REQUEST: Conditional Use to pemit two family dwelling in an
Agricultural (A) District.
GENERAL LOCATION: Dale Magisterial District; property fronts
the southwest line of Courthouse Road and is located 1000
feet northwest of its intersection with Shawanodosee Road.
Tax Map 79-14 (1) Parcel 16 (Sheet 22).
SUBJECT PARCEL: 3.6 acres, zoned Agricultural (A), single
family residential use.
ADJACENT PROPERTY: Zoned Agricultural (A), single family
residential use or vacant.
UTILITIES, SOILS, DRAINAGE AND EROSION, EASEMENTS: Public water
and sewer are not available at this time.
Soils are nearly level to sloping. Soils are fairly suited for
the propsoed use. The Health Department must approve connection
to the existing septic tank system.
Property lies in the Swift Creek drainage area. Due to the flat
topography, soils are subject to severe wetness.
PUBLIC FACILITIES: Property is served by Dale Fire Station,
Company Number 11. Fire service capability at this time is
good.
TRANSPORTATION AND TRAFFIC: This request will have no impact
on traffic.
LAND ASSESSMENT: 1979 Appraised value - $12,300.
GENERAL PLAN: Single family residential use.
D1SCUSSION: It is the applicant's intention to add a wing onto
his existing residence to house his mother-in-law. The existing
residence is barely visable from Courthouse Road and is not
visable to adjacent residences in the summer months. The wing
will consist of a kitchen, living room, two bedrooms, and'a bath.
Given the consideration that the house is adequately sceeened from

view on all sides, this request will not be a detriment to
adjacent property owners.
STAFF RECOMMENDATIONS: STAFF RECOMMENDS APPROVAL SUBJECT TO THE
IMPOSITION OF THE FOLLOWING CONDITIONS:
1. This Conditional use shall be granted to and for Richard E.
DeVore exclusively and shall not be transferable nor run with the
land.
2. The occupancy of the additional wing shall be restricted to
members of the DeVore family.
3. At no time shall the wlng be rented.
4. Architectural design siding, and roofing shall be similar
to that of the existing structure.

The Commission recommended approval of this request subject
to the imposition of the above stated conditions.
The Board of Supervisors on Wednesday, September 26, 1979 beginning at
2:00 p.m. will take under consideration your request for zoning.
