89SN0441 - - 89SN0441*: In Matoaca Magisterial District, ROBERT L. JENKINS requests a Mobile Home Permit to park a mobile home on property fronting the north line of Mansion Drive (unimproved), approximately 200 feet east of Arrowfield Street, and located in the vicinity of 2508 Mansion Drive. Tax Map 163-7 (3) Kovac Acres, Lots 119 through 124 (Sheet 49). The mobile home will be located on property belonging to the applicant. The property will be served by County sewer and private well. The applicant is advised that should this permit be approved, he would need the Health Department's approval of the well location before a building permit is issued. Staff finds there is one (1) mobile home and a mobile home subdivision (Millside) located within one-quarter (1/4) mile of this property. Homes in the general area of this request are in the $40,000 average price range. On October II, 1989, the Board of Supervisors adopted an amendment to the Zoning Ordinance relating to public road frontage for temporary uses (mobile homes). Therefore, the Board can consider the lack of road frontage in conjunction with their consideration of a Mobile Home Permit. If necessary, the Board can impose conditions to address concerns with the lack of public road frontage or deny the request based on the lack of public road frontage. Staff feels that the granting of this Mobile Home Permit without public road frontage will not adversely affect or impair the character of this district. However, before a permanent dwelling is constructed on this property, a Variance for no public road frontage will be required. This request, which is for seven (7) years, appears to be in character with the neighborhood at the present time. The mobile home is located in an area designated by the Southern Area Land Use and Transportation Plan for medium/high density residential use. Adjacent property is zoned Residential (R-7). Development in this area began many years ago. However, the subdivision was never completed. Because of the present development and the potential for further development in this area, staff believes that the Board should advise the applicant to look upon this request as a temporary dwelling and, if approved, it mayor may not necessarily be renewed. Normally, in mobile home cases which have no public road frontage, staff would require the applicant to provide a copy of a recorded deed which includes a fifty (50) foot wide private access easement from an improved public road to the subject property. However, in this case, since Mansion Drive is a recorded right of way, staff feels that the applicant should not be required to record the deed. Thus, staff recommends only two (2) additional conditions related to the right of way be imposed on the applicant as noted below. STAFF RECOMMENDS APPROVAL OF THIS REQUEST, subj ect to Standard Conditions 1 through 7, as listed herein, and the addition of Conditions 8 and 9, as listed below: 3 MHR/PC/JANI0Z - - 8. Within the fifty (50) foot wide right of way, a twenty (20) foot wide roadway shall be constructed to all-weather road standards with a minimum aggregate base of six (6) inches. The all-weather road shall have five (5) to six (6) foot sloping shoulders with a well-defined ditch for adequate drainage. Number 21 or 21A stone shall be laid over a compacted subbase. This construction shall be southwest, from Pine Forest Road to fifty (50) feet west of the eastern boundary line of the subject property. The all-weather road shall be completed "prior to occupancy of the proposed dwelling. Further, when the applicant applies for a building permit, he shall provide a written stipulation that the owner or subsequent owner of the subject property, shall be responsible for maintaining the right of way for the purpose of adequate access by emergency services. 9. The house number shall be installed on the mailbox or a pole and located at the driveway entrance. The house number shall be displayed in at least four (4) inch high numbers.
