REQUEST: A Conditional Use to permit the operatio~ of a Stock Farm.
PROPOSED USE: The keeping of one horse.
TAX MAP IDENTIFICATION: Clover Hill Mag. Dist. T. M. 27-15 (3) BLK
1, Lots 12 and 13, Forest Acres, Sec. C. (Sheet 8).
GENERAL LOCATION: Northwest Corner of the intersection of Chery1ann
Road and Francil1 Road in Forrest Acres subdivisiop.
ACREAGE (SUBJECT PARCEL): Approximately 1.25 acres.
EXISTING ZONING: Residential (R-7).
EXISTING LAND USE (SUBJECT PARCEL): One single family residence plus a
shed area used for keeping one horse.
ADJACENT AND AREA ZONING AND LAND USE: All adjacent property is zoned
Residential (R-7) and is divided into individual lots which are occupied
by single family dwellings.
PUBLIC FACILITIES: Approval of this request will have no impact on
existing or future area public facilities.
TRANSPORTATION AND TRAFFIC: No advers~ traffic situation will be
created as a result of this request.
GENERAL PLAN: Single family residential development for the area
encompassing the parcel in question. .
STAFF ANALYSIS AND RECOMMENDATIONS: The applicant is at present keeping.
a horse on the subject parcel. Inspection of the site revealed that
the appearance of the property and manner in which the pajjock~ahd stall
area is maintained, would offer little objection or create any adverse
situation for adjacent properties.
Although the parcel in question lies within a single family subdivision
there is sufficient area for keeping one horse since the parcel is
composed of two residential lots (Total 1.25 acres). The arrangement
of adjacent lots, and the houses thereon, presents adequate seperation
from the horse lot. It was observed that the area in which the horse
is kept was enclosed by a sturdy fence. It was also observed that this
area is remarkably clean and free of manure and trash. In addition,
the horse shed.is also maintained in a good fashion.
FROM THE APPEARANCE OF THE PARCEL, IT APPEARS THAT THE KEEPING OF ONE
HORSE DOES NOT PRESENT AN ADVERSE SITUATION FOR EITHER A SINGLE FAMILY
DWELLING ON THE'LOT, OR ADJACENT RESIDENCES. IN ORDER THAT THIS

*NO~E* Planning Staff has reviewed the list of restrictive covenants
for Section C of Forest Acres Subdivision. These covenants would
apply to the lots in question. In review, Staff noted no specific
'restriction against the keeping of a horse in the subdivision. How-
ever restrictive covenant number 5 states as follows:
"No noxious or offensive trade or activity shall be carried on
upon any lot, nor shall anything be done thereon which may be
or become an annoyance or nuisance to the neighborhood."
Staff is of the opinion that the manner in wh:Lch a horse is being kept
on the parcel in question is neither noxious or offensive and therefore
does not violate this covenant.

FOR THIS REQUEST
C.P.C. 11 19 74: Recommended approval of the request, subject to the
imposition-of~he following conditions:
1. This Conditional Use shall be restricted to the keeping of no
more than the one horse now located on the parcel.
2. This permit shall be restricted to Mr. Oscar D. Bryant, Jr. for
his use, and the use of his family and friends of the family. This
Conditional Use shall not be transferable or run with the land, and no
cummercial activity with respect to the keeping of this horse shall be
permitted.
3. The enclosure area shall be maintained and secured so as to
confine the animal in question.
4. The enclosure area and shed are to be cleaned and made free of
manure daily. When neccessary, fresh straw and disinfectant shall be
applied to eliminate the proliferation of odor and insects.
5. This permit shall be valid for a period of three years, and may
be renewed upon satisfactory re-application.
