REQUEST
Amendment of zoning approval (Case 95SN0109) to permit parking and storage of recreational
equipment in a Residential (R-15) District.

SUMMARY
Conditions of Case 95SN0109 limit uses within the OS-4tract (including the request property
identified on Page 11) to those uses permitted in the Residential (R-15) District, public and private
profit making clubs and light commercial uses (such as concessions or bicycle rentals) associated
with a permitted golf course use, recreational amenities, maintenance facilities for the
development, model homes and marketing and sales offices. The applicant proposes to include
parking and storage of recreational equipment as a permitted use exclusively for the benefit of
residents of properties included in the Rivers Bend Community Home Owners’ Association,
necessitating a zoning amendment. Incidental shrink-wrapping of the on-site stored equipment
for seasonal winterization would also be permitted. The existing building and property were
previously used as a maintenance shed for the former Rivers Bend Golf Course.
Screening of the stored equipment would be accomplished with security fencing with a solid
windscreen in addition to existing vegetation in the recorded conservation easement to the north
and west and in open space to the south.

Proposal
Parking and storage of recreational equipment exclusively for the benefit of the residents of
Rivers Bend subdivision is proposed within the existing building and in a fenced storage yard
generally as shown on Exhibit A (Attachment 2). Incidental shrink-wrapping of the on-site
stored equipment for seasonal winterization is also proposed.
Existing conditions of Case 95SN0109 limit uses in this OS-4 Tract to uses permitted in the
Residential (R-15) District, public and private profit making clubs and light commercial uses
(such as concessions or bicycle rentals) associated with a permitted golf course use,
recreational amenities, maintenance facilities for the development, model homes and
marketing and sales offices.
The Zoning Ordinance identifies parking and storage of recreational equipment in residential
districts as occurring in the rear yard on individual residential lots and does not envision
commercial recreational equipment parking/storage yards. Such commercial or community
recreational vehicle storage lots would be first permitted as a general industrial use. While
proposed to privately operated, the recreational equipment parking and storage would be
limited to residents of properties includedin the Rivers Bend Community Home Owners’
Association HOA). Therefore, amendment to the 1995 zoning approval is proposed to include
recreational equipment parking and storage as a permitted use in the OS-4 Tract. With
approval of this request, incidental shrink-wrapping of the on-site stored equipment for
seasonal winterization would also be permitted in addition to those uses permitted by Case
95SN0109, provided material used for wrapping the equipment is white or another neutral
color. No repair or maintenance of the recreational equipment would be permitted, and all
equipment stored must be operational and properly licensed. Facility hours would be limited to
between 7:00 a.m. and 9:30 p.m. (Conditions 1, 3, 4 and 5). Condition 5 limits the time period
for this use to three (3) years from the date of approval. Extension of this time period would
require re-application and consideration by the Commission and Board of Supervisors.

Screening
The existing building and property were previously used as a maintenance buildingfor the
former Rivers Bend Golf Course. The proposed recreational equipment storage area would be
secured with fencing. A solid windscreen will be installed on the western side of the fence
(Condition 2). This windscreen in addition to the existing vegetation within the recorded
conservation easement to the north and west and vegetated open space to the south will assist
to minimize visibility of the recreational equipment storage from area residential properties.

The recreational equipment storage will offer residents of Rivers Bend the opportunity to park
personal recreational vehicles at this site as an alternative to storage in the rear yards of
individual lots. While the Comprehensive Plan suggests the property is appropriate for
residential use, the recreational equipment storage use, subject to use restrictions and
screening requirements, would be appropriate.

Geography
The subject property drains from south to north to an existing basin within the overall River’s
Bend development. The entire property is located within the James River Watershed.
Environmental Features
There are no Resource Protection Areas or floodplains on the property. Any areas of wetlands
shall not be impacted without prior approval from the U.S. Army Corps of Engineers and/or the
Virginia Department of Environmental Quality.
Stormwater Management
The redevelopment of the subject property will be subject to the Part IIB technical criteria of
the Virginia Stormwater Management Program Regulations for water quality and quantity.

11/19/19 Citizen Comments:
Several citizens spoke to this request, noting concerns relative to management
of the facility; availability of storage services away from residential
development; preference for limiting use to members of the Rivers Bend
Homeowners’Association; potential for crime, and fuel leakage from stored
vehicles; and the condition and maintenance of the existing access drive to
facility.
In response to questions of the Commission, staff clarified the proposal did not
include acampground, vehicle repair,nor commercial storage; wouldnot
present an environmental risk; represents a minimal transportation impact; and
would be adequately screened from view of theresidentialcommunity.
Lighting, the condition oftheaccess road and signage would be addressed at
the time of site plan review.
Based on citizen input, Mr. Sloan introduced conditions limiting the use for
residents of properties in Rivers Bend CommunityHOA, permitting storage of
operable and licensed vehicles; hours open for use, and a time limit of three (3)
years from approval.

CONDITIONS
Note: Both the Planning Commission and staff recommend the following conditions.
1.In addition to the uses permitted in the OS-4 Tract by Case 95SN0109, the following uses
shall be permitted:
A.Recreational equipment parking and storage exclusively for residents of properties
included in the Rivers Bend Community Home Owners’ Association (HOA). No
vehicle repair or maintenance shall be permitted.
B.Incidental shrink-wrapping of on-site recreational equipment for seasonal
winterization. Shrink-wrapping shall be accomplished with white or other neutral
colored material. (P)
2.The recreational equipment storage yard shall be located as generally shown on Exhibit
A, Attachment 2. A wind screen shall be installed on the western side of the security
fence to assist in mitigating views of stored equipment. (P)
3.All stored recreational equipment shall be operational and shall maintain proper
licensure. No inoperable or junk vehicle storage shall be permitted. (P)
4.Hours that the storage area shall be open for use shall be limited to between 7:00 a.m.
to 9:30 p.m. (P)
