Conditional use and conditional use planned development to permit a utility use requiring a
structure (raw water pump station) and exceptions to Ordinance requirements in an Agricultural (A)
District.

SUMMARY
A public raw water pump station is planned. The station would be utilized for the extraction and
transmission of water directly from the Appomattox River to a proposed public water treatment
facility further upstream. Conditional use approval is required for this pump station in the
Agricultural (A) District. A Substantial Accord request for the public water treatment facility is
pending approval (Case 20PD0137).
An exception to the paving requirement is requested to permit alternative surface treatments for a
parking area which will be utilized by the Parks & Recreation Department and the public for a future
park project (Historic Point of Rocks Park) on a portion of the subject property and adjacent parcels
to the west.

Proposal
A raw water pump station is proposed. The pump station would draw water from the
Appomattox River for use in the public water system. The pump station would be incorporated
into a larger system including a public water treatment facility planned at a location upstream
from the subject property. A Substantial Accord Determination (Case 20PD0137) is being
considered by the Planning Commission at their November 19, 2019 public hearing. Conditional
Use approval is required for a utility use including a structure in an Agricultural (A) District. The
Parks and Recreation Department proposes to develop park uses along with associated parking
areas on the northern portion of the site as part of the future Historic Point of Rocks Park to the
west. Park uses are permitted by-right in the Agricultural (A) District.

Comprehensive Plan
The Water & Wastewater Chapter (Chapter 12) of the Comprehensive Plan recommends the
addition of capacity improvements to the public water and wastewater systems to
accommodate future growth and development envisioned in the Plan. The proposal would
create additional capacity for the public water system as recommended by the Plan.
Exception to Paving Requirement
The Zoning Ordinance requires that parking areas for non-residential uses be paved. An
exception is requested to allow alternative surface treatments such as gravel for parking areas
which would support future public park uses on the site and adjacent properties to the west.
Staff is supportive of this exception as it would allow flexibility to accommodate future park
uses and would minimize improvements on agriculturally zoned property. Use of gravel and
other alternatives to paving is consistent throughout many county parks facilities.

Chesterfield Utilities Department is requesting to install a water pump station on existing
property located off of Point of Rocks Road near the Appomattox River, with an access road off
of Point of Rocks Road. The conceptual plan includes a proposed access road to the riverbank
vault that appears to cross existing VDOT limited access right-of-way for Interstate I-295 near
the bridge over the Appomattox River. VDOT will need to investigate the feasibility of locating
a portion of the access road on limited access right of way, to determine if this is permissible
with a break in the existing limited access line and a perpetual limited access permit for the
access road on state property, or if the County will need to pursue the relocation of the limited
access line and acquisition of the property. Significant coordination will be required to
determine the appropriate solution to this situation.

The request to construct a raw water pump station and intake structure along the tidal
Appomattox River is a Department of Utilities capital improvement plan project and needed to
ensure current and future residents of Chesterfield County have an adequate water supply well
into the future. The Utilities Department strongly supports this request.

ENVIRONMENTALENGINEERING

Geography
The subject properties generally drain in two directions. The eastern third drains to the east to
an unnamed tributary of the Appomattox River. The remaining two-thirds of the properties
drain directly to the Appomattox River. The southeastern third drains to the south directly into
the Appomattox River. All of the subject properties are located within the Appomattox River
Watershed.
Natural Resources
There is 100-year FEMA floodplain on the subject properties along the Appomattox River. Any
fill and/or construction with the FEMA floodplain must be approved by the Department of
Environmental Engineering and/or FEMA prior to site plan approval.
A Resource Protection Area Designation (RPAD) must be submitted to the Department of
Environmental Engineering Water Quality Section prior to the submittal of any site plans. A
Water Quality Impact Assessment must be submitted to and approved by the Department of
Environmental Engineering and/or the Board of Supervisors for any improvements which
encroach into the RPA.
Areas of wetlands may exist along the unnamed tributary on the eastern portion of the
properties and along the southern edge bordering the Appomattox River. Wetlands shall not
be impacted without prior approval from the US Army Corps of Engineers and/or the Virginia
Department of Environmental Quality.
Erosion and Sediment Control
Steep slopes greater than 20 percent are difficult to stabilize when disturbed. The steep slopes on
the subject properties border the river and its tributary; therefore, disturbance of these slopes will
result in the increased potential for sediment to impact the river if erosion occurs. Except for the
installation of the intake pipelines and tunnel, riverbank vault, and associated maintenance access,
these steep slopes should remain in their natural, undisturbed state to the maximum extent
practicable, unless otherwise approved by the Department of Environmental Engineering.
Stormwater Management
The development of the subject properties will be subject to the Part IIB technical criteria of the
VSMP Regulations for water quality and quantity.
