PROPOSED LAND USE: Commercial uses are planned. PLANNING COMMISSION RECOMMENDATION RECOMMEND APPROVAL AND ACCEPTANCE OF THE PROFFERED CONDITIONS ON PAGES 1 AND 2. STAFF RECOMMENDATION Recommend approval of rezon'ing for' the following reasons: A. The requested zoning and land use conforms to the Turner Road Corridor Land Use and Transportation Plan,. which designates the property for commercial uses. B. The development standards of the Zoning Ordinance will further ensure. quali ty development and land use compatibility. c. PROFFERED CONDITIONS (STAFF/CPC) la Prior to obtaining a building permit, one of the following shall be accomplished for fire protection: A. The owner, developer or assignee(s) shall pay to the county $150 per 1,000 square feet of gross floor area adjusted upward or d.ownward by the same percentage that the Marshall Swift Building Cost Index increased or decreased between June 30, 1991 and the date of payment. With the approval of the County's Fire Chief, the owner, developer or assignee(s) shall receive a credit toward the required payment for the cost of any f ire suppression system not otherwise required by law which is included as a part of the development. OR B. The owner, developer or assignee( 5) shall provide a fire suppression system not .otherwise required by law which the County's Fire Chief determines substanti.ally reduces the need for County facilities otherwise necessary for fire protection. Access to Turner Road sball be limited to one (1) entrance/exit; provided, however, that at time of site plan approval the Transportation Department may grant no more than one (1) additional entrance/exit to Turner Road subject to the requirements of Section 21.1-257 of the Zoning Ordinance. The Tharou~hfare, Plan identifies Turner Road as a major arterial with a recommended right of way width of ninety ( 90) feet. The applicant has proffered to dedicate forty-five (45) feet of right of way measured fram the centerline of Turner Road in accordance with that Plan (Proffered Condi tion 2). Development must adhere to the Zoning Ordinance relative to access and internal circulation (Article 7). Access to major arterials such as Turner Road should be controlled. The applicant has proffered to limit access to Turner Road (Proffered Condition 3). At the time of site plan review, specific recnmm~nc\;Jti.ans will be. provided regarding access and. internal circulation. LAND USE General Plan: Lies within the boundaries of tbe Turner Road Corridor Land Use and Transportation Plan, which designates the property for commercial uses. Area Development Trends: The request parcel. lies on the fringe of the M..idlothian Tw:npi.k.e commercial corridor. Further, the request site lies in a Post Development Area.. It is anticipated, based upon the adopted- Plan for the area, that commerc.ial development will continue to occur along Tuxner Road between Midlot.hian Turnpike and Pocosbam Creek.. Zonin~ History: On June 25, 1986, the. Board of Supervisors, upon a recnmnu:~nrl~,t-i on for approval from the pl~nnine Commission, approved a Conditional Use PLanned Development on a portion of the request property (Case 865066) to permit conversion of the single family dwelling for profess'ional office use. Approval was granted for a period of three (3) years. Subsequently, in the absence of a renewal, the Conditional. Use Planned. Development.. expired. The applicants. therefore~ requested a deferru to allow advertisement of the. additional property. Planning Commission Meeting (12/17/91): At the request of the applicants~ the Comm..i.ssion deferred this case. for thirty (30) days to allow proper advertisement of the amended request.. Staff' (12/18/91): The applicants were advised in writing to submit any significant new information no later than December 27!t 1991. Staff (1}3/92): To date, no new information has been received.. Planning Commission Meeting (1/ 21J 92) : There was no opposition present. The applicants. submitted a revised Proffered Condi tion 3 to clarify under what circumstances the Transportation Department would permit more than one (1) access to Turner Road.
