Summary of Information: Lieutenant Darren M. Hurley is retiring from the Fire and Emergency Medical Services Department on May 1, 2022, after providing over 32 years of service to the citizens of Chesterfield County. Hurley will retire from the Fire and EMS Department, Chesterfield County, on May 1, 2022, and has faithfully served the County of Chesterfield and its citizens for 32-1/2 years in various assignments; and WHEREAS, Lieutenant Hurley attended Recruit School #22 in 1989; and WHEREAS, Lieutenant Hurley served as a firefighter at the Chester, Manchester, Bon Air, Wagstaff, Dale, Ettrick, and Centralia Fire and EMS Stations; as a Lieutenant at the Clover Hill Fire and EMS Station; as a Lieutenant assigned to the Resource Management Division in the Apparatus Accessory Coordinator approved staff position; and as a Lieutenant at the Rivers Bend and Phillips Fire and EMS Stations; and WHEREAS, Lieutenant Hurley responded to Colonial Heights, Virginia to assist Colonial Heights with emergency services following a tornado in 1993; and WHERAS, Lieutenant Hurley responded to the City of Richmond, Virginia to assist the Richmond Fire Department following a conflagration on Broad Street in 2004; and WHEREAS, Lieutenant Hurley was recognized in 1993 with an Emergency Medical Services award for his role in saving the life of a citizen who was trapped as the result of a motor vehicle accident on August 26, 1993; and WHEREAS, Lieutenant Hurley was recognized in 1993 with an Emergency Medical Services award for his role in saving the life of a citizen who went into cardiac arrest on April 16, 1993, and WHEREAS, Lieutenant Hurley was recognized in 1996 with a Life Safe award for his role in saving the life of a citizen who was experiencing a diabetic emergency on November 14, 1995; and WHEREAS, Lieutenant Hurley was recognized in 2002 with a Unit Citation award for his role in saving the life of a citizen who went into cardiac arrest on April 30, 2002. NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County Board of Supervisors recognizes the contributions of Lieutenant Page 6 of 14 Darren M. Hurley, expresses the appreciation of all citizens for his service to the county and extends their appreciation for his dedicated service and their congratulations upon his retirement. Subject: Donation of Out-of-Service Body Armor to the Chesterfield County Police Foundation, Inc. Board Action Requested: Authorize the Police Department and Sheriff's Office to donate its out-of-service body armor to the Chesterfield County Police Foundation, Inc. Summary of Information: The Chesterfield County Police Department and Sheriff's Office currently has body armor being rotated out and replaced with new equipment. The out-of-service body armor will no longer be utilized by the Police Department or the Sheriff's Office. Typically, expired body armor or ballistic vests are collected from an officer or deputy upon issuance of the new vest and the expired vests are sent out for destruction. The Police Department and Sheriff's Office would like to donate this equipment to the Chesterfield County Police Foundation, Inc. The Chesterfield County Police Foundation will donate all body armor to the Lift Up Ukraine organization. All Chesterfield County labels, tags, and logos attached to the vests or carriers will be removed prior to the donation. Pursuant to Va. Code, §15.2-953(B), the Board is authorized to donate the equipment to The Chesterfield Police Foundation, Inc. because it is a charitable organization that is tax-exempt as defined under IRS Rule 501(c)(3) and supports law enforcement. The Board is requested to approve the donation of the body armor to The Chesterfield Police Foundation, Inc. Staff recommends approval of the donation. Subject: Adoption of the FY2023 Budget, FY2023-2027 Capital Improvement Plan (CIP), FY2023 Appropriations Resolution, and the FY2023 Community Development Block Grant and the HOME Investment Partnership Annual Plan Board Action Requested: Adopt the FY2023 Budget, FY2023-2027 Capital Improvement Plan (CIP), FY2023 Appropriations Resolution, and the FY2023 Community Development Block Grant and the HOME Investment Partnership Annual Plan with changes as approved. Summary of Information: The County Charter requires that the budget, inclusive of the CIP, be adopted by May 1 and that an appropriations resolution be adopted to authorize the expenditure of funds. In addition, the County's Community Development Block Grant and HOME Investment Partnership Annual Plan for FY2023 is required to be submitted to the U.S. Department of Housing and Urban Development (HUD) by August 16, 2022. CDBG and HOME allocations are based on the final award notification from HUD. Public hearings were held on each of the aforementioned items on March 23, 2022. Any additional changes requested by the Board during this session will be incorporated into the FY2023 budget upon adoption. Subject: Adoption of an Ordinance Establishing the Annual Tax Levy on Various Classes of Real Estate and Personal Property Board Action Requested: Adopt a tax rate ordinance establishing tax rates for calendar year 2022. Summary of Information: The Board held a public hearing on March 23, 2022 concerning the attached ordinance regarding annual tax rates. Tax rates on existing classes of property for calendar year 2022 were advertised as follows: $0.92 for real estate; $3.60 for personal property; $1.00 for machinery and tools personal property; $0.50 for aircraft personal property; $0.96 for personal property for volunteer firefighters, rescue squads, and auxiliary members; $0.01 for wild and exotic animals personal property; $3.24 for vehicles using clean and special fuels; $0.01 for specially equipped motor vehicles for the physically handicapped; $0.96 for vehicle trailers and semi-trailers with a gross weight for 10,000 pounds or more; and $0.24 for computer equipment and peripherals used in data centers. In addition, the $10 gross receipts threshold for the business professional occupancy (BPOL) tax is $400,000. The vehicle registration fee will be reduced from $40 to $20 per vehicle. Subject: Adoption of Ordinance Amendments Relating to the Department of Utilities' Fee Changes Board Action Requested: Adopt amendments to Sections 18-22, 18-27, and 18-114 of the County Code Relating to the Department of Utilities’ fee changes Summary of Information: The Board of Supervisors held a public hearing on March 23, 2022 concerning the proposed changes to Utilities fees. The Utilities Department’s analysis of the FY2023 budget, capital replacement and maintenance projects, and projections over the next ten years indicate that current revenues, without fee increases, will not be sufficient to cover operating and capital expenses. As an enterprise fund fully supported by payments from users, fee increases are necessary to offset costs of capital projects for rehabilitation of pump stations, new and replacement water tanks, new and replacement water and wastewater lines, investments in older neighborhoods to replace water and wastewater lines, the county’s contractual share of Richmond water plant projects, as well as maintaining the integrity of the county’s water and wastewater facilities. The additional revenues are required to meet the projected longer term operating and capital costs. This rate setting approach supports a financial plan to manage current and projected capital expenses and is prudent financial management necessary to maintain the triple AAA bond rating. The proposed changes in utility rates are displayed below. Fee: Rate: Customer cost charges $5.08 /month Water commodity cost charge $2.36/CCF Water capacity cost charge $7.95/ERU/month Wastewater commodity cost charge $2.43/CCF Wastewater capacity cost charge $14.15/ERU/month A net total increase of $3.1 million in revenues is anticipated from the change in the unit rate of the commodity charges. The customer, water and wastewater capacity charges are unchanged from FY2022. A typical residential combined water and wastewater charge will increase $1.54 per month, from $59.17 to $60.71, or 2.6%, based on consumption of 7 CCFs (one CCF is 100 cubic feet or 748 gallons of water). Page 12 of 14 Utility Connection Fees – There are no proposed fee changes for the water and wastewater capital cost recovery charge portion of connection fees. Service Line Charge – The service line charge for a residential five-eighth inch meter will increase by $900, from $1,900 to $2,800, due to the increase in material cost. The service line charge for larger service lines will also proportionally increase. Companion Meter Charge – The installation of a residential companion meter for irrigation usage will increase by $180, from $620 to $800. This is due to the increase in material and labor costs.
