On motion, the Board doth hereby approve the transfer of $1,804.20, to the Virginia Public Assistance ~'und from the General County Fund, by the County Treasurer, said transfer being made necessary by change in policy of the State Department of Public i/elfare. Diggs at this point stated that there was a matter he wished to bring ;-0 the attention of the Board in order that it could be reoorded in the minutes tor the benefit ot those present. their successors. and as he saw it, for the benefit ot Chesterfield County. His statement in substance follows: That it had been about ten years since the negotiations had taken place by the then Board ot Supervisors of the County to bring the DuPont Company to Chestertield and that the lapse of time, changes in the personnel of the Board. together with other things might have conspired to diIll the reoollection ot county officials as to the circumstances under which DuPont settled in Chesterfield. 'lberetore, as he had fairly recently had the opportunity to inquire carefully and thoroughly into the whole matter, he deemed it very lllUch worth while to refresh memories as to it and Illake a matter ot reoord. Mr. Diggs stated that Chesterfield's low rate of levy on machinery and tools had been in his lll1nd for a oonsiderable while and that even though he had been told in a general way that the Chestertield Board had lll8de an agreeIllent with the DuPont interests as to a low levy when negotiating with them, he thought the subjeot should be thoroughly explored before any inorease in the County's general levy. Consequently I when considering the budget tor the fiscal year 1939-1940 and the tax levies incident thereto, he was not satistied until he had inquired into the County's situation. regarding the original oommittment not legally binding, of course, on any Board subsequent to the one which had made the agreement. In consequence of the above, Ur.Diggs, stated that he requested Common\'iealth's Attorney M.A..Cogbill to accolllpany him, and upon engag8lllent with the local DuPont officials, he EIJld Mr. Cogbill had a oonference ot an hour and three quarters at the DuPont Plant the 29th of March with Messrs. _ Swensson, Creadick, l4iss1mer, and Therien. He stated that lIr. Swenason as spokesman for nu>ont was convinoingly clear in his knowledge of the negotiations which had induced the company to settle in Chesterfield and that it was clearlY eTident trom Mr. Swensson's stat~ents that one of the major matters ~. Swensson's predecessor"L1r. Shackleford, had taken pains to acquaf.b,t Mr. SWensson with when the latter C8llle to Chesterfield, was the promise of the County as to the levy on Illachinery and tools. Mr. Diggs f!urther stated that Mr. Swensson made it clear that while his COlllpany haG been definitely informed that the Board negotiating to have the DuPont Plant in Chestertield County could not bind any future Board, that he felt that intoned people of the County would have to agree with the opinion he and his associates held, which he was sure was also the opinion ot the .ont COlllpany itselt, that to increase the said levy would break the gentlemen's agreement under which his company'came to Chesterfield. Attar the conference with the DuPont interests, Mr. Diggs stated that he and l4r. Cogbill sought an interview with Mr. Charles C. Reed, tormer Il18IIlber 01' the Board, who Illore than anyone else was to be acoredited with bringiDg the DUPont Industry to the County. .J4:r. Reed very feelingly stated that on account ot his continued interest in Chesterfield that he would be glad to recite the oircumstances under whioh the agreement was lll8de and his lbpinion as to what continued to be best in that connection tor the County. Mr.Diggs stated that JIr. Reed ou tl1ned the circUlllStanc es completely which, incidentally, ooincided exactly with Mr. Bwensson's previOUS stabBents. Mr. Diggs stated that he thought it was hardly necessary to record in detail What Mr. Heed had stated but briefly put - Atter Chesterfield had lost the opportunity or bri~ the DuPont Plant to the County as a result of a decision of that oompany's offioials to a'oept the otter ot one of the three other oommunities negotiating tor the plant, that Mr. Reed oonoeived the idea of oftering DuPont suoa a low levy on maohinery and tools as to alD10st command a reconsideration and favorable decision, that he got together the Board ot Supervisors who were in oomple:be aooor4 with the exception that at least one Supervisor suggested no levy at all; a 10ct. rate was readily agreed upon, proposed to the DuPonts and accepted, trolll all of which, lIr. Diggs stated, was perfectly clear that it was not the usual case of being one or four bidders with Chesterfield being accepted without special committment, but to the contrary, it was a case in whioh after DUPont had decided to go else- where, that Chesterfield, at least its Board ot SUlBrvisors acting in th,e best interests ot the County, lll8da a competitive bid to get DuPont to reverse a decisi()n already made, whiCh properly put the county, in his judgment, 80 Ur. .1Jiggs, stated, thli.t it was a Illoral obligation not to increase.that levy rate. Reed then further pointed out the large revenues ooming directly frOIll DuPont to the County under the County's poliey ot levies as well as the handsome revenues coming to the county as an indirect result ot having the DUPont employees who had moved into the County, in Illany instances building their OVal homes. ~. Diggs further stated that he was in a rather unusual position in that he had approached the matter in the beliet that the leDy on Illachinery and tools should be inoreased and that it probably could be increased at this time without violence to any agreement because about ten years had elapsed and probably it could be well held that such an agreement was not expected to stand torever,but that he had cOIllpleted his canvass of the subject with the over- whelming conviction that while the Board is not legally bound, any increase in the machinery and tool levy now or hereafter would constitute a breaking of a moral obligation of the Board of Supervisors, that Vlould be so close akin to refusing to carry out a prolllise and a moral obligation made between gentlemen, it would not be in accord with the ideals of Chestertield's Board of Supervisors and Chesterfield's Citizens and Mr. Diggs stated that he offered his opinion for whatever it might be worth, in exact aocord with Mr. Heed's, that both on account ot that agreement and because it had brought DuPont with its great benetits to Chesterfield, the policy of levy should be maintained now and hereafter. ! ~~ Ordered that the Board be now adj ourned until July 5, 1959, at 10:00 A.M. -, ~ fl&:;;- /c/, t 04 J.I~ Chairman.
