Government program.
Summary of Information:
The Model County Government program is an opportunity for high school
government students to learn more about their local government. Each student
attends a board of supervisors' meeting, participates in a public -engagement
session hosted by the school board, and shadows a county or school leader.
The program is made possible through a partnership between Citizen
Information and Resources and the school's Instructional Specialist for
Social Studies.

Monthly Report on District Improvement Funds
Report Date: November 13, 2019

The County annually budgets $33,500 in discretionary funds, referred to as District Improvement Funds
(DIF), for each of the five magisterial districts that are used to improve the quality of life in each district.
The DIF allocations can be used for public improvements, purchase of county -owned equipment, public
events or programs, public school programs, and other legally allowable expenses. In addition, if funds
remain in DIF accounts at the end of each fiscal year, up to $37,500 may be reserved per district at year-
end to be utilized in a future year. With approval of this report, the Board consents to the use of available
reserve balance, if needed.
This report shows the cumulative use of District Improvement Funds for FY2020 as well as the current
funding available for each district. Requests to use funds for the current month are detailed below and
listed as a proposed use on the summary chart for that district. Upon Board of Supervisors acceptance of
this report each month, staff will execute proposed DIF requests.
There are two DIF uses proposed this month. Acceptance of this report by the Board constitutes Board
approval of these requests.
November 2019 Requests:
• Transfer up to $500 from the Bermuda District Improvement Fund to the Department of Parks and
Recreation to assist with costs associated with repairing the Marguerite Christian Athletic
Association Concession Building at Dodd Park. The Board is not authorized to give public funds to
organizations like the Association. The Board can, however, legally transfer public funds to the
Department of Parks and Recreation to make repairs to the concession stand since it is a capital
improvement to County property which will be used for a public recreational program.
Transfer up to $2,000 from the Dale District Improvement Fund to the School Board to assist with
costs associated with repairing the blacktop at Hopkins Road Elementary School. Upon repair, the
blacktop will be updated with curricular materials, such as playground games. The Board can
legally transfer public funds to the School Board to make repairs to the blacktop since it is a capital
improvement to County property which will be used by the public.

RECOGNIZING THE 50TH ANNIVERSARY OF PLANRVA
WHEREAS, in 1966, the General Assembly created the
Metropolitan Areas Study Commission, which found that a holistic
approach to solving local and regional problems needed to be taken
and recommended a new concept, the creation of planning district
commissions and service district commissions; and
WHEREAS, the Virginia Area Development Act (VADA), passed in
1968, created the planning district commission framework to
encourage and facilitate local government cooperation and
state/local cooperation in addressing problems of greater than
local significance on a regional basis; and
WHEREAS, following passage of the VADA, planning district
commission boundaries were announced, and planning district
commissions were established in 19 of the original 22 districts;
and
WHEREAS, in 2019, Virginia's planning district commissions,
now 21 in number, are celebrating 50 years of promoting and
supporting regional collaboration; and
WHEREAS, the Richmond Regional Planning District Commission,
now known as PlanRVA, was formed by local governments in the
greater Richmond region on August 14, 1969; and
WHEREAS, PlanRVA is a voluntary association comprised of nine
local governments intended to foster regional cooperation and to
address issues of a regional nature; and
WHEREAS, Chesterfield County has greatly benefited from its
membership in the organization and the opportunity to collaborate
with neighboring localities to address mutual challenges and
develop solutions for the greater Richmond region.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County
Board of Supervisors, this 23rd day of October 2019, publicly
recognizes PlanRVA, commends the regional commission on its
outstanding accomplishments, and offers congratulations on the
occasion of 50 years of service to the localities of the greater
Richmond region, as well as best wishes for continued success.
AND, BE IT FURTHER RESOLVED that a copy of this resolution be

RECOGNIZING MR. DENNIS K. "DENNY" MORRIS UPON HIS RETIREMENT AS
EXECUTIVE DIRECTOR OF THE CRATER PLANNING DISTRICT COMMISSION
WHEREAS, Mr. Dennis K. "Denny" Morris began his service with the
Crater Planning District Commission (Crater PDC) in 1971 as a planner;
and
WHEREAS, as a planner, Mr. Morris worked on local comprehensive
plans, land use ordinances and grant writing, as well as provided
technical assistance to Crater PDC's member localities; and
WHEREAS, in 1973, Mr. Morris was awarded a Masters degree in
Urban and Regional Planning from the University of Tennessee; and
WHEREAS, Mr. Morris was appointed Executive Director of the
Crater PDC in 1982; and
WHEREAS, Mr. Morris instituted regular meetings of the region's
CAOs and has consistently emphasized that communication with the CAOs
is necessary prior to embarking on new projects and programs; and
WHEREAS, during Mr. Morris' tenure, Crater PDC worked with the
U.S. Small Business Administration to establish the Crater Development
Company, which makes loans available to small businesses and has
maintained a financial portfolio that has reached $100+ million; and
WHEREAS, Chesterfield County joined the Crater Planning District
Commission in 1985, and since that time has greatly benefited from its
membership in the organization and the opportunity to collaborate with
neighboring localities to address mutual challenges and develop
solutions for the Tri -Cities region; and
WHEREAS, under Mr. Morris' leadership, Crater PDC successfully
coordinated the regional efforts on three occasions to not only protect
Fort Lee and the Defense Supply Center through the Base Realignment and
Closure (BRAC) process, but also to create numerous additional jobs and
responsibilities at both of these military installations; and
WHEREAS, since 2018, Crater PDC has been an advocate for the
Commonwealth Center for Advanced Manufacturing and its Apprenticeship
Academy, and Mr. Morris has championed this effort throughout the
region.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board
of Supervisors, this 13th day of November 2019, publicly recognizes Mr.
Dennis K. "Denny" Morris, expresses appreciation for his outstanding
contributions to Chesterfield County and the Tri -Cities region and
congratulates him upon his well-deserved retirement.

FIREFIGHTER COMBAT CHALLENGE TEAM IN THE WORLD CHAMPIONSHIP COMPETITION
WHEREAS, Between October 21St and October 26th, 2019, the Chesterfield
County Fire and EMS Women's Firefighter Combat Challenge Team competed in
the World Championships after achieving qualifying times on their first
attempt; and
WHEREAS, The Women's Firefighter Combat Challenge Team was composed of
Firefighter Audrey Baise, Firefighter Danielle Drinnon, Firefighter Lisette
Fuentes, Firefighter Kendall Litchfield and Firefighter Bebhinn Rae; and
WHEREAS, The Firefighter Combat Challenge course is a physically
demanding competitive obstacle course that simulates the physical demands of
real-life firefighting by preforming a connected series of five core tasks
to include climbing the 5 -story tower, hoisting a rolled hose bundle,
performing a simulated roof breach with a sledge hammer, advancing a charged
hose line and rescuing a life-sized 175 pound "victim"; and
WHEREAS, The Women's Firefighter Combat Challenge Team first qualified
for the World Competition in October 2018 at the State Fair of Virginia,
then again in June 2019 at the Virginia Beach, Virginia competition; and
WHEREAS, The Women's Firefighter Combat Challenge Team advanced through
two days of single elimination seed rounds to secure their spot in the final
bracket; and
WHEREAS, Firefighter Audrey Baise, Firefighter Danielle Drinnon,
Firefighter Lisette Fuentes, Firefighter Kendall Litchfield and Firefighter
Bebhinn Rae executed a tremendous effort on the course yielding a personal
best time of two minutes and twenty-six seconds;
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors, this 13th day of November 2019, publicly recognizes The
Chesterfield County Fire and EMS Department's Women's Firefighter Combat
Challenge Team and extends on behalf of the citizens of Chesterfield County,

Recognize the participants of the Fall Government Citizens Academy and the
Senior Ambassador Program and present certificates of completion.
Summary of Information:
The 2019 Fall Government Citizens Academy began on Sept. 17 and ends on Nov.
13. This is the county's sixth Government Citizens Academy, which began in
the spring of 2017, to enhance and grow the county's communications efforts
with its citizens. The Government Citizens Academy provides a hands-on
learning opportunity where citizens increase their knowledge and engagement
in county government. Through interactive sessions and tours of facilities,
residents get a comprehensive look at how and why programs and services are
provided.
This fall, we also introduced the Senior Ambassador Program, held directly
after Government Citizens Academy sessions. This program was specifically
designed to share information about county and community programs and
services for older adults and caregivers. Graduates of this program will be
able to foster positive change in their community through volunteerism,
education and advocacy. Many of the GCA members attended both sessions and
there were participants who came just for the Senior Ambassador Program.
Spanning nine weeks, both sessions were held on Tuesday mornings from 8:30-
12:30 p.m.

It is requested that the Chesterfield County Board of Supervisors approve the
nominee listed for appointment to the Community Criminal Justice Board for a
two-year term per the adopted by-laws of the Community Criminal Justice
Board. Appointments correspond to prescribed positions in the Code of
Virginia.
Summary of Information:
The Community Criminal Justice Board serves the 12th Judicial Court Circuit
consisting of Chesterfield County and the City of Colonial Heights. The
purpose is to provide for the development, planning, implementation, and
evaluation of community programs and services for the court in diverting
offenders and defendants from local correctional facilities.
At the June 14, 1995 meeting, the Board adopted a Resolution entitled Joint
Resolution Providing for the Implementation of the Comprehensive Community
Corrections Act (COCA) and Pretrial Services Act (PSA); Establishment of the
Chesterfield County and City of Colonial Heights Community Criminal Justice
Board; and provisions for Joint Exercise of Powers.

The Board is requested to set a public hearing for December 11, 2019, to
consider amendments to County Code § 13-41 increasing the penalties for
unlawful parking in fire lanes, too close to fire hydrants, in spaces
reserved for persons with disabilities, or in striped access aisles adjacent
to spots reserved for such persons, and to allow uniformed law-enforcement
department employees to issue written notice of violations.
Summary of Information:
The County Code currently provides for a civil penalty of $25.00 for
unlawfully parking in a fire lane or too close to a fire hydrant. The Police
Department has requested that the penalty be raised to $75.00. This is the
maximum penalty authorized by the state code for these types of violations
of the County's parking ordinance.
In addition, the Police Department has requested that the penalty for
unauthorized parking for spaces reserved for persons with disabilities be
increased from $100.00 to $500.00. The $500.00 penalty is the maximum amount
allowed by state law.

State law now authorizes the County to provide that no vehicle shall be
parked in any striped access aisle adjacent to a parking space reserved for
persons with disabilities. This provision has been added to the ordinance.
Furthermore, the language that refers to persons with disabilities in the
ordinance has been updated and is consistent with the language of the state
enabling legislation.
The General Assembly has amended Virginia Code §46.2-1220 to allow for
uniformed law-enforcement department employees to issue written notice of
violations. This ordinance has been amended to reflect this new statutory
authority allowing enforcement by police service aides in addition to police
officers.
Staff recommends the Board set a public hearing for December 11, 2019, to
consider the attached ordinance amendments.

AN ORDINANCE TO AMEND THE CODE OF THE COUNTY
OF CHESTERFIELD, 1997, AS AMENDED, BY AMENDING AND RE-ENACTING
SECTION 13-41, RELATING TO UNLAWFUL PARKING AND PROVIDING FOR A
PENALTY
BE IT ORDAINED by the Board of Supervisors of Chesterfield County:
(1) That Section 13-41, of the Code of the County of Chesterfield, 1997, as amended, are
amended and re-enacted to read as follows:
See. 13-41. - Unlawful parking generally.
(a) No person shall park a vehicle on county -owned or other public property in violation of
any of the provisions of this subsection. Any person who receives written notice from a
police officer, uniformed law-enforcement department employee, or sheriffs deputy that he
has committed any of the offenses listed in this subsection may waive his right to appear and
be formally tried for the offense. The waiver shall be effective when the person (i)
voluntarily pays $25.00 to the county treasurer's office within five days after receipt of the
notice, except that a violation of Section 13-41(a)(4) or Section 13-41(a)(16) shall require a
payment of $75.00 or (ii) voluntarily places $25.00 in the reply mail envelope on which the
notice of violation is printed and mails it to the county treasurer's office so that it is
postmarked within five days after receipt of the notice, except that a violation of Section 13-
41(a)(4) or Section 13-41(a)(16) shall require a payment of $75.00. Such person shall not
thereafter be required to appear before the general district court for trial upon the offense set
forth in the notice. Such offenses shall include parking a vehicle:

(4) Within 15 feet of a fire hydrant or in any way that obstructs a fire hydrant.

(16) Within any established fire lane.
(b) No person shall park a vehicle on private property, including private parking lots open to
the public and designated to accommodate more than 50 vehicles, in violation of the
provisions of this subsection (b). Any person who receives a written notice from a police
officer or uniformed law-enforcement department employee that he has committed any of
the offenses listed in this subsection (b) may waive his right to appear and be formally tried
for the offense. The waiver shall be effective when the person (i) voluntarily pays $25.00 to
the county treasurer's office within five days after receipt of the notice, except that a

impaired in his ability to walk to park a vehicle in a parking space so designated except when

Summary of Information:
Moving Forward... The Comprehensive Plan for Chesterfield County identifies
several specific area plans that should be completed to provide additional
detailed planning beyond the recommendations of the countywide plan. The
Board is requested to consider a replacement for the current Midlothian Area
Community Plan adopted in 1989.
Staff, community stakeholders, and the elected/appointed Board/Planning
Commissioner for the area have been working to create this draft plan
amendment since February 2016. The draft plan was crafted upon extensive
community input and serves as a vision plan for the future of Midlothian. The
Planning Commission held a public hearing on this item on August 20, 2019 and
deferred action to allow additional community input and revisions.
It is anticipated that the Planning Commission will act on the draft plan at
their regular meeting on Tuesday, November 19, 2019, and if such action
occurs, then a public hearing will occur on December 11, 2019.

Summary of Information:
Under Virginia law, personal property used for charitable and benevolent
purposes may be classified as exempt from taxation by the Board of
Supervisors. This year COSIG, Incorporated ("COSIG"), a non-profit
organization with an office in Chesterfield County, has requested a tax
exemption for personal property located at 12750 Jefferson Davis Highway.
COSIG is a benevolent, non-profit Virginia corporation, which houses, trains,
feeds, and assists homeless veterans. In 2019, it owned personal property
assessed at $64,594.00, leading to a tax of $948.43.
Staff has reviewed the information which state law requires the Board to
consider before granting an exemption and finds that the information is
consistent with COSIG's status as a benevolent, non-profit organization that
is eligible for the tax exemption. The criteria which the Board must consider
under state law are attached.

preserves, and publicly displays antique fire equipment that shows the

RECOGNIZING FIREGHTER JOHN K. "KEVIN" BRANCH UPON HIS RETIREMENT
WHEREAS, Firefighter John K. "Kevin" Branch retired from the
Chesterfield Fire and Emergency Medical Services Department, Chesterfield
County, on November 1, 2019; and
WHEREAS, Firefighter Branch began his career with Chesterfield County
in May 1998, as a member of Recruit School #27; and
WHEREAS, Firefighter Branch faithfully served the citizens of
Chesterfield County for more than 21 years as a firefighter at Ettrick
and Dutch Gap Fire and EMS Stations; and
WHEREAS, Firefighter Branch received his Firefighter Specialist
certification and has assisted numerous officers in the conduct of their
duties, as well as leading firefighters throughout his career; and
WHEREAS, Firefighter Branch served as an acting lieutenant at Dutch
Gap Fire and EMS Station on both Engine 14 and Truck 14; and
WHEREAS, Firefighter Branch served as an assistant fire marshal; and
WHEREAS, Firefighter Branch served as a rescue diver for the
Department's Scuba Rescue Team for 8 years; and
WHEREAS, Firefighter Branch was awarded a LifeSave award for rescuing
a woman trapped in her car in rising floodwater in 2004, exemplifying a
high level of service to the citizens of Chesterfield County; and
WHEREAS, Firefighter Branch received a Unit Citation for rescuing a
horse in 2002; and
WHEREAS, Firefighter Branch received an EMS Unit Citation for
treating and saving the life of a person in cardiac arrest in 2003; and
WHEREAS, Firefighter Branch received a Unit Citation for rescuing
three victims trapped in a vehicle in floodwaters in 2004; and
WHEREAS, Firefighter Branch received a Unit Citation for rescuing
boaters stranded on the James River in 2007; and
WHEREAS, Firefighter Branch received a Unit Citation for treating a
patient with Chest Pain in 2012.
NOW, THEREFORE, BE IT RESOLVED that the Chesterfield County Board of
Supervisors recognizes the contributions of Firefighter John K. "Kevin"
Branch, expresses the appreciation of all citizens for his service to the
county, and extends their appreciation for his dedicated service and their

The Board of Supervisors is requested to accept the Nutrient Offset
Allocation Agreement with Dominion Energy Virginia and authorize the County
Administrator to execute the Nutrient Offset Agreement including possible
future nutrient allocation transfers from Dominion Energy Virginia to
Chesterfield County.
Summary of Information:
Chesterfield County owns and operates two municipal wastewater treatment
plants, the Falling Creek Wastewater Treatment Plant and the Proctors Creek
Wastewater Treatment Plant. Dominion Energy Virginia owns and operates an
electric generating facility located in Chesterfield County. These three
facilities were allocated nutrient wasteload allocations in accordance with
the General Virginia Pollutant Discharge Elimination System Watershed Permit
Regulation for Total Nitrogen and Total Phosphorus Discharges, 9 VAC 25-820,
issued by the Virginia Department of Environmental Quality (DEQ). Compliance
with Nitrogen and Phosphorus allocations is required by the Watershed General
Permit.
All available Nitrogen and Phosphorous allocations for point source
dischargers have been assigned to active facilities with no additional
capacity available for future expansion of existing facilities or new
facilities.

The Falling Creek Wastewater Treatment Plant expanded from 10.1 to 12.0
million gallons per day and the Proctors Creek Wastewater Treatment Plant
will expand from the current capacity of 27 million gallons per day to an
ultimate capacity of 54 million gallons per day in the future. The transfer
of available nitrogen allocation from Dominion Energy Virginia to
Chesterfield County will facilitate continued compliance with the above-
mentioned regulation and provide an additional method for compliance in the
future as the Proctors Creek Wastewater Treatment Plant expands.
By Chesterfield County purchasing and Dominion Energy Virginia providing
additional nitrogen allocation, both parties are assisting DEQ in achieving
state water quality goals while also reducing current demand on limited
resources available through the Virginia Water Quality Improvement Fund,
consistent with DEQ policy.
Chesterfield County has funding available for the $110,539.34 purchase of
28,937 pounds of nutrient allocation within the current operating budget.
Approval is recommended.

NUTRIENT OFFSET ALLOCATION AGREEMENT
BETWEEN DOMINION ENERGY VIRGINIA
AND CHESTERFIELD COUNTY
This Nutrient Offset Allocation Agreement (thus "Agreement') is made this day of
2019, by and between Virginia Electric and Power Company d/b/a Dominion
Energy Virginia ("Dominion") and the County of Chesterfield, Virginia ("Chesterfield") (each a
"Party" and collectively the "Parties").

12 A. Dominion owns and operates an electric generating facility known as the
13 Chesterfield Power Station located at 500 Coxendale Road, Chester, Virginia 23836-2461 in
14 Chesterfield County, Virginia.

16 B. Chesterfield owns and operates two municipal wastewater treatment plants located
17 in Chesterfield County known as the Falling Creek Wastewater Treatment Plant (the "Falling
18 Creek PlanfD and the Proctors Creek Wastewater Treatment Plant (the "Proctors Creek Plant" and,
19 collectively with the Falling Creek Plant, the "Chesterfield Plants'), which provide treatment for
20 wastewater from Chesterfield County and certain surrounding areas.

22 C. The Chesterfield Power Station and the Chesterfield Plants are subject to the
23 General Virginia Pollutant Discharge Elimination System Watershed Permit Regulation for Total
24 Nitrogen and Total Phosphorus Discharges and Nutrient Trading in the Chesapeake Bay
25 Watershed in Virginia, 9 VAC 25-820 et seq. (the "Watershed General Permit").

27 D. The Chesterfield Power Station has been allocated a total nitrogen wasteload
28 allocation ("Nitrogen Allocation") of 272,036 pounds per year ("lbs/yr"), and a total phosphorus
29 wasteload allocation ("Phosphorus Allocation") of 170 lbs/yr.

31 E. The Chesterfield plants are subject to an aggregate Nitrogen Allocation of 564,952
32 lbs/yr (representing the sum of 153,801 lbs/yr for Falling Creek Plant and 411,151 lbs/yr for
33 Proctors Creek Plant, respectively) and an aggregate Phosphorus Allocation of 45,817 lbs/yr
34 (representing the sum of 12,473 lbs/yr for Falling Creek Plant and 33,344 lbs/yr for Proctors Creek

37 F. Each of the above allocations was adopted and affirmed by the Virginia State Water
38 Control Board and Virginia Department of Environmental Quality (collectively, "DEQ'D through
39 its adoption in 2017 of the above -referenced Watershed General Permit and associated
40 Registration List and through adoption of the Water Quality Management Planning Regulation, 9
41 VAC 25-720-60 C (James River Basin Nitrogen and Phosphorus Wasteload Allocations) and is in
42 full force and effect as of the date of this Agreement.

44 G. The above -referenced allocations for the Falling Creek Plant are based on the
45 plant's pre -2013 design capacity of 10.1 million gallons per day ("MGD"). In 2013, Chesterfield
46 expanded the Falling Creek Plant to 12.0 MGD. Chesterfield intends to fully offset the nutrient
47 load associated with the additional 1.9 MGD of capacity by nutrient trading.

49 H. Pursuant to Code of Virginia section 62.1-44.19:12 et seq., 9 VAC 25-720-40 A,
50 and 9 VAC 25-820-70, Part I1 B 1 a, Dominion is authorized to transfer, and Chesterfield is
51 authorized to acquire, a portion of the Chesterfield Power Station's surplus Nitrogen Allocation to
52 satisfy Chesterfield's offset obligation under the Watershed General Permit for the Falling Creek

57 In consideration of the mutual covenants and conditions herein, and for good and valuable
58 consideration, the receipt and sufficiency of which the Parties hereby acknowledge, the Parties
59 agree as follows.

61 1. Agreement for Sale and Purchase of Offset Allocations. Effective January 1, 2020,
62 Chesterfield agrees to purchase, and Dominion agrees to permanently transfer, 28,937 lbs/yr of
63 surplus Nitrogen Allocation to Chesterfield as established on the Wasteload Allocation Schedule
64 attached as ADoendix A hereto (the "Offset Allocation").

66 2. Offset Allocation Transfer—ANrovalbv_DEO. Upon execution of this Agreement,
67 Chesterfield shall notify and provide this Agreement as evidence to DEQ that Dominion and
68 Chesterfield request DEQ permanently transfer the Offset Allocation to Chesterfield by amending
69 the Watershed General Permit Registration List effective January 1, 2020 and that all subsequent
70 documents or regulations, as each document or regulation is reviewed or reissued, be amended as
71 well to reflect the Offset Allocations transfer to offset the expansion of the Falling Creek Plant
72 from 10.1 MGD to 12.0 MGD.

74 3. Offset Allocations Invoice. After DEQ documents the permanent transfer of the
75 Offset Allocations from Dominion to Chesterfield on the Watershed General Permit Registration
76 List indicating the transfer to Chesterfield of the Offset Allocation, Dominion shall invoice
77 Chesterfield for the purchase price specified in Apcendix A. Chesterfield shall pay within 30 days
78 of receipt of a proper invoice. Chesterfield shall have no responsibility for payment of the purchase
79 price if DEQ fails to approve and transfer the Offset Allocation as provided herein and, to the
80 extent the transfer is not successful, and Chesterfield has already paid the invoice, Dominion shall
81 refund Chesterfield the amount previously paid. Chesterfield shall not be responsible for any costs,
82 fees, taxes or other charges of any kind.

84 4. Purchase of Additional Nitrogen Allocation - Right of First Refusal. Dominion
85 understands that Chesterfield intends to expand the Proctors Creek Wastewater Treatment Facility
86 and will have a need for additional Offset Allocations. Dominion agrees to not transfer or sell any
87 of Chesterfield Power Station's surplus Nitrogen Allocation to a third party without first providing
88 Chesterfield a notice of intent to transfer the surplus Nitrogen Allocation (the "Notice").
89 Chesterfield shall have until the close of business on the fifteenth (15'') day after the Notice to
90 notify Dominion of its intent to purchase the surplus Nitrogen Allocation. If Chesterfield notifies
91 Dominion of its intent to purchase the surplus Nitrogen Allocation, the purchase shall be on or

92 before the thirtieth (30t`) day after the initial Notice at the rate specified in the Exchange Credit
93 Price Schedule for that compliance year. If Chesterfield does not exercise its right to purchase the
94 surplus Nitrogen Allocation within the designated timelines, then Dominion may transfer the
95 surplus Nitrogen Allocation to a third party. Dominion will be under no obligation to convey to
96 Chesterfield any Nitrogen Allocation needed for operation of Dominion's facilities, including the
97 Chesterfield Power Station, or otherwise provide notice to Chesterfield of the use of such Nitrogen
98 Allocation by Dominion.

100 5. Mutual Cooperation. The Parties shall continue to cooperate with each other as
101 reasonably necessary to accomplish the transfer of the Offset Allocations provided under this
102 Agreement in accordance with applicable laws, regulations and the Watershed General Permit.

104 6. Tenn. This Agreement shall be binding upon its execution by the Parties. Section
105 4 of this Agreement shall continue in force until terminated in accordance with the provisions of
106 section 7.

108 7. Termination without Cause. Either Party may terminate section 4 of this
109 Agreement without cause upon two (2) years of prior written notice to the other.

111 8. Notices. All notices, requests, demands, claims and other communications
112 hereunder shall be in writing, shall be delivered in person or by mail (first class, postage pre -paid)
113 or overnight delivery, and shall be deemed given when delivered in person or, if not delivered in
114 person, when received (or delivery is refused) by the Party to whom such notice, request, demand,

137 under this Agreement, has been duly authorized by all necessary action on its behalf, and does not

139 a material breach of or constitute a material default under any agreement, indenture or instrument
140 of which it is a party or by which it or its properties may be bound or affected. To each Party's

142 any of its properties, before any court or governmental authority that, if determined adversely to
143 such Party, would have a material adverse effect on the transactions contemplated by this

146 10. No Brokerage Commissions. The Parties represent and warrant to each other that
147 they have not dealt with any business broker or agent who would be entitled to a brokerage
148 commission or finder's fee as a result of this Agreement or any related transactions.

150 11. No Third Party Beneficiaries. This Agreement is solely for the benefit of the Parties
151 hereto and their permitted successors and assignees and shall not confer any rights or benefits on
152 any other person.

154 12. Assignment. This Agreement, and the rights and obligations hereunder, shall inure
155 to the benefit of and shall be binding upon any successors of the Parties. The Parties may not
156 transfer or assign this Agreement, or its rights or obligations hereunder, without the prior written
157 consent of the other Party.

159 13. Governing Law, Severability. This Agreement shall be construed in accordance
16o with and governed for all purposes by the laws of the Commonwealth of Virginia. If any word or
161 provision of this Agreement as applied to any Party or to any circumstance is adjudged by a court
162 to be invalid or unenforceable, the same shall in no way affect any other circumstance or the
163 validity or enforceability of any other word or provision. Any legal action brought under this
164 Agreement shall be brought in the Circuit Court of the County of Chesterfield, Virginia, and in no
165 other court or jurisdiction.

167 14. No Waiver. Neither any failure to exercise nor any delay in exercising any right,
168 power or privilege under this Agreement by either Party shall operate as a waiver, nor shall any
169 single or partial exercise of any right, power or privilege hereunder preclude the exercise of any
170 other right, power or privilege. No waiver of any breach of any provision shall be deemed to be a
171 waiver of any preceding or succeeding breach of the same or any other provision, nor shall any
172 waiver be implied from any course of dealing.

174 15. Change in Law. In the event that there is a change in law, regulation, rule or
175 regulatory policy after the effective date of this Agreement that adversely affects or prevents the
176 performance of a Party's obligation under this Agreement ("Change in Law'), the affected Party
177 shall give the other Party written notice of such change ("Change in Law Notice"). Within five
178 (5) Business Days after receipt of the Change in Law Notice, representatives of the Parties shall
179 enter into a good faith negotiation on mutually agreeable amendments to this Agreement to take
180 into account such Change in Law. If the Parties are unable to agree on the necessary amendment
181 within forty-five (45) days of the Change in Law Notice, either Party may terminate this
182 Agreement upon written notice to the other Party.

184 16. Entire Ageement: Amendments. This Agreement contains the entire agreement
185 between the Parties as to the subject matter hereof and supersedes all previous written and oral
186 negotiations, commitments, proposals and writings. This Agreement does not amend or terminate
187 the Wastewater Supply Agreement executed by Chesterfield and Dominion on March 30, 2007.
188 No amendments, including amendments necessary for the purchase of additional Offset
189 Allocations pursuant to Section 4 of this Agreement, may be made to this Agreement except by a
190 writing signed by both Parties.

192 17. Counterparts. This Agreement may be executed in one or more counterparts, each
193 of which shall be deemed an original, but all of which together shall constitute one and the same
194 instrument.

196 18. Recitals. The Recitals are hereby incorporated by reference as though fully set forth
197 herein.

Additionally, early projections indicate additional FY2020 State revenue of
approximately. $3.8 million. The Board of Supervisors is requested to
appropriate up to $3.8 million toward the initiatives listed in Schedule B.
As delineated below and attached, item numbers one and two address partial
year funding of recurring costs for English language learner/special
education teachers, additional teacher and support staff positions and an
increase in bus driver hourly pay. Item number three allocates approximately
$1.254 million of one-time funding toward security camera enhancements at
two high schools. Personnel estimates listed in items one and two below are
conservative, based on hire and fill dates for the new positions and bus
driver schedules, and will likely result in FY2020 savings. Any FY2020
savings from items one and two will be set aside to create a VRS reserve
that could be used to smooth the increased VRS rate costs, of which the State
will contribute a proportionate share in FY21. Entering FY2021, the full
year cost of items one and two is projected at $3.3 million. Because item
number three is a one-time expense, that funding will become available in
FY2021 to .cover the gap required for a full year of items one and two,
leaving $500,000 in ongoing funding to be applied towards VRS or other needs.

PERTINENT INFORMATION
On May 14, 2019, the School Board adopted the FY2020 annual financial plan totaling
$732,913,880 for all funds, including $31,853,100 for the Grants Fund. There are a number of
grant changes based on actual awards as compared to the adopted budget. These changes are
outlined in Attachment A.
Actual awards for all grants that differ from the budget amounts are reflected in Attachment A;
however, only a subset of these will require Board action. Specifically, action is required for a
transfer from the grant reserve (instruction appropriation category) to the operations and
maintenance category for the School Security Equipment grant, as well as to the technology
category for the STOP School Violence grants.
RECOMMENDED ACTION
The Superintendent recommends that the School Board approve the transfer of $200,000 from
the Instruction appropriation category to the Operations and Maintenance appropriation category
for the School Security Equipment grant and the transfer of $419,678 from the Instruction
appropriation category to the Technology appropriation category for the STOP School Violence
grants.

WHEREAS, the grant budget was adopted on May 14, 2019; and
WHEREAS, the original budget requires an adjustment due to the receipt of additional grant
awards; and
WHEREAS, Attachment A above has stated the changes needed and with these awards a
request for a transfer of funds across appropriations will be required;
NOW, THEREFORE, BE IT RESOLVED, that on motion of
seconded by , the School Board hereby requests the Board of Supervisors
to authorize the transfer of funds from the Instruction appropriation to the Operations and
Maintenance appropriation, in the amount of $200,000, for the School Security grant and to the
Technology appropriation, in the amount of $419,678, for the STOP School Violence grants.

On July 24, 2019, the Board of Supervisors held a public hearing to consider
the adoption of a capital maintenance fee of $ . 04 per gallon of fuel dispensed
at the County Airport to generate additional revenue for ongoing capital
maintenance costs. Following the public hearing, the Board voted to defer a
decision on this item until its September 25, 2019 meeting. At the September
25, 2019 meeting, the Board voted to further defer the item until additional
information became available on development and expansion of the airport and
its impact on future financial sustainability.
At its September 25, 2019 meeting, the Board approved a new hangar land lease
and an extension of the existing FBO agreement with Dominion Aviation
Services (DAS) that included a fuel flowage fee of $.105 per gallon of fuel
dispensed. This provision also contractually increases the fuel flowage fee
of the Airport's other FBO, Richmond Executive Aviation to an equivalent
level.

amended, is enacted to read as follows:

Article XXI. Airport Capital Maintenance Fee
Sec. 9-272. Imposition of fee on fuel dispensed at the airport.
Pursuant to S 5.1-44 of the Code of Virginia, there is hereby imposed a capital maintenance
fee of $0.04 on every Fallon of fuel dispensed from the fuel farm or anv other source of fuel at the
county's airport. Such fee shall be collected by all fixed -base operators located at the airport and
any other entities authorized to dispense fuel at the airport and remitted to the county within ten
( 10) days after the end of the month in which such fees are collected. Remittances shall clearly
break out the capital maintenance fee from any other amounts paid to the county. The revenue
collected from such fees shall be used exclusively to defray the capital costs of providing and
maintaining airport facilities. The county administrator shall review the capital maintenance fee
annually to ensure that the revenue generated by the fee does not exceed the county's costs of
maintaining airport facilities, including establishing reasonable reserves for such purposes.
(2) That this ordinance shall become effective December 1, 2019.

The Board is requested to hold a public hearing to consider amending § 9-64
of the County Code relating to technology zones.
Summary of Information:
Pursuant to state law, the County created five technology zones: the
Jefferson Davis Technology Zone and the Hull Street Road Technology Zone,
both of which will expire on December 31, 2023; and the Walthall Technology
Zone, Eastern Midlothian Technology Zone and Meadowdale-Meadowbrook
Technology Zone, which will expire on December 31, 2025. The goal of the
state authorized "zone programs" is to encourage new job creation and new
capital investment in targeted areas of communities by authorizing a locality
to provide a package of local tax incentives, fee waivers and regulatory
flexibility.
As a component of the incentive package for businesses locating or expanding
in one of the County's Technology Zones, County Code § 9-64 allows for a
rebate of taxes on machinery and tools used by certain businesses located
within a technology zone.

Currently, the Code applies if a business undertakes an expansion or
renovation with a capital investment in machinery and tools that results in
an increase in the assessed value of the property by 15% or $50, 000 whichever
is greater. This threshold investment criterion was added in 2005 to prevent
application of the rebate for routine maintenance and replacement of existing
equipment. But, the criterion has proved to be ineffective in actually
incentivizing business expansion. Among other problems, the threshold
affects small businesses and large businesses differently and can't be
applied fairly. For example, a large company could make a very substantial
capital investment in an expansion that doesn't increase the assessed value
of its property by 15%. The proposed ordinance amendments will provide a
more detailed and useful definition of a "qualified facility expansion or
renovation" which can be applied fairly to small and large businesses, and
will encourage new capital investment and new job creation for those
businesses undertaking a bona fide expansion.
Staff recommend holding a public hearing to consider adoption of the
proposed amendments.

(1) That Section 9-64 of the Code of the County of Chestedeld, 1997, as amended, is amended
and re-enacted to read as follows:
Sec. 9-64. Rebate Machinery and tools used by eer-tain manufacturing businesses located
within an enterprise zone or subzone or technology zone.
(a) Any manufacturing business which after- january1.2006 either (i) locates in an enterprise
zone or subzone or technology zone or (ii) undergoes a f eility o.,,,nevatwfi
"qualified facility expansion or renovation' as defined herein „hie result ise ^�

qualify for the rebate specified below, to the extent permissible under the Constitution of
Virginia. For any "small business" as defined by § 2.2-1604 of the Code of Virginia, a
,,qualified facility expansion or renovation' shall mean (i) creating 5 net new jobs and at least
$5,000,000 in new capital investment in machinery and tools or (ii) creating 10 net new jobs
and at least $1,000,000 in new capital investment in machinery and tools. For a business not
meeting the Code of Virginia definition of a "small business", a "qualified facility expansion
or renovation' shall mean (i) creating 25 net new jobs and making at least a $100,000,000
capital investment in machinery and tools, or (ii) creating 50 net new jobs and at least
$5,000,000 capital investment in machinery and tools.
(b) An application for enterprise zone or technology zone benefits must be submitted to the
department of economic development and the benefit accessed by the business within one-
year of start of operations in the enterprise zone or subzone or technology zone, or within one-
year of a qu qualified facility expansion or renovation in order to receive the
machinery and tools tax rebate.
(c) The rebate amount shall be 100 percent of the tax on the assessed value being reported for
machinery and tools taxes for each of five consecutive years (the "rebate period"), beginning
the tax year after the business located in the zone or the tax year after the business achieves a
quali qualified facility expansion or renovation. However, in the case of a qu
mit qualified facility expansion or renovation, the rebate shall be limited to 100 percent of
the tax on the increase in the assessed value over the value from the base year assessed value.
The rebate period cannot be extended solely by relocating within or to another zone or by an
ownership change. The Treasurer shall issue a rebate within 60 days of receipt of full payment
of the machinery and tools tax for each year of the rebate period.

Summary of Information:
Staff has made bonafide but ineffectual efforts to acquire permanent
restoration easements and temporary construction easements for the Pocoshock
Creek Stream Restoration Project. Offers have been made for easements across
the following properties: 460 Pocono Drive, Chester T. Purvis, IV and Jessica
T. Nguyen, $100.00; 10503 Keithwood Parkway, Raymond E. Melton, $291.00; and
10100 Natural Bridge Road, Tina M. Saintsing, $100.00. The offers have not
been accepted. Staff will continue to negotiate with these owners in an
effort to reach an agreement.
Staff has acquired permanent restoration and temporary construction easements
across the following properties: 10505 Keithwood Parkway, Emily Jean Freeman
and Robert M. Mothershead, $100.00; and 410 Pocono Drive, Daniel Christopher
Loving,$144.00. However, it is necessary to proceed with eminent domain due
to the inability to obtain subordinations or consents from their lenders in a
timely manner.
