1941, showing a total of $1234.32, of which two-thirds or '822.88 has been paid
by the County, the remainder to be paid by the State, and the Board approving
the said report, the same is filed.

of expenses incurred in the operation and maintenance of his office for the month I
of March, 1941, showing a total of $733.33, of which two-thirds has been paid by !

This day, Marcus A. Cogbill, Commonwealth's Attorney, submitted to the Board his
report for the month of March, 1941, showing expenses incurred in the operation
and r~intenance of his office, showing a total of $458.32, of which one-half or
$229.16, has been paid by the County, the remainder to be paid by the State, and
the Board apprving the same, the report is filed.

This day the matter of the audit of records of the County, inclusive of the
Department of Public Welfare, came before the Board, and also came A. M.To1er,
of A. M.Toler and Company, Gertified Public Aocountants, and submitted his offer
to make such audit for the sum of '500.00 for the audit of the County and $175.00
for the audit of records of the Department of Public Welfare for the fisoal year
1940-'41. Upon consideration whereof and on motion of vi. A. Horner, it is
resolved that this Board employ A. M. Toler and Company to audit the reeords
of the County for the fiscal year 1940-'41 for the consideration of $500.00
and records of the Department of Publio ilelfare for the oonsideration of $175.00.
It is here noted that A. M. Tolar agrees to complete such audit by September 1,
1941.

This day there was presented to the Board a petttion of residents of Chesterfield I
County residing along the road known as the Dorsett Road. On !'lotion of W. A. I
Horner, it is reso+ved that the Virginia Depart~nt of Hi[hways be, and it is
hereby requested to hard-surface said Dorsett Road - .2 mile State Route #717. I

On motion of vi. a. Horner, the ~sident Engineer, Virginia Department of Highways,
p. w. ~nead, and the Exeoutive Secretary, W. H. Caldwell, are authori~ed and
directed to work out the mileage of roads to be taken into the County Road
System, and correct s~e to conform as nearly av possible to the propoaed list I
of March 11, 1941. And be it further resolved that the Executive Seoretary, be,
and he hereby is authorized to procure the minimum of thirty (30) feet of rights-

Chief Engineer, of the Virginia Department of Highways, acknowledging resolution
of this Board adopted December 10, 1940, requesting improvement on permanent
location of Rt. #10, and on motion, it is resolved that the said letter be and
the same is hereby filed with the papers of this Board.

Secondary System of highways for the fiscal year July 1, 1941 - June 30, 1942,
the State Highway Commission, and the same is read and filed.

On motion of H. T. Goyne, it is resolved that W. L. Broaddus of Hopewell, Virginia,:
be, and he is hereby requested to construct the road which is proposed in lieu i
of the Old Stage Coach Road, leading southwardly from Rt. #10 in Bermuda District.
On motion of h. T. Goyne, tre Com.monwe~lth' s Attorney, is requested to prepare
the proper deed for that portion of the road which is to replace the Old Stage
Coach Road, leading south from Rt. #10, such deed to be executed by A. T. Curtis
and H. T. Goyne and their consorts.

It appearing to the Board that a permit is now required from the Virginia Departmen~
of Health for the operation of the Baker Nutrition Camp, it is resolved on motion i
of H. T. Goyne that the Virginia Department of Health, be, and it is hereby I
requested to grant the Board of I::lupervisors of Chesterfield County, permission !
to operate the Baker Nutrition Camp for undernourished children for the period .
June 1, through September 15, 1941.
This day there was presented to the Board a deed from Jos. T. Moore and Flossie
M. Moore, conveying to the Cmunty of Chesterfield two strips of land for road
purposes; one being, a strip of land 40' wide extending northwardly from Old Mill
Road to Shelton Avenue, and the other being a strip of land 10' wide along Shelton
Avenue for the purpose of widening said Shelton Avenue.
Upon consideration whereof and on motion of Wi. A. Horner, it is resolved that said
deed be accepted and same is ordered to be recorded.
And be it further resolved that the said 40' road, so leading from the Old tlill
Road to Shelton fivenue and Shelton rlvenue inclusive of 10' conveyed in the deed
mentioned, be, and the same are hereby taken into the County Road System.

adoption of a "Noise'" Ordinance, relative especially to barking dogs.' Upon
consideration whereof and on motion, the matter of the adoption of such ordinance
is referred to the Ordinanfe Committee to report to thfs Board at its next
regular meeting.
This day this Board's ~ttention was called to the matter of the adoption of an
Ordinance regarding and defining restaurants, other food establishments, employee,
eating, drinking and cooking utensils, health officers, person, unwholesome
food, etc., and providing for the inspection of such establishments and the
enforcement of such Ordinance. Upon consideration whereof, it is resolved that
the said Ordinance as submitted and read before this Board, be, and the same is
adopted in tba following words and figures:

Defining restaurants, other food ~stablishments, employee, eating,
drinking and cooking utensils, health officers, person, unwholesome
food, etc., providing for the issuance o~ revocation of permits,
prohibiting the sale of unwholesome food and drinking, regulating
the inspectionof such establishments, the enforcement of this
ordinance and fixing penalties for the violation thereof
Under and by virtue of the authority copferred upon the Board of
Supervisors of Chesterfield County, Virginia, by an ~t of the
General ~sembly of Virginia, approved March 2, a938, and known
as Chapter 55 of said Acts of Assembly, this Board of Supervisors
having carefully considered the matter, doth subject to the
approval of the Judge of the Circuit Court of Chesterfield County,
Virginia, ordain as follows:
SECTION 1. Definitions. The following words, figures and phrases when used
in this ordinance shall, for the purpose of this ordinance have the meanings
respectively ascribed to them in this section except in those instances where
the context clearly indicates a different meaning.
A. Restaurant -- The term "restaurant" shall mean restaurant, coffee sn$p,
cafeteria, short order cafe, luncheonette, hotel dining room, ,tavern,
sandwich shop, soda fountain, and all other eating and drinking
establishments.
B. Other Food Establishments __" Other Food Establishments" shall mean all
places that manufacture, pack, store, se 11 or distribute food or food
products and beverages, that are not eating or drinking establishments.
C. ](nPIOl:ees -- The term" employee" sha 11 mean any person who handles food
or dr nk d~ring preparation or serving, or who comes in contact with any
eating or cooking utensils, or who is employed at any t~e in a room
in which food or drink is stored, prepared 9r served.
D. Eati~ Drinki!f and Gooking Utensils -- "~ating, drinking and cooking
utens is" shal include any kitchenware, tableware, cutlery, containers,
or other equipment with which food or drink oomes in contact during
storage, preparation, or serving.
E. Health Officer -- The term" health Officer" shall mean the director of
health activities of the County of Chesterfield or his authorized
representative.
F. Person - The word tt person" shall mean person, firm, corporation or
association.
G. Unwholesome Food -- "Unwholesome food " shall mean any food or drink not
fit for human consumption.
SECTION 2. Permits -- It shall be unlawful for any person to operate a re-
staurant in the County of Chesterfield who dees not possess an unrevoked
permit from the health officer and in whose place of business such permit
is not posted in a conspicuous placejB.ndhnaiiioense to operate a restaurant
shall be issued by any officer or official of the County of Chesterfield
until a health department permit is presented by the operator or proprietor.
Persons who meet the requirements of ttds ordinance shall be entitled to
receive and retain such a permit or to secure a lioense to operate.
It shall be unlawful for any employee to work in a restaurant or other ~ood
establishment without first securing a permit from the health officer. To
obtain such permit the employee shall furnish suoh infor.mation and laboratory
speoimens and submits to such physical examinations as the health officer
may require, and receive instructions on personal hygiene and an explanation
of the items of the Ordinance. Each permit shall remain in force until
revoked for cause.
SECTION 3. ~xamination and Condemnation of Unwholesome Food or Drink --
Samples of food and drink may be taken and examined by the health officer
as often as he deems neoessary for the detection of unwholesomeness. The
health offioer may condemn, remove and destroy any food or drink which he
deems unwholesome.

SECTION 4. Inspection of Restaurants and Other b'ood ~stablishments -- The local
health offioer is hereby made respOnsible for the enforcement of this
urdinance. Inspection shall be made as frequently as deemed necessary
by the health offioer.
One copy of the inspeotion report shall be retained by the establishment;
another copy shall be filed with the re~Qrds of the Health Department.
SECTION 5. Notification of Disease -- Notice shall be sent to the health officer
iWmediately by the owner or manager of the restaurant or other food establis -
ment, or by the employee concerned, if the manager or any employee or any
member of his or her respective household contracts any infeotious, oontagio
or communioable disease, or has a fever, a skin eruption, a oough lasting
more than 3 weeks, or a~y other suspioious symptoms. It shall be the duty
of any such employee to notify the owner or mana@er of the restaurant or oth r
food establishment immediately when any of said conditions exist, and if
neither the manager nor the employee concerned notifies the health officer
immediately when any of said conditions exist, they shall be held jointly
and severally to have violated this section.
SECTION 6. Prooedure when Infection Suspected -- ~ihen suspioio~Barises as to the
possibility of transmission of infection from any restaurant or other food
establishment employee, the health officer is authorized to reQuire any or all
of the following measures. (1) Tla inmedia te exolusion of the employee from
all restaurants or other food establishments; (2) The immediate closing of the
restaurant or other food establishment concerned until no further danger of
disease outbreak exists, in the opinion of the health offioer; (3) adequate
medical examinations of the employee and of his assooiates, with suoh laboratory
examinations as may be indicct~d. '
Ittem 1. li'loors --The floors of all restaurants and other food esteblishments
shall be of such construction as to be easily cleaned, shall be smooth, and
shall be kept olean and in good repair.
Item 2. iiells and Ceilinp:s .... Walls and cei lings of all restaurants and other
food establishments 'Spall be kept clean and in good repair j finished in light
color, and have a smooth, washable surface up to the level reaohed by splash
or spray.
Item 3. Lighting --If lighting of window space be less than 10 per cent of the
floor area, its equivalent in artifioial ligpt shall be provided.
Item 4. Ventilation -- All restaurants and other food establishments shall be
well ventilated, exhaust fans and metal hoos. over ranges, equipped with
ventilators, must be provided when necessary to prevent odors and condensation
and to promote oleanliness.

Item 5. Toilets -- ~equate, approved toilet facilities must be provided for I
employees. Toilets must be constructed and maintai~d in accordanoe with the
rules and regulations of the State Health Department. I
Toilets must be entirely separate and apart from any room used for the manufactu~e,
stora@e or handling of food products. Flush toilets used in any restaurants ,
or other food establishment must be provided with tight, self-olosing doors, I
and Qll new construction must be vestibuled, and toilet room must be ventilated, I
by means of window or flue leading to the outside. All flush toilets must be I
connected to an approved sewer system or provided with properly oonstruoted
septic tank.

Item 6. liater Supply -- Any water supply used at a restaurant or other food I
establishment shall be properly located, constructed, operated and shall be !
easily accessible, adequate, and of a safe sanitary quality. I
Item 7. Handwashi~ facilities -- All employees must observe a high standard of I,'
personal cleanl1ness, and they must be constantly supervised in this respect I
by the employer. The hands of all employees shall be washed thoroughly with
soap and water after Visiting the toilet. Emplpfees, such as clerks, waiters, cooks,
etc., must keep their hands away from the mouth and nose and wash their hands I
imm. ediately with soap a.nd water should they become contaminated with oral or
nasal secretions. Employees must keep fingernails short and olean.
Adequate handwashing facilities .include running hot and cold water, or a sUitab11
vessel and an adequate supply or clean water, soap, and a clean individual towel
for each employee. I
Item 8. ocreenl~ -- All openings to the outer air shall be effectively screeneJ
and doors shall be self-closing and opening outward, unless other effective I
means are provided to prevent the entrance of flies. I

Item 9. Const uction of utensils and e ui ment-- All eating and cooking utensil~!

operation of a restaurant or other food establishment shall be so constructed I
as to be easily cleaned and shall be kept clean and in good repair. J

Handwashing signs shall be posted in each toilet room used by employees.
Item 10. Dishwashinr eQuir:ent -- Adequate facilities shall be provided and main-
tained for the wash ng, r nsing and bactericidal treatment of all eating and
drinking utensils, each to be separate and distinct op~ration requiring a minimum
of a three-compartment sink. Adequate facilities for heating water for cleaning
must be provided. An approved waShing powder must be used. A sufficient
number of approved dish baskets must be provided.
In establishments where only beverages and ice cream are served, cold water
washing of glassware and silver may be approvea, if thorough and effective.
Provided, that nothing contained under this shallbe construed as disbarring any
other equipment which has been demonstrated as of at least equal efficiency and
:liB approved by the health officer.
Item 11. Methods of bactericidal Treatment Recommended -- One of the following
methods must be used: rtot water or chlorine chemicals. Utensils must be
submer~d in hot water at l700F., or more, for at least two minutes; or submerged
in a chlorine solution containing not less than fifty parts per million of
residual chlorine for at least two minutes. (a solution containing one hundred
parts per million, or more, is recommended).
The practice of drying eating and drinking utensils with a towel shall not be
permitted.
Provided, that nothing contained under this item shall be constructed as dis-
barring any other process which has been demonstrated as of at least equal
efficienoy and is approved by the health officer.
The above requirements apply to manual dishwashing methods. vihere dishwashing
machines are used, the operation of the machine, temperature of wash and rinse
waters, and retension period ~f dishes in the machine, must meet the approval
of the health officer.
item 12. Storage and hSrdling of utensils and eiuiIment -- After bactericidal
treatment no utensil sha 1 be stored exoept in c c .ean, dry place protected from
flies, dust, or other contamination, and no utensil shall be handled except in
such manner as to prevent contamination as far a s practicable. Single service
utensils shall be pUrchased only in sanitary containers and shall be stored
therein in a clean dry place until used.
Item 13. DiSPosal of Wastes -- All wastes shall be properly disposed of, and all
garbage and trash shall be kept in suitable covered receptables, in such manner
as not to become a nuisance.
Drain and waste pipes from fl~ors, wash sinks, soda fountains, ice boxes, etc.,
must be sufficient size, well trapped, and in a good state of repair.
Item 14. Refri~eration -- Refrigerators, ice boxes, etc., shall be of adequate
size to store a 1 perishable food, constructed of materials that will permit
thorough cleaning, shall be properly drained and ventilated, shall be equipped
with thermometer and kept at a temperature of 500F., or lower, at all times,
except during periods of defrosting. Floors, walls, ceilings, racks, hooks,
pipes, etc., shall be kept clean. Drains from ice boxes shall not be connected
directly to a sewer but shall drain into an open fixture.

tem 19. ables. shelves. etc. -- All tables must be properly constructed of
materials that can be thoroughly and easily cleaned. All table tops must be
absorbent material when dee~d necessary by the health officer. Table tops
must be free of unnecessary articles. Table covers, napkins, etc.must be
clean and all shelves shall be clean, free of unnecessary articles and neatly
arrange d. All napkins shall be discarded or laundered after each usage.
Item 15. Milk and cream-- Only gra4ed milk or cream shall be used or served
in a food establishment. Official placards, stating the grade of milk served,
whether pasteurized or raw, must be displayed in a place designated by the
health officer. All milk must be served in the original container in which
it was bottled at the plant.
Item 16. storafe and display of food and drink--All food and drink shall be
so stored and d splayed as to be protected from dust. flies, vermin, handling,
droplet infection, overhead leakage, and other contamination. No animals
or fowls shall be kept or allowed in any room in which food or drink is prepared
or stored. all means ncessary for the elimination of flies shall be used.
Item 17. Cleanliness of em~lo~es --All employees shall wear clean outer
garments and shall keep their nds clean at all times while engaged in handling
food, drink, utensils or equipment.
Item 18. Miscellaneous -- The surrounding of all restaurants and other food
establishments shall be kept clean and free of litter or rubbish. None of the
operations connected with a restaurant shall be conducted in any room used for
domestic purposes. ~equate lockers or dressing rooms shall be provided for I
employees' clothing. Soiled linens, coats, and aprons shall be kept in containersi
provided for this purpose. I

No articles, polish, or other substance containing any cyanide preparation or other'
poisonous material shall be used for the cleansing or polishing of eating or
cooking utensils. I

Item 20. Ver.min and rodent control methods -- Methods used for the control of
vermin and rodents must be effective at all restaurants and other food establish-
me n ts .
SECTION 7. Reheal -- All ordinances and ~rts of ordinances in conflict with this
ordinance are ereby repealed. '
SECTION 8. Unoonstitutionality Clause -- Should any section, paragraph, sentence,
clause, or phrase of this ordinance be deolared unconstitutional or inval~d for
any reason the remainden of said ordinance shall not be affected thereby.
SECTION ~. Penalties --~~y person who violates any provision of this ordinance
shall be fined not more than $50.00 at the discretion of the Court having
jurisdiotion. Eaoh day's oontinuance to violate any provision of this ordinance
shall constitute a separate offense.
SECTION 10. Trials -- Trial of all violation of this ordinance shall be ha~ by
proceedings before the Trial Justioe Court of Chesterfield County in like manner
and with like rig~t of appeal as is provided in misdemeanor cases.
SECTION 11. Effective Date of Ordinance -- This ordinance shall become effective
when approved by the Judge of the Circuit Court of Chesterfield County, Virginia.
On motion of P. \f. Covington, it is resolved that the bills this day presented
on behalf of the Ettriok Sanit ary District for expenditures thereon, be, and the
same are ordered to be paid.
This day again the matter of a contract with the City of Petersburg for the furniS1'-
ing of water to the Ettrick Sanitary District was brought to the attention of
the Board, and there was submitted a contract in duplicate executed by the City of
Petersburg.
Whereas, it appearing it is the best contract fhe County could 9btain from the Cit~
of Petersburg for this service, it is resolved on motion of P. W. Covington, that I
this Board do enter into said contract with this City for such service, and that I
the Chairman, be,and he hereby is authorized to sign on behalf of this Board such I
contract being in the following words and figures:

THIS AGREm.lENT, made and entered into this 1st day of A:pril, in tbe
year 1941, be and between the CITY OF PETERSBURG, a munlcipal
corporation, acting herein by its City Manager, pursuant to a
resolution of the Council of the City of Petersburg adopted at a
meeting held on the 18th day of March, 1941, party of the first
part, and the BOARD OF SUPERVISORS OF CHESTERFIELD COUNTY, VIRGINIA,
acting herein by its chair.man, pursuant to a resolution of the said
Board adopted .,at a meeting held on the 19th day of March, 1941,
on behalf of Ettrick Sanieary District No.1, of Chesterfield
County, Virginia, and on behalf of the County of Chesterfield, party
of the second part,
WITNESSETH: That, for an in consideration of the mutual agreements
herein made and the mutual benefits to accrue to the praotice hereto,
it is agreed by and between the parties as follows:
The party of the first part agrees to sell to the party of the
second part, and the said party of the second IB rt agrees to buy
from the said party of the first part, water from the regular
mater supply of the party of the first part passing through a
meter installed at a point w~thin the corporate limits of the City
of PeterSburg, on the water main running across the Appomattox
River into the Village of Ettrick, at the rate of One Dollar ($1.00)
per thousand CUbic feet, as measured by the said meter and as shown
on the books of the said City of Petersburg; and the said party of
seoond part agrees to p~ to the said party of the first part, on
or before the 10th day of each month, the charges for warer as ascertained
by the reading of the said meter and as shown on the books of the
said party of the first part. And the said party of the second part
further agrees to pay to the said party of the first part for water
as measured by the said meter, from the 1st day of July, 1940, to the
1st day of ~pril, m941, at the rate of One Dollar and Thirty Cents I
($1.30) per thousand cubic feet, and to pay to the said City of Petersburg,
in advance, beginning on the 1st day of April, 1941, the sum of Ten
Dollars ($10.00) a year for each ijydrant installed or to be installed
within the area hereinifter defined and which is served by water supplied
by the City of Petersburg, and such water delivered through such
hydrants is to be used for the purpose of fire protection only, but
the charge of Ten Dollars (#10.00) for each hydrant shall be in addition
to the charge for the water registered by the sail ~, whether the
said water shall be delivered through the said U,drants or otherwise.
And the said party of the second part agrees to pay to the said party
of the first part, for each hydrant located within the said area, between
jhe 1st d~ of 1st day of July, 1940, and the t8t day of April 1941
the prorated portion of the sum of Ten Dollars ($10.00) for ea~h periOd
and further agrees to pay to the said City of Petersburg, in advance ea~h
month, be6inning with the 1st day of April, 1941, a meter charge of Six
Dollars ('6.00) and the same charge from July ~, 1940 to April 1, 1941.
The water to be furnished by the City of Petersburg under this contra~t shall
be used only in Ettrick Sanitary ~istrict Number One of Chesterfield vounty,
Virginia, as defined by metes and bounds in an order of the Circuit Court of
Chesterfield County, entered on the 23rd day of March, 1928, and in the territory
immediately adjacent to the River Road, as extended beyond the limits of said
Sanitary District, for a distance of two thousand, sixty-four (2,064) feet along
said road, and in the territory immediately adjacent to the Hickory Road from a
point where such road leaves the River Road for a distance of one thousand,
five hundred and fifteen (1,515) feet along said road.
The City of Petersburg shall not be held to guarantee eitrer the quantity or
quality of water to be supplied, but the City shall be obligated to furnish only
such quantity or qaulity of water as may be available in its water supply system
for use in such territory at any given time, and this agreement is not to be
construed as an agreement on the part of the City that it will furnish any
particular quantity or quality of water for any purpose or purposes of the said
Sanitary D1strict or of the territory referred to above outside of said dtstrict,
or to the users of water within such district or territory, and the City is not
to be held liable for its failure 80 to do. find if at any time the require-
roentS3 of the City of Petersburg or of the residents or other users of water
within the said city should be such that the City can no longer supply water
to the said district or to the territory mentioned above outside of said district,
or to the users of water therein, then the City of Petersburg may terminate this
agreement with respect to the sale or use of water to be supplied by the City
upon six months' notice of its intention so to do.
It is further understood and agreed that this contract shall be and remain in
force until the 11th day of January, 1943, with the right of the said party of
the second part to renew the same, upon the same terms and conditiona for one
additional period of five years~ provided it shall notify the City Manager of
the City of Petersburf, or the Mayor of the said City, of its intention so to do,
ninety (90) days before the expiration of this Contract.
IN lV1INESS \ tHEREOF , the City of Petersburg has caused this agreement to be signed
in its oorporate name by its City Manager, and the Board of SuperVisors of
Chesterfield County has caused its name to be signed hereto by its Chairman, all
of which is done as of the say, month and year first written above, and pursuant
to resolutions duly adopted by the City Council of the City of Petersburg and by
the Board of dupervisors of Chesterfield County.
On notion of P. Ii. COVington, it is resolved that the Executive secretary,be, and
he hereby is direfted to make arrangements to secure the inspection of the
Ettrick Fire engine and ba ve the same put in proper condition.
This day the matter of the approval and adoption of the School Budget for the
year 1941-'42, came before this Board and on motion of J. G. Hening, it is
resolved that theochool Budget as presented to this Board on this day and the
budget of the Department of Public ilelfare, be, and the same is hereby approved
and incorporated into this Board's Budget for the year 1941~'42.
On motion of J. G. Hening, it is resolved that this Board's budget for the year
1941-'42, inclusive of the School Budget and Welfare Department's Budget, be,
and the same is hereby tentatively adopted. ~d be it further resolved that
the Executive Secretary make publication of the tentatively adopted budget
as is required by law and that May ~3, 1941, be, and the same is hereby fixed
as the final adoption of same.
On motion of Ii.A. Horner, it is resolved that this Board tentatively adopt single
