Gentlemen:
In compliance with the requirements of Sections 17-9 and 17-11 of
the Zoning Ordinance of Chesterfield County I have applied for a conditional use
permit to remove gravel from a parcel of land located in Dale Magisterial District.
A map showing the location on my property of the areas from which I wish to remove
gravel is attached to the application.
It is my purpose by this letter, in compliance with Section 17-11 of
the Zoning Ordinance, to set forth the plan of operation which I propose to follow
in the removal of gravel.
The areas for which a permit is requested are outlined in red on the
map, and are located on a 153 acre parcel of property owned by me in Dale Magis-
ter-ial District, designated 1IParcel 111 on the map. The only access to this area is
by means of a 50 foot right-of~way extending from Route 10, on which right-of-way
there is an existing gravel road. At the date of this letter the fee simple title
to this right-of-way is owned by me. I have agreed to convey it to the State of
Virginia, but will retain the right to use the road until it is developed by the
State for Route 892.
In connection with the removal of gravel I will do the following:
1. During the term of the requested permit I will periodically apply
calcium chloride or other chemicals to the access road to control dust resulting
from use of the road by trucks hauling gravel.
2. I will conduct operations from this area only between the hours
of 6:00. o'clock a.m. and 7:00 o'clock p.m. Monday through Saturday.

3. Prior to expiration of the permit I will slope the sides and
seed the area labeled npit" on the attached map, which is just east of the area
labeled "Old Workings", in order to restore it to substantial conformity to the
land immediately surrounding.
4. At the present time there is a quantity of top soil stored ad-
jacent to the "1958 Workingstt which was preserved at the time gravel was last re-
moved from that area. In conformity with the progress of removing additional
gravel from the area requested adjacent thereto I will at the proper time slope
the sides of the area marked tt1958 Workings", spread this top soil on it and seed
it so as to make it confonn substantially to the area surrounding it.
5. Before removing gravel from the areas now requested I will re-
move and preserve the top soil, and as the removal of gravel progresses will slope
the sides, level the area of removal to the extent necessa~ to leave the land in
substantial conformi~ to that surrounding it, replace the top soil and seed it.
6. All sloping, grading and seeding will be done so as to minimize
erosion and the accumulation of anything but negligible quantities of water.
7. I will keep Route 10 in the vicinity of its intersection with
the access road reasonably free of gravel.
8. The only machinery which will be used in connection. with work
pursuant to the requested permit will be trucks for hauling, a bulldozer from time
to time and a front end loader. No buildings will be erected to house machine~
or otherwise.

Application for Use Permit
Gentlemen:
Reference is made to my application for a use permit to remove
gravel from property owned by me and located in Dale Magisterial District.
The application has been assigned the number stated above, and was origi-
nally scheduled for consideration by you on May 11, 1966. I have been
advised it was continued until June 8, 1966 at the request of an attorney
representing persons opposing the application.
MY application includes a plan of operation, which is contained
in a letter attached to the application. In that lett,er I stated that
as of the date it was written the fee simple title to the fifty foot
right of way extending from Route 10, through which I propose to remove
gravel, was owned by me. The purpose of this letter is to infonn you
that I no longer own this right of way. It has been conveyed by me
under threat of condemnation for construction of State Route 892.
Under the terms of the conveyance I retained the right to use the road
existing on this right of way until development thereof for Route 892
prevents such use.
My pending application is hereby amended as stated in this letter.

Dear Fred:
This is with reference to your request that I advise you
whether this office considers the captioned property as
highway right of way.
Upon receipt of your request, I reviewed the file on
this matter and found that by deed dated January 25, 1966
and recorded in the Clerk's office of Chesterfield
County on April 12., 1966 in Deed Book No. 835 at page 193
that Mary B. Stratton, Widow, ~onveyed certain property
to the Commonwealth of Virginia .for the construction of
Route 892. In view of the fact that this land has been
obtained by the Commonwealth of Virginia, Department of
Highways, and the plats attached thereto, show the highway
to be constructed thereon, I am of the opinion that the
land in question is highway right of way. I might also
add that construction of this section of road should be
undertaken in the near future since the Highway Department
has advised that bids are to be received on June 9, 1966.
