REQUEST: Rezoning from Community Business (B-2) to General Business
(B- 3) .
GENERAL LOCATION: Bermuda Magisterial District; property lies in
the southwest quadrant of the intersection of Velda Road and
Jefferson Davis Highway. Tax Map 82-13 (1) Parcel 5 (Sheet 23).
SUBJECT PARCEL: .79 acres, zoned Community Business (B-2);
occupied by a television repair shop.
ADJACENT PROPERTY: Zoned Community Business (B-2), General
Business (B-3), Light Industrial (M-l) , and Residential (R-7).
Occupied by single family dweLlings or business establishments.
UTILITIES, SOILS, DRAINAGE AND EROSION, EASEMENTS: Public
water is located along Velda Road. The closest trunk sewer
is located along Proctor's Creek. Connection to public
sewer is not feasible.
Soils are gently sloping and under present conditions, have only
a slight chance for erosion. Soils are well suited for construction
of parking areas. Prior to any paving, the existing drainfield
must be located.
Property lies in the Proctors Creek drainage area. There are no
existing drainage or erosion problems. Prior to clearing and
paving, a site plan to include an erosion control and drainage
plan must be submitted for approval.
PUBLIC FACILITIES:
Company Number 3.
Property is served by Bensley Fire Station,
Fire service capability is adequate.
TRANSPORTATION AND TRAFFIC: Area roads are in good condition.
Vehicluar movements will be distributed over Velda Road and
Jefferson Davis Highway. In order to limit the number of traffic
confli~t points, access to Jefferson Davis Highway and Velda Road
should be carefully controlled.
LAND ASSESSMENT: 1979 Appraised value - $108,460.
GENERAL PLAN: Commercial use.

DISCUSSION: The applicant is requesting rezoning to the General
Business (B-3) classification in order to permit operation of a
used car business on the subject property. The request parcel is
currently being utilized for a television repair business and is
nonconforming relative to parking setbacks, paving and general
bulk requirements of the Zoning Ordinance.
It should be noted, however, that all new parking and display areas
for the sale of used cars must conform to the minimum zoning re-
quirements; therefore, prior to the start of operation, the applicant
must submit site plans for review and approval. The Commission
and Board in their review of this request should consider imposition
of a buffer condition which would better define extrance/exits
along both Velda Road and Jefferson Davis Highway. . The present
internal parking layout is somewhat haphazard and does not adequately
provide for proper turning movements which would preclude hazardous
traffic conditions.
Furthermore, in view of the fact that General Business (B-3) Zoning
allows intensive commercial uses, consideration must be given to a
provision for buffering the uses from the adjacent residential
property located to the west.
It should be noted that the Commission and Board upon approval of
General Business (B-3) Zoning for property which lies in the north-
west quadrant of the intersection of Velda Road and Jefferson Davis
Highway imposed a buffer requirement along the western and southern
property line. The current request is very similar to the previously
approved request.
STAFF RECOMMENDATION: RECOMMEND APPROVAL SUBJECT TO THE IMPOSITION
OF THE FOLLOWING CONDITIONS:
1. A fifteen (15) foot buffer shall be maintained along the northern
(adjacent to Velda Road) property line and the southern (adjacent to
Jefferson Davis Highway) property line. Within this buffer, there
shall not be permitted any driveways, parking or other facilities
with the exception of a single access drive through each of the
buffers. To accomplish this, curb and gutter shall be installed
to control access to both Velda Road and Jefferson Davis Highway.
2. A six foot high solid board fence or chain link fence interwoven
with board slats shall be installed along the western property line
adjacent to Residential (R-7) Zoning. (NOTE: The Zoning Ordinance
will require this if parking is expanded and located adjacent to
the Residential (R-7) property).
