Gates, health Officer, of Chesterfield County, advising this Board of the necessity for. controlling sanitation in respaurants and other public places serving neals. ~jhereupon it is resolved on motion of W. A. Horner that the need of an Ordinance regarding Food Establishments in Chesterfield County be, and it is hereby referred to the Ordinance Committee of this Board. This day came, John Guy and others being property owners in Chesterfield County along the James River, between the Viestham Bridge and Route d44 whero same enters Powhatan County and petitioned this Board to establish a new County road by extending the Cherokee Road &long the hi~~ ground until the same intersects Route ff44, near the Powhatan County Line and offered to furnish the right of way for the said proposed roadway. Upon consideration whereof and on motion of T. D. 1Jatkins, it is resolved th&t the petition be, and it is hereby received and filed i and the Virginia Departnent of Hif"hways be, and they are hereby requested to make survey of the proposed roau, without cost to the County, looking to the establishment of a road as a permanent location of Route ff44. I It appearing to the Bo.,.d that Newport Street, between Terminal ~venue and I Summerhill ..:-\.Venue' Terminal Avenue, between Berkley Street. and Newport. Street; I. and Sumnerhill Av~nue, between Berkley Street and Ne~iport I::ltreet, are papidly being populatea by the construction of new home s on, said streets, and said , .. I streets being in an unimproved state, therefore be ~ t resolved on motion of Vj. .ri.. I Horner, that Newport I::ltreet, between Terminal Avenue and Sunw~rhill Avenues; I Terminal Avenue, between Berkley Street and Newpo.rt Street; an..d Summerhill Avenue, between Berkley Street and Nev~ort Street, be, and they are hereby adopted into the County Road System. And be it further re solved that the Virginia Department of Hichways be, and they , are hereby requested to grade, drain and surface with local materials the aforesa~ streets, the co st of such improvements to be borne by the County. Broaddus, and the ComrQittee is continued. I I I I I ! I This day the attention of the Board was called to the sugfestion of Mr. J. Gordon II Bohannon, City Attorney, of Petersburg, that a Committee from this Board again confer with representatives of the City of Petersburg in an effort to make satisfactory settlement in the matter of a new rate for the purchase of domestic I water from the City of Petersburg by Chesterfield County for use in the Ettrick II Sanitary District ~l. v~hereupon it is resolved on motion of W. A. Horner, that the Chairman appoint a Committee from this Board with a Committee from this Board to confer with a Committee or authorized representatives of the City of i Petersburg in the matter of a rate for water purchased ~y Chesterfield County I' from the City of PeteYsburg. and be it further resolved that said Committee be, and it is hereby authorized and empowered to enter into agreement or contract with the said City of Petersburg for the purchase of water by Chesterfield County.; nnd be it further resolveQ that the Committee be and it hereby is directed to .1 investigate the cost of drilli~' a well and erecting a new tank and pipe lines for the purpose of obtaining a s~ply of water for the furnishing of same to the l!:ttrick Sanitary District and such other areas as may be feasible. ! And be it further resolved that the Corn.mittee in its effort to obtain a water sup-I ply by neans of drilling a well be and it hereby is authorized to employ R. Stuart' Royer in a technical capacity. Be it here noted that the Chairman appointed: P.',;. Covington, \..A. Horner and \;m. S. Coburn, as such Committee. This day the attention of the Board was brought to the offer of Mrs. Ella A. Deissner to seLl to ehe County a 50 ft. right of way through the property, adjacent to the Melrose Subdivision, for the extension of Highland Avenue, easterly from Second Street, for the sum of ~125.00. Upon consideration wherdofand on motion of \l. A. Horner, the Board doth hereby accept the offer of the said Mr's. Deissner and the Executive Secretary is authorized and directed to pay to the said l~s. Deissner the sum of $125.00 upon receipt of properly executed deed for a 50 ft. right of way, approximately 200 feet long, through the entire depth of said pro~erty, eastwardly from Second Street in the Melrose Subdivision. And be it further resolved that the sum of $125.00 be and it is hereby transferred from the General Fund's Unappropriated Surplus in the current budget, to "furchase of Rights-of-way - budgetary code 18-602. I This day, E.S.E. Greene, Supt. of Schools of Chesterfield County, presented a resoj- lution of the County School Board of Chesterfield County requesting this Board to I a..pprove a. temporary loan for ~12, 000.00 for the purpose of restoring to the Origil nal contract for the construction of a bigh School at Chester certain alternates which were nude in the revised contract of the construction of said High School. And the Supt. submitted to the Board a list of the alternates in said such constrlic- tion contract for consia.eration of this Board. I Upon consideration whereof, it is resolved on motion of T. D. ,:atkins, that the County School Board of Chesterfield County be, and it is hereby authorized to I restore to the original contract for the co.nstruction of Chester High School alte1- nates 5, 6, 10, 12, 15, 16, 17 and 18, as set out on the list of alternates filed with this B06rd's papers of today's nenting. On mot~on of T.D. "atkins, it ~s resolved that the County School Board of Chester~ fiela,County be an~ ~t hereby ~s requested to t~ke ne?essary proceedings to have in electIon for a bone ~ssue for the purpose of ra~sing ~200,OOO.OO for the ccnstruc tion of Chester and l:anchester Eigh Schools I On motion of H. T. Goyne, it is resolved that the voml'lonwealth's rlttorney be. and he hereby is requested to draw an Ordinance prohibiting the removal of milk bottles by companies or agents of such companies other than the actual owners of uch bottles. 'iJhereas, on December 27, 1 940, the Board of Supervi sors adop ted an Ordinance imposing a license tax on "automobile graveyards" and v'hereas, this Board is not satisfied with the definition of "automobile graveyard'" as defined by the Virginia State Legislature and ) ~lhereas, it is the desire of the Board to re~cind such Ordinance, Now, Therefore, be it Resolved on motion of Ii. A. liorner, that said "autonobile graveyard" Ordinance adopted on said day be and the same is hereby rescinded. This day the Board was advised of the offer of O.L.Landrum to make settlement in the matter of an easement across his pror:e rty in the Bellmeade Sanitary District for the construction and installation of an outfall sewer line for the sum of ;;PloO.OO. Upon consideration whereof, it is resolved on motion of Ii. A. Horner, that the aforesaid offer of the settlement by O.L.Laundrum be, and it is rejected . It appearing to the Board that during extrerle high water in the Appomatt~ River tlmt Campbell's Bridge on ~t. #36 is closed to public travel. And it further appearing to the Board that said Ca~pbellts Bridge restricts heavy truck travel; therefore, be it resolved on motion of P.W.Covington, that the Virginia Department of Highways be, and it is hereby requested to re-locate Route it36 by running eastwardly along the Appomatt~ River to the intersection of Route *1 at Dunn I::ltreet in the Town of Colonial He iVhts, provided rights of way for said relocat ion are donated. This day the Executive Secretary recommended to the Board the use of fluorescent lights in the lighting of the offices and buildings at the Courthouse. v[hereupon, it is resolved on motion of T.D. This day the ~xecutive Secretary read before the Board an order from the Circuit Court of this County directing the payment of $25.00 to J. Bagby Womble, Esq., Attorney at Law, in the defense of Eugafte Ellis when such services are rendered. On motion of H. T. Goyne, the Executive Secretary is authorized and directed to pay to J. Bagby Womble, Esq. the sum of $25.00 upon completion of services rendered in the defnese of Eugene Ellis in the Circuit Court of this County. ~d be it further resolved that the sum of $25.00 be, and it is hereby appropriated to "Compensation of Special Attorneys", budgetary coda 18-103a, from the unapprop- riated surplus of the General Fund. ' This day came A. M. Toler of A. 1':. Toler and "'ompany and presented his report of his audit to the Board, withcopies of each member' of the Board. On motion of W. A. Horner, the audit is received and filed. The claims of A.M.Toler and Uompany for auditing the records of the County, and the ~ocal \~lfare Department, aggregating ~700.00 was presented to the Board for approval and payment. On motionof ~i. A. Horner, the claim of $700.00 is ordered paid. And be it further resolved that the sum of $200.00 be, and it hereby is appropriated to "Audit of the County" - budgetary code 1a-201, from the Unappropriated SurplUS of the General Fund. This day D. Edgar Wooa, of the Village of Ettrick, requesting this Board to make the necessary appropriation for the purchase of rubber coats and boots for the use of the Volunteer Fire Dep~tment in line of duty. Whereupon, it is resolved on motion of p. IV. Covington, that the Executive Secretary be, and he is hereby authorized and directed to purchase t~ necessary rubber coats and boots for the volunteer fire department of the Village of Ettrick. And be it further resolved that the sum of $130.00 be and it hereby is appropriated from the Unappropriated Surplus of the ~ttrick Sanitary District Operating Fund for the purchase of boots and coats for the Volunteer Fire Department. On I21otion of 'lC. D. yvatkins, the compensation of the Executive Secretary to this Board is hereby incre~sed in the amount of $25.00 per month, etfective February 1, 1941. And be it further resolved that the sum ot $125.00 be, and it is hereby appropriated to "Compensation of Executive Secretary" in the current budget - budgetary code. A petition signed by thirty-odd residents of the Ettrick Sanitary pistrict com- plaining of the sanitary district tax imposed on all residents of the sanitary district, in which all residents are not served by water and sewer facilities, and requested this Board to or have the said sanitsry district tax eliminated on all properties not being served or accessible to have these facilities. The petition is received and filed and the Chairman appointed P. vi. Covington, Supervisor, and Wm. S. Coburn, Executive Secretary, as a Committee to make study of thi s matter and report back to this Board at its next regular meeting. ~he claim of H. A. HaWkins and Company for emergency repairs to the heating system of this Courthouse in the amount of $423.80 was read before the Board. On motion of H. T. Goyne, the said claim of H. A. Hawkins and Company, in the amount of $423.80 is hereby approved and ordered paid. On motion of T. D. 'viatkins, it is resolved that the owner and/or keeper of all dogs kept continuouslY in this County be, and they are hereby required under penalty, to keep such dogs oonfined to the premises where their home or place of keeping is, during the period April 1 to August 1, 1941, except while under the immediate control of such owner and/or keeper, as provided 60r by Statute.
