01-18-1940 Minutes VIRGINIA: At a special meeting of the ~oard of Supervisors of Uhesterfield ~ounty, held at the ~ourthouse on uanuary 18, 1940, at 4:00 p.m. and in the l64th year of the vommonw~alth. .Present: H.L.vhalkley, Chairman p. ,i. ~ovington W.A..tiorner .n. Li..nening Absent: 'l'.lJ.\iatkins On motion of ii.A..tlorner, it is resolved that the terms and provisions of the ~oning Act as set forth in the Code of Virginia, lQ36, be, and the same are hereby adopted. Whereas, this Board has heretofore this day adopted the provisions of the .woning Act, and - I Whereas, it follows that this .!:Soard should appoint a Zoning "'ommissi'On as provided for in said Aotwithin a reasonable time, ~ow Therefore, on motion of H.~.Lioyne, it is resolved that the Chairman of this Board be,and he hereby is empowered and directed to appoint a uommittee to make recommendations as to the personnel for said ~oning ~ommission. ~ote: .Be it here noted that the uhaiI-man appointed w".A..t1orner, .P.lil~ovington and ti.~.~oy~, as such Uommittee. Vll.;ereas, this Board has heretofore thi s dya adopted tbe provisions of the Zoning law wherein it is empOwered, among other things, to zone the Count~of Chester field int. the several classifioations as is provided in said Zoning law, and ~ihereas, this Board desires that where anyaeotion in the County is pre- dominately residential to keep said section in that olassification, with suoh exce~t ions as may appear to be necessary in any given case, and, Whereas, a certain length of time will have to elapse before the zoning regulationa can be made effective and it appearing prpper to do so, this Board on motion of W.A.Horner, doth resolve that any person, form or oorporation who comtem- plated the immediate oonstruction of any building in any residential section which is predominately residential, be, and i~ and/or they are hereby respectfully request ed to refrain fram so doing until this .!:Soard oan ~ke 'proper and suttable regulation vdth suoh exceptions as may be found to-be neoessary and proper. Whereas, this Board of Supervisors, from a stu~ of the reports of the Clerk of the Trial Justice Court of Chesterfield County has been oaused to know that tho Commonwealth of Virginia contributes the sum of $600.00 to each County in this State, to assist in oarrying out the provisions of the Trial Justice~t, and >- - - - - - - - - -~ vVhereas, it appears that the Commonwealth of Virginia does not contribute a sufficient sum of money to this County to assist in carrying out of the 'provisions of the said Act, ' Now, Therefore, on motion of W.A.Horner, it is resolved that the Honorabl l~unedon Cary and the Honorable E.Floyd Yates, Representatives of this County in the General AssemblY, be, and tlzey are hereby respectfully requested to make a study of the conditions reoited in the preamble above, in Section 4gS7 of the ode and in the State Auditor's report 011 Trial Justice Courts and cause to be introduoed in the General Assembly a bill to more equitably contribute to the several oounties of this State in assisting the carrying out of the provisions of the Trial Justice Act. This day again in the matter of the annexation of certain territory in Chesterfield County by the town of olonial Heights came before this Board and upon the request, in writing, of ~.A.Co@~ill, Commonwealth'. Attorney, that this Board authorize the employment of an engineer, and accountant and such other professional assistance as he might require and this board authorize to assist him in the defense of said annexat:on proceedings. Upon consideration whereof and on motion of J.G. ~ning, it is resolved that the resolution heretofore adopted on July 5, 1939, direc _ iag the ~ommonwealthts Attorney to oppose the said annexation by the said town of Colonial tielghts be, and the same is hereby rescinded. And be it further resolved that M.A. Cogbill be and he hereby is direoted to make appearance in the annexation case brought by Uolonial heights ar.d do and p~rform such duties as the case may require in protection of the ~ountyas interest This day the ~xecutive Seoretary advised the Board of the request made by the American Tobacco Company for the ~otinty to improve 17th Street, between the Riohmond corporate limits at Jackson Avenue and Bruce Avenue. 1Jhereupon the Board doth on motion of li.A. horner, accept 17th Street in the subdivision of Powhatan ights, between uackson Avenue and Bruce Avenue, into the ~ounty road system. And be it further resolved that the American ~obacco vompany be, and it hereby is grante ermission to improve this street by such grading, draining and surdacing as it sees fit to do.
