Recommend denial for the fellewing reasens:
A. The request parcel lies within the boundaries of the Central Area Land
Use and Transportation Plan. The Plan deSignates the request parcel
and surrounding area to the north and west for medium density
residential use. The proposed zoning and land use do not, therefore,
conform to the Plan. Further, the proffered conditions fail to
adequately addresSConcerns relative to land Use compatibility and
transition.
B. Since the Plan designates property to the squth and east for general
commercial use, it may be appropriate to zone the property for a use
which would provide a transition between anticipated commercial
development to the south and east, along Willis Road, and residential
development to the north. Rezoning for a less intense commercial or
office use may be appropriate with proper design criteria to insure
transition and land use compatibility.

1.
Prior to the issuance of a building permit, thirty (30) feet of
right of way. as measured from the centerline of Pams Avenue.
shall be dedicated to and for the County of Chesterfield. free
and unrestricted.
2.
Outdoor pole lighting shall be no more than fifteen (15) feet
high.
3.
There shall be no outdoor public address or speaker system.
4.
The uses permitted shall be restricted to a fraternal lodge for
the sole use of Chester Lodge #1980, Loyal Order of Moose.
5.
Signs shall comply with the requirements of the Emerging Growth
Area Standards.
6.
Easements shall be granted to the County of Chesterfield to
provide public pedestrian access from the site to Fort Stephens
Park and parking on the subject site for the public who visit
Fort Stephens Park. Such easements shall allow improvements by
the County of Chesterfield to accommodate pedestrian access. The
location of the easements shall be approved by the Department of
Parks and Recreation at the time of site plan review.
7.
Public sewer shall be used.
8.
A ninety-five (95) foot buffer shall be provided adjacent to Lots
7c and 5 on Tax Map 81-4 (3), Kingsland Heights and more
specifically along the northern property line. With the
exception of the one-story frame structure. pedestrian access and
utilities, there shall be no facilities located within this
buffer.
9.
All new structures shall conform to the arc~itectural treatment
requirements of the Emerging Growth Area Standards.
10.
Site plans shall be submitted to the Planning Commission for ap-
proval. The developer shall notify all adjacent property owners
of the time and date of this site plan review by the Planning
Commission.
11.
The hours of operation for the new Chester Moose Lodge shall be:
Monday - Thursday: 11 AM to 10 PM; Friday: 11 AM to 1 AM;
Saturday: 9 AM to 1 AM; Sunday: 9 AM to 10 PM.
12.
In conjunction with site plan submission, a Class 1
Archaeological Survey, prepared by a person acceptable to the
Virginia Department of Historic Resources, shall be s~bmitted to
the Planning Department. If the survey reveals any significant
finds, as determined by the Planning Department, based on Section
106 of the National Preservation Act. the site plan shall be

conditions may be imposed to either protect significant finds or

Utilities:
Water:

16 inch water line located along Pams Avenue. Use of public water
required by Ordinance and intended.
Sewerage:
Lies in Kingsland Creek sewage drainage area. 8 inch public waste-
water lines located along Willis Road. Use of public wa6tewater
system recommended and intended (Proffered Condition 7). The own-
er/developer should coordinate the extension of public wastewater with
anticipated development on adjacent properties to the south and east.
Draina2e and Erosion:
Drains to Willis Road, then through storm sewers to the James River. No
on- or off-site drainage and/or erosion problems anticipated. Acquisition
of off-site drainage easements to the west may be necessary to accommodate
increased runoff.

Fire Service:
Bensley Fire Station, Company /13. At present, fire service capability
adequate. County water flows and fire hydrants must be .provided for fire
protection purposes in compliance with nationally recognized standards.
Parks and Recreation:
The request property is located adjacent to Fort Stephens Historical Park.
Any development. adjacent to the park should be designed to ensure
compatibility. The applicant has agreed to work with the Parks and
Recreation Department to explore the possibility of cooperating in the
development of trails, picnic areas, and other recreational facilities that
would be of mutual benefit to both uses. (Proffered Condition 6)
Transportation:
Trip generation rates for a fraternal organization are not available.
Based on civic center trip ratest development of this parcel could generate
approximately 328 average daily trips. These vehicles will be distributed
along pams Avenue, which had a 1986 traffic count of 726 vehicles per day.
Development must comply with Zoning Ordinance requirements relative to
access and internal circulation. Additional pavement, curbt and gutter
should be provided along Pams Avenue to facilitate turning movements. At
the time of site plan reviewt staff will make specific recommendations
regarding access ~d mitigating road improvements.
The Zoning Ordinance stipulates that the ultimate right of way width of
Pams Avenue, adjacent to commercial developmentt be a minimum of sixty (60)
feet. The applicant has agreed to dedicate right of way in accordance with
the Ordinance. (Proffered Condition 1)
LAND USE
General Plan:
Lies in the Central Area Land Use and Transportation planninR Area which
designates the property for medium density residential use (1.51 to 4.00
units/acre).
Area Development Trends:
The Plan designates property south of the request site, along Willis Roadt
for general commercial use. Adjacent property to the east is zoned and
being developed commercially. Area properties northt northeastt and west
of the request site are zoned residentially and have been developed for
public/semi-public uses (Fort Stephens Park), single family residences, or
are vacant.
Site Design:
A conceptual plan has been submitted which depicts a 18,750 square foot
structure with a 4t500 square foot picnic area. A drop-off area with

canopy is located on the south side of the structure (main entrance) and a
delivery and service area on the north (rear)4 The proposed structure is
surrounded on three (3) sides by paved parking areas. It should be noted
that, depending upon the internal layout of the building, additional
parking may be required. At the time of site plan review, a determination
would be made relative to the parking required for this use.
Architectural Treatment:
The request property lies within the Jefferson Davis Highway Post Devel-
opment Area (Northern Area). However, the applicant has proffered that the
building exterior will comply with the architectural treatment requirements
of Emerging Growth Areas (Proffered Condition 9). Within Emerging Growth
Areas, unadorned building exteriors and mechanical equipment must be
shielded or screened from public rights of way and residentially zoned
properties.' In addi tion, buildings cannot be constructed of unpainted
concrete block or corrugated and/or sheet metal. Given the proximity of
the use to are~ residences, it would be appropriate for the applicant to
proffer that buildings will have an architectural style which compliments
the area neighborhood.
Buffers & Screenin~:
In conjunction with the requested zoning and land use, a seventy-five (75)
foot buffer is required adjacent to residentially zoned properties to the
north, south, and west of the request site, unless modified by the Planning
Commission through the site plan review process. In addition, the
applicant has proffered a ninety-five (95) foot buffer along the northern
property boundary, adjacent to Fort Stephens Park and an adjacent residence
(Proffered Co~dition 8). It should be noted that a rezoning request, to
rezone the adjacent property to the south to a commercial classification,
is currently pending. If -the adjacent property is rezoned,' the required
buffer along the southern property boundary may be deleted. The conceptual
plan depicts a seven (7) foot wide buffer along the western property line.
The seven (7) foot buffer must be approved by the Planning Commission
through site plan review; otherwise, a seventy-five (75) foot buffer will
be required along the western property line.
Conclusions:
The proposed zoning and land use do not conform to the Plan and represents
an intensity of development on the property that is incompatible with area
res idential uses. Specif ically , the acti vi ties and hours of operation
typically associated with fraternal uses could have an adverse impact upon
the existing single family neighborhood located north and northeast of the
request property. Given area development patterns, non-residential use of
the property may be appropriate. However, any development on the request
property should provide a transition between planned and anticipated
commercial land uses, on property to the south and east, and existing
residential uses to the north and northeast. Rezoning for less intense,
light commercial'or office uses would, therefore, be appropriate.

Currently, adjacent property to the south is being considered for rezoning
to permit a heating and air conditioning business (Case 89SN0325 , Battle'
Heating and Air Conditioning). The Planning Commission has recommended
denial of Case 89SN0325. However, should the Board wish to approve this
request, acceptance of the proffered conditions would be appropriate.
Staff would note that the proffered conditions fail to adequately address
concerns relative to land use compatibility and transition.
In addition, the Board may wish to encourage the applicant to proffer
additional conditions to address concerns relative to quality of
development and the impact of the use on area residents. Specifically JI
suggested Proffered Condition 1 would increase the front yard setback along
Pams Avenue from fifteen (15) feet to twenty-five (25) feet and require
additional landscaping along Pams Avenue. This condition would also
require a forty (40) foot landscaped rear yard setback for buildings I
driveways, and parking areas along the western property boundary.
Suggested Proffered Condition 2 would limit the hours of operation for
organized outdoor activities to essentially daylight hours and restrict
Sunday outdoor acti vi ties, and is more restrictive than the applicant 1 5
proffered hours of operation.
SUGGESTED ADDITIONAL PROFFERED CONDITIONS
1. Development shall conform to all requirements of the Zoning Ordinance
for General Business (C-S) Districts in Emerging Growth Areas.
2. Organized outdoor activities shall be restricted to the hours between
12 noon and 5:00 p.m. on Sunday; to between 8:00 a.m. and 8:00 p.m.,
Monday through Saturday, during the months of May through September;
and to between 8:00 a.m. and 6:00 p.m., Monday through Saturday,
during the months of October through April.

Policy 3.102. Encourage attractive and efficient grouping of
commercial uses at appropriate locations and discourage the formation of
commercial strip development.
