Liberty has indicated they will widen the westbound lane of Route 10 from Meadowville Road to I-295. The County can accelerate' the construction of the widening of the eastbound lane by providing VDOT a $1 million "loan." Under the terms of the proposed VDOT/Countyagreement {draft attached}, the County will provide VDOT $1 million in July, 1996, for the construction of the eastbound lane and will be repaid by VDOT in three equal yearly installments beginning in 1996. The County's "loan" can be provided by a temporary transfer of funds from the John Tyler Community College project. The VDOT repayments will repay the "loan" to the John Tyler fund. The timing of the repayments from VDOT will not impact the progress or timing of the County's participation in the John Tyler Community College project. Application to Amend Zoning Case 95SN0109 The Board approved zoning case 95SN0109 (River's Bend) with conditions which require, among other things, the construction of one eastbound lane along Route 10 from Old Bermuda Hundred Road to Kingston Avenue prior to recordation of more than 400 residential units or site plan approval for more than 670,000 square feet of light industrial/office warehouse. The VDOT/County agreement will address the construction of the lane. To enhance the economic development opportunities in the River's Bend Business Center Industrial Park, and since the eastbound lane construction will be addressed, staff recommends the zoning conditions requiring the eastbound lane be deleted. WHEREAS, the Board believes that adherence to such principles, and the values they reflect, is necessary to ensure provision of quality behavioral health care services to target populations historically served with public funding; and WHEREAS, the County of Chesterfield has, for more than two decades, demonstrated commitment and support of the provision of quality public services for persons with mental disabilities both locally and across the Commonwealth; and WHEREAS, the Board hereby encourages the state to maintain the current system of oversight by local citizens, consumers, families, and elected and appointed officials, while utilizing the best aspects of managed care technology during the redesign of the public behavioral health care system. Box 40 Chesterfield, VA 23832 Dear Mr. Ramsey: I recently read that the Chesterfield County noise ordinance has been modified to prohibit the playing of music from car radios that can be heard from a distance of 50 feet or greater. I.) I would like to see the wording modified to include anv outdoor radio, speaker, etc., (or onc near an open window), e.g. not limited only to music coming from cars. Without this somcone could, for instance, be playing a radio in his car parked in his driveway that could be heard from a distance greater than 50 feet. If a policeman told him to turn it down, he could cut off the car radio, take out a boombox, set it down next to his car, and play it at the same volume. In this case he would be in compliance with the ordinance. 2.) I would like to see some wording in the ordinance regarding specific duration for the playing of an outdoor radio if it is within a certain distance from a dwelling, i.e. two hours during any 24 hour period. There are individuals (people living in neighborhoods as well as contractors) who have played outdoor radios. speakers, boomboxes etc. for up to 10 hours per day. It is like having to listen to outdoor "musack", and is very disturbing when one wants to sit in their own backyard and enjoy the peace and quiet. Although the music can be heard for a distance greater than 50 feet, it is not prohibited under the existing noise ordinance. The police will do nothing as it does not fit tlleir guidelines of "cxcessive" loudness. I feel that the noise ordinance should protect all Chesterfield County residents against this type of problem. A change in the ordinance seems to be the only way to address an occurrence of this nature. I do not want ordinances passed that are unnecessarily intrusive or infringe upon the rights of others. However, residents who invest in homes in our county have the right to enjoy peace and quiet when they sit out in the privacy of their own yard. Therefore I feel that it is not unreasonable to limit the duration that one can playa radio outdoors specifically to two hours. The result would be that anyone could play the radio outdoors for a reasonable length of time, and others could enjoy the peace and quiet also. Everyone wins. The ordinance would not be overly prohibitive as the only time it would come into play is when someone called the police after someone else was being unreasonable. Also for this type of sitnation, the new car radio ordinance should not be limited only to cars. I would like to address the Board of Supervisors at the next meeting (October 25th) to bring this up during hearings of citizens on unscheduled matters. Thank you very much. Box 40 Chesterfield, Virginia 23832 Dear Mr. Ramsey: I wish to appear before the ,Board of Supervis6rs during their next meeting on october 25, 1995 to express my opposition to the State of Virginia's plan to build a new juvenile prison at the Bon Air Complex in chesterfield County and ask the Board to help me and other County citizens stop the state's plan. My wife and I own the property and live at 10133 Iron Mill Road which is about 1000 feet from the boundary of the Bon Air Complex on old Bon Air Road. The State is planning to add 310 new medium-security permanent beds to the Bon Air Complex through new bUilding and conversion of a transient bed facility. If they carry out their plans the Bon Air Complex will have a total of 485 permanent beds. The State's plan is bad for the inmates, bad for the surrounding community, and clearly against the County's wishes as proclaimed in the Resolution of May 24, L995 by the Board. I will ask the Board to consider taking the following actions to help stop the Bon Air juvenile prison expansion: * Issue another resolution send it to Governor Allen. of results. strongly opposing the State's plans and Request a prompt reply and notify citizens * Use the Board's best resources to arrange a meeting with the governor to plead the case of Chesterfield's citizens. * Direct the County's utilities, safety, and legal departments to search for reasons to stop or delay the State's plans. The issue is likely to be reconsidered by the State legislature when it reconvenes in 1996. The legislature needs to consider withdrawing the funds for the project before spent or contracted to be spent by the State. The State is trying to spend the funds as quickly as possible to avoid heeding the informed voice of the legislature in 1996. * Recognize and support the efforts of the Bon Air area citizens opposing the poor decision by the state to expand the Bon Air Complex. 062 '\ . . .' ...,.. CABINESS, II UPON HIS ATTAINING RANK OF EAGLE SCOUT WHEREAS, the Boy Scouts of America was incorporated by Mr. William D. Boyce on February 8, 1910; and WHEREAS, the Boy citizenship training, individuals; and Scouts of America was founded to promote personal development, and fitness of WHEREAS, after earning at, lea~t twenty-one merit badges in a wide variety of fields, serv~ng ~n a leadership position in a troop, carrying out a service project beneficial to his community, being active in the troop, demonstrating Scout spirit, and living up to the Scout Oath and Law; and WHEREAS, Mr. James D. cabiness, II, Troop 801, sponsored by South Minster Presbyterian Church, has accomplished those high standards of commitment and has reached the long-sought goal of Eagle Scout which is received by less than two percent of those individuals entering the Scouting movement; and WHEREAS, growing through his experiences in Scouting, learning the lessons of responsible citizenship, and priding himself on the great accomplishments of his County, James is indeed a member of a new generation of prepared young citizens of whom we can all be very proud. Summary of information: BACKGROUND: The County's Meadowville Area Plan recommends that the Virginia Department of Transportation (VDOT) should be requested to restrict through truck traffic on North Enon Church Road (Route 746) from the Brown and Williamson Development (formerly the American Tobacco Company) access to Meadowville Road (Route 618). The recommended alternative route is North Enon Church Road, East Hundred Road (Route 10), Rivers Bend Boulevard, and Meadowville Road. RECOMMENDATION: Staff recommends that the Board adopt the attached resolution requesting VDOT to prohibit through truck traffic on North Enon Church Road. CHESTERFIELD COUNTY: At a regular meeting of the Board of Supervisors, held at the Courthouse on October 25, 1995 at 3:00 p.m. WHEREAS, the Chesterfield County Board of Supervisors received a request from citizens to prohibit any through truck or truck and trailer or semi-trailer combination except pickup or panel trucks from using North Enon Church Road (Route 746) from the Brown and Williamson Development (formerly The American Tobacco Company) access to Meadowville Road (Route 618); and WHEREAS, the County's Meadowville Area plan recommends that the Virginia Department of Transportation should be requested to restrict through tr~cktraffic on, this section of North Enon Church Road; and WHEREAS, the recommended alternate route is North Enon Church Road, East Hundred Road (Route 10); River's Bend Boulevard, and Meadowville Road; and WHEREAS, the Board has conducted a public hearing on the prohibition. NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors requests the Virginia Department of Transportation to prohibit through truck traffic on North Enon Church Road.
