Summary of Information:
Recently, two Chesterfield County businesses made the Inc. 500 list. These two firms are Barber
Martin & Associates and Herald Pharmacal Inc., now known as Herald-Allergan Inc. Barber is an
advertising firm which has grown more than 1,000% from 1990 to 1994. Herald mDved into the
county 1 year ago and has grown from eight employees to more than 90 during the same period.
Inc. magazine is the premier private industry and small business magazine and rarely do compa-
nies attain a growth rate that merit their prestigious ranking in the Inc. 500 list. These companies
deserve special recognition for their achievements, Mr, Robert Barber is here to represent Barber
Martin & Associates, and Mr. Tom Mitro is here representing Herald-Allergan, Inc.

WHEREAS, Sergeant Sgt. R. H. "Randy" Watkins will retire from
the Chesterfield County Police Department on November 1, 1995; and
WHEREAS, Sgt. R. H. "Randy" watkins, has provided over 18
years of quality service to the citizens of Chesterfield County;
and
WHEREAS, Sgt. R. H., "Randy" Watkins has served the County in
the capacity of Patrol Officer, Technician, and Sergeant; and
WHEREA-S, Sgt. R. H. "Randy" Watkins has throughout the years
demonstrated an expertise in the fields of crime prevention and
highway ,safety; and
WHEREAS, Sgt. R. H. "Randy" Watkins has significantly
contributed to the development of the both the Chesterfield Police
D.A.R.E. Program and the Crime Prevention Unit, making them the

WHEREAS, Sgt. R. H. "Randy" Watkins has had a very positive
influence on the development of many young police officers in the
D.A.R.E and crime Prevention functions of the Police Department.
WHEREAS, Sgt. R. H. "Randy" Watkins went above andbeyond':'the'
S~ll of duty to the citizens of Chesterfield County by volunteering
years of service to Law Enforcement Explorer Post 609 and to Boy
Scout Troop 822; and WHEREAS, Sgt. R.. H. ,"Randy" Watkins, has
provided the Chesterfield County Police Department with many.years
of loyal and dedicated service; and
WHEREAS, Chesterfield county and the 'Board of Supervisors 'will
miss Sgt. R. H. "Randy" Watkins' service.
NOW ,Therefore, Be It Resolved, that this Board of Supervisors
publicly recognized Sgt. R. H. "Randy" Watkins, and extends on
behalf of its members and the citizens of Chesterfield County their
appreciation for his service to the County,
AND, Be It Further Resolved, that a copy of this Resolution be
presented to Sgt. R. H. "Randy" Watkins and that this Resolution be
permanently recorded among the papers of this Board of Supervisors

Summary ofInformation:
In 1993 Congress passed and began implementation of a new federal Family Preservation
and Family Support Services program. The Act appropriated nearly a billion dollars
nationwide over a five-year period for services to promote family strength and stability;
enhance parental functioning and protect children.
The legislation encourages the community to identify and deliver the services based upon the
community's needs assessment rather than simply accepting the state or federal concepts of
need. Based on a needs assessment, the public-private partnership of Social Services,
Health, Mental HealthlMental Retardation and Substance Abuse; and Johnston-Willis
Hospital are collaboratively pursuing the development of an expanded, countywide
prevention program to strengthen all families and encourage the optimal development of all
children in Chesterfield County and Colonial Heights. The proposed program is based on
the Hawaii Healthy Families model and includes intensive home-based intervention and
parent education.

Liberty Property Development Corporation intends to develop the River's
Bend Business Center Industrial Park. Liberty has indicated they will widen
the westbound lane of Route 10 from Meadowville Road to I-295. The County
can accelerate' the construction of the widening of the eastbound lane by
providing VDOT a $1 million "loan." Under the terms of the proposed
VDOT/Countyagreement {draft attached}, the County will provide VDOT $1
million in July, 1996, for the construction of the eastbound lane and will
be repaid by VDOT in three equal yearly installments beginning in 1996.
The County's "loan" can be provided by a temporary transfer of funds from
the John Tyler Community College project. The VDOT repayments will repay
the "loan" to the John Tyler fund. The timing of the repayments from VDOT
will not impact the progress or timing of the County's participation in the
John Tyler Community College project.
Application to Amend Zoning Case 95SN0109
The Board approved zoning case 95SN0109 (River's Bend) with conditions
which require, among other things, the construction of one eastbound lane
along Route 10 from Old Bermuda Hundred Road to Kingston Avenue prior to
recordation of more than 400 residential units or site plan approval for
more than 670,000 square feet of light industrial/office warehouse. The
VDOT/County agreement will address the construction of the lane. To
enhance the economic development opportunities in the River's Bend Business
Center Industrial Park, and since the eastbound lane construction will be
addressed, staff recommends the zoning conditions requiring the eastbound
lane be deleted.

THIS AGREEMENT, made this day of ,1995, between the
COUNlY OF CHESTERFIELD, VIRGINIA, a political subdivision of the
Commonwealth of Virginia (the "County"), and the COMMONWEALTH OF VIRGINIA,
VIRGINIA DEPARTMENT OF TRANSPORTATION (the "Department").
WHEREAS, the Department, pursuant to its statutory authority, is planning
improvements to Route 10 in Chesterfield County under primary Project 0010-020-127,
PE-101; and
WHEREAS. the County pursuant to Section 33.1-75.2 and Section 33.1-75.3 of
the Code of Virginia, as amended, desires to expedite, by advancing monies for
construction of the eastbound lane, the advertisement of project 0010-020-127, PE-
101, C-, which encompasses Route 10 between 1-295 and Old Bermuda Hundred
Road (Route 618); and
WHEREAS, the Department has indicated to the County that project 0010-020-
127, PE-101, C-, can be advertised for construction by . as long
as advancement of monies are provided the Department by the County; and
WHEREAS, the benefits of such improvements will inure to the Department,
County and motorists traveling on Route 10, and will secure and promote the health,
safety and general welfare of the inhabitants.

WITNESSETH:
That in consideration of the mutual covenants herein, the parties agree as follows:
1. In the event that an a construction bid acceptable to both the Department
and the County for Project 00010-020-127, C_, is received by the
Department and approved by the Commonwealth Transportation Board,
the County agrees to deposit with the Department monies in the amount
of $1,000,000 between July 1 and July 15, 1996.
2. The Department agrees to return to the County the $1,000,000 identified
in Section 1 in three equal payments with the first payment made between
July 1,1996 and July 15,1996, the second payment made between
July 1,1997 and July 15,1997, and the third payment made between
July 1,1998 and July 15,1998.
3. Nothing herein shall be construed as creating any personal liability on the
part of any officer or agent of the parties; nor shall it be construed as
creating any rights or benefits hereunder to anyone other than the parties
to this agreement

Change Order Number 6 includes the additional work and materials
necessary to install the 30 inch transmission main, as a result of the
changed field conditions due to the relocation of the original water
main alignment. The new alignment is now more acceptable to the
neighboring community. Funds for this change order are available in the
current Capital Improvement Budget. .

During the summer of 1994 the county was responsible for 70 days of delay due
to Bell Atlantic and virginia Power Company's inability to accomplish their
utility relocations in a timely manner. This impacted the contractor's
ability to work during those 70 days. This represents settlement in full for
impact delays due to this situation (original claim 69k - settled at 22k).
Funds are available from the project.

Summary ofInformation:
Under the Virginia Constitution, non-profit organizations seeking an exemption from
local real estate taxation must obtain the exemption from the General Assembly. The
General Assembly cannot, however, consider a tax exemption request until the request has
been considered, after a public hearing, by the governing body of the locality in which the
organization is located.
Winters Hill Properties, Inc., a non-stock, non-profit corporation located in the County,
has applied to have its real estate exempted from the County's Real Estate Tax. Winters
Hill Properties, Inc. was created for the sole purpose of holding title to property currently
owned by the Department of Housing and Urban Development (HUD). Winters Hill
Properties, Inc. will purchase and rehabilitate its property with a HUD grant which was
established to benefit mentally disabled citizens of the County. HUD regulations require that
Winters Hill Properties, Inc. apply for local real estate tax exemption as a condition for
receiving the grant.

The Code of Virginia sets forth a number of conditions that all non-profit organizations
must meet in order to qualify for the local real estate tax exemption. Winters Hill

Conditional Use to permit a group care facility at 11990 Reedy Branch
Road.
Summary ofInformation:
Gateway Center is' a non-profit organization that provides resident
services for the mentally ill. Currently, Gateway Center has occupancy
for 15 residents in a family living setting. The organization wishes to
expand by constructing twelve (12) multifamily units to house the
mentally ill on the subject property. As an extension of the present
facility these individual units, in a cluster design, will enable the
program to better evaluate whether residents are ready for a more
independent living arrangement. Living in the cluster units will enable
present staff to have immediate access to residents that may need
assistance.
At the request of Dr. Nicholas, the Board of Supervisors' is requested to
initiate an application for a Conditional Use to permit a group care
facility at 11990 Reedy Branch Road. Gateway Center, an existing group
care facility housing 15 residents, is located on an adjacent parcel at
11901 Reedy Branch Road.

ENDORSING THE "PRINCIPLES TO GUIDE THE PUBLICLY-FUNDED
MENTAL HEALTH/MENTAL RETARDATION/SUBSTANCE ABUSE SERVICES SYSTEM
AND THE "OPERATIONAL CONCEPTS" DEVELOPED AND PUBLISHED BY THE
VIRGINIA ASSOCIATION OF COMMUNITY SERVICES BOARDS
WHEREAS, the Commonwealth of virginia is in the process of
considering how best to redesign and improve mental health, mental
retardation, and substance abuse services to citizens; and
WHEREAS, the Chesterfield County Board of supervisors believes
that all decisions must be guided and managed by sound, agreed-upon
principles integrating the best information and technologies
available; and
. WHEREAS, the Board believes that adherence to such principles,
and the values they reflect, is necessary to ensure provision of
quality behavioral health care services to target populations
historically served with public funding; and
WHEREAS, the County of Chesterfield has, for more than two
decades, demonstrated commitment and support of the provision of
quality public services for persons with mental disabilities both
locally and across the Commonwealth; and
WHEREAS, the Board hereby encourages the state to maintain the
current system of oversight by local citizens, consumers, families,
and elected and appointed officials, while utilizing the best
aspects of managed care technology during the redesign of the
public behavioral health care system.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield County
Board of Supervisors hereby )OlnS the Chesterfield Community
Services Board in unanimously endorsing the "principles to Guide
the Publicly-Funded Mental Health/Mental Retardation/Substance
Abuse services system" and the "operational Concepts" developed and
published by the Virginia Association of Community services Boards.
AND, BE IT FURTHER RESOLVED, that a copy of this resolution be
forwarded to the General Assembly as a public endorsement of
guiding principles to be utilized during restructuring of the State
Mental Health/Mental Retardation/Substance Abuse Services system.

Dear Mr. Ramsey:
I recently read that the Chesterfield County noise ordinance has been modified to prohibit the playing of music
from car radios that can be heard from a distance of 50 feet or greater.
I.) I would like to see the wording modified to include anv outdoor radio, speaker, etc., (or onc near an open
window), e.g. not limited only to music coming from cars. Without this somcone could, for instance, be playing a
radio in his car parked in his driveway that could be heard from a distance greater than 50 feet. If a policeman
told him to turn it down, he could cut off the car radio, take out a boombox, set it down next to his car, and play it
at the same volume. In this case he would be in compliance with the ordinance.
2.) I would like to see some wording in the ordinance regarding specific duration for the playing of an outdoor
radio if it is within a certain distance from a dwelling, i.e. two hours during any 24 hour period.
There are individuals (people living in neighborhoods as well as contractors) who have played outdoor radios.
speakers, boomboxes etc. for up to 10 hours per day. It is like having to listen to outdoor "musack", and is very
disturbing when one wants to sit in their own backyard and enjoy the peace and quiet. Although the music can be
heard for a distance greater than 50 feet, it is not prohibited under the existing noise ordinance. The police will do
nothing as it does not fit tlleir guidelines of "cxcessive" loudness.
I feel that the noise ordinance should protect all Chesterfield County residents against this type of problem. A
change in the ordinance seems to be the only way to address an occurrence of this nature.
I do not want ordinances passed that are unnecessarily intrusive or infringe upon the rights of others. However,
residents who invest in homes in our county have the right to enjoy peace and quiet when they sit out in the
privacy of their own yard. Therefore I feel that it is not unreasonable to limit the duration that one can playa
radio outdoors specifically to two hours. The result would be that anyone could play the radio outdoors for a
reasonable length of time, and others could enjoy the peace and quiet also. Everyone wins. The ordinance would
not be overly prohibitive as the only time it would come into play is when someone called the police after someone
else was being unreasonable. Also for this type of sitnation, the new car radio ordinance should not be limited
only to cars.
I would like to address the Board of Supervisors at the next meeting (October 25th) to bring this up during
hearings of citizens on unscheduled matters. Thank you very much.

I wish to appear before the ,Board of Supervis6rs during their next
meeting on october 25, 1995 to express my opposition to the State of
Virginia's plan to build a new juvenile prison at the Bon Air Complex
in chesterfield County and ask the Board to help me and other County
citizens stop the state's plan.
My wife and I own the property and live at 10133 Iron Mill Road which
is about 1000 feet from the boundary of the Bon Air Complex on old Bon
Air Road. The State is planning to add 310 new medium-security
permanent beds to the Bon Air Complex through new bUilding and
conversion of a transient bed facility. If they carry out their plans
the Bon Air Complex will have a total of 485 permanent beds. The
State's plan is bad for the inmates, bad for the surrounding
community, and clearly against the County's wishes as proclaimed in
the Resolution of May 24, L995 by the Board.
I will ask the Board to consider taking the following actions to help
stop the Bon Air juvenile prison expansion:
* Issue another resolution

* Use the Board's best resources to arrange a meeting with the
governor to plead the case of Chesterfield's citizens.
* Direct the County's utilities, safety, and legal departments to
search for reasons to stop or delay the State's plans. The issue is
likely to be reconsidered by the State legislature when it reconvenes
in 1996. The legislature needs to consider withdrawing the funds for
the project before spent or contracted to be spent by the State. The
State is trying to spend the funds as quickly as possible to avoid
heeding the informed voice of the legislature in 1996.
* Recognize and support the efforts of the Bon Air area citizens
opposing the poor decision by the state to expand the Bon Air Complex.

General Information
The Chesterfield County School Board will meet as follows for the 1995-1996 school year:
July 11, 1995; August 8, 1995; September 12 and 26, 1995; October 10 and 24, 1995; November 14,
1995; December 12, 1995; January 9 and 23, 1996; February 13 and 27, 1996; March 12 and 26,
1996; April 18, 1996; May 14 and 28, 1996; and June 11 and 25, 1996. The executive
sessions/work sessions will begin at 5 :00 p.m. and will be held at the School Administration Building.
9900 Krause Road, Chesterfield. Virginia. The regular meetings will begin at 7:30 p.m. and will be
held at the Public Meeting Room, 9901. Lori Road, Chesterfield. Virginia. If the place or time is
changed, the public will be notified.
Following is the procedure by which the public may speak before the School Board at any of
the above meetings:
1. Persons wishing to be heard on action items must notify the Superintendent's office by
2:00 p.m. on the day of the meeting.

considered.
3. Persons to be heard on non-agenda items will be heard during the specified section of
the meeting.
4. It is requested that an individual conduct his/her presentation in three minutes;

in writing their request for hearing and their proposals to the Superintendent at least
five days prior to the meeting at which they wish to be heard.

RECOGNIZING MR. JAMES D. CABINESS, II UPON
HIS ATTAINING RANK OF EAGLE SCOUT
WHEREAS, the Boy Scouts of America was incorporated by Mr.
William D. Boyce on February 8, 1910; and
WHEREAS, the Boy
citizenship training,
individuals; and
Scouts of America was founded to promote
personal development, and fitness of
WHEREAS, after earning at, lea~t twenty-one merit badges in a
wide variety of fields, serv~ng ~n a leadership position in a
troop, carrying out a service project beneficial to his community,
being active in the troop, demonstrating Scout spirit, and living
up to the Scout Oath and Law; and
WHEREAS, Mr. James D. cabiness, II, Troop 801, sponsored by
South Minster Presbyterian Church, has accomplished those high
standards of commitment and has reached the long-sought goal of
Eagle Scout which is received by less than two percent of those
individuals entering the Scouting movement; and
WHEREAS, growing through his experiences in Scouting, learning
the lessons of responsible citizenship, and priding himself on the
great accomplishments of his County, James is indeed a member of a
new generation of prepared young citizens of whom we can all be
very proud.
NOW, THEREFORE BE IT RESOLVED, that the Chesterfield county
Board of Supervisors hereby extends its congratulations to Mr.
James D. cabiness, II and acknowledges the good fortune of the
County to have such an outstanding young man as one of its
citizens.

A public hearing is scheduled to consider
truck traffic on North Enon Church Road.
Summary of information:
BACKGROUND: The County's Meadowville Area Plan recommends that the
Virginia Department of Transportation (VDOT) should be requested to
restrict through truck traffic on North Enon Church Road (Route 746) from
the Brown and Williamson Development (formerly the American Tobacco
Company) access to Meadowville Road (Route 618). The recommended
alternative route is North Enon Church Road, East Hundred Road (Route 10),
Rivers Bend Boulevard, and Meadowville Road.
RECOMMENDATION: Staff recommends that the Board adopt the attached
resolution requesting VDOT to prohibit through truck traffic on North Enon
Church Road.

WHEREAS, the Chesterfield County Board of Supervisors
received a request from citizens to prohibit any through truck or
truck and trailer or semi-trailer combination except pickup or
panel trucks from using North Enon Church Road (Route 746) from
the Brown and Williamson Development (formerly The American
Tobacco Company) access to Meadowville Road (Route 618); and
WHEREAS, the County's Meadowville Area plan recommends that
the Virginia Department of Transportation should be requested to
restrict through tr~cktraffic on, this section of North Enon
Church Road; and
WHEREAS, the recommended alternate route is North Enon
Church Road, East Hundred Road (Route 10); River's Bend
Boulevard, and Meadowville Road; and
WHEREAS, the Board has conducted a public hearing on the
prohibition.
NOW, THEREFORE, BE IT RESOLVED, that the Board of
Supervisors requests the Virginia Department of Transportation to
prohibit through truck traffic on North Enon Church Road.
