the said report the same is filed.

Board his report of expenses incurred in the operation and maintenanoe of his dffio1e
for the month of July, 1940, showing a toral of $684.08, of which two-thirds or ,
$456.05, has been paid by the County, the remainder to be paid by the State, and I
the Board approving the same, the report is filed. '
This day, Marcus A.COgbill, Commonwealth Attorney, submitted to the Board I
his report for the month of July, 1940, showing expenses incurred in the operation I
and maintenance of his office, showing a total of $487.16, of whioh one~halt or i

This day a letter from the hone J. Edgar Hoover, .l.J5.rector of }ederal Investi-
gation, l/ashington, was called to the attention of the Board, concerning training
for National ~efense, and offering such training to police departments of this couhty.
And it appearing that it is proper for this Board to authorize the training of its
police department in such defense, it is resolved on motion of H. T. Goyne, that
C. ii. 0mith, Chief of Police, of this County be sent to the school conducted by the
Federal Bureau of Investigation in iiashington for such training. And be it further
resolved that the sum of ~50.00 be, anu the same is hereby appropriated to defray
expense of said G.... umith in attendance of such school.
Thi s day in accord.a}1ce with the Board's instructions nt a special meeting held
in this County on July 29, lfiJ40, the Commonwealth's Attorney presented to this Board
a draft of a zoning ordinance for the County of Chesterfield and upon consideration
whereof, and on motion of il. A. .l.J.orner, the said zoning ordinance as submi t ted by
the Commonwealth's Attorney be, and the same is hereby adopted, the same being in the
following words and figures, to-wit:
AN ORDINANCE.

Kstablishing zpning districts and zones in the County of Chesterfield,
Virginia, and regulating the use of lands therein; providing for the
enforcement of said regulations and compliance with terms of said ordinance;
providing for issuance of permits for the construction, conversion, erection,
or placement of buildings in said zonine d.istricts; providinE a method
whereby violation of this ordinance may be enjoined and providing a penalty
for violation of the terms of this ordinance.

Under and by virtue of the authority conferred upon the Board of Supervisors
of Chesterfield County, Virginia, by an Act of the General Assembly of
Virginia, approved March 2, 1938 and known as Chapter 55 of said Acts of
Assembly, this Board of Supervisors having carefully considered the matter)
doth subject to the approval of the Judge of the Circuit ~ourt of vhesterr
field ~ounty, Virginia, ordain as follows:
Sec. 1. That the County of Chesterfield be, and it hereby is, divided into zones
or districts, to be knoVln as resicience or non-residence zones or distriots.

Sec. 2. Non-residence districts shall comprize all lands which at the time this
ordinance goes into effect are used for any business or industry, and all lands
located and fronting upon any section of any street or road between two successive
intersecting streets or roads, when not less than one-half the ground floor front-
,age between such intersecting streets or roads is devoteci to any such business or
industry or is manifestly intended to be so used at the time this ordinance takes
effect. In computing such area the property already built upon shall be included.
Provided, however, the conduct of a farm, truck gardening, the growing of trees,
shrubs, vines, or plants, shall not, for the purpose of this ordinance be consDrued
as a conduct of a business or industry.
Sec. 3. Residence zones or districts wl,lch comprise all areas not included in non-
residence districts as defined in Sec. 2 of this ordinance.
Sec. 4. bxcept as hereinafter provided no parcel of land lying in a residence zone
or districb and not, at the 6ffective date of this ordinance, devoted toany busi~
ness or industry as defined in ~ec. 2 hereof, shall thereafter be used for business
or industry, and no per~it shall be issued for the erection, alteration or conver-
sation or placement of any building for or two such use upon any such parcel.
Sec. 5. ~ permit may be eranted and issued for the erection in a residance zone or
district of a building for the purpose of any business or industry or for the alte-
ration and conversion or placement of a building in such district for or to such
purposes, provided, that there be filed with the application for such parmi t wri tte,n
consent thereto signed and acknowledred by the owners or their Attorneys in Fact Of
not less than thr@@-fourths of all lands used for other than business or industriaL
purposes, which lie on the same side of the street or road with any residence
fronting thereon and between the two intersecting streets or roads nearest to and
on either side of the land to be so occupied or with 400 feet on either side thereof
where the nearest intersectinf' road or street is more than that distance and also'
of all lands fronting upon the opposite side of the street or road upon ~hich the
~and to be occupied is and within 4CO feet of a like area of sround where the nearest
lntersectinL street or road is more than 400 feet distant from said like plot of
ground, and af all lands immediately in the rear thereof and within 400 feet or the'j
street upon which the site to be occupied fronts where the street paralleling the
street upon which the site to be occupied fronts is more than '00 feet distant i
therefrom; provided, however, that where two or more buildings on anyone side of ~y
street or road between two intersecting streets or roads is or are used for busines~
purposes it shall only be necessary to secure in the above manner the consent of tj
owner or their attorneys in ~'act of two-thirds of the ground floor frontage on the
side of the street or road on which said properties so devoted to business purposesl
are lo~ated, and likewise of all lands fronting upon the opposite side of the stree~
or roau and likewise the oonsent of the owners of property lying immediately in thel
rear of the site to be oocupied, all within the distances herein above set out. I
Sec. 6. That the Comraissioner of the .1;. 'evenue of the County of Chesterfield is hereLy
conetitu.ed and designated the ~ent of this Board of Supervisors to issue the per-I
mits oontemplated in this ordinance. that said Commissioner shall not issue permit~
provided for herein or by any other law special or general until he shall be satisfred
that the construction, conversion, erection and plaoement of any building comes !
within the terms of this ordinance. ~hat said Commissioner of the Revenue shall nor
issue anv permit contemplated in this ordinance or by law special or general unless
and until the approval ot the Executive Secretary of hhis Board is had and endorsed
upon such permit. . i
Sec. 7. The ~xecutive Secretary of this Board is hereby designated as the Agent Of
this ooard for the purpose of enforcement of the terms of this ordinance and he is
hereby vested with all the powers of this Board as if the Board was acting in
meeting and by resolution. ~ch powers shall authorize him to institute proCeedingr
to enjoin any violation of this ordinance and he is heweby authorized to institute
such proceedings in the name of the Board of Supervisors of Chesterfield County, '
Virginia. The ~xecutive Seoretary is authorized, in his discretion, to employ a II
technical advisor when in his judgment the same is necessary to determine whether
the proposed construction, conversion, ereotion or placement is within the terms ofl
this ordinance.
Sec. 8. Any person, firm, company, corporation or association who shall willfUlly I
violate the terms of this ordinance by failing and or refusing to obtain the permitl
provided for herein before the oommencement of the construction, oonversion of plape~
ment of any building upon &ny plot of ground shall be deemed guilty of a miSdemeanOr
and upon a conviction therefor shall be punished by a fine not exceeding ~50.00.
And each day's continuance to prosecute the construction,erection, conversion or
placement of any building in violation of this ordinance shall be deemed guilty of ,
a separate offense and shall be prosecuted as such, provided, however, there shall I
be an appeal of right from any conviction for the violation of the terms of ~his f
ordinance. any prosecution had under this ordinance shall be before the Trial Just ce
Court of Chesterfield County and shall be conducted in the same manner and in the s e

stating that he was deolining to request an allotment for the improvement ot
46th Street between Reedy and Garland Avenues in Forest Hills Terraoe, as same.
appeared to serve only a few individuals. On motion of W.~Horner. the Exeoutive
Seoretary is directed to send a copy ot the aforesaid letters to Mr. Allen G.
Taylor, who is affected by this road, and the letter is tiled.
The Board having heretofore on ~y 20, 1940, laid a levy of three (3)
cents per hundred, the revenue from such levy to be used for road purposes as
set torth in Chapter 415~ Seotion 3, ot the 1932 Acts of the Virginia Assembly,
and it appearing to the Jjoard that the funds provided by said road levy must be
expended bn county roads or roads in the State Seoondary Road System by or under
the supervision of the Virginia Department of Highways, it is resolved on motion
of R.T.Goyne. that the Virginia Department of Highways be, and it is hereby
requested to improve such oounty or Secondary roads as, if and when requested by
this Board, the cost of same to be borne by the County.
It appearing to the Board that the paymeht of the conneotion charges
on a deferred payment plan to be helpful to some persons desiring water or service
c~ection to the water and sewer systems in the various sanitary districts, it is
therefore resolved on motion of W.A.Horner, that the owner of the property to
