STAFF RECOMMENDATION
Recommend approval of rezon'ing for' the following reasons:
A. The requested zoning and land use conforms to the Turner Road Corridor
Land Use and Transportation Plan,. which designates the property for
commercial uses.
B. The development standards of the Zoning Ordinance will further ensure.

c. The proffered conditions address the impact on fire services and the
transportation network.

Prior to obtaining a building permit, one of the following
shall be accomplished for fire protection:
A. The owner, developer or assignee(s) shall pay to the
county $150 per 1,000 square feet of gross floor area
adjusted upward or d.ownward by the same percentage that
the Marshall Swift Building Cost Index increased or
decreased between June 30, 1991 and the date of
payment. With the approval of the County's Fire Chief,
the owner, developer or assignee(s) shall receive a
credit toward the required payment for the cost of any
f ire suppression system not otherwise required by law
which is included as a part of the development.
OR
B. The owner, developer or assignee( 5) shall provide a
fire suppression system not .otherwise required by law
which the County's Fire Chief determines substanti.ally
reduces the need for County facilities otherwise
necessary for fire protection.
Applicants agree to, accomplish A or B prior to obtaining a
building permit.

of way on the east side of Turner Road measured fram the
centerline of that part of Turner Road ;mmpn; ;:ITf'Jy adjacent
to the property shall be dedicated, free and unrestricted,
to and for the benefit of Chesterfield County.

Access to Turner Road sball be limited to one (1)
entrance/exit; provided, however, that at time of site plan
approval the Transportation Department may grant no more
than one (1) additional entrance/exit to Turner Road subject
to the requirements of Section 21.1-257 of the Zoning
Ordinance. The exact location of this access ( es) shall be
approved by the Transportation Department.

Section 20-195).. The applicants have indicated their intention to use
the public systems.
Draina~e and Erosion:
The site drains to Pocosham. Creek- No existing or anticipated erosion
problems. It should be not'ed that Cloverleaf Lake Apartments.,. located.
southeast of the site. floods during severe storms. The proposed
development will have a. minimum. affect. on the area. t s existing dra..i..n.a.ge
problem. May be necessary to acquire off-site drainage easements.

Fire Service:
Manchester Fire Statian~ Company 112. Provide County.water and fire hydrant
placement for fire protection purposes. in compliance. wi t:h nariona.lly
recognized standards (i.e., National Fire. Protection Association and
Insurance Services Office) . Fire lanes must, be provided as per the
Chesterfield Fire Pre.vention Code.,. Section 313. The proposed zoning and
land uses will generate addition~ need. for fire protection services.
Proffers have been received to address this need. (Proffered Condition 1)
Transportation:
This request will not limit development to a specific land use; therefore,
it is dif.ficult to anticipate traffic generation a Based on fast food
restaurant with drive-through window trip rate, development could generate
approximately 5,690 average daily trips. These vehicles wil~ be

d istri buted along Turner Road which had a 1990 traffic count of 13,474
vehicles per day.
The Tharou~hfare, Plan identifies Turner Road as a major arterial with a
recommended right of way width of ninety ( 90) feet. The applicant has
proffered to dedicate forty-five (45) feet of right of way measured fram
the centerline of Turner Road in accordance with that Plan (Proffered
Condi tion 2). Development must adhere to the Zoning Ordinance relative to
access and internal circulation (Article 7). Access to major arterials
such as Turner Road should be controlled. The applicant has proffered to
limit access to Turner Road (Proffered Condition 3). At the time of site
plan review, specific recnmm~nc\;Jti.ans will be. provided regarding access and.
internal circulation.
LAND USE
General Plan:
Lies within the boundaries of tbe Turner Road Corridor Land Use and
Transportation Plan, which designates the property for commercial uses.
Area Development Trends:
The request parcel. lies on the fringe of the M..idlothian Tw:npi.k.e commercial
corridor. Further, the request site lies in a Post Development Area.. This
portion of Turner Road is characterized by agricultural, commercial and
r~sidential zoning and is occupied by single family res.i rlPn"tia J J commercial.
uses or is vacant,. It is anticipated, based upon the adopted- Plan for the
area, that commerc.ial development will continue to occur along Tuxner Road
between Midlot.hian Turnpike and Pocosbam Creek..
Zonin~ History:
On June 25, 1986, the. Board of Supervisors, upon a recnmnu:~nrl~,t-i on for
approval from the pl~nnine Commission, approved a Conditional Use PLanned
Development on a portion of the request property (Case 865066) to permit
conversion of the single family dwelling for profess'ional office use.
Approval was granted for a period of three (3) years. Subsequently, in the
absence of a renewal, the Conditional. Use Planned. Development.. expired.
Conclusions:
The requested zoning and land use conforms to the Turner Road Corridor Land
Use and Transportation Plan " which des ignate.s the property for commercial
use.. Addi tionally , the development standards of the Zoning Ordinance will
ensure quali ty deve.lopment and land use compatibility. Further ,. the
proffered conditions address impact on fire services and the transportation
network. Therefore, approval of this request is appropriate...

(1) Parcel 31). The applicants. therefore~ requested a deferru to allow
advertisement of the. additional property.

thirty (30) days to allow proper advertisement of the amended request..

There was no opposition present. The applicants. submitted a revised
