Recommend approval subject to the condition recomme.nded by staff and that th.e proffered
condition not be accepted~ This recommendation is made for the folloVving reasons:
A. The proposed computer-controlled, variable message electronic sign, with the
recommended condition, conforms to the Zoning Ordinance and adopted policy
for such signs~
B~ The requested exceptions to the Electronic Message Center Policy could set a

CONDITION

In. addition to Ordinance requirements~ any computer-controlled, variable
message, electronic sign shall conform to the following standards:
az Copy shall be limited to a maximum of two (2) lines which shall not
move, but Inay fade;

Comprehensive Plan:
Lies within the boundaries of the H.uguenot-Robious-Midlothian Plan which suggests the
property is appropriate for regional mixed use uses~
Area .Development Trends:
The area is characterized by a mixture of commercial and office uses on the Johnston Willis
campus of CJW Hospitals and within the Koger Center office park.
Zoning History:
On August 22, 1984, the Board of Supervisors, upon a favorable recommendation by the
Planning Commission, approved Office Business (0) zoning with Conditional Use
Planned Development 011 the request property. and adjacent property to the south with
Conditional lJse Planned Develo.pment to permit commercial use exceptions to include
indoor recreational uses (Case 84S 1 09). A mixed-use development \vas planned (Koger
Center). With the approval of Case 848109, a sign package was to be submitted to an.d
approved by Planning statr prior to the erection of allY signs4 In addition, signs we-re to
comply with the requirements of the Office Business (0) District, unless nlodified by the

Planning staff through schematic plan approvaL This is an amendment to the Conditional
Use Planned Development
Subsequent amendments in 198-6 (Case 86S083) and 1996, allo\ved for outdoor
recreational faciliti.es and a health club. (Case 96SN0155)
Sign D.esign:
The applicant plans to incorporate a computer-controlled, variable message electronic
sign into a freestanding sign. The proposed sign an.d computer-controlled, variable
message electronic sign would comply with the requirements of the Zoning Ordinance
and the adopted policy regarding such signs, with imposition of the condition
recommende.d by staff~ in lieu of acceptance of the applicant's proffered condition. l'he
current Ordinance would allow a freestanding sign 62.5 square feet in area (including
changeable copy) at a h.eight of fifteen (15) feet.
The applicant has requested two (2) exceptions to the adopted Electronic Message Center
Policy (Proffered Condition)~ These requested exceptions are relative to lines of copy
and display color limitations and are noted on the attached chart~ The sign depicted on
the applicant's elevation measures approximately 55.8 square feet in area and
approximately 9~3 feet in height (including the changeable copy).
CONCLUSION
The proposed computer-controlled, variable message electronic sign, with the condition
recommended. by staff, conforms to the Zoning Ordinance and adopted policy for such signs~
The requested. exceptions to the Electronic Message Center Policy could set a precedent for
similar requests.
Given these considerations, staff recommends approval~ subJect to the condition. and that tlle
proffered condition not be accepted.
CASE HISTORY
Planning Commission Meeting (11/16/06):
The applicant did not accept staff's recommendation, but did accept the Planning
Commission ~ s rec.ommendation~ There was no opposition present~
Mr~ Gecker indicated that the site is located across the street from the rear of a shoppil1g
center and not in an area that is highly visible. He indicated for these reasons, it would be
appropriate to deviate from the policy.

On motion of Mr. Gecker, seconded by M.r~ Litton, the Commission recommended
approval and acceptance of the proffered condition..
