Virginia, commonly called Moore's Lake Pr~erty, being
all of the contiguous lots, parcels and tracts of land
including and surrounding .MOore's Lake, and including the
right to use in common with other entitled persons. the
road', leading to Moore' s Lake from U. S. Route 1 across the
property now belonging to Crump and thence over the property
of Spinners, the road being a 30 foot riqht-or-way across
the property belonging to Crump, and SO feet wia8 along
.the property belonging to Spinners, it, being the intention
of tpis option to cover all property conveyed to Spinners
by deed from R. Dunbar MOore and Ruth Priend Moore, husband
and vife, dated Pebruary 1, 1947. recorded in the Clerk.s
Office of the Circuit Court of Chesterfield Cou~ty, Virginia
in Deed Sook 304, page 195, and a five -Bcre tract of land
conveyed to Spinners by deed from Sykes, also of record
in the aforesaid Clerk's Office.

connection to the sewer line on Telstar Drive before the lagoon is

On motion of Mro DietsCh, seconded by MrQ Purdy, it is resolved that
theEngineering Department be requested to award the bid for the
installation of sewer lines along Route 1, north of Colonial Heights,
as shown on Contract 569-25D, provided same is awarded to the lowest
responsible bidder when received on ~pril 14, 19700
It was generally agreed that a definitive study would be made on the
Elkhardt ~ad separating various property owners as to drainage areas
for the planning of extending sewer serviceo
On motion of Mro Purdy, seconded by MrQ Apperson, it is resolved that
this Board requests the Highway Department to improve Pine Street
not to exceed $2288000, which improvements will meet the old Highway
specificationso
And be it further resolved, that the foregoing resolution be sent to
the Highway Department upon the receipt of one-half of the cost of
said improvement from the developer of this subdivisiono
On motion of Mro Apperson, seconded by Mro Browning, it is resolved
that this Board requests the Highway Department to improve Cumbermede
Road in North Beulah Village, at a price not to exceed $712080, which
improvement will meet the old standards of road constructiono

in Pocoshock Hills Subdivision, which improvements would include

that the low bid of $3950GOO submitte~ by Bemco, Inco for the
construction of each of three (3) brush trucks be and it hereby is
accepted, to be awarded one at a time, each being judged acceptable
before the next awardo
It was cited that bids had been received for 2-Comor Television sets
for the Nursing Home and that the low bid had been submitted by
the Blueficld Hdwco Company bidding on the Admiral at $344.00, and
that Goldberg Company, Inca had bid on RCA -$399000, and that Harris
T-V & Appliance Center had bid $~89.00 on the Zenith, which would
carry a free outside antenna and local service.
Upon consideration whereof, Mro Martin moves: That the County purchase
two (2) Zenith Televisions for th0 Nursing Home at a price of $489aOO
each, which motion was seconded by MrQ Appersono

There was presented a budget totalling $41,624,588.00 for the year
1970-'71, which budget calls for no tax increaseo
Upon consideration whereof, and on motion of ~kD Purdy, seconded by
Mro Browning, it is resolved thut this budget be advertised for
formal adoption on April 22, 1970 at 3:00 o'clock PaM.
The Executive Secretary reported to the Board that he had offers
from Wilbur Smith & Assciates to perform a study on the combined
noise rating of the County airport and to submit a land use plan
at the ends of the runwqY for a fee rangin~ from $3000 to $5000000
and that the Bolt, Beranek & Newman Company have agreed to review
the computations of the County's ~onsultants and to present a
lali'd use plan takirlg the CNR into consideration for a fee of
approximately $1500QOO which will not guarantee a maximum fee or
cover a visit to the area.
There was read a letter from Ralph Mo Parson & Company which
generally agreed with and supported the findings of the County's

Consultants in its CNR studyo
It was reported that Dewberry, Nealon & Davis, the County's Consultants
would present a land use plan showing some proposals at the ~nd of
each runway as a park,on the contract with the County.
Mro William Gilmer states that the County should have an independent
study to substantiate criteria already presented.

Upon consideration whereof, and on motion of Mra Purdy, second0d by
Mr~ Dietsch, it is resolved that this Board will accept the studies
of Dewberry, Nealon & Davis and land use reports as already provided
for by contract and to ask said Company to accelerate the completion
of these studies.
It is here noted that Mra Martin abstains from voting and Mr. Apperso~

It was reported that previously the Board had agreed to construct a
fire station in the area of Walmsley Boulevard and ~rner Road and
upon further investigation of this site, found conditions were not
as previously explained, making this use of the location desired
almost impossible, and it was stated further that the School Board
had agreed to allow a fire station on the wes.tern end of this property
fronting on Rto360o
Upon consideration whereof, and on motion of Mro Dietsch, seconded by
Mro Purdy, it is resolved that with the School Board's concurrence
a temporary building be 2rected on the School grounds and that plans
be completed as soon as possible for the construction of a permanent
fire station at said locationo
There was presented a request for a new piece of equipment for the
Ettric~ Volunteer Fire Departmento Upon consideration whereof, and
on motlon of Mr. Browning, seconded by Mro Purdy, it is resolved
that the request of the Ettrick Fire Department be referred to the
Fire Committeeo
On motion of Mro Purdy, seconded by Mro Martin, it is resolved that
the Museum CSmrnittee of thE County be allowed to place two mill stones
on the Courthouse propertyo

Re: Midlothian Mall, Inc. (Woolco Shopping
Center on Route 60 at German School Road)
Dear Mr. Burnett:
This firm represents Midlothian Mall, Inc., which is developing
the above shopping center on the Southside of U. S. Route 60. The property
has been annexed into the City of Richmond as of January 1, 1970. Last year
when the property was still in the County of Chesterfield, you may recall that
I appeared before the Board of Supervisors, and I enclose herewith newspaper
account of that appearance. The newspaper quoted Assistant Commonwealth's
Attorney Morris Mason as saying that he believed that the County "has no
authority to deny a permit to a developer even if the property will flood. "
I, of course, argued the same thing as well as my opinion that payment
prerequisite to the issuance of the building permit was unauthorized under. the
law.. I felt then as I do now that the requirement amounted to a nonuniform
tax assessment which was illegal and unconstitutional.
The Board of Supervisors, however, did not go along with my argument
and since a delay in the building permit would have cost my client thousands of
dollars, I advised my client that he should forward the required check in the
form required by MI. Elrod, the drainage engineer, Enclosed herewith is xerox
copy of my letter to Mr. Elrod dated July 7, 1969, in which I forwarded this
firm's law check in the amount of $2, 500. 00, payable to George W. Moore, Jr.,
Treasurer.

Chesterfield.

apply for a building permit for the construction of a shopping center on th~
south line of Midlothian Turnpike in Manchester District, Che-sterfield County,
Virginia, and this ~etter is written to set forth our understanding as to the
drainage situation in the Reedy Creek drainage basin as it relates to said
property.
We understand that the proposed development of the' said property by
Midlothian Mall, Inc., as set forth in the plans submitted with our appl,ication ..
for building permit complies with the present qrainage requirements in the area
where located and complies with the County's existing drainage plans ~o~r the futUre
in such area. We further understand that substantial development which is now
projected for the Reedy Creek drainage basin.in the future may present a drainage
problem. Although the County has nQt ~btained or approved any plans.for solving
this prospective future problem, we agree to contribute to the cost of such project
the sum equal to the percentage which our 20 acres bears t~ the total acreage in
the Reedy Creek drainage basin, but in any event not to exceed the sum of $2,500. 00.
It is our understanding that we vIllI not be called upon to contribute to the cost of
said project unless all future developers also contribute their _proportionate share

Dear Mr. Burnett:
In accordance with a request of Mr. V. R. Gingell, associate of Dewberry,
Nealon & Davis, we have made an analysis of the noise contours depicted
on the drawing furnished to us. We have compared the noise contours with
those developed by Bolt, Beranek & Newman and the work done by the Air-
borne Instruments Laboratory of Cutler Hammer. We find that the contours
tbat you depict under the conditions stipulated, including the noise abate-
ment turn after take-off, conform to the determinations made by the afore-
mentioned organizations. We generally think that the three business jet
operations daily postulated by you for 1980 is a high estimate and therefore
the noise contours would tend to be smaller than shown. The noise contours
coupled ~ith a chart on obstructions to air navigation for this airfield
would yield parameters which should be used in the preparation of a land
use map. In preparing such a land use map, it is assumed that the ecological
and physical attributes of the areas involved WDuld receive adequate consider-
ation.

Dear Mr. Burnett:
The firm of Dewberry I Nealon & Davis requested the Ralph M to Parsons
Company of Los Angeles I California to review our noise profiles in the
vicinity of the proposed airport site. We have attached a letter pre-
pared by the Parsons Company and directed to your office which indicates
their findings. You will note that the comparative analysis was based
upon a similar set of noise profiles which Bolt, Beranek.and Newman and
Airborne Instrument Laboratories of Cutler Hammer performed on the
Montgomery County Airpark for the Ralph M. Parsons Company. It is
also well to note that the Parsons Company feels that our estimate of
pure jet turbine operations per day is high. This I of course, would have
the overall effect of reducing the level of noise in the vicinity of the
Nursing Home and the proposed school and would also reduce the area
of noise saturation to considerably less acreage than that indicated by
Mr. Gilmer and others. We sincerely believe that the number of jet
operations (3) which we used in the projection of the noise profiles would
not generally disturb the peace and tranquillity of the area surrounding the
airport. and:if this number of jet operations was reduced to two~ the en-
croachment would be even less serious.
We are also convinced that the light aircraft noise which we taped and
played before the board and in the court case will be the predominant
sounds to which most people will have to become accumstomed, and there
are going to bervery few of those.
. All of the areas which Mr.. Gilmer deems critical lie in Zone I. This zone
by definition may be objectional to some people depending on the in-
dividual- s susceptibility to noise; however, this zone by FHA standards
is acceptable in obtaining new construction loans. In fact most areas

in Zone II by FHA standards will qualify and in many instances the
installation of storm windows will qualify the home for loan if the lo-
cation is questionable. The only problem locations are in Zone III,
and this has been our area of concern for .some time, in fact led us to
our suggestion of having noise be given consideration in the areas along
Rt. 10 indicated in the report.
Based upon our findings which have now been concurred in by the Ralph
M. Parsons Co., the following is a resume of CNR1s for those locations
considered in Mr. Gilmer's report of 11 March 1970 to the Chesterfield
County Board of Supervisors.

both now and in the future.

Our firm, under the pre sent agreement with Chesterfield County, will
prepare a land use plan in the vicinity of the proposed Chesterfield
County Airport which will reflect noise (CNR's) and building heights
restrictions based on Federal Air Regulations Part-77. This plan will
furnish the County a useful tool in its comprehensive planning efforts.
We have just recently ordered the topography and are proceeding on the
airport layout plan which is Item II of our proposal.

As you may know the Manchester Fire' Department
which 1s presently 10 the. City of Richmond is going. out
of business on April 30, 19700 We had a~proved a lot at
the intersection of \1almsley. Boulevard and Turner Road"
for a -proposed Fire Station, which lot was of dlffereot
proportions than originallyspeclfied and therefore cannot
be used. .
The Fire Insurance Rating Bureau has stated that
it would be far better to have a Fire Station on Rt'.360,
approximately at the location Of the Manchester School.
The Board of Supervisors .has favored such a site bu.t
thought that the members who were to support a .Voluntee~
Fire Company in the are~ would not agree to such a location.
These members have' nQw agreed to this new area and we ask
now. that t~school Board give ,th~ County the right to
. locate a Fire Station on Rt.360 on the w~stern boundaty of
th~' School Board property. This would not affec:tt~e parking
lot-nor the baseball field. It is an excellent location so
far' as ',sight distance and area covered by the. station, water
and sewers are available.

With reference to the resolution from the Board of Supervisors
dated March 11, 1970, concerning the low bid of $206,000 received for the
construction of five fieldhouses (fundS to be ,matched by the governing body
and the school board) the school board,. on motion of 'Mr. Russell, seconded
by Mr. Spencer, directed that the Board of Supervisors of Chesterfield
County be respectfully requested to guarantee the said sum of $103,000
to the school board if the school board advances this amount for the building
of these fieldhouses and subsequently falls short of fllllds for certain school
construction proj~_ects now underway, as follows: Robious Elementary,
. S'alem Elementary, _ Salem Junior High, Midlothian High renovations,
Watkins kindergarten complex, Clover Hill ltmior High, Matoaca High
renovation, Robious Junior High, a.nd furniture and equipment for Robious,
. Salem and others.
Mr. Russell further moved that this resolution be forwarded
immediately to Mr. M.. W. Burnet~,. Executive Secretary of the Chesterfiel
COlU1ty Boafd of Supervisors, for consideration.
