Monthly Report on District Improvement Funds
Report Date: October 23, 2019

The County annually budgets $33,500 in discretionary funds, referred to as District Improvement Funds
(DIF), for each of the five magisterial districts that are used to improve the quality of life in each district.
The DIF allocations can be used for public improvements, purchase of county -owned equipment, public
events or programs, public school programs, and other legally allowable expenses. In addition, if funds
remain in DIF accounts at the end of each fiscal year, up to $37,500 may be reserved per district at year-
end to be utilized in a future year. With approval of this report, the Board consents to the use of available
reserve balance, if needed.
This report shows the cumulative use of District Improvement Funds for FY2020 as well as the current
funding available for each district. Requests to use funds for the current month are detailed below and
listed as a proposed use on the summary chart for that district. Upon Board of Supervisors acceptance of
this report each month, staff will execute proposed DIF requests.
There are five DIF uses proposed this month. Acceptance of this report by the Board constitutes Board
approval of these requests.
October 2019 Requests:
• Transfer up to $5,000 from the Bermuda District Improvement Fund to the Enon Volunteer Fire
Department to assist in funding the replacement of the HVAC system at Enon Volunteer Fire
Department. The HVAC will be replaced in the portion of the building that hosts community
meetings. The Board can legally transfer public funds to the Enon Volunteer Fire Department
pursuant to § 15.2-9536 of the Code of Virginia.
Transfer up to $900 from the Bermuda District Improvement Fund to the Falling Creek Ironworks
Foundation for the purchase and installation of a monument at Falling Creek Ironworks in memory
of Bryan H. Walker. The Board is authorized to transferthese funds under § 15.2-9536 of the Code
of Virginia because the Foundation is a nonprofit organization that commemorates historic events
and because the funds will be used to commemorate historical events and structures.
Additionally, the monument will become the property of the County upon installation.
• Transfer up to $1,500 from the Clover Hill District Improvement Fund to the School Board to pay
conference registration fees for seven teachers from W. W. Gordon Elementary School to attend
the "Get Your LEAD On" Conference in Charlotte, North Carolina on October 28, 2019. The County
can give money to the School Board to pay registration fees for teachers to attend educational
conferences.

• Transfer up to $1,495 from the Dale District Improvement Fund to the School Board to assist with
the replacement of the laser cutter used for the community Makerspace at Lloyd C. Bird High
School. The County can give money to the School Board to purchase capital equipment to be used
in school facilities. The purchase must be made by the School Board in accordance with the
Virginia Public Procurement Act and County purchasing policies.
• Transfer up to $1,000 from the Matoaca District Improvement Fund to the School Board to assist
with purchasing licenses for the online Lexia® Cores® Reading program for 142 Spring Run
Elementary School students who are below level benchmark readers. The Board can legally
transfer public funds to the School Board to fund programs and purchase reading materials which
will be owned by the School Board and used for public educational purposes. The purchase must
be made by the School Board in accordance with the Virginia Public Procurement Act and County
purchasing policies.

RECOGNIZING THE 50TH ANNIVERSARY OF
CAREER FIREFIGHTER RECRUIT SCHOOL ONE
WHEREAS, on October 1, 1969, the Chesterfield Fire Department graduated
its first recruit school of Career Firefighters, 41 years after the first
volunteer fire station was established in Chesterfield County; and
WHEREAS, Career Firefighter Recruit School One was the product of
discussions between the Board of Supervisors and Fire Chief Robert L. Eanes
dating back to Spring 1967; and
WHEREAS, Career Firefighter Recruit School One included Doug Alexander,
Edward Anderson, John Bucka, Joseph Carroll, James Hajocas, Irving Hall,
Richard Murry, David Palumbo, Carl Riggin, Wayne Tunstall, and Benton
Woodruff Jr.; and
WHEREAS, Career Firefighter Recruit School One established the
foundation for the organizational culture that makes Chesterfield Fire and
EMS the quality organization that it is today; and
WHEREAS, upon graduating, all members of Career Firefighter Recruit
School One were assigned to Fire Station 4 in Bon Air to provide 24-hour
service to the citizens of Chesterfield County; and
WHEREAS, Edward Anderson, David Palumbo, Wayne Tunstall, and Benton
Woodruff Jr. served Chesterfield County until their retirement from
Chesterfield Fire and EMS; Irving Hall served Chesterfield County until his
retirement from the Chesterfield Emergency Communications Center; John Bucka
served Chesterfield County until his retirement from the Chesterfield Police
Department; Richard Murry served Chesterfield County until his retirement
from the Chesterfield Fleet Management Division, and Joseph Carroll served
the Commonwealth of Virginia until his retirement from the Department of
Forestry; and
WHEREAS, 50 years later and upon the graduation of Career Firefighter
Recruit School Number 58 in December 2019, Chesterfield Fire and EMS will
have grown to 462 career members supported by 42 civilian personnel, 32 part
time positions and 239 operational volunteers distributed among nine
divisions, four battalions, 22 fire stations and eight rescue squad stations,
and responding to over 43,000 incidents annually in service to 349,000
citizens.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 23rd day of October 2019, publicly recognizes the 50th
anniversary of Career Firefighter Recruit School One and extends on behalf
of the citizens of Chesterfield County, sincere appreciation to the first
career firefighters in the county for their years of dedicated public
service.

RECOGNIZING MR. PETE ADLER FOR OUTSTANDING
COMMUNITY SERVICE
WHEREAS, Mr. Pete Adler is a resident of the Bermuda District;
and
WHEREAS, as a member of the Chester Rotary Club, Mr. Adler
learned in 2005 of the need for volunteers to build wheelchair
ramps, and offered to lead the effort for the club's building of
its first ramp; and
WHEREAS, as a volunteer handyman for Tri -Cities Workcamps, Mr.
Adler introduced and coordinated a partnership with Project: HOMES,
and five ramps were completed by high school age volunteers during
TCW 2006, 11 ramps in 2007, and ramps, porches and other projects
have been completed through the partnership every year since 2007;
and
WHEREAS, Mr. Adler has led mission trip teams to construct
ramps in several states across the country; and
WHEREAS, Mr. Adler designed and supervised construction of
wheelchair ramps and porches, in partnership with others, for the
Greenleigh and Shady Hill community centers; and
WHEREAS, Mr. Adler designed and constructed a ramp inside the
Chesterfield Food Bank, enabling the organization to pass
Chesterfield Building Code requirements; and
WHEREAS, Mr. Adler organized the first "Three Ramps in a Day"
service project in 2018, and this model has already been repeated
three times; and
WHEREAS, Mr. Adler has constructed ramps for disabled veterans
and both children and adults with disabilities and injuries; and
WHEREAS, known as "Pete the Ramp Guy," Mr. Adler has completed
over 180 wheelchair ramps in Chesterfield, Dinwiddie, Prince
George, Petersburg, Hopewell, Colonial Heights and Richmond, as
well as eight ramps in five other states; and
WHEREAS, the residents of Chesterfield County and surrounding
localities have greatly benefited from Mr. Adler's tireless efforts
to ensure that many of their most vulnerable residents are able to
safely transfer in and out of their homes; and
WHEREAS, Mr. Adler's example of dedicated community service is
an inspiration to others.

RECOGNIZING MS. JEWELL AIKEN HUNTER UPON HER RETIREMENT
WHEREAS, Ms. Jewell Aiken Hunter was hired by Chesterfield County Mental
Health Support Services on September 26, 1994, as a Senior Administrative Officer,
subsequently holding the titles of Office Administrator 1 and Administrative
Manager before being promoted to Chief of Administrative Services in 2008; and
WHEREAS, Ms. Hunter supervised all administrative support personnel and
provided oversight to word processing staff who transcribed medical evaluations
for psychiatrists prior to the adoption of the electronic health record; and
WHEREAS, in the role of Chief of Administrative Services, Ms. Hunter became
responsible for facilities management of the Rogers Building and five satellite
locations and worked collaboratively with Buildings and Grounds, Security
Management, Purchasing, Risk Management and other county departments to address
facilities concerns; and
WHEREAS, Ms. Hunter assisted the agency transition to the electronic health
records in 2010 which resulted in re-engineering administrative processes,
eliminating paper records and implementing centralized scheduling; and
WHEREAS, Ms. Hunter coordinated the redesign of the Rogers Building lobby to
prepare the agency for the implementation of Same Day Access in 2015; and
WHEREAS, Ms. Hunter was a key member of the team providing oversight of the
Rogers Building HVAC replacement which resulted in 485 staff moves involving seven
different locations over the period of one year; and
WHEREAS Ms. Hunter served as the MHSS United Way Campaign Coordinator
consistently meeting or exceeding the department goal and was the MHSS
Chesterfield Employee Association representative being one of the CEA's top sales
people for fundraisers; and
WHEREAS, Ms. Hunter was a certified instructor for Nonviolent Crisis
Intervention and CPR/First Aid serving as a lead instructor for the MHSS
Department; and
WHEREAS, Ms. Hunter contributed to the annual County Black History Month
celebrations having chaired various committees and served on the Scholarship
Committee, was a member of the National Forum for Public Black Administrators and
was recognized by the Future Business Leaders of America for outstanding service;
and
WHEREAS, Ms. Hunter was a part of Communities in Schools, mentoring students
at Hopkins Elementary and Salem Middle schools, participated in "Read Across
America Day," provided job shadowing opportunities for Model County Government Day
and taught classes for Junior Achievement; and
WHEREAS, Ms. Hunter served in leadership roles on many departmental
committees including Risk Management, the Diversity Advisory Inclusion Team,
Customer Service, Employee Recognition, Environmental Safety Group, Emergency
Response Team, Trauma Informed Care, Leader on Duty and Access Redesign; and
WHEREAS, Ms. Hunter was a member of the First Choice Toastmasters Club
winning many awards and ribbons as "Best Speaker" and served as President in 2018.

RECOGNIZING MR. JAMES M. PERDUE UPON HIS RETIREMENT
WHEREAS, Mr. James M. Perdue will retire from the Chesterfield County
Parks and Recreation Department on November 1, 2019, after providing 35 years
of dedicated service to the citizens of Chesterfield County; and
WHEREAS, Mr. Perdue began with the Parks and Recreation Department in
1981 as a Seasonal Maintenance Worker and became a Park Aide in October 1984
as a full-time employee and was promoted thru the department to his current
position of Assistant Director of Parks and Recreation, Parks in August 2014;
and
WHEREAS, Mr. Perdue manages grounds maintenance supporting 70 parks and
athletic complexes, 66 schools, 9 libraries, 6 county facilities, supervises
turf management, athletic field preparation, landscaping of 140 elementary
school and park playgrounds, 42 trail miles and manages emergency assistance
during natural disasters and snow events to quickly reopen county and school
facilities; and
WHEREAS, Mr. Perdue was instrumental in the inception of sports tourism
at River City Sportsplex generating $33.8+ million in economic regional
impact to the county, supports 51+ sports tourism events annually serving
192,000+ visits and was recognized by Richmond Region Tourism in 2016 for
outstanding contribution to sports tourism in the region; and
WHEREAS, Mr. Perdue was instrumental in the development, implementation
and improvement to the Career Development Program for the Principal
Maintenance Worker position, implemented mandatory cross -training, maintains
a Certified Playground Safety Inspector Certification (CPSI), was Employee
of the Year for the department in 2010 and as Assistant Director faced the
major challenge of potential out -sourcing of school grounds maintenance, and
secured continued provision of high-quality grounds maintenance by the Parks
division; and
WHEREAS, Mr. Perdue has been a member of the Virginia Recreation and
Park Society (VRPS), National Recreation and Park Association (NRPA), was
instrumental in securing the Department Commission for Accreditation of Park
and Recreation Agencies (CAPRA) and worked diligently with the Parks and
Recreation Advisory Commission (PRAC), Eppington, Falling Creek, Mid -Lothian
Mines and Henricus Foundations.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of

WHEREAS, Mr. Richard C. Witt will retire from Chesterfield County on
November 1, 2019, after providing over 34 years of dedicated service to
the residents of Chesterfield County; and
WHEREAS, Mr. Witt' was hired by Chesterfield County in January 1985 as
a mechanical/plumbing engineer in the Department of Building Inspection;
and
WHEREAS, Mr. Witt served Chesterfield County's Department of Building
Inspection for 34 years and was promoted to the following positions: chief
of plan review, chief of code compliance, assistant director, interim
director and in 2010 was made director of Building Inspection; and
WHEREAS, under Mr. Witt's leadership, the department's performance,
customer service, and employee career development programs served as a
model for building departments across the state and nation; and
WHEREAS, he championed the training and education of department staff
to always know why a code provision exists and its purpose; and
WHEREAS, Mr. Witt chaired the development of Chesterfield County's
nationally recognized "Fast Track" permitting and site plan process, and
he served as a member of the Customer Service 2000 Committee which
developed the concept and led to the provision of customer service
centers; and
WHEREAS, Mr. Witt's leadership in his field was recognized by
multiple governors of Virginia who appointed him to the Virginia Board of
Housing and Community Development and the Virginia Board of Building Code
Appeals; and
WHEREAS, Mr. Witt was recognized by his peers who elected him as
president of the Virginia Building Code Officials Association in 1998,
further honoring him with the 2018 Award for Excellence; and
WHEREAS, Mr. Witt was recognized by the Virginia Plumbing and
Mechanical Inspectors Association in 2008 with the Gordon I. Dameron
Award, in 2013 with the D. Paul Jack Award and in 2017 with the Pack A.
Proctor Award; and
WHEREAS, the International Code Council recognized Mr. Witt by
appointing him as chairman of the ICC Certification Committee and vice
chairman of the ICC Code and Standards Committee, as well as ICC Code
Official of the Year in 2016; and
WHEREAS, Mr. Witt's overall contributions to his profession improved
the provisions of the Virginia Uniform Statewide Building Code, especially
with respect to shrink swell soils and apartment building fire protection;

the nation's codes and standards for safe and secure buildings,
influencing the Virginia Uniform Statewide Building Codes, the standards

residents and citizens alike.

146.19(B)(2), the County Administrator, as Director of Emergency Management
for the County, must formally appoint a Coordinator of Emergency Management

RECOGNIZING THE LATE MR. BRYAN H. WALKER FOR HIS SERVICE TO THE COMMUNITY
AND AS A MEMBER OF THE FALLING CREEK IRONWORKS FOUNDATION
WHEREAS, Mr. Bryan H. Walker was born November 28, 1931, in Richmond,
Virginia and his father, Harold, worked in Chesterfield County's Treasurer's
Office and as the Commissioner of Revenue for 60 years; and
WHEREAS, Mr. Walker's father taught about service to the community and
the importance of the county's historic roots; and
WHEREAS, Mr. Walker became a pillar of the Bensley community, dedicated
to his church and a champion in preserving local history; and
WHEREAS, Mr. Walker was a founding member of the county's Preservation
Committee, which he served on for 30 years; and
WHEREAS, Mr. Walker was instrumental in advocating for the county to
purchase the property that is the current site of Falling Creek Ironworks
Park; and
WHEREAS, Mr. Walker also volunteered with the Chesterfield Historical
Society of Virginia, the Parks and Recreation Advisory Committee, the Friends
of Chesterfield's Riverfront and the Jefferson Davis Association; and
WHEREAS, Mr. Walker was one of the founding members of the Bensley Civic
Association and the Falling Creek Ironworks Foundation; and
WHEREAS, in 2017, Mr. Walker was recognized by the Chesterfield County
Board of Supervisors for his significant contributions to the preservation of
the historic fabric of Chesterfield County; and
WHEREAS, in memory of his life of service and dedication to preservation
of history, the 400th anniversary celebration of Falling Creek Ironworks was
dedicated to the memory of Bryan H. Walker, with gratitude for all his
efforts on behalf of the Falling Creek Ironworks Foundation; and
WHEREAS, a new monument will be placed in his honor on the overlook of
Falling Creek to commemorate his contributions to all who visit Falling Creek
Ironworks Park.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors publicly recognizes the late Mr. Bryan H. Walker and commends him
for his dedication and outstanding service to Chesterfield County and the
Falling Creek Ironworks Foundation.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be presented
to the family of Mr. Walker and that this resolution be permanently recorded

RECOGNIZING MRS. DEBORAH B. MABE UPON HER RETIREMENT
WHEREAS, Mrs. Deborah B. Mabe will retire from the Chesterfield County
Police Department on November 1, 2019, after providing over 31 years of
outstanding quality service to the residents of Chesterfield County; and
WHEREAS, Mrs. Mabe began her career in 1988 in the Chesterfield Circuit
Court as a Deputy Clerk, and in 1990, continued her service in the Police
Department where she has held the positions of Sr. Clerk Typist/Receptionist,
Secretary, Administrative Secretary and Administrative Assistant; and
WHEREAS, Mrs. Mabe was honored in 1996 with the Mason T. Chalkley Award
for Outstanding Civilian Employee of the Year, which recognized. her
outstanding working relationships with internal and external customers, her
can -do attitude and professional demeanor; and
WHEREAS, Mrs. Mabe was recognized by her supervisors for her major
contribution in the form of a time -critical communication that facilitated
the capture of an armed and dangerous fugitive who was on the 1110 Most -
Wanted" lists of Richmond, Henrico and Chesterfield; and
WHEREAS, Mrs. Mabe was an iconic figure in the Investigations Bureau who
was well known throughout the county as the individual who provided a
professional, accommodating, customer -service friendly attitude with internal
and external customers; and
WHEREAS, Mrs. Mabe was cited as being an essential element to
Investigations' team -building through her support and organization of
numerous events during her career, and her efforts were especially important
during a renovation period which necessitated the bureau being housed in
three different locations for an extended period; and
WHEREAS, Mrs. Mabe has provided the Chesterfield County Police
Department with many years of loyal and dedicated service; and
WHEREAS, Chesterfield County and the Board of Supervisors will miss Mrs.
Mabe's diligent service.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes Mrs. Deborah B. Mabe and extends on behalf of its

RECOGNIZING RICHARD GOODE UPON HIS RETIREMENT
WHEREAS, Mr. Richard Goode retired from the Office of the Commissioner
of the Revenue on October 1, 2019; and
WHEREAS, Mr. Goode began his public service with the county as a Tax
Assessment Specialist in the Office of the Commissioner of the Revenue on
April 1, 2002; and
WHEREAS, through his strong work ethic, knowledge, and dedication, Mr.
Goode was successful in his career, demonstrating his commitment to
improvement in part by taking all relevant career development courses;
participating in the University of Virginia, Weldon Cooper Center's Public
Service Program; working toward his Master Deputy Commissioner certification;
and he was a member of both the Virginia Association of Local Tax Auditors
and the Commissioner of the Revenue Association; and
WHEREAS, Mr. Goode had exemplary customer service skills and was very
effective working with the county's senior citizens regarding real estate tax
relief issues; and
WHEREAS, Mr. Goode has been a dedicated and faithful employee of
Chesterfield County's Commissioner of the Revenue for 17 years, and he
commuted over 100 miles each day from his home in the Northern Neck of
Virginia; and
WHEREAS, Mr. Goode opened his home to his co-workers when training
requiring an overnight stay was scheduled in that area of the state, and he
will be missed by his co-workers for his generosity, sense of humor, honesty,
integrity and caring attitude; and
WHEREAS, Mr. Goode was always helpful and displayed an understanding
attitude toward his customers, often going out of his way to explain tax
issues, help those in need, and remain calm as he assisted customers when
they were upset; and
WHEREAS, Mr. Goode will be fondly remembered for his pleasant
personality, light-hearted attitude and caring ways; may God bless him with
many more years filled with enriching the lives of others; and
WHEREAS, more than anything else, Mr. Goode has been a loyal friend to
many, a dedicated servant with a generous spirit, strong values, enduring
commitment and will be sorely missed at the county.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the contributions of Mr. Richard Goode to the citizens
and administration of Chesterfield County; and extends appreciation for his

Road Storm Sewer Repair Project

The Board is requested to appropriate $275,000 from the General Road
Improvement Account and authorize staff to proceed with the Redwater Ridge
Road Storm Sewer Repair Project.
Summary of Information:
Redwater Ridge Road is an existing two-lane, county -owned right-of-way with
curb, gutter, drainage inlets, and storm sewer that is in disrepair. A video
inspection of this facility was conducted, indicating extensive repairs were
necessary in order to transfer the roadway to the Virginia Department of
Transportation maintenance system.
The project involves rehabilitation of approximately 615 feet of storm sewer
ranging from 15 to 24 inches.
With the approval of this request, staff will proceed with the project
utilizing county funds.

Pursuant to state law, the County created five technology zones: the
Jefferson Davis Technology Zone and the Hull Street Road Technology Zone,
both of which will expire on December 31, 2023; and the Walthall Technology
Zone, Eastern Midlothian Technology Zone and Meadowdale-Meadowbrook
Technology Zone, which will expire on December 31, 2025. The goal of the
state authorized "zone programs" is to encourage new job creation and new
capital investment in targeted areas of communities by authorizing a locality
to provide a package of local tax incentives, fee waivers and regulatory
flexibility.
As a component of the incentive package for businesses locating or expanding
in one of the County's Technology Zones, County Code § 9-64 allows for a
rebate of taxes on machinery and tools used by certain businesses located
within a technology zone.

Currently, the Code applies if a business undertakes an expansion or
renovation with a capital investment in machinery and tools that results in
an increase in the assessed value of the property by 15*1 or $50, 000 whichever
is greater. This threshold investment criterion was added in 2005 to prevent
application of the rebate for routine maintenance and replacement of existing
equipment. But, the criterion has proved to be ineffective in actually
incentivizing business expansion. Among other problems, the threshold
affects small businesses and large businesses differently and can't be
applied fairly. For example, a large company could make a very substantial
capital investment in an expansion that doesn't increase the assessed value
of its property by 150. The proposed ordinance amendments will provide a
more detailed and useful definition of a "qualified facility expansion or
renovation" which can be applied fairly to small and large businesses, and
will encourage new capital investment and new job creation for those
businesses undertaking a bona fide expansion.
Staff recommends setting a public hearing for November 13, 2019 to consider
adoption of the proposed amendments.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTION 9-64 RELATING TO MACHINERY
AND TOOLS USED BY CERTAIN BUSINESSES LOCATED WITHIN
AN ENTERPRISE ZONE OR SUBZONE OR TECHNOLOGY ZONE
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 9-64 of the Code o the Countg_o Chester reld, 1997, as amended, is amended
and re-enacted to read as follotivs:
Sec. 9-64. Rebate—Machinery and tools used by eer-tain manufacturine businesses located
within an enterprise zone or subzone or technology zone.
(a) Any manufacturing business which after january 1, 2006 either (i) locates in an enterprise
zone or subzone or technology zone or (ii) undergoes a f edity exp—sti^^ .-nev^*i^.
"qualified facility expansion or renovation" as defined herein Whieh results in an inerease 0�
15 pereent or- $50,000.00, whiehever is greater-, in the assessed value of its machinery an
tools ever- the value of its maehinery and tools from the previous year- ("base year -2), shall
qualify for the rebate specified below, to the extent permissible under the Constitution of
Virginia. For any "small business" as defined by § 2.2-1604 of the Code of Virginia, a
"qualified facility expansion or renovation" shall mean Q creating 5 net new jobs and at least
$5,000,000 in new capital investment in machinery and tools or (ii) creating 10 net new jobs
and at least $1,000,000 in new capital investment in machinery and tools. For a business not
meeting the Code of Virginia definition of a "small business", a "qualified facility expansion
or renovation" shall mean (i) creating 25 net new jobs and making at least a $100,000,000
capital investment in machinery and tools, or 60 creating 50 net new jobs and at least
$5,000,000 capital investment in machinery and tools.
(b) An application for enterprise zone or technology zone benefits must be submitted to the
department of economic development and the benefit accessed by the business within one-
year of start of operations in the enterprise zone or subzone or technology zone, or within one-
year of a qualifying qualified facility expansion or renovation in order to receive the
machinery and tools tax rebate.
(c) The rebate amount shall be 100 percent of the tax on the assessed value being reported for
machinery and tools taxes for each of five consecutive years (the "rebate period"), beginning
the tax year after the business located in the zone or the tax year after the business achieves a
qualifying qualified facility expansion or renovation. However, in the case of a qualifying
plat qualified facility expansion or renovation, the rebate shall be limited to 100 percent of
the tax on the increase in the assessed value over the value from the base year assessed value.
The rebate period cannot be extended solely by relocating within or to another zone or by an
ownership change. The Treasurer shall issue a rebate within 60 days of receipt of full payment
of the machinery and tools tax for each year of the rebate period.

. To receive a rebate, a business
must file the annual return of machinery and tools, along with a detailed list of assets, with
the office of the commissioner of the revenue. The business must pay the resulting machinery
and tools tax and then submit mit ., ft4e., request to this efflee within 90 days of suepayment
asking at. the allowable portion of these taxes will be rebated. The commissioner may request
additional documentation from the business, and that documentation must be received within
ten days from the date of this request unless the commissioner agrees, in his sole discretion,
to an extension of time for the submission of such documentation. In no case, however, shall
the extension exceed 90 days. Failure to request the rebate or to submit the required
documentation, as determined by the commissioner in a timely manner shall result in
forfeiture of the machinery and tools rebate incentive for that year of the rebate period. Neither
a sale and lease -back agreement nor a subsequent purchase of equipment originally leased
shall extend the rebate period beyond the original five-year period.
(e) The rebate of tax on qualifying leased property must be issued directly to the lessor unless the
lessee provides documentation showing that the lessee either paid the tax on such property
directly to the county or reimbursed the lessor for such taxes.
(f) Any rebate available pursuant to this section shall first be used to satisfy any delinquent debts
owed to the county by the business.
(2) That this ordinance shall become effective immediately upon adoption.

Summary of Information:
Priority Way is a private road, .30 miles in length. It is a through -way
running from Ruffin Mill Road south to Walthall Center Drive named to conform
with the then Priority Auto Group ownership of automobile dealerships at this
location. This road is not in the state secondary road system.
The Priority dealerships are being sold and the new name will be Loyalty.
The new owners are requesting the change from Priority Way to Loyalty Way to
conform in the same manner.
There are two addresses on the current Priority Way, both of which are now
owned by the Loyalty organization.
This road name change requires Board of Supervisors approval, generally, as
all such changes must be approved by the Board, and specifically, as the new
name references a commercial entity.

The U.S. Department of Housing and Urban Development (HUD) awarded the County
$1,355,285 in Lead -Based Paint Hazard Reduction grant program funding and
$225,000 in Healthy Homes Supplemental funding. This grant is provided
through HUD's Lead Based Paint Hazard Reduction Program and Healthy Homes
Production Grant Program to identify and clean up dangerous lead in low-
income housing.
Proposed Use of Funds
With this funding, the County will address lead hazards in 75 housing units
providing safer homes for low- and very low-income families with children.
The grant will also provide funding to perform healthy homes assessments in
53 units, and work with other medical and social service providers.

To qualify for assistance, residents must live in a home built prior to 1978,
meet income eligibility guidelines, and must have a child in the residence
under 6 years of age.
The County will allocate $1,088,480 in funding to Project: HOMES as a sub-
grantee for this grant. Project: HOMES will be responsible for overseeing
the day-to-day operations for recruitment, applicant processing, scope of
work development, bidding for and selection of contractors, and oversight of
home interventions.
The program will use HUD Healthy Homes supplemental funding to conduct
Healthy Homes environmental assessments in homes receiving lead hazard
reduction interventions. These healthy homes interventions will address
household injury risks, indoor allergens, and other home-based environmental
health hazards such as mold and other asthma triggers, trip and fall hazards,
and radon and threats to building durability. In support of the county's
integrated program model, funds will be leveraged from weatherization and
home rehabilitation interventions provided by Project: HOMES to reduce energy
consumption, energy costs, and can address structural defects in homes
receiving lead interventions. In addition to improving the housing stock and
reducing the number of County residents exposed to lead hazards, this program
will provide free lead worker training, certification, and licensing to
residents to expand contract capacity and create career opportunities for
unemployed and underemployed County residents.
Additionally, the grant award does have a local match requirement, which
will leverage - in-kind funding that is appropriated and available in the
current FY20 budget, equal to $376,405.

I have advocated for years for "Responsible Development." My definition would
be simply: "To consider FIRST the ramifications of any proposed rezoning case
with respect to it's effect on existing and future residents and surrounding
properties, including traffic, noise, pollution, and suitability of proposed use." In
other words, put the citizens FIRST.
Previous Boards, and yes, this Board too, have not, in my opinion, followed this
simple, important concept. Some examples would be:
1. Allowing rezoning for Residential development adjacent to or across from
existing industrial zoning.
2. Allowing rezoning and building of schools adjacent to or across from
existing industrial zoning.
3. Allowing Industrial and Residential development on existing substandard
roads.
4. Allowing more intense uses adjacent to or across from existing residential
developments.
5. Allowing more intense, industrial zoning uses under the guise of what I term
"creative descriptive uses", to disguise the true use of the property, in
order to justify the rezoning.
6. Disregarding the ability of the Board to impose impact fees on developers,
to lessen the impact on residents.
Many times, you deal with cases involving the bad decisions of past Boards.
Please don't add even one more bad decision to those that have come before
you. I ask that in your consideration of cases, you put the residents,
homeowners, and taxpayers of this County FIRST. They are the ones who will live
with your decisions long after you have left the Board.
I request that the Board approve a) that real estate tax revenue generated by the
project be identified annually by staff and applied to transportation
improvements within -the traffic shed in which the project is located, or any traffic
shed which would provide relief to that shed, including turn lane improvements
to Woods Edge Road at Walthall Creek Drive and Southcreek Drive; sidewalk; and
noise mitigation measures if the average, 24 hour noise level measured at the
property line exceeds 65 decibels; b) that this application of tax revenue be
reflected in future appropriation resolutions; and c) that this application of
project revenue not be changed unless it is changed by a public vote of the Board
of Supervisors after holding a public hearing.

Staff requests the Board hold a public hearing for a land lease for the
construction of an additional corporate airplane hangar and to consider an
extension to the FBO Services Agreement with Dominion Aviation Services, Inc.
Summary of Information:
Dominion Aviation Services (DAS) has been a fixed based operator at the
Chesterfield County Airport since 1991, providing services such as fueling,
aircraft maintenance, hangar storage and aircraft management services. To
support business growth, DAS wishes to construct an additional corporate
hangar(s) and to extend its FBO services agreement with the County.
DAS wishes to construct one (1) at least 10,000 square foot hangar on pad
site 3 of the North Ramp Development area and enter into a FBO services
agreement extension with the County. Further, DAS intends to construct one or
more at least 10,000 square foot corporate hangars on the Southeast Ramp in
order to relocate their existing FBO operations.

As part of the FBO agreement extension, DAS will continue to provide the
following services: hangar storage of aircraft, tie -down parking of
aircraft, line service and sale of fuel, oil, lubricants and other incidental
supplies, maintenance and airframe repair of piston, rotor and turbine
aircraft, aircraft charter and management, sale and/or lease of aircraft and
aircraft parts and supplies, damaged aircraft removal for owned and/or
managed aircraft and ground transportation including provision of courtesy
and rental vehicles and rental vehicles. Aircraft rental and flight training
services will be provided through June 30, 2021. Restaurant services will be
provided until one of several contingencies occurs.
Staff has reached an agreement in principle with DAS with the following major
terms:
• DAS shall construct hangar(s) and relocate all its FBO operations to the
Southeast Ramp upon completion of Southeast Ramp infrastructure by the
County;
• If the County does not construct the Southeast Ramp by December 31, 2028,
DAS shall relocate its second -floor administrative offices to the
restaurant space in the terminal building at the County's request;
• Billing and collection of T -hangar rent increases from 50 of rent to 6.50;
• A 30 -year FBO services agreement. Two 5 -year options added if total
investment exceeds $1.8M;
• A 40 -year land lease; and
• $.105 per gallon fuel flowage fee reduced by the amount of the capital
maintenance fee or $.04 whichever amount is less (an increase of $.04 from
current agreement)

Following a public hearing adopt attached code amendment.
Summary of Information:
Following a public hearing on September 17, 2019, the Planning Commission by
unanimous vote forwarded a recommendation of approval on the attached code
amendment. In addition, by motion the Commission directed Staff report
annually to Commission over next four years on residential development
occurring under the provisions of the amendment. The motion also directed
staff to prepare, no later than four years from the date of the ordinance
adoption, an evaluation of the ordinance and its implementation for
Commission review and, if deemed appropriate by Staff, include any
recommendations regarding modifications or other actions relating to its
provisions. This evaluation shall thereafter occur on a cycle of four years.
The Northern Jefferson Davis Special Area Plan adopted in 2018 provided a
variety of guidelines as well as implementation steps to encourage
redevelopment along the corridor. As part of such guidance a steering
committee was established to help implement the plan. Among the
recommendations thus far provided by the committee is that staff undertake
efforts to provide for multifamily residential unit development along the
corridor.

This recommendation followed a market study that showed that smaller scale
multifamily development was a market need within the area plan boundaries.
Planning undertook a review of the committee recommendation, to include an
analysis of design standards, and proposed an ordinance amendment that would
provide for high density residential, to include multifamily and townhouse
dwelling units, as a restricted use in certain areas along the corridor.
Projects meeting the ordinance criteria would be limited in area, utilize
corridor frontage and be designed to be compatible with the established
Northern Jefferson Davis Highway Design District (NJDHDD)standards for
commercial properties. Such proposal is in keeping with the area plan's
guidelines of establishing new quality multifamily housing of a smaller
project size in mixed-use settings.
The amendment would, among other things, provide that certain C-3 and C-5
properties that front upon Jefferson Davis Highway north of Osborne Road be
permitted as multi -family or townhouse use with restrictions. The multifamily
residential uses would be limited to a depth of 500 feet from the corridor to
help encourage orientation towards the corridor and reduce impact upon
existing single family residential which is the predominant use in many
areas. In addition, projects containing such uses will be limited to only
those commercial uses permitted in the C-2 district and not include
automobile -oriented uses. The intent of such limitations is to provide for
commercial uses meeting the plan guidance of neighborhood business and to
help ensure compatibility, and reduce conflict, between the residential and
commercial uses allowed. Projects containing the multifamily or townhouse
residential use would be limited to a maximum of 10 acres and a minimum of 3
acres, provided that projects of 1.5 acres in size may be permitted where the
project is located at the intersection of an existing local road and
Jefferson Davis Highway. The density minimums for such residential uses are
15 and 10 dwelling units per acre respectively for multifamily or townhouse
use. Building design and the required community space for the uses are
intended to promote quality projects similar to that expected in more urban
environments elsewhere in the region.
AN ORDINANCE TO AMEND THE CODE OF THE COUNTY OF CHESTERFIELD,
1997, AS AMENDED, BY AMENDING AND REENACTING SECTIONS 19.1-53 & 19.1-378 OF
THE ZONING ORDINANCE RELATIVE TO ROUTE 1 RESIDENTIAL OVERLAY
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Sections 19.1-53 & 19.1-378 of the Code of the County of Chesterf eld, 1997, as amended, are
amended and re-enacted, to read as follows:
Chapter 19.1

districts provided that the restrictions as outlined below are met. If the restrictions cannot be met, the
use may be allowed in the respective zoning district through either a Conditional Use or Special
Exception.

a. Property was zoned C-3 or C-5 after April 11, 1989 and prior to May 24, 2006;
b. Minimum size of project incorporating multifamily uses is 67 gross acres;
c. Maximum of 30 percent of the gross acreage zoned C-3 or C-5 of the project is used for
multifamily and townhouse uses;
d. Use is incorporated into an integrated schematic plan;
e. Use complies with the requirements of the R -MF Zoning District, except that density may be
increased to 14 units per acre; and
f. Construction has begun on a minimum of 50 percent of the gross project area devoted to
nonresidential uses.
2. C-3, C-5 Districts:
a. Proiect fronts Jefferson Davis Highwav north of Osborne Road and nronerty is recommended
for Neighborhood Business, Community Business, Suburban Residential II, Residential Mixed
Use or Community Mixed Use in the Comprehensive Plan;
b. Use is located within 500 feet of Jefferson Davis Highway, this would not preclude accessory
parking or buildings from extending beyond the 500 feet;
c. Project has a minimum of 100 feet of contiguous frontage along Jefferson Davis Highway-,
d. Proiect size is no less than 3 acres and no more than 10 acres, provided that proiects of 1.5
acres shall be permitted if located at the intersection of a local road with Jefferson Davis

e. Minimum density is 15 dwelling units per acre;

f. In addition to buffers required by Table. 19.1-263.A.1.b., where use is located adjacent to an
occupied C or I property outside of project, a buffer shall be provided between use and the
adiacent property as required between the applicable C or I district and a R -MF zoning district;
g. Project meets Northern Jefferson Davis Highwily Design District (NJDHDD) standards as
identified in Sec. 19.1-379 except as otherwise stated within this subsection;
h. For projects containing less than 6 acres, buildings shall be a minimum of 3 stories and a
maximum of 4 stories. For projects 6 acres or more, buildings shall be a minimum of 3 stories
and a maximum of 6 stories. In no case shall the height of a building exceed 3 stories or 40
feet within 100 feet of MH or R districts;
i. The greater of 50 square feet per residential unit or 10 percent of total proiect area shall be
provided as hardscaped or landscaped common area. Up to 50 percent of required common
area may include rooftop garden space where such space is commonly accessible to, and
provides activity space for, residents;
j. At least 50 percent of residential units located above ground floor shall have a usable balcony
consisting of a minimum area of 5 feet by 8 feet;
k. Buildings shall be designed to impart harmonious proportions and avoid monotonous facades
or large bulky masses. Buildings containing multifamily units shall possess architectural
variety while at the same time have an overall cohesive urban character. Design elements such
as, but not limited to, balconies, terraces, articulation of doors and windows, sculptural or
textural relief of facades, architectural ornamentation, varied rooflines, other appurtenances
such as lighting fixtures and plantings may be used to achieve desired design;
1. The first floor of a building directly fronting Jefferson Davis Highway shall meet applicable
commercial building code requirements so as to provide for flexibility to accommodate
commercial uses. The first floor of a building directly fronting a road shall be on grade with
such road and have a minimum of 12 foot ceilings, or a higher standard if required by code,
where fronting Jefferson Davis Highway. This is not intended to preclude the use of an interior
elevated floor design for residential uses to provide privacy;
m. In addition to requirements of the NJDHDD, architecture for buildings containing dwellings
shall employ masonry at least to top of first floor on all facades visible from a road;
n. Commercial uses in the proiect are limited to those permitted in a C-2 district, excluding
automobile accessory store, automobile rental, automobile self service station and automobile
self service station, unmanned;

Summary of Information:
On May 27, 2015, the Board adopted a resolution requesting VDOT to restrict
through truck traffic from using Woods Edge Road between Ruffin Mill Road
and Lawing Drive. On November 2, 2015, VDOT denied the Board's request.
On July 24, 2019, the Board again adopted a resolution requesting VDOT to
restrict through truck traffic from using Woods Edge Road between Ruffin
Mill Road and Lawing Drive. VDOT subsequently informed the Transportation
Department that the route requested for restriction should be expanded to
include Lawing Drive and the section of Woods Edge Road between Lawing Drive
and Ramblewood Drive, and that a new public hearing should be held on the
revised route.
Staff recommends approval of the revised request for the truck restriction.

WHEREAS, the Chesterfield County Board of Supervisors
received a request to restrict any through truck or truck and

to consider amendments to County Code § 4-3 regarding wild or exotic animals.
Summary of Information:
The current County Code prohibits the keeping of poisonous snakes or other
poisonous animals as pets. A violation of County Code § 4-3 is a misdemeanor.
Recently, a resident keeping rattlesnakes was acquitted of that offense. The
defendant argued at trial that rattlesnakes are not technically poisonous
(poison is generally considered an ingested substance) and that rattlesnakes
are properly described as venomous because they inject venom with their
fangs. Accordingly, the defendant successfully maintained that he did not
keep poisonous snakes and that venomous snakes were not prohibited by County
Code § 4-3.

OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING
AND RE-ENACTING SECTION 4-3 RELATING TO
WILD OR EXOTIC ANIMALS AND PROVIDING FOR A PENALTY
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 4-3 of the Code of the County of Chesterreld. 1997, as amended, is
amended and re-enacted to read as folloivs:
Chapter 4. ANIMALS AND POULTRY
ARTICLE III. ANIMALS
DIVISION 1. GENERAL PROVISIONS
Sec. 4-3. Wild or exotic animals.
(a) A wild or exotic animal means any (i) live monkey (nonhuman primate), raccoon, skunk,
wolf, squirrel, fox, leopard, panther, tiger, lion, lynx or any other warm-blooded mammal,
(ii) poisonous or venomous snake, (iii) tarantula, (iv) other poisonous or venomous animal
normally found in the wild, or (v) any member of the crocodilian family including, but not
limited to, alligators, crocodiles, caimans, and gavials. Nonpoisonous or nonvenomous
snakes, ferrets, rabbits, laboratory rats, gerbils, hamsters and other similar small mammals,
and other domesticated animals which have been bred in captivity are not wild or exotic
animals.
(b) No person shall keep or permit to be kept on his premises any wild or exotic animal as a
pet, for display, or for exhibition purposes, whether gratuitously or for a fee. This
prohibition shall not apply to performing animal exhibitions, circuses, veterinary clinics, or
indoor/outdoor recreational facilities which have proper zoning and licenses from the
government; provided however, that no person shall exhibit or display any wild or exotic
animal in a manner so that persons other than their handlers can pet, fondle or come in direct
physical contact with them.
(c) The owner of any wild or exotic eri poisonous, animal as defined in subsection (a), found
to be running, roaming, or otherwise at large off of the owner's property shall reimburse the
county for its actual costs incurred, including without limitation the actual cost of the time
expended by the animal warden, deputy animal warden or other county personnel, in
locating and capturing or otherwise disposing of the animal.
(d) Nature centers, refuges or parks owned or operated by the federal, state or local
government are exempt from this section.
(2) That this ordinance shall become effective immediately upon adoption.

resolution of support for the project, upon approval by VDOT, appropriate up
to $476,000 in anticipated VDOT reimbursement, and transfer up to $95,200 in
county appropriations for local match funds.
Summary of Information:
On June 26, 2019 the Board of Supervisors held a public hearing and adopted
resolutions to request VDOT approval and guarantee the local match for the
following FY2021 and FY2022 Transportation Alternatives Program (TAP)
projects:
• Courthouse Road (Courts Complex Road to Route 10) Trail project,
estimated at $550,000: This project would continue the effort to provide
a pedestrian and bike facility along Courthouse Road as recommended in
the County's Bikeways and Trail Plan. Ultimately, this facility will
connect to Pocahontas State Park.
• Route 1 (Gettings Lane to Dwight Avenue) Sidewalk and Bike Improvements,
estimated at $575,000: This project is consistent with recommendations
in the Northern Jefferson Davis Special Area Plan and will support
on-going efforts to improve mobility options in the corridor.

Subsequent to the June 26, 2019 hearing, VDOT asked localities to consider
submitting additional TAP applications for projects that were considered for
federal safety program funds but were not selected for funding. One of these
projects is the Route 1 at Marina Drive HAWK Signal, estimated at $476,000.
This project involves the installation of a pedestrian -actuated signal that
will stop vehicular traffic on Route 1, allowing pedestrians to cross. This
project supports the county's effort to add bike/pedestrian facilities along
Route 1.
Transportation Alternatives Program (TAP) funding is intended for smaller -
scale, non-traditional transportation projects with applications for funding
submitted on a biennial basis.
TA projects are financed with 80 percent VDOT funds and a minimum 20 percent
local match. The local match is usually provided from county funds, other
sources, and/or from in-kind contributions.
VDOT staff will review project applications for eligibility and the
Commonwealth Transportation Board and Transportation Planning Organization
(TPO) will select projects for funding.
If selected and approved, this project will require a local match of $95,200.
Staff will provide the Board with a subsequent item recommending a source of
funding for the local match if the project is approved.
Recommendation:
Staff recommends the Board take the following actions:
Adopt the attached resolution requesting VDOT approval and guaranteeing the
local match for the Route 1 at Marina Drive HAWK Signal project.
WHEREAS, it is necessary that the local governing body
request, by resolution, approval of a proposed transportation
alternatives project.
NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors
of Chesterfield County requests the Commonwealth Transportation
Board provide funding for the Route 1 at Marina Drive HAWK Signal
project.
AND, BE IT FURTHER RESOLVED that the Board hereby agrees to
pay 20 percent of the total estimated cost of $95,200 for
construction of the Route 1 at Marina Drive HAWK Signal project.

James Street and Byrd Street and authorize the exercise of eminent domain for
the acquisition of the fee simple interest of James Street and Byrd Street
from the unknown heirs of Mable L. McCombie for the replacement sites for
Ettrick Elementary School and Fire and EMS Station 12, including the filing
of a certificate of deposit prior to the commencement of eminent domain
proceedings.
Summary of Information:
The replacement sites for Ettrick Elementary School and Fire and EMS Station
12 are within Part of "Orange Hill" subdivision. The developers of this 1930
subdivision granted a public easement or right of passage over the streets in
the subdivision, but reserved unto themselves the fee simple interest, or
ownership of the land for the streets. In order to clear title to James
Street and Byrd Street which are needed for the replacement sites, the public
right of use must be vacated, and title to the land acquired by the County.
Mable L. McCombie has been documented as the last owner of record, but no
record of the disposition of her estate has been found. Ms. McCombie was born
in 1896 and the last record of her was from Pennsylvania in 1974. Staff
located one potential heir of Ms. McCombie who refused to provide information
about the family. Because the current owners are unknown, staff could not
make a bona fide offer to purchase the property.
