Executive Secretary, It and immediately there-under shall be listed all such items settled ~ince last report and the amount thereof shall be shown as a sub-total set out to the right of the column of individual item. 3rd. There shall be an underscored sub-heading reading "Routine Standard Claim Paid by Executive Secretarylf'lith such items listed a.nd sub-totaled as provided for in "2nd" above rela.ting to salaries, etc. - 4th. If there be such items paid, there shall be an underscored sub-heading reading, I1Claims Paid by Executive Secretary on Items Authorized by Executive Secretary," with such items listed and sub-totaled as in U2nd" and "3rd" above. 5th. Then shall follow, if there be such claims presented, an underscored sub- heading "Miscellaneous Claims allowed by Board and Chargeable to the General County Fundlf, with the itens listed and sub-totaled as in "2nd", and 3rd and 4th" above, followed by claims likewise listed, sub-totaled and separated as to special funds such as "Claims Approved by Board Against Bellmeade Sanitary District No.1 Fundtl, "Claims Approved by Board Against Do~ Tax Fund,"etc., with the "Total" of all claim paid and shown in right hand column. ~ And be it further resolved, that the Treasurer of Chesterfield County, Virgini be, and he hereby is, authorized empowered and jirected to accept and pay,all warrants of the Executive Secretary authorized in "Thirteenth (a) and (c)' above in the aggregate sum not exceeding $3,500.00 monthly, and to accept and pay all warren s of the Executive Secretary authorized "Thirteenth (b)" Above in the aggregate sum .. This day there was presented by E. S. H. Greene, Superintendent of Schools, a I resolution of the County School Board of Chesterfield County resolving that it wouldi cooperate with the Board of Supervisors in instituting a central accounting system : in the Treasurer's office, reserving, however, to itself the authority to purchase i all supplies for the County school system, and the said resolution is ordered to be I filed. I The Superintendent of Schools, E. S. H. Greene, advised this Board of the countf School Board's willingness to connect its school water system in Bellmeade Sanitary: IDistrict with that of said Sanitary District. ! 1 " On motion of G. H. Diggs, it is resolved that this Board extend it's thanks to i the County School Board for it's willingness to cooperate in the matters of central accounting system and the water supply in Bellmeade Sanit~ry District. This day, at the request of ',/0. S. Coburn, the Executive Secretary, !Iessrs. Charles Uilhiser and Fred ii. vl1se, representing the Virginia Electric and Power Company, came before the Board and explained in detail the new "STREET iJID HIGH~iAY LIGHTING SERVICE" plan and the "MISCELLANEOUS LICHT AND Po\iER SERVICE" plan Which was the result of a survey of county-,vide street and highway lighting by the i $xecutive Secretary in conjunction with Messrs. lUlhiser and \/isej and it appearing to the Board that it is advantageous to the County to adopt the plan proposed for "STREET AND HIGlfvlAY l..IGHTlNG SERVICE" and "MISCELlJJIEOUS LIGHT AIID POI/ER SERVICEIt and having had the form of contract read to this Board and approved by the Attorney for the Commonwealth after stating that the Board in it's resolution accepting the proposed contract and authorizing the signing thereof, should include a provision that in the case of the annexation of any territory of the County, which is in the area served by the Virginia Electric and Power Company the County would be relieved of the responSibility of paying for any service rendered under the contract in t~ area so annexed from the County on and after the day of wlnexation:- Therefore, on motion of G. \1. Diggs, it is resolved that this Board enter into the contract this day, presented in connection ,d th the proposed "STREET AND HIGH- WAY LIGHTnm SERVICE" and "l.IISCELI...iiliEOUS LIGHT AND POI/ER SERVICE" plan, and J. B. i vmtkins, Jr., Chairman Pro Tem of this Board, and 11m. S. Coburn, Executive Secretary; to this Board be, and they are hereby, authorized and directed to execute the said I contract on behalf of this Board, the oontract, however, shall be of no force and I effect except and until the Virginia Electric and Power Company shall agree to the following verbage being made a part of the contract, viz: "It is understood and agreed by the parties to this contract that in case of the annexation of any territof'y of the County which is served by the Virginia Electric and Power Company under pay- ment for service in the area annexed from the County on and after the day of annexa-I tion". and upon the further condition "that the County will be permitted to purchasel Iservice elsewhere or by installation of it's own service plant in any area not i serviced by the Virginia Electric and Power Company. (d) For the operation of any lamp installed during a oontraot y-ear and no in operation for all of such oontraot y-ear, the rates and charges shall be determin ed on a pro rata basis at the yearly rates herein specified. 3. Additional Street Lights (a) The Company agrees that it will from time to time during the life at this agreement, furnish such street lights in addition to those specltied in "E%hib t A" referred to in Paragraph (a) of Part 2 here9f, on existing lighting circuits or extensions to the same as hereinafter provided for, together with the necessary poles, fixtures, wiring and apparatus, and will operate and maintain such additiona street lights at the same rate per lamp for the types and sizes hereinabove speci- fied, provided, however, the Company shall not be required to furnish or install additional lamps, poles, fixtures, wiring and apparatus, within one year next pro- ceeding the date of expiration of this agreement or any renewal thereof. ~ (b) The Company agrees that it will, at its own cost and expense, make suoh extensions to said strQet lighting system and erect and maintain such addition 1 street lights as may be desired by the County, provided, the Company-'s cost and ex- pense-of labor and material for each installation requested, inoluding extension Of its overhead lines,of circuits, and all poles, fixtures, wiring and apparatus, is not greater than three times the annual revenue to be derived by- the Company from eaoh suoh additional installation. Where such cost of said extension exceeds the ~ount ascertained as above, the excess shall be paid by the County to the Company, but any extension so construoted shall be the property of, and maintained and oper- ated by, the Company. . . I (c) The County agrees to furnish or assist in Obtaining, without cost to the Company, the necessary authority and right-of-way- satisfactory to the Company for the ereotion of anY pole or poles, wiring, fixtures, or other apparatus require , and to obtain the oonsent of or right from any property owner, where such consent 0 right is neoessary, for the location, maintenance, and operation thereof, together with the turther right to trim, out, and thereafter to keep olear all trees, limbs, undergrowth, or other obstruotions along said lines or adjaoent thereto, that may, in the Company's opinion, endanger or interfere with the proper and efficient operation of the same, and there Shall be no obligation upon the Company to make a such extension or extensions of lines until the necessar, authority, right-of-way 0 consent is so obtained by the Company and proper evidence thereof filed with the Company. Provided, however, where the Company- owns or oontrols a right-ot-way whic oould be used for such extension or extensions, then so muoh Of such right-of-way a may be used in supplying service under this agree~ent shall, so long as the Company may have the right to use the same, be used for' purposes of fulfilling this agree- ment, without cost to the County for suoh right-of-way. 4. Hours of Burning. The lamps to be furnished by the Company under this agreement for all night servioe shall burn under normal conditions, eaoh and every night during the year from dusk to dawn, or approximately four thousand (4,000) hours each year, duriDg the entire term of this agreement. 5. Outages (a) The County shall oause its police or other proper authorities to re- port to the Company, as promptly as possible, any and all lights that are out or no burning properly, and if the lights so reported shall not be repaired and relit as soon thereafter as praotioable, then the County may make a pro rata deduction at the rate of the oompensation provided for herein covering any substantial period of tim .during which any of the lamps shall faiL to burn. .An accurate account of such time shall be kept by the Company and by the County. Any difference between the two accounts shall be equitably adjusted. (b) The Company shall restore service with reasonable promptness after an interruption due to Acts of God, or pUblio enemy-, sleet, storms, or unavoidable aocidents or any other cause. 6. Modernization of Equipment In order that the County may be in a position to avail itself of the benefits of any and all improvements in eleotric lamps or fixtures during the lit-e of this agreement, it is agreed that the said County may, at any time from the date on whic this agreement shall become effective, require the Company to install, in lieu of the la.m;ps and/or fixtures at that time installed and in use, other lamps and/or fixtures whioh will not consume a greater amount of energy par hour of use; provide that, in the event of substitution Of suoh lamps and/or fixtures the County shall reimburse the Company the actual oos.t and expense to the Company oooasioned by such SUbstitution. PART 3 Miscellaneous Light and Power Service (a) The Company agrees that, throughout the Life of this agreement, it will supply to the 'County, and the County agrees tha t it will purchase from the Company, all electric energy required by the County for use by it in all publio buildings, water pumping station, or stations ~ow ovmed by hereafter construoted or aoquired by the County, and for all other use.s.. All such electric energy shall lIJe metered' by standard meters to be o'Wlled, furnished, and maintained by the Company. All wires. fixtures, lanps, and appliances used in suid building, shall be instulledt owned, maintained, and operated by the County at its oym cost and expense.. (b) The COlnl)all~r shall not bo oblig~tlrAto construct or ovm any line extension or other facilities to provide the County with such uiscellaneous li~ht and pavler service, the cost of which shall exceed three times the annual revenue reasonably to be expected by the Company fron any such extension. (c) It is agreed between the parties hereto that the Company shall chnrge and the Countv shall pay to the Coopany for all electrio energy furnished by the Company for miscellaneous li~ht and power service under Part 3 of this agreement at the rftte of two cents (2~) per kvlhr.
