PROJECT UPDATE - LIBRARY SERVICES

Ettrick-Matoaca and LaPrade Libraries
Schedule Update
Work at the referenced project is moving ahead on schedule. Costs, however are in excess of
the $500,000 appropriation - current projected cost: $785,000.00; County received
construction bids to repair the libraries on September 12. The construction contract is
circulating for signatures. Key target dates for remaining work at Ettrick-Matoaca and

The Virginia Association of Counties has a long-standing concern about the
proliferation of unfunded mandates imposed on local governments. For many
years, it has been V ACo's position to oppose any state or federal mandates on local
governments which are not accompanied by full funding. We regard unfunded
mandates as hidden tax increases. They leave counties with few alternatives but to
increase local taxes as state and federal tax rates remain unchanged. Combined with
the overall trend of fewer federal dollars being distributed to localities, county
governments are under serious fiscal stress.
We wish to applaud you for the concern that you have already demonstrated about
unfunded mandates. We recognize and appreciate that your stance against
unfunded mandates has severely limited the introduction and passage of these bills
by the General Assembly. We would like to work with you to arrive at mutually
acceptable strategies to stem the tide of any future unfunded mandates on localities.
As president of V ACo, I appointed an Unfunded Mandates Task Force this spring
which has been working diligently to resolve the problem of unfunded mandates.
With the backing of the V ACo Board of Directors, the Task Force has come up
with the attached recommendations for reducing or eliminating unfunded mandates
on localities, both at the statutory and regulatory level.
Representatives from the task force--R. B. Clark (County Administrator of
Charlotte County), Robert Dix (Board of Supervisors of Fairfax County), Flip
Hicks (General Counsel for the Virginia Association of Counties)--and I would like
to request an audience with you to discuss these recommendations. It is our hope
to meet with you before November 1 so that we can share the results of our meeting
at V ACo's annual conference on November 13-15. By the way, we would be
delighted if you and Mrs. Allen could join us at the annual meeting.

Proposal to Address the Problem of Unfunded Mandates
Background
Existing procedures for evaluating fiscal impacts of legislation or
regulations on localities are woefully inadequate. Currently,
whenever a legislator or other participant in the legislative process
believes a proposed bill may result in increased costs to local
governments, the bill is referred by the Division of Legislative
Services to the Commission on Local Government which then surveys
approximately fifty to sixty local governments throughout Virginia.
Through this survey, the participating localities are asked to
determine any additional costs that may be associated with the
proposed new or expanded service. Within the time-frame
established by COLG, many of the sparsely staffed localities being
surveyed may not have adequate time to perform a complete
analysis. The rapid pace of events that always characterize
legislative sessions also creates a problem. There are many
instances when a bill in question may be amended to such an extent
that it quickly invalidates many of the underlying assumptions in the
local government's analysis.
As a basic consequence of this flawed process, there may be many
occasions when neither the state, nor local governments, have truly
accurate ideas of how much money certain mandates will cost. In
reality, the cost of a mandate is most often not sufficiently
understood until well into the implementation stage. By that time,
they become politically entrenched programs that are extremely
difficult to eliminate. For example, many of the costs associated
with local efforts to comply with recycling requirements (imposed
as a result of legislation passed in 1989) were not adequately
understood until years later. Curiously enough, there is no record
that any local fiscal impact analysis was ever performed to try and
understand the local costs of mandated recycling programs.
This proposal is not to suggest that recycling, and other programs
are without merit. In many cases, local governments adopted
programs of this type at their own option, long before mandates. In
all too many instances similar to the recycling example, mandates
are based on assumptions that one approach to addressing a
particular problem fits all local circumstances. As a consequence,

there is an impediment to the ability of local governments (together
with the citizens they serve) to develop programs that might most
meaningfully improve their own communities. Local creativity
becomes stifled. Mistrust and conflict between local, state and
federal officials can intensify. These are among the chief reasons
why we, as county government officials, believe unfunded mandates
to be inconsistent with "good government" principles.
Recom mendation
Because of the problems identified above, we urge the
institutionalization (preferably by statute) of new policies and
procedures that would achieve the following results:
· Establish a reasonable time-frame (perhaps ten months)
to allow a state agency (possibly the Department of
Planning and Budget) to analyze the future fiscal impacts
of any legislation that may impose a financial burden on
local governments. A procedure of this type should allow
a thorough study (to be conducted in cooperation with
local governments) to determine all possible net
additional costs that a local government would assume
as a result of a new or expanded service. This more
extensive analysis should yield more accurate cost
estimates. The minimal ten month period for analysis
and review would coincide with the time period between
adjournment and commencement of legislative sessions.
No bill deemed to have any possible fiscal impacts upon
local governments could become law until the completion
of such a review.
· Require all regulatory agencies to adopt and promulgate
any new, non-emergency regulation on or before
December 1 of the year adopted, but with the regulation
to become effective after the the date of the veto
session of the following year. This would enable the
Governor and the General Assembly to study the
regulation, its effect and cost, and receive any criticism
from the affected sections of the regulated community
and local governments. The Governor and/or General
Assembly could take such action as necessary to modify
the effect of the regulations if he or they believe this to
be necessary. Most agencies now spend well in excess of

one year in the process of adopting regulations. This
time would not be unduly burdensome on the agencies.
· In each session, require the General Assembly to
appropriate additional aid to localities which is equal to
cumulative net costs which would result from
the new or expanded services required under state law.
The amount appropriated as new financial aid to local
governments would equal the cumulative amount of funds
determined as necessary to pay for all newly
mandated public services to be performed by

The county has utilized a performance-based budget for over 14 years, in which resources are
provided to departments so that they can achieve state goals and objectives. The monitoring
of departmental workload, in relation to these goals and objectives, is essential to the
allocation of scarce resources, as the needs for these resources are varied and, often, urgent.
More importantly, the challenge of meeting increased demands for service requires
departments to be more efficient and productive in carrying-out their responsibilities.
The Quarterly Performance Report is produced, and presented to the Board of Supervisors, to
provide summary information regarding county departments' goals and objectives, and their
progress in meeting those goals and objectives.
A list of departmental accomplishments and productivity improvements is also included.

Summary of Information:
The Board of Supervisors has appropriated funds for the acquisition and
Phase I development of the Clover Hill Athletic Complex on the Mount
Hermon/Genito Road site. Additional funding will be required from
Recreation Access Grant to construct the entrance road and improvements
to Genito Road to access the athletic complex.
Budqet and Management Comments:
Upon approval of grant application by the state, the Board of
supervisors is authorized to appropriate up to $250,000 for road

RE: RECREATIONAL AREA ACCESS ROAD FUNDS - CLOVER HILL ATHLETIC COMPLEX
WHEREAS, the Clover Hill Athletic Complex is owned and is to be
developed by the County of Chesterfield as a recreational facility
serving the residents of Chesterfield County and adjoining counties; and
WHEREAS, the facility is in need of adequate access; and
WHEREAS, the right-of-way of the proposed access is provided by the
County of Chesterfield at no cost to the State; and
WHEREAS, the procedure governing the allocation of recreational
access funds as set forth in Section 33-136.3, Code of Virginia 1966, as
amended, requires joint act ion by the Director of Conservat ion and
Historic Resources and the Highway and Transportation Board; and
WHEREAS, a statement of policy agreed upon between the said
Director and Board approves the use of such funds for the construction
of access roads to publicly-owned recreational areas; and
WHEREAS, the Board of Supervisors of Chesterfield County has duly
adopted a zoning ordinance pursuant to Article 8 (Section 15.1-486 et
seq.), Chapter 11, title 15.1; and
WHEREAS, it appears to the Board that all requirements of the law
have been met to permit the Director of Conservat ion and Hist oric
Resources to designate Clover Hill Athletic Complex as a recreational
facility and further permit the Virginia Highway and Transportation
Board to provide funds for access to this pUblic recreat ion area in
accordance with Section 33-136.3, Code of Virginia 1966, as amended; and
WHEREAS, the Board acknowledges that pursuant to the provisions of
Section 33.1-233, as amended, this road shall be designated a "Virginia
Byway" and recommends the State Highway and Transportat ion Board in
cooperation with the Director of Conservation and Historic Resources,
take the appropriate act ion to implement this des ignat ion. Further, the
Board agrees, that in keeping with the intent of Section 33.1-63, to use
its good office to reasonably protect the aesthetic or cultural value of
this road:
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors of
Chesterfield County hereby requests the Director of Conservation and
Historic Resources to designate the Clover Hill Athletic Complex as a

Summary of Information :
Coopers and Lybrand, the County's external auditors, recommended that the fixed
assets system by replaced. The existing system is over 13 years old and fails to
perform calculations correctly. A Project Team of employees from Accounting, IST,
Schools, Police, Fire and Utilities thoroughly evaluated each proposal, conducted
interviews and unanimously selected GBA as the most qualified to best meet the
diverse needs of the County. The cost of the contract will not exceed $150,000,
pending final negotiations, and funds for a new system were appropriated in the
1994 budget. '

construction of the Ramblewood drainage project to the firm of
Southern Construction in an amount not to exceed $136,602.80.
Summary of Information:
In September of 1993, the County entered into a contract with the firm
of Charles C. Townes & Associates to complete the design for
redirecting the water along Ramblewood Road so as not to flood the
rear of approximately ten extremely flat lots. After numerous
meetings and revising the plans to meet the State's criteria for
installation under traffic, we have an approved set of construction
plans (no easements are necessary). The plans were picked up by eight
contractors, of which only one bid was submitted in the amount of
$136,602.80. There is approximately $205,000.00 available for
construction.

RECOMMENDATION:
Staff recommends that the Board of Supervisors authorize the County
Administrator to enter into a contract with the firm of Southern
Construction in an amount not to exceed $136,602.80 for the
construction of the Ramblewood drainage project.

agreement with Glen Roy Corp. and Tuckahoe Cardinal Corp. for storm water
management associated with the expansion of the Midlothian Library.
Summary of Information:
The temporary agreement provides for the storm water drainage
requirements for the expansion of Midlothian Library. The storm water
has been designed to sheet flow across adjacent property with the
adjacent property owner being responsible for erosion control outside of
the maintenance area as shown on the attached plat. This agreement will
terminate when construction of permanent drainage improvements are
completed on the adjacent property. Staff has reviewed the request and
recommends approval.

1994; April 11 and 25,1995: May 9 and 23,1995; and June 13 and 27,1995, The executive
sessions/work sessions will begin at 5:00 p,m, and will be held at the School Administration Building.

3, Persons to be heard on non-agenda items will be heard during the specified section of
the meeting,
4, It is requested that an individual conduct his/her presentation in three minutes;

RECOGNIZING THE COMMUNITY EFFORTS OF THE VILLAGE OF MIDLOTHIAN
VOLUNTEER COALITION FOR PRESERVING AND ENHANCING
THE VILLAGE OF MIDLOTHIAN
WHEREAS, The Village of Midlothian Volunteer Coalition was
established to preserve the Village's history; and
WHEREAS, a portion of Midlothian -- approximately 1.2 miles
has been designated as a historical village; and
WHEREAS, a flexible, phased landscaping plan for the Village
of Midlothian has been developed by local community and business
representatives working with a landscape architect and County
representatives; and
WHEREAS, this innovative plan responds
needs of the growing community, reinforcing
history as a working village; and
to the aesthetic

WHEREAS, the Village of Midlothian Volunteer Coalition was
awarded the "America the Beautiful" Grant through the Virginia
Department of Forestry and the "Natural Resources" Grant from the
Small Business Administration for their efforts in the
construction of a village park, the planting of 135 trees within
the historic district, and the establishment of day lily beds on
Route 60; and
WHEREAS, The Village of Midlothian Volunteer Coalition
received the 1992 "Meritorious Planning Award" from the Virginia
Chapter of the American Planning Association; the 1992
"Achievement Award" from the National Association of counties;
the 1993 "Keep Virginia Beautiful Award" designating the Village
of Midlothian as one of Virginia's "Best Small communities;" and
a 1994 grant from the Federal Transportation Enhancement Program
administered by the Virginia Department of Transportation; and
WHEREAS, the Village of Midlothian' s landscaping plan is
important to the community by retaining the community's sense of
place; better preserving the unique character of the Village; and
enhancing the beauty of the community through the preservation
and addition of landscaping; and
WHEREAS, the Coalition has coordinated additional
enhancement efforts by community organizations including the
Midlothian Garden Club, the Salisbury Garden Club, and the Walton
Park Woman's Club; and
WHEREAS, the Coalition established an annual community
festival, "Visit the Village Day," which draws thousands of
people to the historic district every October.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County
Board of Supervisors does hereby recognize the community efforts
of the Village of Midlothian Volunteer Coalition for preserving

RECOGNIZING OCTOBER 7-9, 1994 AS IIRICHMOND
METROPOLITAN YOUTH SOCCER LEAGUE COLUMBUS DAY
SOCCER TOURNAMENT WEEKENDII
WHEREAS, Christopher Columbus discovered the New World on October 12,
1492 and we since have celebrated that date as an important American
holiday; and
WHEREAS, a holiday weekend in the Fall is a wonderful time to hold a
sporting event; and
WHEREAS, the sport of soccer is the fastest growing sport played by
American youth, with thousands of boys and girls playing in all 50 states
across the Nation; and
WHEREAS, the Richmond Metropolitan Youth Soccer League, consisting of
19 clubs with a total of 145 select teams fielding 1,600 or more players
(and an additional 13,000 in recreational programs) representing the cities
of Richmond and Charlottesville, and the Counties of Chesterfield, Hanover,
Henrico, Orange, Powhatan, and Spotsylvania, is sponsoring the 12th Annual
Columbus Day Tournament on October 7-9, 1994; and
WHEREAS, Pocoshock Valley Youth Soccer League, a Chesterfield County
soccer club, is hosting said event for the ninth consecutive year,
utilizing 27 soccer fields at 8 complexes in Chesterfield County; and
WHEREAS, 204 soccer teams (each with 15 or more players and two or
more coaching staff and numerous parents, siblings and friends) have been
invited to play in the Richmond Metropolitan Youth Soccer League Columbus
Day Tournament, coming from Virginia, North Carolina, Maryland, West
Virginia, Pennsylvania, New Jersey and Michigan; and
WHEREAS, these tournament participants will be renting approximately
1,200 rooms in more than 17 hotels in Chesterfield County and purchasing
food and other items during the weekend in County restaurants and
businesses; and
WHEREAS, the revenue generated for Chesterfield County by this one
event should be appreciable.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of
Supervisors hereby declares the weekend of October 7-9, 1994 as "Richmond
Metropoli tan Youth Soccer League Columbus Day Soccer Tournament Weekend" in
Chesterfield County, Virginia.

OCTOBER 16-22, 1994 AS "AMERICA'S SAFE SCHOOL WEEK"
WHEREAS, crime prevention and safe schools are everyone's
business and they depend on an active partnership among law
enforcement, other government agencies, and school officials; and
WHEREAS, effective programs excel because of a sense of
community responsibility and shared pride; and
WHEREAS, excellence in education is dependent on safe and
secure school settings and youth-oriented prevention programs
encourage youth to make significant contributions to their
communities; and
WHEREAS, all citizens should become aware of crime prevention
efforts within the community to nurture a safe, caring environment
for future generations; and
WHEREAS, youth and citizens should be aware of Chesterfield
County's "Zero Tolerance" for weapons and violent acts among
juveniles; and
WHEREAS, the Chesterfield County Board of Supervisors and
School Board are eagerly collaborating to focus attention on their
efforts for safe schools and a safe community.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County
Board of Supervisors and the School Board hereby recognizes October
as "Crime Prevention Month" and October 16-22, 1994, as "America's
Safe School Week."
AND, BE IT FURTHER RESOLVED, that the Board of Supervisors and
the School Board enthusiastically pledge to work together to make
Chesterfield County a safe place for learning, living, and working,
free of drugs, weapons, and fear.

Summary of Information:
The County historically has not had a clear policy on paying interest on erroneously assessed
tax refunds resulting in an inconsistent treatment of taxpayers. Under the existing practice, interest
is not paid on refunds in most cases because the amount of tax collected is minimal and the money
has been held for a short period of time. But in special cases, when a large amount of tax has been
assessed due solely to an error of the County Assessor or Commissioner of Revenue and held by
the County for a long period of time, the refund is paid by the Treasurer with interest. A rate of
ten percent (10%) is sometimes used because that is also the rate charged by the County for taxes
paid late. In other cases, a rate equivalent to the rate received by the County from investing the
tax receipt is used.
State law allows the County to adopt an ordinance providing for the payment of interest for
tax refunds. Staff recommends considering amending the County Code to codify the existing
practice. Under the proposed amendments, tax refunds shall be paid by the Treasurer only when

exceeds $100; and (iv) that the interest paid shall be at a rate equal to the interest rate the County
received by holding the funds in the County's investment portfolio, provided such rate does not
exceed ten percent (10%). As this amendment will simply codify existing practice, the Treasurer
anticipates no significant financial impact as a result of this amendment. The amendment will
apply to refunds paid by the County voluntarily as well as to refunds paid as a result of judgments
or settlements of erroneous assessment litigation" Currently, there are approximately four
erroneous assessment cases pending, one of which is in the process of being resolved and would
be affected by the adoption of this ordinance.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1978, AS AMENDED, BY AMENDING
AND REENACTING SECTION 8-12.7 RELATING TO
TAX REFUNDS
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 8-12.7 of the Code of the County of Chesterfield. 1978, as amended,
is amended and reenacted to read as follows:
Sec. 8-12.7. Refunds.
( a) If the commissioner of revenue or the real estate assessor is satisfied that he has
erroneously assessed any taxpayer with a local tax, he shall certify to the treasurer the
amount erroneously assessed. If the tax has not been paid, the taxpayer shall be exonerated
from payment of the tax. If the tax has been paid, the tax together with applicable penalties
and interest shall be refunded to the taxpayer in accordance with Code of Virginia, section
58.1-3990,
@ All erroneously assessed taxes refunded under this section which were
erroneously assessed due solely to the fault of the commissioner of revenue or the real
estate assessor and not due to the fault of the taxpayer in filing his return and were held by
the County for more than thirty (30) days shall be be repaid pursuant to Code of Virginia
section 58.1-3991 with interest. The interest paid under this subsection shall be paid at a
rate equal to the lesser of (i) the average interest earned on the County's investment
portfolio as reported in the treasurer's quarterly reports to the board for the periods of time
such taxes were held by the County or (ii) the rate imposed by the County for delinquent
taxes. Such interest shall run from the date such taxes were required to be paid or were
paid. whichever is later. and shall only be paid if the amount of interest owed exceeds one-
hundred dollars ($100).
(b~) No tax refund shall be made under this section if the request for a refund was
made more than three (3) years after the last day of the tax year for which the tax was
assessed.
(€.Q) The refund procedure established by this section shall not apply to refunds
resulting from the decision of the commissioner of revenue to reclassify a business for
business license taxation. Such refunds may, however, be processed in accordance with Code
of Virginia, section 58.1-3980 and 58.1-3981.
(2) That this ordinance shall become effective immediately upon adoption.

Staff recommends the Board of Supervisors convey a parcel and renew an option agreement for
that same parcel in the Airport Industrial Park, and authorize the County Administrator to execute
the contract documents.
Summary of Information:
On February 9, 1994, the Board of Supervisors approved an option agreement with Childress
Klein Properties (CKP) for the conveyance of approximately 3.8 acres at the end of White Bark
Terrace. CKP is currently working with a prospect who has asked CKP to develop a proposal for
a 25,000 square foot office building. In order to position their proposal, CKP needs to verify that
the land will be available, thus their request for the option.
CKP wishes to renew the option agreement for 6 months, while the prospect continues the admin-
istrative work necessary to facilitate the project. If the option is exercised, the property will be
sold for $45,000 per acre.

Board Action Requested: On September 14, 1994, a public hearing was set to
consider approval of the exchange of parcels of land for the Bensley Fire
Station. Staff requests that the Board of Supervisors approve the
exchange and authorize the Chairman of the Board and County Administrator
to sign the necessary deeds.
Summary of Information:
Staff requests that the Board of Supervisors approve the exchange of a
0.10 acre parcel for a 0.03 acre parcel which is needed to make the
necessary road improvements in conjunction with the construction of the
new fire station. The owners of the 0.03 acre parcel are Harry L.
Hamilton and EIleen W. Hamilton.

TAKE NOTICE:
That on the 28th day of SEPTEMBER 1994, at 7:00 p.m. or as soon thereafter as may
be heard, the Board of Supervisors of Chesterfield County at its regular meeting place in the
Public Meeting Room of Chesterfield County, Virginia, will consider the exchange of two
parcels of land off of Dundas Road for road improvements in conjunction with the new Bensley
Fire Station, located in BERMUDA District Chesterfield County, Virginia.
A more particular description of the parcels to be exchanged and further information is
on file in the office of the Right of Way Manager in Chesterfield County, Virginia, and may be
examined by all interested parties between the hours of 8:30 a.m. and 5:00 p.m., Monday
through Friday.
